सामान्य प्रशासन विभाग ——— अधिसूचना 12 सितम्बर 2024 सं॰ 7/एम-1-413/2002-14565/सा0प्र0 —भारत संविधान के अनुच्छेद 233, सहपठित अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, उच्च न्यायालय, पटना के परामर्श से बिहार उच्च न्याय सेवा नियमावली, 1951 में संशोधन हेतु निम्नलिखित नियमावली बनाते हैंः-
1. संक्षिप्त नाम, विस्तार एवं प्रारंभ।-
(1) यह नियमावली ''बिहार उच्च न्याय सेवा (संशोधन) नियमावली, 2024'' कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत के प्रभाव से प्रवृत्त मानी जायेगी।
2. बिहार उच्च न्याय सेवा नियमावली, 1951 के नियम-2 में जोड़ा जाना।- उक्त नियमावली के नियम-2(घ) के बाद 2(ङ) एवं 2(च) निम्नवत् जोड़े जायेंगेः-
''2(ङ) प्रधान जिला एवं सत्र न्यायाधीश से तात्पर्य है न्यायमंडल में सबसे वरिष्ठ जिला एवं सत्र न्यायाधीश, जिनके पास जिले का प्रशासनिक प्रभार भी है;
2(च) जिला एवं अपर सत्र न्यायाधीश से तात्पर्य है विभिन्न न्यायमंडलों में अपर जिला एवं सत्र न्यायालयों का पद धारण करने वाले और उच्च न्यायिक सेवा के पद से प्रतिनियुक्त होने वाले पदाधिकारी।''
3. बिहार उच्च न्याय सेवा नियमावली, 1951 में प्रतिस्थापन।-उक्त नियमावली में प्रयुक्त शब्दों ''अपर जिला एवं सत्र न्यायाधीश'' तथा ''जिला एवं सत्र न्यायाधीश'' को प्रत्येक स्थान पर क्रमशः शब्दों ''जिला एवं अपर सत्र न्यायाधीश'' तथा ''प्रधान जिला एवं सत्र न्यायाधीश'' द्वारा प्रतिस्थापित किया जायेगा।
2 (cid:464)बहार गजट (असाधारण), 23 िसत(cid:224)बर 2024 The 12th September 2024No-7/M-1-413/2002-14565/GAD —In exercise of the powers conferred by Article 233 of the Constitution of India read with the proviso to Article 309, the Governor of Bihar, in consultation with the High Court of Judicature at Patna is pleased to make the following amendment in the Bihar Superior Judicial Service Rules, 1951:-
1. Short title, extent and commencement:-
(1) These rules may be called "the Bihar Superior Judicial Service (Amendment) Rules, 2024".
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force with immediate effect.
2. In the Bihar Superior Judicial Service Rules, 1951 the following new definition clauses shall be added as 2(e) and 2(f) after rule 2(d):-
"2(e) The Principal District and Sessions Judge shall mean the senior most District and Sessions Judge in the judgeship, who also has the administrative charge over the District;
2(f) The District and Additional Sessions Judge shall mean and include the officers occupying the posts of Additional District and Sessions Courts in various Judgeships and those on deputation from the Superior Judicial Service."
3. Substitution in the Bihar Superior Judicial Service Rules, 1951:- The words "Additional District and Sessions Judge" and "District and Sessions Judge" wherever used in the said Rules, 1951 shall be substituted by the words "District and Additional Sessions Judge and Principal District and Sessions Judge" respectively.
