सं॰ 14/एम7-39/2016/1431—प्राईवेट शिक्षा संस्था (अधिग्रहण) अधिनियम, 1987 बिहार अधिनियम-1987 की धारा 11 की उपधारा (1) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल एतद् द्वारा ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन नियमावली 2017, को संशोधित करने हेतु निम्नलिखित नियमावली बनाते हैः-
1. संक्षिप्त नाम एवं विस्तार-यह नियमावली ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन संस्थान, सेवा शर्त्त (संशोधन) नियमावली-2024 कही जायेगी।
2. यह गजट में प्रकाशन की तिथि से प्रवृत होगी। 3. ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन संस्थान, सेवा शर्त्त नियमावली-2017 के नियम 2 (VII) को निम्नवत् प्रतिस्थापित किया जाएगा।
'' 2 (VII)'आयोग' से अभिप्रेत है बिहार राज्य विश्वविद्यालय सेवा आयोग।'' 4. ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन संस्थान, सेवा शर्त्त नियमावली-2017 के नियम-3 (i) में एक अतिरिक्त प्रशासनिक पद का सृजन निम्नवत् किया जायेगाः-
''(घ) उप कुलसचिव - एक पद ''
5. ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन संस्थान, सेवा शर्त्त नियमावली-2017 के नियम-4 में एक अलग उप कंडिका (12) निम्नरूपेण अंतः स्थापित किया जायेगा।
''4(12) उप कुलसचिव- संस्थान के निदेशक द्वारा संस्थान के प्राध्यापक/सह-प्राध्यापक/सहायक प्राध्यापक को इस पद हेतु Ex-Officio के रूप में कार्य करने हेतु नामित किया जायेगा तथा कुलसचिव एवं उप कुलसचिव के बीच कार्य का आवंटन किया जायेगा।''
6. ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन संस्थान, सेवा शर्त्त नियमावली-2017 के नियम 4-के उपनियम (4), (5) एवं (9) में उल्लेखित ''बिहार लोक सेवा आयोग'' को '' बिहार राज्य विश्वविद्यालय सेवा आयोग'' द्वारा प्रतिस्थापित किया जायेगा।
7. ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन संस्थान, सेवा शर्त्त नियमावली-2017 के नियम 4 (6) को निम्नवत् प्रतिस्थापित किया जायेगाः-2 ;बपकरू464द्ध ;द्धए 3 ;बपकरू200द्ध 2024 ''4 (6) चयन के लिए प्रक्रिया का अवधारण बिहार राज्य विश्वविद्यालय सेवा आयोग के द्वारा ए॰आई॰सी॰टी॰ई॰/यू॰जी॰सी॰ के मार्गदर्शन एवं ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिर्वतन संस्थान द्वारा निर्धारित योग्यता अंक वितरण के अनुसार किया जायेगा।'' 8. ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन संस्थान, सेवा शर्त्त नियमावली-2017 के नियम-4 (8) को निम्नवत् प्रतिस्थापित किया जायेगाः-
''4 (8)(i)भर्ती प्रक्रिया प्रारंभ करने की पूर्व की तिथि से संस्थान में कार्यरत वैसे शिक्षकों को, जो अवधारित अर्हता पूरी करते हों, को अधिभार अंक इनके द्वारा प्रतिवर्ष की गयी संतोषजनक सेवा के लिए अधिकतम पाँच अंक प्रतिवर्ष की दर से अधिकतम 25 अंकों की अधिमानता (किसी वर्ष के अंश के लिए कार्यदिवसों की संख्या में 5 से गुणा करने के पश्चात् 365 से भाग देकर प्राप्त अनुपातिक अंक जोड़ा जायेगा)दी जायेगी।
(ii) संविदा नियोजन के फलस्वरूप किये कार्य अवधि के समतुल्य अवधि की छूट अधिकतम उम्र सीमा में दी जायेगी। किसी कार्यरत वर्ष के अंश को भी इसमें शामिल किया जायेगा। (iii) इस संबंध में सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत निदेशों का अनुपालन किया जायेगा।''
9. विभागीय अधिसूचना संख्या-1466 दिनांक 19.12.2017 द्वारा अधिसूचित ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन संस्थान, सेवा शर्त्त (संशोधन) नियमावली-2017 को विलोपित किया जाएगा। ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन संस्थान, सेवा शर्त्त नियमावली-2017 के नियम-9 को निम्नवत् प्रतिस्थापित किया जाएगाः-
" 9. संस्थान के कर्मियों के देय लाभ ।- (क) संस्थान में विधिवत रूप से नियुक्त एवं कार्यरत कर्मी कर्मचारी भविष्य निधि योजना (EPF) से आच्छादित है। इन्हें कर्मचारी भविष्य निधि योजना का लाभ प्राप्त होगा।
(ख) ग्रेच्युटीः- संस्थान के कर्मियों को संस्थान में 10 वर्षो की लगातार सेवा पूर्ण कर लेने पर बिहार सरकार द्वारा समय-समय पर घोषित ग्रेच्युटी संबंधित नियमावली/प्रावधान के अनुरूप सेवानिवृति उपरांत ग्रेच्युटी का लाभ देय होगा।
(ग) लीव इनकैशमेंटः- संस्थान से सेवानिवृति के पश्चात् कर्मियों के लीव इनकैशमेंट की सुविधा प्राप्त होगी। यह सुविधा बिहार सरकार द्वारा समय-समय पर इस संबंध में घोषित नियमों के अनुसार विश्वविद्यालय कर्मियों के भाँति देय होगा।"
10. ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन संस्थान, सेवा शर्त्त नियमावली-2017 के नियम-10 (1) को निम्नवत् प्रतिस्थापित किया जायेगाः-
''10 (1)- संस्थान के शैक्षणिक पदों के लिए ए॰आई॰सी॰टी॰ई॰/यू॰जी॰सी॰द्वारा अवधारित मानदंड का अनुपालन राज्य सरकार के आदेशानुसार संस्थान द्वारा किया जायेगा।''
11. ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन संस्थान सेवा शर्त नियमावली-2017 के नियम-16 को निम्नवत् प्रतिस्थापित किया जायेगाः-
''(क) अखिल भारतीय तकनीकी शिक्षा परिषद् के मार्गदर्शन एवं ललित नारायण मिश्र आर्थिक विकास एवं सामाजिक परिवर्तन संस्थान द्वारा निर्धारित मानक के अनुरूप, एक खुली, पारदर्शी एवं वस्तुपरक कार्य-मूल्यांकन-पद्धति, जिसमें स्वमूल्यांकन एवं सही प्रयास मूल्यांकन निहित रहेगा, संस्थान द्वारा विकसित एवं लागू की जायेगी।''

No.-14/M7-39/2016/1431—In exercise of the powers conferred under Sub-Section (1) of Section 11 of Bihar Private Educational Institution (Taking Over) Act, 1987, (Bihar Act 11-1987), the Governor of Bihar is pleased to make the following Rules to amend Lalit Narayan Mishra Economic Development and Social Change Institute Service Conditions Rules, 2017:
1. Short title and commencement: These Rules may be called the Lalit Narayan Mishra Economic Development and Social Change Institute Service Conditions (Amendment) Rules, 2024.
2. It shall come into force from the date of publication of the notification in the official gazette.
3. Rule 2(VII) of the Lalit Narayan Mishra Economic Development and Social Change Institute Service Conditions Rules, 2017, shall be substituted by the following:
;बपकरू464द्ध ;द्धए 3 ;बपकरू200द्ध 2024 3"2(VII) 'Commission' means Bihar State University Service Commission." 4. An additional post shall be created in Rule 3(i) of the Lalit Narayan Mishra Economic Development and Social Change Institute Service Conditions Rules, 2017, which is as follows:
"(d) Deputy Registrar- One Post"
5. A new Subsection (12) in Rule-4 of the Lalit Narayan Mishra Economic Development and Social Change Institute Service Conditions Rules, 2017 shall be inserted as follows:
"4(12) Deputy Registrar- The Director of the Institute shall nominate, Professor/Associate Professor/Assistant Professor of the Institute for working on this post in an ex-officio manner and shall allocate works to Registrar and Deputy Registrar."
6. The expression 'Bihar Public Service Commission' shall be substituted by 'Bihar State University Service Commission' in Sub Rule (4), (5) and (9) of Rule-4 of the Lalit Narayan Mishra Economic Development and Social Change Institute Service Conditions Rules, 2017.
7. Rule 4(6) of the Lalit Narayan Mishra Economic Development and Social Change Institute Service Conditions Rules, 2017, shall be substituted by the following:
"4(6) The Bihar State University Service Commission shall determine the process of selection as per the guideline of AICTE/UGC and on the basis of qualifying marks distribution, fixed by the Lalit Narayan Mishra Economic Development and Social Change Institute."
8. Rule 4(8) of the Lalit Narayan Mishra Economic Development and Social Change Institute Service Conditions Rules, 2017, shall be substituted by the following:
"4(8) (i) those teachers working in the institute, having prescribed qualification shall be given additional marks for each year of satisfactory service rendered by them at the rate of maximum five marks per year, with a maximum of 25 marks (for part working period in any year, the proportional marks shall be added after multiplying the number of working days by 5 and dividing the same by 365).
(ii) The maximum age limit shall be relaxed for the period equivalent to the period of working on contract basis. Part of any such working in a year, shall also be included in this.
(iii) The Directions issued by the General Administration Department from time to time in this regard, shall be complied with. 9. The Lalit Narayan Mishra Economic Development and Social Change Institute Service Conditions (Amendment) Rules, 2017, notified by the Departmental Notification No. 1466 dated 19.12.2027 shall be repealed. Rule 9 of the Lalit Narayan Mishra Economic Development and Social Change Institute Service Conditions Rules, 2017, shall be substituted by the following:
"9. Benefits payable to the employees of the institute:-
(i) Employees appointed in accordance with law and working in the institute are covered under the Employees' Provident Fund Scheme (EPF). They shall get the benefit of the Employees' Provident Fund Scheme.
(ii) Gratuity:- The employees of the Institute shall be entitled for the benefit of gratuity after retirement, after completion of 10 years of continuous service in the Institute, as per the Rules/provisions related with gratuity, announced by the Government of Bihar from time to time.
4 ;बपकरू464द्ध ;द्धए 3 ;बपकरू200द्ध 2024(iii) Leave Encashment:-The Employee shall get the benefit of Leave Encashment after retirement from the Institute. This benefit shall be given in accordance with the Rules declared by the State Government from time to time in this regard, similar to the employees of the University.
10. Rule 10(1) of the Lalit Narayan Mishra Economic Development and Social Change Institute Service Conditions Rules, 2017, shall be substituted by the following:
"10(1):-The Institute shall follow the norms prescribed by the AICTE/UGC for the teaching post, as per the direction issued by the State Government." 11. Rule 16 of the Lalit Narayan Mishra Economic Development and Social Change Institute Service Conditions Rules, 2017, shall be substituted by the following:
"(a) The Institute shall develop and implement an open, transparent and objective performance evaluation system including self-evaluation and true effort evaluation under the guideline of All India Council for Technical Education and in accordance with the standards laid down by the Lalit Narayan Mishra Economic Development and Social Change Institute."
