सं॰ सं0-2/बी0एस0सी0ई01-1025/2009 श्र0सं0/5383—भारत के संविधान के अनुच्छेद-309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल "बिहार सचिवालय भोजशाला समूह 'घ' नियमावली, 2017" (समय-समय पर यथासंशोधित) मेें संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैं :- 1. संक्षित नाम, विस्तार एवं प्रारम्भ।-
(1) यह नियमावली, "बिहार सचिवालय भोजशाला परिचारी (विशिष्ट) (भर्त्ती एवं सेवा शर्त्तें) (संशोधन) नियमावली, 2024" कही जा सकेगी।
(2) इसका विस्तार बिहार सचिवालय भोजशाला, पटना तक सीमित होगा। (3) यह अधिसूचना राजपत्र में प्रकाशन की तिथि से प्रवृत्त होगा। 2. बिहार सचिवालय भोजशाला समूह 'घ' नियमावली, 2017 के नियम-1(1) का प्रतिस्थापन।- उक्त नियमावली के नियम-1 के उपनियम-(1) को निम्नवत् प्रतिस्थापित किया जाता है- "(1) यह नियमावली, "बिहार सचिवालय भोजशाला परिचारी (विशिष्ट) (भर्त्ती एवं सेवा शर्त्तें) नियमावली, 2017" कही जा सकेगी।"
3. बिहार सचिवालय भोजशाला समूह 'घ' नियमावली, 2017 में प्रयुक्त समूह 'घ' शब्द का प्रतिस्थापन।- उक्त नियमावली में जहाँ कहीं भी समूह-'घ' शब्द प्रयुक्त है, उसे 'परिचारी (विशिष्ट)' से प्रतिस्थापित किया जाता है।
4. बिहार सचिवालय भोजशाला समूह 'घ' नियमावली, 2017 में के नियम-2(iv) एवं (vi) का
प्रतिस्थापन तथा नियम-2(vii) का अन्तःस्थापन।- (क) उक्त नियमावली के नियम-2 के उप नियम-(iv) एवं (vi) को निम्नवत् प्रतिस्थापित किया जाता है- " (iv) "संवर्ग" से अभिप्रेत है श्रमायुक्त, बिहार के नियंत्रणाधीन बिहार सचिवालय भोजशाला 'परिचारी (विशिष्ट)' का संवर्ग।
(vi) 'आयोग' से अभिप्रेत है, बिहार तकनीकी सेवा आयोग।"
(ख) उक्त नियमावली के नियम-2 के उप नियम (vi) के बाद उपनियम (vii) को
निम्नवत् अन्तःस्थापित किया जाता है-2 ;बपकरू464द्ध ;द्धए 4 ;बपकरू200द्ध 2024 "(vii) "परिचारी (विशिष्ट)" से अभिप्रेत है समूह-'ग' के कार्यालय परिचारी के समकक्ष विशिष्ट कार्य प्रकृति के पद यथा-परिचारी (सहायक कारीगर), परिचारी (वेटर), परिचारी (विक्रेता), परिचारी (चौकीदार) आदि।"
5. बिहार सचिवालय भोजशाला समूह 'घ' नियमावली, 2017 के नियम-5 का प्रतिस्थापन।- उक्त
नियमावली के नियम-5 को निम्नलिखित द्वारा प्रतिस्थापित किया जाता है- "5. आरक्षण। इस संवर्ग में सीधी भर्त्ती तथा प्रोन्नति में सामान्य प्रशासन विभाग, बिहार सरकार द्वारा समय-समय पर यथानिर्धारित आरक्षण रोस्टर से संबंधित प्रावधान लागू होंगे।"
6. बिहार सचिवालय भोजशाला समूह 'घ' नियमावली, 2017 के नियम-6 का प्रतिस्थापन।- उक्त
नियमावली के नियम-6 को निम्नलिखित द्वारा प्रतिस्थापित किया जाता है -
"6.भर्त्ती।-(i) इस संवर्ग के मूल कोटि के पद पर सीधी भर्त्ती की जा सकेगी।
(ii) सीधी भर्त्ती हेतु प्रत्येक वर्ष की पहली अप्रैल की स्थिति के आधार पर रिक्तियों की गणना की जाएगी तथा आरक्षण कोटिवार उपलब्ध रिक्तियों का रोस्टर क्लीयरेंस करवाकर अधियाचना सामान्य प्रशासन विभाग को भेजी जा सकेगी। (iii) इस संवर्ग के अन्तर्गत अनुसूची-'क' में उल्लिखित मूल कोटि के पद पर सीधी भर्त्ती बिहार तकनीकी सेवा आयोग द्वारा इस प्रयोजनार्थ समय-समय पर आयोजित प्रतियोगिता परीक्षा के आधार पर की जा सकेगी।
(iv) चयन प्रक्रिया की कार्रवाई एवं तत्संबंधी अन्य कार्यों के संबंध में बिहार तकनीकी सेवा आयोग द्वारा नियमावली एवं विद्यमान प्रावधानों के आलोक में निर्णय लिया जा सकेगा।"
7. बिहार सचिवालय भोजशाला समूह 'घ' नियमावली, 2017 के नियम-7 का प्रतिस्थापन।- उक्त
नियमावली के नियम-7 को निम्नलिखित द्वारा प्रतिस्थापित किया जाता है- "7. (i) सीधी भर्त्ती के लिए न्यूनतम शैक्षणिक योग्यता दशम्/मैट्रिक अथवा मान्यता प्राप्त किसी समकक्ष परीक्षा में उत्तीर्णता होगी।
(ii) सीधी भर्त्ती के लिए उम्मीदवारों का स्वस्थ होना आवश्यक होगा। (iii) सीधी भर्त्ती के लिए न्यूनतम उम्र 18 वर्ष होगी तथा अधिकतम उम्र वही होगी, जैसा सामान्य प्रशासन विभाग, बिहार सरकार द्वारा समय-समय पर निर्धारित किया जाय।" 8. बिहार सचिवालय भोजशाला समूह 'घ' नियमावली, 2017 के नियम-10(4) का विलोपन।- उक्त नियमावली के नियम-10 के उपनियम (4) को विलोपित किया जाता है।
9. बिहार सचिवालय भोजशाला समूह 'घ' नियमावली, 2017 के नियम-11 का प्रतिस्थापन।- उक्त
नियमावली के नियम-11 को निम्नलिखित द्वारा प्रतिस्थापित किया जाता है-
"11. सीधी भर्त्ती से नियुक्त कर्मी की वरीयता आयोग के मेधाक्रमानुसार निर्धारित होगी। परंतु, इस नियमावली के प्रवृत्त होने के पूर्व यदि, वरीयता निर्धारित करते हुए वरीयता सूची प्रकाशित की गई हो, तो वह अपरिवर्तित रहेगी।"

No.-2/BSCE-1-1025/2009, LRD-5383—In exercise of powers conferred under article-309 of the Constitution of India, the Governor of Bihar is hereby pleased to make the following Rules for amendment in Bihar Secretariat Canteen Group 'D', 2017 (As amended from time to time)-
1. Short title, extent & commencement :-
(1) These rules may be called "Bihar Secretariat Canteen Attendant (Specific) (Recruitment & Service Conditions) (Amendment) Rules, 2024."
(2) It shall extent to Bihar Secretariat Canteen, Patna only. (3) It shall come into force from the date of publication in official Gazette. 2. Substitution of Rule 1(1) of Bihar Secretariat Canteen Group 'D'Rules, 2017:-
Sub rule (1) of Rule-1 of the said Rules is substituted as below- (i) "These rules may be called Bihar Secretariat Canteen Attendant (Specific) (Recruitment & Service Conditions) Rule, 2017."
3. Substitution of word Group 'D' used in Bihar Secretariat Canteen Group 'D'
Rules, 2017:- Wherever "Group D" word is used in said Rules it shall be substituted by 'Attendant (specific)'.
Sub :- Notification of "Bihar Secretariat Canteen Attendant (Specific)
(Recruitment & Service Conditions) (Amendment) Rules, 2024."
4. Substitution of Rule-2(iv) and (vi) and insertion of Rules-2(vii) :-
(A) Sub rule (iv) and (vi) of Rule-2 of the said Rules are substituted as below- (iv) 'Cadre' means Bihar Secretariat Canteen Attendant (Specific) Cadre under the control of Labour Commissioner, Bihar. (vi) 'Commission' means Bihar Technical Service Commission. (B) Sub rule (vii) is inserted after sub rule (vi) of Rule-2 of the said Rules as below- "(vii) 'Attendant (Specific)' means the post of specific work nature equivalent to office attendant of group 'C', such as Attendant (Assistant Cook), Attendant (Waiter), Attendant (Sells man), Attendant (Chowkidar) etc.
5. Substitution of Rule-5 of Bihar Secretariat Canteen Group 'D', 2017:-
Rule-5 of said Rules are substituted as below- "In direct recruitment and promotion in this cadre, the provisions related to reservation roster as prescribed from time to time by the General Administrative Department, Government of Bihar will be applicable."
6. Substitution of Rule-6 of Bihar Secretariat Canteen Group 'D' Rules, 2017:-
Rule-6 of the said Rules is substituted as below- (i) Direct recruitment may be made only on the basic grade of this cadre. (ii) For the direct recruitment calculation of the vacancies will be done on the basis of status of vacancies as on 1st April of each year and roster wise available vacancies will be made available to General Administrative Department.
(iii) Recruitment on basic post of this cadre as mentioned in Annexure 'A' will be done by competitive examination conducted from time to time by Bihar Technical Service Commission.
4 ;बपकरू464द्ध ;द्धए 4 ;बपकरू200द्ध 2024(iv) Decision can be taken in light of existing Rules and provisions of the Bihar Technical Service commission regarding the action and selection process and other related works.
7. Substitution of Rule-7 of Bihar Secretariat Canteen Group 'D' Rules, 2017:-
Rule-7 of the said Rules is substituted as below- (i) The minimum educational qualification for the post is passing of 10th/Matriculation or any recognized equivalent examination.
(ii) Candidate for direct recruitment shall be of sound health. (iii) The minimum age for direct recruitment will be 18 years and the maximum age will be same as it is fixed by General Administrative Department, Government of Bihar from time to time.
8. Deletion of Rule-10 (4) of Bihar Secretariat Canteen Group 'D' Rule, 2017:-
Sub rule (4) of the said Rules is hereby deleted.
9. Substitution of Rule-11 of Bihar Secretariat Canteen Group 'D' Rules, 2017:-
Rule-11 of the said Rules is substituted as below- "Seniority of the personnel appointed by direct recruitment will be determined according to the merit list of the commission. Provided that if the seniority list determining seniority has been published before coming into force of these rules, it shall remain and changed.
