आदेश

िनवा(cid:91)चन सदन, अशोक रोड, नई (cid:464)द(cid:227)ल(cid:547)-110001/ (cid:464)दनांक 17 अ(cid:200)टूबर, 2024

1. सं. 3/4/आईडी/2024/एसडीआर/ख(cid:7003)ड-I यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 61 में यह उपबंधित है कि निर्वाचकों के प्रतिरूपण का निवारण करने की दृष्टि से, ताकि उक्त अधिनियम की धारा 62 के अधीन वास्तविक निर्वाचकों का उनके मत देने के अधिकार को और अधिक प्रभावी बनाया जा सके , मतदान के समय निर्वाचकों की पहचान सुनि(िcid:7391)त करने के साधन के रूप में निर्वाचकों के लिए निर्वाचक फोटो पहचान पत्र के उपयोग हेतु नियमों के द्वारा उपबंध किए जा सकते हैं;, तथा

2. यतः, निर्वाचकों का रजिस्ट्रीकरण नियम, 1960 का नियम 28 निर्वाचन आयोग को इस दृष्टि से कि निर्वाचकों के प्रतिरूपण का निवारण हो सके तथा मतदान के समय उनकी पहचान को सरल बनाया जा सके , निर्वाचकों को राज्य की लागत पर फोटोयुक्त निर्वाचक फोटो-पहचान पत्र जारी करने के लिए निदेश देने की शक्ति प्रदान करता है; तथा

3. यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 49 ज(3) और 49 ट(2) (ख) में यह उपबंधित है कि जहाँ किसी निर्वाचन क्षेत्र के निर्वाचकों को निर्वाचक रजिस्ट्रीकरण नियम, 1960 के नियम 28 के उक्त उपबंधों के अधीन निर्वाचक फोटो पहचान-पत्र दिए गए हैं, वहां निर्वाचकों को मतदान के न्(cid:7076) में अपना निर्वाचक फोटो पहचान-पत्र दिखाना होगा तथा उनकी ओर से उन निर्वाचक फोटो पहचान पत्रों को नह(cid:7277) दिखाए जाने या दिखाने में असमर्थ होने पर उन्हें मत डालने की अनुमति देने से इनकार किया जा सकता है; तथा

4. यतः, उक्त अधिनियम और नियमों के पूव(cid:7299)क्त उपबंधों को मिलाकर एवं सामंजस्यपूर्ण ढंग से उनके अध्ययन से यह स्प्षट होता है कि यद्यपि मत देने का अधिकार निर्वाचक नामावली में नाम के होने से ही होता हैं, यह निर्वाचन आयोग द्वारा राज्य की लागत पर, मतदान के समय उनकी पहचान स्थापित करने के साधन के रूप में प्रदान करवाए गए निर्वाचक फोटो पहचान पत्र के प्रयोग पर भी निर्भर करता है, तथा दोनों का एक साथ प्रयोग करना होता है; तथा

5. यतः, निर्वाचन आयोग ने एक समयब(cid:7373) कार्य(cid:7059)म के अनुसार सभी निर्वाचकों को निर्वाचक फोटो पहचान-पत्र एपिक जारी करने का निदेश देते (cid:7263)ए 28 अगस्त, 1993 को एक आदेश जारी किया था; तथा 6. यतः,झारखंड, महाराष्ट्र राज्यों, और असम, बिहार, छत्तीसगढ़, गुजरात, कर्नाटक, के रल, मध्य प्रदेश, महाराष्ट्र,मेघालय, पंजाब, राजस्थान, सि(िcid:7333)म, उत्तर प्रदेश, उत्तराखंड और प(िcid:7391)म बंगाल राज्यों में लगभग100% निर्वाचकों को निर्वाचक फोटोपहचान पत्र जारी किए जा चुके है, तथा

7. अत: अब, सभी संब(cid:7373) कारकों तथा विधिक एवं तथ्यात्मक वस्तुस्थिति को ध्यान में रखते (cid:7263)ए, निर्वाचन आयोग एत(cid:7375)ारा, निदेश देता है कि-

- 18.10.2024 & 22.10.2024 को अधिसूचित की जाने वाली झारखंड विधान सभा, और - 22.10.2024 को अधिसूचित की जाने वाली महाराष्ट्र विधान सभा के चालू साधारण एवं उप निर्वाचनों (संल(cid:7336)क-1 के अनुसार) के लिए, और

- 18.10.2024 को अधिसूचित किए जाने वाले 47 विधान सभा निर्वाचन क्षेत्रों एवं के रल में 04-वयनाड संसदीय निर्वाचन क्षेत्र के उप निर्वाचनों के लिए और

- 22.10.2024 को अधिसूचित किए जाने वाले 07-के दारनाथ विधान सभा निर्वाचन क्षेत्र एवं 16-नांदेड़ संसदीय निर्वाचन क्षेत्र के उप निर्वाचनों के लिए3 (cid:464)बहार गजट (असाधारण), 22 अ(cid:200)तूबर 2024 सभी निर्वाचकों जिन्हें निर्वाचक फोटो पहचान पत्र जारी किए गए हैं, से अपेक्षा की जाती है कि वे मतदान के न्(cid:7076)ों पर अपना मत डालने से पहले अपनी पहचान सुनि(िcid:7391)त करने हेतु अपना निर्वाचक फोटो पहचान पत्र दिखाएं। ऐसे निर्वाचक जो अपना निर्वाचक फोटो पहचान पत्र प्रस्तुत नह(cid:7277) कर पाते हैं, उन्हें अपनी पहचान स्थापित करने के लिए निम्नलिखित वैकल्पिक फोटो पहचान दस्तावेजों में से कोई एक प्रस्तुत करना होगा:-

i. आधार कार्ड,

ii. मनरेगा जॉब कार्ड,

iii. बैंको/डाकघरों द्वारा निर्गत फोटोयुक्त पासबुक,

iv. (cid:7088)म मंत्रालय की योजना के अन्तर्गत निर्गत स्वास्थ्य बीमा स्मार्ट कार्ड,

v. (cid:7071)ाइविग लाइसेंस,

vi. पैन कार्ड,

vii. एनपीआर के अंतर्गत आरजीआई द्वारा निर्गत स्मार्ट कार्ड,

viii. भारतीय पासपोर्ट;

ix. फोटोयुक्त पेंशन दस्तावेज,

x. के न्(cid:7076)/राज्य सरकार/लोक उप(cid:7059)म/पब्लिक लिमिटेड कं पनियों द्वारा अपने कर्मचारियों को जारी किए गए फोटोयुक्त सेवा पहचान पत्र,

xi. सांसदो/विधायकों/विधान परिषद सदस्यों को जारी किए गए सरकारी पहचान पत्र, और xii. यूनिक डिस्एबिलिटी आईडी (यूडीआईडी) कार्ड़, सामाजिक न्याय एवं अधिकारिता मंत्रालय, भारत सरकार

8. एपिक के संबंध में, लेखन-अशु(िcid:7373)यां, वर्तनी की अशु(िcid:7373)यां इत्यादि को नजरअंदाज कर देना चाहिए बशत(cid:7288) निर्वाचक की पहचान एपिक से सुनि(िcid:7391)त की जा सके । यदि कोई निर्वाचक कोई ऐसा निर्वाचक फोटो पहचान पत्र पेश करता है, जो कि किसी अन्य विधान सभा सभा निर्वाचन-क्षेत्र के निर्वाचक रजिस्ट्रीकरण अधिकारी द्वारा जारी किया गया हैं, तो ऐसे एपिक भी पहचान स्थापित करने हेतु स्वीकृ त किए जाएंगे बशत(cid:7287) उस निर्वाचक का नाम जहां वह मतदान करने आया है उस मतदान कें (cid:7076) से संबंधित निर्वाचक नामावली में उपलब्ध हो। यदि फोटो(cid:7061)ाफ इत्यादि के बेमेल होने के कारण निर्वाचक की पहचान सुनि(िcid:7391)त करना संभव न हो तब निर्वाचक को उपयु र्क्त पैरा 7 में उल्लिखित किसी एक वैकल्पिक फोटो दस्तावेज को प्रस्तुत करना होगा।

9. उपयु र्क्त पैरा 7 में किसी बात के होते (cid:7263)ए भी, प्रवासी निर्वाचकों को जो अपने भारतीय पासपोर्ट में विवरणों के आधार पर लोक प्रतिनिधित्व अधिनियम, 1950 की धारा 20क के अधीन निर्वाचक नामावलियों में पंजीकृ त हैं, मतदान के न्(cid:7076) में के वल उनके मूल पासपोर्ट (तथा कोई अन्य पहचान दस्तावेज नह(cid:7277)) के आधार पर ही पहचाना जाएगा।

(cid:292)धान सिचव।6 (cid:464)बहार गजट (असाधारण), 22 अ(cid:200)तूबर 2024 ELECTION COMMISSION OF INDIA ——— Order Nirvachan Sadan, Ashoka Road, New Delhi-110001/ Dated 17th October, 2024 No.3/4/ID/2024/SDR/VOL.I —Whereas, Section 61 of the Representation of the People Act, 1951 provides that with a view to preventing personation of electors, so as to make the right of genuine electors to vote under section 62 of that Act more effective, provisions may be made by rules under that Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling; and

2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to direct, with a view to preventing personation of electors and facilitating their identification at the time of poll, issue of Electors' Photo Identity Card to electors bearing their photographs at State cost; and

3. Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that where the electors of a constituency have been supplied with Electors' Photo Identity Card under the said provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Elector Photo Identity Card at the polling station and failure or refusal on their part to produce those Elector Photo Identity Card may result in the denial of permission to vote; and

4. Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it is also dependent upon the use of the Elector Photo Identity Card, where provided by the Election Commission at State cost, as the means of establishing their identity at the time of polling and that both are to be used together; and 5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of Electors' Photo Identity Card (EPIC) to all electors, according to a time bound programme; and

6. Whereas, Electors' Photo Identity Card have been issued to approximately 100% 7. Now, therefore, after taking into account all relevant factors and the legal and factual position, the Election Commission hereby directs that for the current general and bye elections (as per Annexure-1) to-

- the Legislative Assembly of Jharkhand, to be notified on 18.10.2024 & 22.10.2024, and

- the Legislative Assembly of Maharashtra, to be notified on 22.10.2024, and bye elections (as per Annexure-1) to

- 47 Assembly Constituencies & 04-Wayanad Parliamentary Constituency in Kerala, to be notified on 18.10.2024 and

- 07-Kedarnath Assembly Constituency in Uttarakhand & 16-Nanded Parliamentary Constituency in Maharashtra to be notified on 22.10.2024 all electors who have been issued EPIC are expected to produce the EPIC for their identification at the polling stations before casting their votes. Those electors who are7 (cid:464)बहार गजट (असाधारण), 22 अ(cid:200)तूबर 2024 not able to produce the EPIC shall produce one of the following alternative photo identity documents for establishing their identity: -

(i) Aadhaar Card, (ii) MNREGA Job Card, (iii) Passbooks with photograph issued by Bank/Post Office, (iv) Health Insurance Smart Card issued under the scheme of Ministry of Labour,

(v) Driving License, (vi) PAN Card, (vii) Smart Card issued by RGI under NPR, (viii) Indian Passport, (ix) Pension document with photograph, (x) Service Identity Cards with photograph issued to employees by Central/ State Govt./PSUs/Public Limited Companies,

(xi) Official identity cards issued to MPs/MLAs/MLCs, and (xii) Unique Disability ID (UDID) Card, M/o Social Justice & Empowerment, Government of India

8. In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the identity of the elector can be established by the EPIC. If an elector produces an EPIC which has been issued by the Electoral Registration Officer of another Assembly Constituency, such EPIC shall also be accepted for identification provided that the name of that elector finds place in the electoral roll pertaining to the polling station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on account of mismatch of photograph, etc. the elector shall have to produce one of the alternative photo documents mentioned in Para 7 above.

9. Notwithstanding anything in Para 7 above, overseas electors who are registered in the electoral roll under Section 20A of the Representation of the People Act, 1950, based on the particulars in their Indian Passport, shall be identified on the basis of their original passport only (and no other identity document) at the polling station.
