बिहार-राज्यपाल के आदेश से, fefFkys'k dqekj lkgq, संयुक्त सचिव ।2 (cid:464)बहार गजट (असाधारण), 11 नव(cid:224)बर 2024 भारत िनवा(cid:170)चन आयोग ——— अिधसूचना िनवा(cid:170)चन सदन, अशोक रोड, नई िद(cid:208)ली – 110001/िदनांकः 11 नव(cid:204)बर, 2024 / काित(cid:170)क 20, 1946(शक) सं. 100/िबहा.-िव.प./12/2024-जी&टी:- यतः, िबहार रा(cid:186)य क(cid:236) िवधान प(cid:229)रषद् के िलए ितरह(cid:242)त (cid:214)नातक िनवा(cid:170)चन (cid:177)े(cid:253) से िनवा(cid:170)िचत (cid:174)ी देवेश च(cid:198)(cid:254) ठाकु र, का (cid:214)थान उनक(cid:236) पदाविध, जो िक 16.11.2026 सिहत उस तारीख तक थी, के समा(cid:302) होने से पूव(cid:170) उनके (cid:194)यागप(cid:253) देने के कारण 15.06.2024 से (cid:229)र(cid:265) हो गया है; और
यतः, इस (cid:255)कार ह(cid:242)ई (cid:229)रि(cid:265) को भरने के (cid:255)योजन से एक उप िनवा(cid:170)चन आयोिजत िकया जाना है; अतः, अब, लोक (cid:255)ितिनिध(cid:194)व अिधिनयम, 1951 (1951 का 43) क(cid:236) धारा 151, धारा 30 और धारा 56 के अनुसरण म(cid:164), िनवा(cid:170)चन आयोग एतद्(cid:300)ाराः-
(अ) िबहार रा(cid:186)य के ितरह(cid:242)त (cid:214)नातक िनवा(cid:170)चन (cid:177)े(cid:253) से यह अपे(cid:177)ा करता है िक वे 12 िदस(cid:204)बर, 2024 (गु(cid:321)वार) से पूव(cid:170) तथा उ(cid:265) अिधिनयम और तदधीन बनाए गए िनयम(cid:332) और उनके तहत जारी िकए गए आदेश(cid:332) के उपब(cid:198)ध(cid:332) के अनुसार रा(cid:186)य क(cid:236) िवधान प(cid:229)रषद् म(cid:164) उ(cid:265) (cid:229)रि(cid:265) को भरने के (cid:255)योजन से एक (cid:211)यि(cid:265) िनवा(cid:170)िचत कर द(cid:164);
(आ) उ(cid:265) िनवा(cid:170)चन के संबंध म(cid:164):-
(क) नाम िनद(cid:165)िशत करने क(cid:236) अि(cid:198)तम तारीख – 18 नव(cid:204)बर, 2024 (सोमवार);
(ख) नाम िनद(cid:165)शन क(cid:236) संवी(cid:177)ा क(cid:236) तारीख – 19 नव(cid:204)बर, 2024 (मंगलवार);
(ग) अ(cid:203)यिथ(cid:170)ताएं वापस लेने क(cid:236) अि(cid:198)तम तारीख – 21 नव(cid:204)बर, 2024 (गु(cid:321)वार);
(घ) वह तारीख िजसको यिद आव(cid:212)यक ह(cid:242)आ तो मतदान होगा – 05 िदस(cid:204)बर, 2024 (गु(cid:321)वार); और (ड.) वह तारीख िजससे पूव(cid:170) िनवा(cid:170)चन स(cid:204)प(cid:198)न करा िलया जाएगा – 12 िदस(cid:204)बर, 2024 (गु(cid:321)वार);
िनयत करता है; और
(इ) 08:00 बजे पूवा(cid:170)(cid:313) से 04:00 बजे अपरा(cid:313) तक का समय उस समय के (cid:322)प म(cid:164) िनयत करता है िजसको, यिद आव(cid:212)यक ह(cid:242)आ तो, िविनिद(cid:170)(cid:310) तारीख को मतदान होगा।

No.100/BR-LC/12/2024-G&T—WHEREAS, the seat of Shri Devesh Chandra Thakur in the Legislative Council of the State of Bihar, elected from Tirhut Graduates' Constituency has become vacant on 15th June, 2024 by the reason of his resignation, before the expiration of his term of office which was up to and including 16.11.2026; and
WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so caused;
NOW, THEREFORE, in pursuance of Section 151, Section 30 and Section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission hereby- (A) calls upon the Tirhut Graduates' Constituency, in the State of Bihar to elect, before 12th December, 2024 (Thursday), and in accordance with the provisions of the said Act and of the rules and orders made thereunder, a person for the purpose of filling the said vacancy in the Legislative Council of the State; and
(B) appoints, with respect to the said election;
(a) the 18th November, 2024 (Monday), as the last date for making nominations;
(b) the 19th November, 2024 (Tuesday), as the date for the scrutiny of nominations;
(c) the 21st November, 2024 (Thursday), as the last date for the withdrawal of candidatures;
(d) the 05th December, 2024 (Thursday), as the date on which a poll shall, if necessary, be taken; and
(e) the 12th December, 2024 (Thursday), as the date before which the election shall be completed; and
(C) fixes the hours from 08:00 am to 04:00 pm, as the hours during which the poll shall, if necessary, be taken on the date specified above for the election.
