सं॰ 09/सी0बी0आई0-80-03/2024, गृ0आ0/13292—जबकि, दिल्ली विशेष पुलिस स्थापना अधिनियम-1946 (1946 का अधिनियम-25) की धारा-6 में प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, पूर्णियाँ जिला अंतर्गत मधुबनी थाना काण्ड संख्या-25/2024, भारतीय दंड संहिता (IPC) की धारा 420, 419, 409, 406 और 201 के साथ धारा 120B और भ्रष्टाचार निवारण अधिनियम, 1988 की धारा 13(2) के साथ 13(1)(A) के तहत एक आपराधिक मामला दर्ज किया गया है, जो 5 मई 2024 को आयोजित NEET(UG) 2024 परीक्षा की अनियमितताओं से संबंधित है, के अनुसंधान/पर्यवेक्षण एवं अन्य अपेक्षित कार्रवाई के लिए दिल्ली विशेष पुलिस स्थापना के सदस्यों को समूचे बिहार राज्य में शक्तियों एवं अधिकारिता के प्रयोग के लिए सहमति देते हुए अधिसूचना सं0-7903, दिनांक-16.07.2024 निर्गत की गयी थी। निर्गत अधिसूचना में अंकित दंडनीय धाराएँ एफ0आई0आर0 में अंकित दंडनीय धाराएँ से भिन्न अंकित हो गयी हैं। अतएव उक्त अधिसूचना में इस आशय का संशोधन किया जाना अनिवार्य है। अतः अधिसूचना सं0-7903, दिनांक-16.07.2024 में अंकित 'भा0द0वि0 की धारा 420, 419, 409, 406 और 201 सह-पठित धारा 120B और भ्रष्टाचार निवारण अधिनियम, 1988 की धारा 13(2) सह-पठित 13(1)(A)' के स्थान पर 'भा0द0वि0 की धारा 419/ 420/ 467/ 468/ 34' पढ़ा जाए। उक्त अधिसूचना के शेष अंश यथावत रहेंगे। विश्वासभाजन, प्रणव कुमार, सरकार के सचिव। 2 ;बपकरू464द्ध ;द्धए 20 ;बपकरू224द्ध 2024 The 14th November 2024

No-9/C.B.I-80-03/2024/13292 HP—Whereas, In exercise of the powers conferred under section-6 of the Delhi Police Establishment Act, 1946 (Act 25 of 1946), the Governor of Bihar has been pleased to accord his consent to exercise of powers and jurisdiction to the whole of Bihar and other places related to the Case to the members of Delhi Special Police Establishment to investigate/supervise and inquire into the FIR No. 25/24, registered at Madhubani Police Station under Purnia District, Bihar, under sections 120B r/w Section 420, 419, 409, 406 and 201 of the IPC and Section 13(2) r/w 13(1)(a) of the Prevention of Corruption Act, 1988, which relates to irregularities in NEET (UG) 2024 examination held on 5th May 2024 vide notification No.7903 dated 16.07.2024.

Further, it has been found that penal sections mentioned in aforesaid Notification dated- 16-07-2024 are different from the penal sections mentioned in the FIR of the said case.

Now, therefore, it is imperative to modify the aforesaid notification. Hence, penal sections mentioned in the aforesaid notification No.7903 dated 16.07.2024 be read as '419/ 420/ 467/ 468 /34 of IPC' in place of penal sections '120B r/w Section 420, 419, 409, 406 and 201 of the IPC and Section 13(2) r/w 13(1)(a) of the Prevention of Corruption Act, 1988'.

The remaining parts of the said notification will remain as it is.
