सं॰ 2/एम०-43/2022-1595(2)/1595(2)/स्वा॰—भारत के संविधान के अनुच्छेद 309 के परन्तुक में प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल "बिहार स्वास्थ्य सेवा (नियुक्ति एवं सेवा र्शा) नियमावली, 2013" (समय-समय पर यथासंशोधित) का संशोधन करते हुए निम्नलिखित नियमावली बनाते हैं :- 1. संक्षिप्त नाम, विस्तार एवं प्रारंभ-
(i) यह नियमावली "बिहार स्वास्थ्य सेवा (नियुक्ति एवं सेवा शर्त्त) (संशोधन) नियमावली, 2024" कही जा सकेगी।
(ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (iii) यह नियमावली अधिसूचना निर्गत होने की तिथि से प्रभावी होगी।
2. "बिहार स्वास्थ्य सेवा (नियुक्ति एवं सेवा र्शा) नियमावली, 2013" (समय-समय पर यथासंशोधित) के नियम 4(1) का आंशिक विलोपन।-उक्त नियमावली के नियम 4(1) में प्रयुक्त वाक्यांश ''बिहार लोक सेवा'' को विलोपित किया जाता है।
3. "बिहार स्वास्थ्य सेवा (नियुक्ति एवं सेवा र्शा) नियमावली, 2013" (समय-समय पर यथासंशोधित) के नियम 5 का आंशिक विलोपन।-उक्त नियमावली के नियम 5 के अंतिम पारा/परन्तुक को विलोपित किया जाता है।
4. "बिहार स्वास्थ्य सेवा (नियुक्ति एवं सेवा र्शा) नियमावली, 2013" (समय-समय पर यथासंशोधित) के नियम 6 का प्रतिस्थापन।-उक्त नियमावली के नियम 6 को निम्नलिखित द्वारा प्रतिस्थापित किया जाता है :-
''बिहार स्वास्थ्य सेवा के सामान्य कर्त्तव्य उपसम्वर्ग में नियुक्ति हेतु चिकित्सकों के चयन के लिए अभ्यर्थियों को प्रतियोगिता परीक्षा एवं कार्यानुभव के लिए अंक प्रदान किए जाएेंगे। प्रतियोगिता परीक्षा का पाठ्यक्रम वही होगा जो विभाग द्वारा तय किया जायेगा। प्रतियोगिता परीक्षा एवं कार्यानुभव के लिए कुल निर्धारित अंक 100 होगा। इन 100 अंकों का निर्धारण निम्नानुसार होगाः-2 ;बपकरू464द्ध ;द्धए 26 ;बपकरू224द्ध 2024 (i) प्रतियोगिता परीक्षा में प्राप्तांक के लिए - 75 अंक - 25 अंक (ii) बिहार राज्य के अन्तर्गत किसी भी गैर निजी अस्पतालों (यथा बिहार सरकार, केन्द्र सरकार, नगर पालिका, पंचायती राज संस्थानों एवं अन्य लोक संस्थानों, सैनिक अस्पताल सहित) में संविदा के आधार पर पूर्व में समकक्ष पद पर अभ्यर्थी द्वारा प्रति वर्ष की गई संतोषजनक सेवा के लिए अधिकतम पाँच अंक प्रति वर्ष की दर से अधिकतम 25 अंको की अधिमानता (किसी वर्ष के अंश के लिए कार्यदिवसों की संख्या में 5 से गुणा करने के पश्चात् 365 से भाग देकर प्राप्त अनुपातिक अंक जोड़ा जाएगा) दी जाएगी।
कुल अंक - 100 अंक टिप्पणी :- (क) प्रतियोगिता परीक्षा में प्राप्तांक के लिए किसी अभ्यर्थी को प्रदान किये जाने वाले अंकों का निर्धारण उक्त प्रतियोगिता परीक्षा में प्राप्त कुल अंकों के प्रतिशत को 0.75 के गुणक से गुणा करके होगा। यथा- यदि किसी अभ्यर्थी द्वारा प्रतियोगिता परीक्षा में 60 प्रतिशत अंक प्राप्त किया गया हो तो उसे 60×0.75= 45 अंक दिये जायेंगे।
टिप्पणी :- (ख) प्रतियोगिता परीक्षा हेतु न्यूनतम अर्हतांक 30 प्रतिशत होगा।
5. "बिहार स्वास्थ्य सेवा (नियुक्ति एवं सेवा र्शा) नियमावली, 2013" (समय-समय पर यथासंशोधित) के नियम 7 का आंशिक विलोपन।- उक्त नियमावली के नियम 7 के अंतिम पारा/परन्तुक को विलोपित किया जाता है।
6. "बिहार स्वास्थ्य सेवा (नियुक्ति एवं सेवा र्शा) नियमावली, 2013" (समय-समय पर यथासंशोधित) के नियम 8 का प्रतिस्थापन।- उक्त नियमावली के नियम 8 को निम्नलिखित द्वारा प्रतिस्थापित किया जाता है :-
''बिहार स्वास्थ्य सेवा के विशेषज्ञ उपसम्वर्ग में नियुक्ति हेतु चिकित्सकों के चयन के लिए अभ्यर्थियों को प्रतियोगिता परीक्षा एवं कार्यानुभव के लिए अंक प्रदान किए जाएेंगे। प्रतियोगिता परीक्षा का पाठ्यक्रम वही होगा जो विभाग द्वारा तय किया जायेगा। प्रतियोगिता परीक्षा एवं कार्यानुभव के लिए कुल निर्धारित अंक 100 होगा। इन 100 अंकों का निर्धारण निम्नानुसार होगा :-

7. "बिहार स्वास्थ्य सेवा (नियुक्ति एवं सेवा र्शा) नियमावली, 2013" (समय-समय पर यथासंशोधित) के नियम 19 का प्रतिस्थापन। - उक्त नियमावली के नियम-19 को निम्नलिखित द्वारा प्रतिस्थापित किया जाता है :-
''प्रतियोगिता परीक्षा एवं कार्यानुभव हेतु प्राप्त कुल अंकों के आधार पर उम्मीदवारों के नाम आयोग द्वारा योग्यता क्रम में रखे जाएंगे। इस प्रकार क्रमांकित उम्मीदवारों की सूची से आयोग उतने उम्मीदवारों का आरक्षण कोटिवार चयन करेगा जितना सरकार ने अधियाचित किया हो और उन्हें नियुक्ति के लिए अनुशंसित करेगा।''

No.-2/M-43/2022-1595(2)/Health—In exercise of the powers conferred by the proviso to the Article 309 of the Constitution of India, the Governor of Bihar is hereby pleased to make amendments to "The Bihar Health Service (Appointment and Service Condition) Rules, 2013" (as amended from time to time) as per the following rules – 1. Short title, extent and commencement:
a. These Rules may be called "The Bihar Health Service (Appointment and Service Condition) (Amendment) Rules, 2024."
b. These Rules extends to the entire State of Bihar. c. This notification will be effective from the date of issue.
2. Partial deletion of Rule 4(1) of "The Bihar Health Service (Appointment and Service Condition) Rules, 2013" :- The clause "Bihar Public Service" used in Rule 4(1) of the said rule is deleted.
3. Partial deletion of Rule 5 of "The Bihar Health Service (Appointment and Service Condition) Rules, 2013" :- The last paragraph/proviso of Rule 5 of the said rule is deleted.
4. Substitution of Rule 6 of "The Bihar Health Service (Appointment and Service Condition) Rules, 2013" :- The said rule is hereby substituted as follows- ''Candidates will be given marks for competitive examination and work experience for the selection of doctors for appointment in general duty sub-cadre of the Bihar Health Services. The syllabus of the competitive examination will be the same as decided by the department. The total marks prescribed for competitive examination and work experience will be 100. Out of that 100 marks will be determined as follows :-
(i) For marks obtained in competitive examination - 75 marks
- 25 marks (ii) On the basis of satisfactory service on equivalent post rendered by the candidate on contractual basis, maximum weightage of 25 marks at the rate of maximum five marks per year (the proportionate marks obtained by dividing 365 after multiplying the number of working days by 5, will be added for any part of a year), will be given for work experience obtained in any non-private hospitals (either Bihar government, Central government, Municipal corporation, Panchayati raj institutions or any other local institutions, including Military hospital) within the jurisdiction of the State of Bihar.
Total marks - 100 marks NOTE :- (a) The marks to be awarded to a candidate for the marks obtained in the competitive examination will be determined by multiplying the percentage of total marks obtained in the said competitive examination by a multiple of 0.75. For example, if a candidate has obtained 60 percent marks in the competitive examination, then he will be given 60 × 0.75 = 45 marks.
NOTE :- (b) The minimum qualifying marks for the competitive examination will be 30 percent.''4 ;बपकरू464द्ध ;द्धए 26 ;बपकरू224द्ध 2024 5. Partial deletion of Rule 7 of "The Bihar Health Service (Appointment and Service Condition) Rules, 2013" :- The last paragraph/proviso of Rule 7 of the said rule is deleted.
6. Substitution of Rule 8 of "The Bihar Health Service (Appointment and Service Condition) Rules, 2013" :- The said rule is hereby substituted as follows- ''Candidates will be given marks for competitive examination and work experience for the selection of doctors for appointment in specialist sub-cadre of Bihar Health Service. The syllabus of the competitive examination will be the same as decided by the department. The total marks prescribed for competitive examination and work experience will be 100. Out of that 100 marks will be determined as follows:-
(i) For marks obtained in competitive examination - 75 marks

7. Substitution of Rule 19 of "The Bihar Health Service (Appointment and Service Condition) Rules, 2013" :- The said rule is hereby substituted as follows- "The names of the candidates will be placed in order of merit by the Commission on the basis of total marks obtained in competitive examination and work experience. From the list of candidates so numbered, the Commission will select the names of such number of candidates reservation category wise as requested by the Government and will recommend their names for appointment.''
