सं॰ 1/ए॰जी॰-21/2010/387—भारत के संविधान के अनुच्छेद-309 के परन्तुक के अधीन प्रदत शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार कृषि सेवा कोटि-8 (माप एवं तौल) में भर्ती, प्रोन्नति एवं सेवा शर्तों के लिए निम्नलिखित नियमावली बनाते हैं :- 1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ ।-
(1) यह नियमावली 'बिहार कृषि सेवा कोटि-8 (माप एवं तौल) नियमावली, 2014 कही जायेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत के प्रभाव से प्रवृत होगी।
2. परिभाषा ।- इस नियमावली में जब तक संदर्भ में अन्यथा अपेक्षित न हो -
(i) 'राज्य' से अभिप्रेत है बिहार राज्य, (ii) 'राज्यपाल' से अभिप्रेत है बिहार के राज्यपाल, (iii) 'सरकार' से अभिप्रेत है बिहार सरकार, (iv) 'विभाग' से अभिप्रेत है बिहार सरकार का कृषि विभाग, (v) 'कृषि सेवा अधिनियम' से अभिपे्रत है बिहार कृषि सेवा अधिनियम 1982 (बिहार अधिनियम संख्या- 44, 1982),
(vi) कोटि-8 (माप एवं तौल) से अभिप्रेत है बिहार कृषि सेवा अधिनियम-1982 की धारा-2 के अंतर्गत अनुसूची-1 में उद्धृत कोटि-8 (माप एवं तौल)
(vii) 'बिहार कृषि सेवा (कोटि-8)' से अभिप्रेत है बिहार राज्य की कृषि सेवा, कोटि-8 (माप एवं तौल) (viii) 'संवर्ग' से अभिप्रेत है बिहार कृषि सेवा कोटि-8 (माप एवं तौल) का संवर्ग, (ix) 'आयोग' से अभिप्रेत है ''बिहार लोक सेवा आयोग'', (x) 'सदस्य' से अभिप्रेत है बिहार कृषि सेवा कोटि-8 (माप एवं तौल) में नियुक्त व्यक्ति, (xi) नियुक्ति प्राधिकार से अभिप्रेरित है, बिहार राज्य सरकार,
3. संवर्ग नियंत्रण।-यह सेवा एक राज्य सेवा होगी तथा कृषि विभाग इस सेवा का नियंत्री एवं प्रशासी विभाग होगा।2 ;बपकरू464द्ध ;द्धए 27 ;बपकरू464द्ध;बपकरू224द्ध 2024
4. पदसोपान।-
(1) (क) मूल कोटि का पद- सहायक नियंत्रक (माप एवं तौल), एवं समकक्ष
(ख) प्रथम प्रोन्नति का पद - उप नियंत्रक (माप एवं तौल), एवं समकक्ष (ग) द्वितीय प्रोन्नति का पद - संयुक्त नियंत्रक (माप एवं तौल), एवं समकक्ष (घ) तृतीय प्रोन्नति का पद - नियंत्रक (माप एवं तौल),
(2) संवर्ग की सभी कोटियों में पदो की संख्या उतनी ही होगी जितनी सरकार द्वारा समय-समय पर निर्धारित की जाय तथा उनका वेतनमान वही होगा जो सरकार द्वारा समय-समय पर निर्धारित की जाय।
5. मूल कोटि में नियुक्ति एवं प्रोन्नति।-
(1) सेवा में नियुक्ति के लिए भारत का नागरिक होना अनिवार्य होगा। मूल कोटि के 67 प्रतिशत पद सीधी नियुक्ति से तथा 33 प्रतिशत पद प्रोन्नति से भरे जायेंगे।
(2) प्रति वर्ष 1 ली अप्रैल को मूल कोटि में स्वीकृत पदों के विरूद्ध प्रोन्नति के लिए तथा सीधी नियुक्ति के लिए रिक्त पदों की गणना अलग-अलग की जायेगी। यह गणना पदों के आधार पर की जायेगी अर्थात सीधी नियुक्ति के पदों के रिक्त होने पर इन्हें सीधी नियुक्ति द्वारा तथा प्रोन्नति के पदों के रिक्त होने पर इन्हेें प्रोन्नति द्वारा भरा जाएगा। 30 अप्रैल को रिक्तियों के संबंध में विभाग द्वारा आरक्षण कोटिवार अधियाचना आयोग को प्रेषित कर दी जाएगी।
(3) शैक्षणिक योग्यता ।- संवर्ग में मूल कोटि के पदों पर सीधी नियुक्ति या प्रोन्नति के लिए न्यूनतम शैक्षणिक योग्यता मान्यता प्राप्त विश्वविद्यालय/ संस्थान/ राष्ट्रीय विश्वविद्यालय/विश्वविद्यालय से विज्ञान (भौतिकी के साथ)/अभियंत्रण/प्राद्यौगिकी में स्नातक की डिग्री होगी।
(4) सीधी भर्ती द्वारा नियुक्ति।-(क) सीधी नियुक्ति आयोग द्वारा संचालित प्रतियोगिता परीक्षा के आधार पर अनुशंसित अभ्यर्थियों से की जायेगी। (ख) उम्र सीमा।-आवेदन आमंत्रित करने वाले वर्ष के पहली अगस्त को, न्यूनतम आयु 21 (इक्कीस) वर्ष होगी। अधिकतम उम्र सीमा वही होगी जो सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी भर्ती के लिए समय-समय पर, विनिश्चित की जाय किन्तु विशेष परिस्थिति में इसे राज्य सरकार के आदेश से बढ़ाया जा सकेगा।
(ग) आरक्षण ।- सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी नियुक्ति के लिए, समय-समय पर, किए गए आरक्षण प्रावधान लागू होंगे।
(घ) सीधी नियुक्ति हेतु विभाग द्वारा सामान्य एवं आरक्षण कोटिवार रिक्तियों की संख्या के साथ अधियाचना प्रत्येक वर्ष आयोग को भेजी जायेगी।
(ड़) प्रतियोगिता परीक्षा के विषय तथा पाठ्यक्रम ।- ऊपर नियम 5 (iv) (क) में उल्लेखित प्रतियोगिता परीक्षा में 100 अंकों के हिन्दी विषय में उतीर्ण होना अनिवार्य होगा। परन्तु इसके प्राप्तांक की गणना मेधा सूची बनाने में नहीं की जायेगी। मेधा सूची विज्ञान (भौतिकी के साथ)/अभियंत्रण/प्रौद्योगिकी में 200-200 अंकों के दो प्रश्न पत्रों, सामान्य ज्ञान के 100 अंकों के एक प्रश्न पत्र तथा मौखिक परीक्षा के 50 अंकों के विरूद्ध कुल प्राप्त अंकों के आधार पर तैयार की जायेगी। हिन्दी तथा सामान्य ज्ञान का पाठ्यक्रम वही होगा जो बिहार लोक सेवा आयोग द्वारा आयोजित संयुक्त प्रतियोगिता परीक्षा के लिए विनिश्चित किया जाय। विज्ञान (भौतिकी के साथ)/अभियंत्रण/प्रौद्योगिकी का पाठ्यक्रम विभाग द्वारा बिहार लोक सेवा आयोग के परामर्श से तैयार किया जाएगा। विज्ञान (भौतिकी के साथ)/अभियंत्रण/प्रौद्योगिकी तथा सामान्य ज्ञान के उपरोक्त तीन पत्रों के प्राप्तांक के योग के आधार पर अभ्यर्थियों को समुचित संख्या में मौखिक परीक्षा के लिए बुलाया जाएगा। मौखिक परीक्षा 50 अंकों की होगी। (च) आयोग द्वारा अभ्यर्थियों की अनुशंसा ।- आयोग लिखित एवं मौखिक परीक्षा में प्राप्त अंकों के आधार पर सामान्य तथा प्रत्येक आरक्षण कोटि के लिए अलग-अलग मेधा सूची तैयार करेगा। ऐसी तैयार की गयी सूचियों में से आयेाग प्रतिवेदित रिक्तियों के अनुसार अनुशंसा विभाग को करेगा।
(5) प्रोन्नति द्वारा नियुक्ति।-बिहार कृषि सेवा कोटि-8 (माप एवं तौल) के 33% पदों पर कृषि अधीनस्थ सेवा (निरीक्षक, माप-तौल), कोटि-8 (माप एवं तौल) से विज्ञान (भौतिकी के साथ)/अभियंत्रण/प्रौद्योगिकी स्नातक योग्ताधारी को ही प्रोन्नति दी जायेगी। कृषि अधीनस्थ सेवा (निरीक्षक, माप-तौल), कोटि-8 (माप एवं तौल) में कार्यरत पदाधिकारियों को सामान्य प्रषासन विभाग द्वारा समय-समय पर विनिि"चत कालावधि आरक्षण रोस्टर एवं निर्गत नीति निर्धारक परिपत्रों के आलोक में वरीयता के आधार पर सक्षम प्राधिकार द्वारा प्रोन्नति दी जायेगी।
6. परिवीक्षा।-
(1) सेवा में सीधी भर्ती से नियुक्त प्रत्येक सदस्य पदग्रहण की तिथि से दो वर्षों की अवधि के लिए परिवीक्षाधीन होगा परन्तु विशेष परिस्थितियों में लिखित रूप में अभिलिखित किए जाने वाले कारणों से यह अवधि विभाग के द्वारा एक वर्ष तक बढ़ाई जा सकेगी। यदि बढ़ाई गयी अवधि में भी कार्य;बपकरू464द्ध ;द्धए 27 ;बपकरू464द्ध;बपकरू224द्ध 2024 3 संतोषप्रद नहीं होगा, तो ऐसे सदस्यों की सेवा सरकार द्वारा बिना कारण पृच्छा के समाप्त की जा सकेगी, परन्तु इसकी लिखित सूचना कारण सहित दी जाएगी।
(2) परिवीक्षाधीन अवधि की गणना नियमित सेवा में की जायेगी।
7. प्रशिक्षण।-बिहार कृषि सेवा में नियुक्त सदस्यों के लिए प्रोन्नति हेतु राज्य सरकार द्वारा विनिश्चित संस्थान से प्रशिक्षण प्राप्त करना अनिवार्य होगा, किन्तु अवधारित प्रोन्नति के पूर्व यदि प्रशिक्षण आयोजित नहीं हुआ हो, तो प्रोन्नति बाधित नहीं होगी। प्रशिक्षण संस्थानों का चयन समय-समय पर विभाग द्वारा किया जायेगा। 8. विभागीय परीक्षा।-
(1) सदस्यों को केन्द्रीय परीक्षा समिति (राजस्व पर्षद्), बिहार द्वारा आयोजित विभागीय परीक्षा में उत्तीर्ण होना अनिवार्य होगा।
(2) मूल कोटि के वेतनमान में प्रथम वेतनवृद्धि विभागीय परीक्षा उत्तीर्णता के उपरान्त ही देय होगी। 9. सम्पुष्टि ।-
(1) परिवीक्षा की समाप्ति, विभागीय परीक्षा में उत्तीर्णता तथा विनिश्चित प्रशिक्षण कार्यक्रम के संतोषप्रद रूप से पूर्ण किये जाने पर तथा सेवा स्वच्छ पाये जाने पर सीधी नियुक्ति के सदस्यों की सेवा स्थायी संवर्गीय पदों के विरूद्ध मूल कोटि में संपुष्ट की जाएगी।
(2) प्रोन्नति से मूल कोटि में नियुक्त सदस्यों की उप नियम (1) के अधीन वर्णित शर्त्तों (परिवीक्षा को छोड़कर) पर सेवा संपुष्ट की जा सकेगी।
10. वरीयता का अवधारण ।- सीधी भर्त्ती से नियुक्त पदाधिकारियों की वरीयता आयोग द्वारा अवधारित मेधा क्रम के अनुसार होगी तथा किसी एक ही वर्ष में सीधी भर्त्ती द्वारा नियुक्त पदाधिकारी उसी वर्ष प्रोन्नति द्वारा नियुक्त पदाधिकारी से कनीय होगे। अन्य कोटियों में वरीयता का अवधारण, समय-समय पर, सामान्य प्रशासन विभाग द्वारा अवधारित नीति के आलोक में किया जाएगा।
11. मूल कोटि से उच्चतर पदों पर प्रोन्नति ।-
(1) सेवा संवर्ग के पदसोपान में उच्चतर पदों पर प्रोन्नति ठीक नीचे की पंक्ति में कार्यरत पदाधिकारियों से वरीयता सह मेधा के आधार पर तथा सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत आदेशों के आलोक में दी जाएगी। लेकिन सदस्यों को नियम-7 में यथा प्रावधानित प्रशिक्षण में भाग लेने पर ही प्रोन्नति देय होगी।
(2) विभाग/संस्थान द्वारा ससमय प्रशिक्षण आयोजित नहीं किये जाने के फलस्वरूप प्रोन्नति बाधित नहीं होगी।
(3) कार्यरत पदाधिकारियों की मूल कोटि में संपुष्टि, गोपनीय अभ्यिुक्ति, आंतरिक स्वच्छता, निगरानी स्वच्छता एवं लोकायुक्त का प्रतिवेदन, सामान्य प्रशासन विभाग द्वारा अवधारित कालावधि, आरक्षण, पदों की उपलब्धता आदि पर विचार करते हुए वरीयता के आधार पर, सक्षम प्राधिकार द्वारा प्रोन्नति दी जायेगी।
(4) विभागीय प्रोन्नति समिति ।- विभागीय प्रोन्नति समिति की अनुशंसा पर प्रोन्नति हेतु विचार किया जा सकेगा। विभागीय प्रोन्नति समिति अलग से सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत संकल्पों/अनुदेशों के आलोक में विभाग द्वारा गठित की जायेगी।
12. प्रकीर्ण ।- कठिनाई का निराकरण ।-
(1) इस नियमावली के नियमों का विवेचन करने के लिए विभाग, विधि विभाग से परामर्श के पश्चात, सक्षम होगा।
(2) विभाग, विधि विभाग के परामर्श के पश्चात, इस नियमावली के किसी नियम को लागू करने में आने वाली कठिनाई का निराकरण, राजपत्र में समुचित आदेश द्वारा, जो इस नियमावली के प्रावधानों से असंगत न हो, कर सकेगा।
(3) जिन विषयों या बिन्दुओं का प्रावधान इस नियमावली में नहीं है, उनके सम्बन्ध में राज्य सरकार द्वारा तत्समय प्रवृत संहिता/नियमावली/संकल्प/अनुदेश में किये गये प्रावधान इस सेवा के संदर्भ में उनके संबंध में लागू होंगे।
13. निरसन एवं व्यावृति ।-
(1) इस संवर्ग के कर्मियों की नियुक्ति/सेवा शर्त्त संबंधी पूर्व में निर्गत सभी परिपत्र/अनुदेश/संकल्प निरसित समझे जायेंगे।
(2) उक्त निरसन के होते हुए भी पूर्व निर्गत परिपत्र/अनुदेश/संकल्प के अन्तर्गत की गयी कोई कार्रवाई या पूर्व में निर्गत कोई आदेश प्रभावित या अविधिमान्य नहीं समझा जायेगा।

No.-1/A.G-21/2010/388—In exercise of the powers conferred under proviso to Article 309 of the Constitution of India, the Governor of Bihar, is hereby pleased to make the following rules to regulate the appointment, promotion and service-conditions in the Bihar Agriculture Service Category- 8 (Weights and Measures):-
1. Short title, extent and commencement-
(1) These rules may be called Bihar Agriculture Service Category- 8 (Weight and Measures) cadre Rules, 2014.
(2) It shall extend to the whole of the State of Bihar (3) It shall come into force at once.
2. Definition- In these rules, unless otherwise is required in the context-
(i) "State" means the State of Bihar; (ii) "Governor" means the Governor of Bihar; (iii) "Government" means Government of Bihar; (iv) "Department" means Agriculture Department of Bihar; (v) "Agriculture Service Act" means Bihar Agriculture Service Act, 1982 (Bihar Act no. 44, 1982);
(vi) Category- 8 (Weights and Measures) means Category- 8 (Weights and Measures)mentioned under schedule -1 of section 2 of Bihar Agriculture Service Act, 1982;
(vii) Bihar Agriculture Service Category- 8 means Agriculture Service Category- 8 (Weights and Measures) of the State of Bihar;
(viii) "Cadre" means the cadre of the Bihar Agriculture Service Category-8 (Weights and Measures);
(ix) "Commission" means theBihar Public Service Commission; (x) ""Member" means the person appointed under Bihar Agriculture Service Category- 8 (Weights and Measures);
(xi) Appointing Authority meansState Government of Bihar;
3. Cadre Control- This service shall be a state service and Agriculture Department shall be its Controlling and Administrative Department.
4. Hierarchy-(1)(a)Post of basic category- Assistant Controller(Weights and Measures) and equivalent post.
(b) First promotional post- Deputy Controller (Weights and Measures). (c) Second promotional post- Joint Controller (Weights and Measures). (d) Third promotional post- Controller (Weights and Measures).
(2) The number of posts of all categories of this cadre shall be determined by the department, from time to time, and pay scale shall bethe same as may be determined by the government, from time to time.
5. Appointment and promotion in the basic category-
(1) It shall be obligatory for the candidate to be a citizen of India for the appointment in the service. 67 percent posts of the basic category shall be filled by direct appointment and 33 percent posts shall be filled up by promotion.
(2) The calculation of vacant posts for promotion and direct appointment, against the sanctioned posts in the basic category, shall be made separately as on 1stApril, every year. This calculation shall be made on the basis of posts. It means that in case of the post of direct appointment falling vacant, it shall be filled by direct appointment and in case of the post of promotion falling vacant it shall be filled by promotion.Reservation Category wise;बपकरू464द्ध ;द्धए 27 ;बपकरू464द्ध;बपकरू224द्ध 2024 5 requisition of these vacancies shall be sent by the Department to the Commission by 30th April.
(3) Educational Qualifications- Minimum Educational qualification for direct appointment or promotion to the posts of basic category in the cadre, shall be degree of bachelor in Science (with Physics)/Engineering/Technology form any recognized University/Institute/National University.
(4) Direct Appointment-
(a) Direct appointment shall be made from the candidates recommended on the basis of Competitive Examination conducted by the Commission.
(b) Age Limit- The minimum age shall be 21 (Twentyone) years on the 1st August of the year in which application is invited. The maximum age limit shall be the same as may be prescribed by the department of General Administration, from time to time for direct appointment in the services of the State Government but it may be increased in special circumstances by the order of the state government.
(c) Reservation-Thereservation provisions made by the Department of General Administration, from time to time for direct appointment in services of the state Government shall be applicable to it.
(d) For direct appointment, the requisition with number of general and reservation category wise vacancies will be sent by the department to the commission every year.
(e) Subject and syllabus for the competitive examination- It shall be compulsory to pass in Hindi subject carrying 100 marks, in the Competitive Examination mentioned in Rule 5(4)(a) of these Rules but its obtained marks shall not be calculated for the purpose of preparation of merit-list. The merit list shall be prepared on the basis of sum total of marks obtained in two question papers of Science (with Physics)/Engineering/Technologyeach carrying 200 marks, one question paper of general knowledge carrying 100 marks and oral test of 50 marks. The syllabus of Hindi and General Knowledge, shall be the sameas may be determined for the Joint Competitive Examination conducted by the Bihar Public Service Commission. The syllabus of Science (with Physics)/Engineering/Technology shall be prepared by the department in consultation with the Bihar Public Service Commission. The candidates shall be called for oral test in appropriate number, on the basis of sum total of marks obtained in aforesaid three papers of Science (with Physics)/Engineering/Technologyand General Knowledge. The oral test shall be for 50 marks.
(f) Recommendation for candidates by the Commission-The Commission shall prepare merit-list separately for the candidates of general category and for each reservation category, on the basis of marks obtained in written and oral test. The Commission shall recommend to the department from the list so prepared according to the reported vacancies.
(5) Appointment by promotion-Only the Graduate qualification holders in Science (with Physics)/Engineering/Technology shall be promoted to the 33% posts of the Bihar Agriculture Service Category- 8 (Weights and Measures) from the Agriculture subordinate service Category- 8 (Inspector, Weights and Measures). Promotions will be given to the officers working in the Agriculture Subordinate Service (Inspector, Weights and6 ;बपकरू464द्ध ;द्धए 27 ;बपकरू464द्ध;बपकरू224द्ध 2024 Measures), Category- 8 by the Competent Authority on the basis of seniority in view of determined kalawadhi and reservation roster and policy deciding circulars issued by the department of General Administration, from time to time.
6. Probation-
(1) Every member appointed by direct recruitment shall be on probation for the period of two years from the date of joining the post but in special circumstances, this period may be extended for one year by the department with reasons to be recorded in writing. If the work of a member is not found satisfactory during the extended period too,the service of such members may be terminated by the Government without asking any show cause, but its written information,with reasons, shall be given.
(2) The calculation ofprobation period shall be made in the regular service.
7. Training- It shall be compulsory for the members appointed in the Bihar Agriculture Service to obtain training from the institute determined by the State Government before the promotion. However, the promotion shall not be barred if the training is not conducted by the state Government before the promotion.The place of training shall be selected by the department, from time to time.
8. Departmental Examination-
(1) It shall be compulsory for the members to pass the Departmental Examination conducted by the Central Examination Committee (Revenue Board).
(2) The first increment in the pay scale of basic category shall be payable only after passing the Departmental Examination.
9. Confirmation-
(1) After completing probation period, passing in the Departmental Examination, and obtaining the determined training programme satisfactorily, and services found clear, service of the member of direct recruitment shall be confirmed against the permanent cadre posts in the basic category.
(2) The services of the members appointed in the basic category by promotion, shall be confirmed on the conditions mentioned under Sub Rule (1) (except probation).
10. Determination of seniority-Seniority of the officers appointed by direct recruitment shall be according to the order of merit determined by the Commission and the officers appointed by direct recruitment shall be Junior to the officers appointed by promotion in the same year. Determination of seniority in other categories shall by in view of the policy determined by the General Administration Department, from time to time.
11. Promotion to higher post from the basic category-
(1) In the hierarchy of service cadre, promotion shall be given to a member from the officers working just one post below, on the basis of seniority- cum-merit, in the light of orders issued by the Department of General Administration, from time to time but the said promotion shall be given to the member only after completing the training as provided under Rule-7.
(2) The said promotion shall not be obstructed due to not organizing training on time by the department/institute.
(3) Promotion shall be given by the Competent Authority on the basis of seniority, after considering confirmation of the working officers in the basic category, confidential remarks, internal clearance, clearance of;बपकरू464द्ध ;द्धए 27 ;बपकरू464द्ध;बपकरू224द्ध 2024 7 vigilance, and report of Lokayukta and Kalawadhi determined by the Department of General Administration etc.
(4) Departmental promotion committee-It may be considered for promotion on the recommendation of the Departmental Promotion Committee. The Departmental Promotion Committee shall be constituted separately in the light of resolutions/instructions issued by the Department of General Administration, from time to time.
12 Miscellaneous: Removal of difficulty-
(1) The department after consultation with the Law Department shall be competent to interpret the rule of these Rules.
(2) The department mayafter consultation with the Law Department remove the difficulty, coming in implementation of any rule of these rules, by appropriate order which is not inconsistent with the provisions of these Rules.
(3) The subjects or points for which provisions are not made in these rules, the provisions made in the code/rules/resolution/instruction for the time being enforced by the State Government, shall be applicable to them in context of this service.
13. Repeals and Savings-
(1) All circulars/instructions/resolutions regarding appointment of staff/ service conditions, of this cadre, are hereby repealed.
(2) Not with standing the said repeal the action taken or any order issued earlier shall not be deemed affected or invalid.
