(1)- यतः, िबहार रा(cid:186)य क(cid:236) िवधान सभा के सद(cid:214)य(cid:332) (cid:300)ारा िवधान प(cid:229)रषद के िलए िनवा(cid:170)िचत डॉ. सुनील कु मार िसंह, का (cid:214)थान उनक(cid:236) पदाविध, जो िक 28.06.2026 सिहत उस तारीख तक थी, के समा(cid:302) होने से पूव(cid:170) िनरह(cid:170)ता के कारण 27.07.2024 से (cid:229)र(cid:265) हो गया है; और
यतः, इस (cid:255)कार ह(cid:242)ई (cid:229)रि(cid:265) को भरने के (cid:255)योजन से एक उप िनवा(cid:170)चन आयोिजत िकया जाना है;
अतः, अब, लोक (cid:255)ितिनिध(cid:194)व अिधिनयम, 1951 (1951 का 43) क(cid:236) धारा 151, धारा 39 क(cid:236) उपधारा (1) और धारा 56 के अनुसरण म(cid:164), भारत िनवा(cid:170)चन आयोग एतद्(cid:300)ाराः-
(अ) िबहार रा(cid:186)य के िवधान सभा सद(cid:214)य(cid:332) से यह अपे(cid:177)ा करता है िक वे 25 जनवरी, 2025 (शिनवार) से पूव(cid:170) तथा उ(cid:265) अिधिनयम और त(cid:294)ीन बनाए गए िनयम(cid:332) और उनके तहत जारी िकए गए आदेश(cid:332) के उपब(cid:198)ध(cid:332) के अनुसार रा(cid:186)य क(cid:236) िवधान प(cid:229)रषद म(cid:164) उ(cid:265) (cid:229)रि(cid:265) को भरने के (cid:255)योजन से एक (cid:211)यि(cid:265) िनवा(cid:170)िचत कर द(cid:164);
(आ) उ(cid:265) िनवा(cid:170)चन के संबंध म(cid:164):-
(क) नाम िनद(cid:165)िशत करने क(cid:236) अि(cid:198)तम तारीख – 13 जनवरी, 2025 (सोमवार); (ख) नाम िनद(cid:165)शन क(cid:236) संवी(cid:177)ा क(cid:236) तारीख – 14 जनवरी, 2025 (मंगलवार); (ग) अ(cid:203)यिथ(cid:170)ताएं वापस लेने क(cid:236) अि(cid:198)तम तारीख – 16 जनवरी, 2025 (गु(cid:321)वार); (घ) वह तारीख िजसको यिद आव(cid:212)यक ह(cid:242)आ तो – 23 जनवरी, 2025 (गु(cid:321)वार); और मतदान होगा
– 25 जनवरी, 2025 (शिनवार);
(ड.) वह तारीख िजससे पूव(cid:170) िनवा(cid:170)चन स(cid:204)प(cid:198)न करा
िलया जाएगा
िनयत करता है; और
(इ) 09:00 बजे पूवा(cid:170)(cid:313) से 04:00 बजे अपरा(cid:313) तक का समय उस समय के (cid:322)प म(cid:164) िनयत करता है िजसको, यिद आव(cid:212)यक ह(cid:242)आ तो, िविनिद(cid:170)(cid:310) तारीख को मतदान होगा।
आदेश से, 3 (cid:464)बहार गजट (असाधारण), 6 जनवर(cid:547) 2025 ELECTION COMMISSION OF INDIA ——— NOTIFICATION Nirvachan Sadan, Ashoka Road, New Delhi. Dated: 06th January, 2025 Pausha 16, 1946 (Saka) No.100/BR-LC/13/2024-MLA (1).—Whereas, the seat of Dr. Sunil Kumar Singh in the Legislative Council of the State of Bihar, elected by the members of the Legislative Assembly of the State, has become vacant on 27.07.2024 by the reason of his disqualification, before the expiration of his term of office which was up to and including 28.06.2026; and
WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so caused;
NOW, THEREFORE, in pursuance of Section 151, sub-section (1) of Section 39 and Section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India hereby-
(A) calls upon the members of the Legislative Assembly of the State of Bihar to elect, before 25th January, 2025 (Saturday), and in accordance with the provisions of the said Act and of the rules and orders made thereunder, a person for the purpose of filling the said vacancy in the Legislative Council of the State;
(B) appoints with respect to said election, -
(a) the 13th January, 2025 (Monday), as the last date for making nominations;
(b) the 14th January, 2025 (Tuesday), as the date for the scrutiny of the nominations;
(c) the 16th January, 2025 (Thursday), as the last date for the withdrawal of candidatures;
(d) the 23rd January, 2025 (Thursday), as the date on which a poll shall, if necessary, be taken; and
(e) the 25th January, 2025 (Saturday), as the date before which the election shall be completed; and
(C) fixes the hours from 09:00 am to 04:00 pm, as the hours during which the poll shall, if necessary, be taken on the date specified above, for the election.
