(सं0 पटना 90) पटना, बुधवार, 5 फरवर(cid:547) 2025 lkekU; iz'kklu foHkkx ——— vf/klwpuk 5 Qjojh 2025 —भारत-संविधान के अनुच्छेद-309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, "बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005" (समय-समय पर यथासंशोधित) का संशोधन करने के लिए निम्नलिखित नियमावली बनाते हैं :-

(1) यह नियमावली कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में प्रकाशन की तिथि से प्रवृत्त होगी।
उक्त नियमावली के नियम-2 में उपनियम-(त) निम्नवत्
अन्तःस्थापित किया जाता है-
निदेशालय' से अभिप्रेत है, मुख्य जाँच आयुक्त निदेशालय।
उक्त नियमावली के नियम-4, 5, 6 एवं 6
(स्पष्टीकरण) में प्रयुक्त शब्द "समूह-'घ'" को विलोपित किया जाता है।
उक्त नियमावली के नियम-14 में स्पष्टीकरण-3
के बाद स्पष्टीकरण-4 निम्नवत् जोड़ा जाता है-2 (cid:464)बहार गजट (असाधारण), 5 फरवर(cid:547) 2025 " इस नियम में विहित कोई दण्ड अधिरोपित किये जाने के पूर्व, नियम-31 के प्रावधानानुसार निर्धारित विहित प्रपत्र में गठित एवं अनुशासनिक प्राधिकार द्वारा अनुमोदित, आरोप-पत्र (अवचार या कदाचार के लांछन/लांछनों का अभिकथन) के आधार पर आरोपी सरकारी सेवक को बचाव का लिखित अभिकथन समर्पित करने का अवसर दिया जाना आवश्यक होगा।" उक्त नियमावली के नियम-16 में उपनियम-3 निम्नवत् जोड़ा जाता है-
" सरकार के सामान्य अथवा विशेष आदेश द्वारा शक्ति प्रदत्त निदेशालय द्वारा, आरोपी सरकारी सेवकों के विरुद्ध संस्थित कार्यवाही का संचालन, पर्यवेक्षण एवं अनुश्रवण किया जा सकेगा।"
उक्त नियमावली के नियम-17(2) के परन्तुक में प्रयुक्त शब्दों "विभागीय जाँच आयुक्त" तथा "अपर विभागीय जाँच आयुक्त" को क्रमशः "मुख्य जाँच आयुक्त" तथा "जाँच आयुक्त" से प्रतिस्थापित किया जाता है।

No.-3/M-33/2024-2163/GAD—In exercise of the powers conferred under proviso to Article 309 of the Constitution of India, the Governor of Bihar makes the following Rules to amend the "Bihar Government Servant (Classification, Control and Appeal) Rules, 2005" (as amended from time to time)—
1. Short title, extent and commencement.—
(1) These Rules may be called as the "Bihar Government Servant (Classification, Control and Appeal) (Amendment) Rules, 2025."
(2) It shall extend to the whole State of Bihar.
(3) It shall come into force from the date of its publication in official Gazette.
2. Insertion of Rule-2(p) in Bihar Government Servant (Classification, Control and Appeal) Rules, 2005 (as amended from time to time).—In the said rules, Rule-2(p) shall be inserted as follows-
"(p) "Directorate" means 'Chief Inquiry Commissioner Directorate'."
3. Amendment in Rules-4, 5, 6 and 6(Explanation) of Bihar Government Servant (Classification, Control and Appeal) Rules, 2005 (as amended from time to time).— In Rules 4, 5, 6 and 6(Explanation) of the said rules, group of words "Group-D", wherever used, shall be deleted.
4. Addition of Explanation-4 in Rule-14 of Bihar Government Servant (Classification, Control and Appeal) Rules, 2005 (as amended from time to time).—In Rule-14 of the said Rules, Explanation-4 shall be added after Explanation-3 as follows-
"Explanation-4: Before imposing any of the penalties specified in this Rule, the concerned Government Servant shall be given an opportitunity, to submit his statement of defence, on the basis of Article of Charges (statement of the imputations of misconduct or misbehaviour), formed in the format as prescribed according to the provisions contained in Rule-31, and approved by the disciplinary authority."3 (cid:464)बहार गजट (असाधारण), 5 फरवर(cid:547) 2025 5. Addition of Sub-rule-3 in Rule-16 of Bihar Government Servant (Classification, Control and Appeal) Rules, 2005 (as amended from time to time).—In Rule-16 of the said Rules, Sub-rule-3 shall be added as follows-
"(3) The Directorate, empowered by a general or special order of the Governement, shall conduct, supervise and monitor the proceedings instituted against the delinquent government servants."
6. Amendment in Proviso of Rule-17(2) of Bihar Government Servant (Classification, Control and Appeal) Rules, 2005 (as amended from time to time).— The group of words "Departmental Enquiry Commissioner" and "Additional Departmental Enquiry Commisioner" used in Proviso of Rule-17(2) shall be substituted by the group of words "Chief Enquiry Commissioner" and "Enquiry Commisioner" respectively
