सं॰ 108(न॰को॰) (ई॰)--जबकि सेवाओं या लाभों या सब्सिडी के वितरण के लिए पहचान दस्तावेज के रूप में आधार का उपयोग सरकारी वितरण प्रक्रियाओं को सरल बनाता है, पारदर्शिता और दक्षता लाता है तथा लाभार्थी को अपनी पहचान की पुष्टि करने हेतु कई दस्तावेजों प्रस्तुत करने की आवश्यकता को समाप्त कर सुविधाजनक और निर्बद्ध तरीके से सीधे अपने अधिकार प्राप्त करने में सक्षम बनाता है;

और जबकि, (जिसे इसके आगे विभाग कहा जायेगा) द्वारा

(जिसे इसके आगे योजना कहा जायेगा) अंतर्गत

जिसका कार्यान्वयन

(जिसे इसके आगे कार्यान्वयन एजेन्सी कहा जायेगा) के द्वारा किया जा रहा है; और जबकि, मौजूदा योजना के दिशानिर्देशो के अनुसार, लघु जल संसाधन विभाग, बिहार सरकार द्वारा इस

i)

योजना के अंतर्गत

ii)

(जिसे इसके आगे लाभार्थी कहा जायेगा);

और जबकि, उपर्युक्त योजना में बिहार सरकार की संचित निधि से आवर्ती व्यय शामिल है। अब इसलिए, आधार (वित्तीय एवं अन्य सब्सिडी, लाभ एवं सेवाओं का लक्षित वितरण) अधिनियम, 2016 (2016 का 18) (जिसे इसके आगे अधिनियम कहा जायेगा) के धारा-7 के अनुसरण में, बिहार सरकार निम्नलिखित को अधिसूचित करती है; यथा-

1. (1) इस योजना के अंतर्गत लाभ प्राप्त करने हेतु इच्छुक व्यक्ति को आधार संख्या होने का प्रमाण प्रस्तुत करना होगा अथवा आधार प्रमाणीकरण करना होगा। (2) योजना के अंतर्गत लाभ प्राप्त करने के इच्छुक किसी भी व्यक्ति को, जिसके पास आधार संख्या नहीं है या जिसने अभी तक आधार के लिए नामांकन नहीं कराया गया है, योजना के लिए पंजीकरण करने से पहले आधार नामांकन के लिए आवेदन करना होगा, बशर्ते की वह उक्त अधिनियम की धारा-3 के अनुसार आधार प्राप्त करने के हकदार है और ऐसे व्यक्तिे आधार हेतु नामांकन कराने के लिए किसी भी आधार नामांकन केंद्र (भारती विशिष्ट पहचान प्राधिकार (यू0आई0डी0ए0आई0) की वेबसाईट www.uidai.gov.in पर सूची उपलब्ध है) पर जा सकते है। (3) आधार (नामांकन एवं अद्यतन) विनियम, 2016 के विनियम, 12 के अनुसार, विभाग को अपने कार्यान्वयन के एजेन्सी के माध्यम से उन लाभार्थीयों के लिए, जो अभी तक आधार के लिए नामांकन नहीं है आधार नामांकन सुविधाएं प्रदान करनी होगी और यदि संबंधी प्रखंड या तालुक/तहसील में कोई आधार नामांकन केंद्र स्थित नहीं है, तो विभाग अपने क्रियान्वयन एजेन्सी के माध्यम से यू0आई0डी0ए0आई0 के मौजूद रेजिस्ट्रार के समन्वयन में या स्वयं यू0आई0डी0ए0आई0 रेजिस्ट्रार बनकर सुविधाजनक स्थानों पर आधार नामांकन सुविधाए प्रदान करेगा;

बशर्ते कि जब तक व्यक्ति को आधार नहीं सौंप दिया जाता है तब तक ऐसे व्यक्ति को योजना के अंतर्गत लाभ निम्नलिखित दस्तावेज प्रस्तुत करने के अध्यधीन दिया जायेगा, यथा-

(क) यदि व्यक्ति ने आधार के लिए नामांकन किया है, तो आधार नामांकन पहचान पत्र और (ख) निम्नलिखित में से कोई एक दस्तावेज पहचान प्रमाण के रूप में

(i) बैंक या पोस्ट ऑफिस पासबुक जिसमें फोटो हो; या (ii) स्थायी खाता संख्या (PAN) कार्ड; या (iii) पासपोर्ट; या (iv) राशन कार्ड; या (v) मतदाता पहचान पत्र; या (vi) मनरेगा कार्ड; या (vii) किसान फोटो पासबुक; या

(viii) मोटर वाहन अधिनियम, 1988 (59, 1988) के तहत लाइसेंसिंग प्राधिकरण द्वारा जारी ड्राइविंग लाइसेंस; या

(ix) गजेटेड अधिकारी या तहसीलदार द्वारा आधिकारिक पत्रक पर फोटो के साथ पहचान प्रमाण पत्र; या

(x) कोई अन्य दस्तावेज, जिसे विभाग द्वारा निर्दिष्ट किया गया हो।

इस प्रावधान में यह भी कहा गया है कि उपरोक्त दस्तावेजों की जांच विभाग द्वारा नियुक्त अधिकारी द्वारा की जाएगी।

2. योजना के अंतर्गत लाभार्थियों को सुविधाजनक ढंग से लाभ प्रदान करने के लिए, विभाग अपनी कार्यान्वयन एजेन्सी के माध्यम से सभी आवश्यक व्यवस्थाएं करेगा ताकि लाभार्थियों को उक्त जरूरतों के बारे में जागरूक करने के लिए मीडिया के माध्यम से व्यापक प्रचार सुनिश्चित किया जा सके।

3. ऐसे सभी मामलों में, जहां लाभार्थियों के खराब बायोमैट्रिक्स या किसी अन्य कारण से आधार प्रमाणीकरण विफल हो जाता है, निम्नलिखित उपचरात्मक तंत्र अपनाए जाएंगे, यथा-

(क) फिंगरप्रिंट के खराब गुणवता के मामले में, प्रमाणीकरण के लिए आइरिस स्कैन या चेहरे का प्रमाणीकरण सुविधा अपनाया जायेगा, जिसके तहत विभाग अपने कार्यान्वयन एजेन्सी के माध्यम3 (cid:464)बहार गजट (असाधारण), 10 फरवर(cid:547), 2025 से लाभ को निर्बाध तरीके प्रदान करने के लिए फिंगरप्रिंट प्रमाणीकरण के साथ-साथ आइरिस स्कैनर या चेहरे की प्रमाणीकरण की सुविधा का प्रावधान करेगा;

(ख) यदि फिंगरप्रिंट या आइरिस स्कैन या चेहरे के प्रमाणीकरण के माध्यम से बायोमैट्रिक्स प्रमाणीकरण सफल नहीं होता है तो जहाँ भी संभव और स्वीकार्य हो, आधार वन टाईम पासवर्ड या सीमित समय वैद्यता के साथ समय आधारित वन टाईम पासवर्ड द्वारा प्रमाणीकरण, जैसा भी मामला हो, पेश किया जायेगा;

(ग) अन्य सभी मामलों में जहाँ बायोमैट्रिक्स या आधार वन टाईम पासवर्ड या समय आधारित वन टाइम पासवर्ड प्रमाणीकरण संभव नहीं है, योजना के तहत लाभ भौतिक आधार पत्र के आधार पर दिया जा सकता है जिसकी प्रमाणीकता आधार पत्र मुद्रित त्वरित प्रतिक्रिया कोड (Quick Response Code) के माध्यम से सत्यापित की जा सकती है और त्वरित प्रतिक्रिया कोड रीडर की आवश्यकता व्यवस्था विभाग द्वारा अपनी कार्यान्वयन एजेन्सी के माध्यम से सुविधाजनक स्थानों पर प्रदान की जायेगी। 4. ऊपर उल्लेखित के अतिरिक्त, यह सुनिश्चित करने के लिए कि योजना के तहत किसी भी वास्तविक लाभार्थी को उसके उचित लाभ से वंचित न किया जाए, विभाग अपनी कार्यान्वयन एजेंसी के माघ्यम से मिशन, कैबिनेट सचिवालय, भारत सरकार के 19 दिसंबर 2017 के कार्यालय ज्ञापन में उल्लिखित अपवाद प्रबंधन तंत्र का पालन करेगा।

5. यह अधिसूचना राजपत्र में प्रकाशन की तिथि से प्रभावी होगी।

No. 108(न॰को॰) (E)--Whereas, the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

And whereas, the Minor Water Resources Department (hereinafter referred to as the Department), is administering the Mukhyamantri Niji Nalkup Yojna (hereinafter referred to as the Scheme) to to provide subsidy using Direct Benefit Transfer (DBT) in Aadhaar seeded account for installation of private tubewells in non-irrigated areas of Bihar (excluding the overexploited and critical blocks as identified by Central Ground Water Board (CGWB), which is being implemented through the Minor Water Resources Department (hereinafter referred to as the Implementing Agency (IA));

And whereas, under the Scheme, subsidy in two stages -i) for boring (based on the depth) ii) for motor pump (based on the power of pump) (hereinafter referred to as the benefit) is given to the farmers who have applied under the scheme (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the extant Scheme guidelines;

Now, therefore, in pursuance of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Government of Bihar hereby notifies the following, namely:-

1. (1) An individual eligible for receiving the benefits under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any individual desirous of availing benefits under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment before registering for the Scheme provided that he is entitled to obtain Aadhaar as per section 3 of the said Act, and such individuals shall visit any Aadhaar enrolment centre (list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in) to get enrolled for Aadhaar.

(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:

Provided that till the time Aadhaar is assigned to the individual, benefits under the Scheme shall be given to such individual, subject to the production of the following documents, namely: –

(a) if he has enrolled, his Aadhaar Enrolment Identification slip; and (b) any one of the following documents, namely: -

(i) Bank or Post office Passbook with Photo; or (ii) Permanent Account Number (PAN) Card; or (iii) Passport; or (iv) Ration Card; or (v) Voter Identity Card; or (vi) MGNREGA card; or (vii) Kisan Photo passbook; or (viii) Driving license issued by the Licensing Authority under the

Motor Vehicles Act, 1988 (59 of 1988); or

(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or5 (cid:464)बहार गजट (असाधारण), 10 फरवर(cid:547), 2025 (x) any other document as specified by the Department: Provided further that the above documents may be checked by an officer specifically designated by the Department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through the media shall be given to the beneficiaries to make them aware of the said requirement.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:-

(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, thereby the Department through its Implementing Agency shall make provisions for iris scanners or face authentication along with finger-print authentication for delivery of benefits in seamless manner;

(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-based One-Time Password with limited time validity, as the case may be, shall be offered;

(c) in all other cases where biometric or Aadhaar One Time Password or Time-based One-Time Password authentication is not possible, benefits under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Department through its Implementing Agency.

4. In addition to the above, in order to ensure that no bona fide beneficiary under the Scheme is deprived of his due benefits, the Department through its Implementing Agency shall follow the exception handling mechanism as outlined in the Office Memorandum of DBT Mission, Cabinet Secretariat, Government of India dated 19th December 2017.

5. This notification shall come into effect from the date of its publication in the Official Gazette.
