सं॰ 7/स्था0-04-02/2017(खंड)-2756/सा0प्र0वि॰—भारत संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत शक्तियों का प्रयोग करते हुए बिहार राज्यपाल, उच्च न्यायालय, पटना से परामर्ष के पष्चात् ''बिहार उच्च न्यायालय के भूतपूर्व मुख्य न्यायाधीशों और भूतपूर्व न्यायाधीशों की घरेलू सहायता (समय-समय पर यथा संशाेिधत) नियमावली, 2019'' को संशोधित करने हेतु निम्नलिखित नियमावली बनाते हैंः-
1. संक्षिप्त नाम, विस्तार, प्रारम्भ और लागू होना।-
(1) यह नियमावली ''बिहार उच्च न्यायालय के भूतपूर्व मुख्य न्यायाधीशों और भूतपूर्व न्यायाधीशों की घरेलू सहायता (संशोधन) नियमावली, 2025'' कही जा सकेगी।
(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह नियमावली राजपत्र में प्रकाषन की तारीख से प्रवृत्त होगी। (4) यह नियमावली ऐसे व्यक्ति पर लागू होगी जिसने पटना उच्च न्यायालय के मुख्य न्यायाधीश या न्यायाधीश के रूप में पद ग्रहण किया हो, जिन्हें भारत के माननीय उच्चतम न्यायालय के न्यायाधीष के रूप में नियुक्त किया गया है।
2. "बिहार उच्च न्यायालय के भूतपूर्व मुख्य न्यायाधीशों और भूतपूर्व न्यायाधीशों की घरेलू सहायता (संषोधन) नियमावली, 2020" द्वारा अंतःस्थापित "बिहार उच्च न्यायालय के भूतपूर्व मुख्य न्यायाधीशों और भूतपूर्व न्यायाधीशों की घरेलू सहायता (समय-समय पर यथा संषोधित) नियमावली, 2019" के नियम-10ए का प्रतिस्थापन।-उक्त नियमावली के नियम-10ए को निम्नवत् प्रतिस्थापित किया जायेगाः-
10ए- इस नियमावली में किसी अन्यथा प्रावधान के होते हुए भी पटना उच्च न्यायालय के पूर्व मुख्य न्यायाधीश के पास पटना उच्च न्यायालय के दो सेवारत् सहायक अथवा ग्रुप सी अथवा ग्रुप डी के कर्मियों को अपने विशेष निजी सहायक या घरेलू सहायक के रूप में प्रतिनियुक्ति के आधार पर रखने का विकल्प होगा। यह सुविधा पूर्व मुख्य न्यायाधीश को उनके किसी अन्य स्थान पर पदस्थापन होने पर भी उपलब्ध होगी, जहाँ वे दूसरे पद पर नियुक्ति स्वीकार करते हैं।2 (cid:464)बहार गजट (असाधारण), 18 फरवर(cid:547) 2025 3. "बिहार उच्च न्यायालय के भूतपूर्व मुख्य न्यायाधीशों और भूतपूर्व न्यायाधीशों की घरेलू सहायता (संषोधन) नियमावली, 2023 द्वारा अंतःस्थापित भूतपूर्व मुख्य न्यायाधीशों और भूतपूर्व न्यायाधीशों की घरेलू सहायता (समय-समय पर यथा संषोधित) नियमावली, 2019 के नियम-10बी का प्रतिस्थापन।-उक्त नियमावली के नियम-10बी को निम्नवत् प्रतिस्थापित किया जायेगाः-
10बी- इस नियमावली में किसी अन्यथा प्रावधान के होते हुए भी पटना उच्च न्यायालय के पूर्व मुख्य न्यायाधीश अथवा न्यायाधीश, जो माननीय उच्चतम न्यायालय में नियुक्त किये गये हों, को माननीय उच्चतम न्यायालय में अपनी सेवाएँ देने तक तथा माननीय उच्चतम न्यायालय से सेवानिवृत होने के पष्चात् पटना उच्च न्यायालय में कार्यरत् दो स्थायी कर्मियों को घरेलू सहायक के रूप में रखने का विकल्प होगा।
उपरोक्त सुविधा, जो इस न्यायालय से सेवानिवृत पूर्व मुख्य न्यायाधीष तथा माननीय उच्चतम न्यायालय में नियुक्त पूर्व मुख्य न्यायाधीष अथवा पूर्व न्यायाधीष को दी जाती है, वह पूर्व मुख्य न्यायाधीष अथवा पूर्व न्यायाधीष की, यथास्थिति, जीवित पत्नी या पति को, उनके जीवनकाल तक उन्हीं नियमों और शर्तों पर प्रदान की जायेगी।

No-7/Ashta.-04-02/2017(Part)-2756/ GAD—In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India the Governor of Bihar, in consultation with the High Court of Judicature at Patna is pleased to make the following Rules to amend the Bihar Domestic Help to Former Chief Justices and Former Judges of High Court (as amended from time to time) Rules, 2019:-
1. Short title, extent, commencement and application.-
(1) These Rules may be called the 'Bihar Domestic Help to Former Chief Justices and Former Judges of the High Court (Amendment) Rules, 2025'.
(2) It shall extend to whole of the State of Bihar. (3) These Rules shall come into force from the date of its publication in the official Gazette.
(4) The Rules shall apply to a person who has held office either as a Chief Justice or as a Judge of the Patna High Court, who have beeen elevated as a Judge of Hon'ble Supreme Court of India.
2. Substitution of Rule-10A of the "Bihar Domestic Help to Former Chief Justices and Former Judges of High Court (as amended from time to time) Rules, 2019", inserted by the "Bihar Domestic Help to Former Chief Justices and Former Judges of High Court (Amendment) Rules, 2020".- Rule-10A of the said rules shall be substituted as follows:-
"10A— Notwithstanding anything to the contrary in these Rules, a former Chief Justice of Patna High Court will have the choice to keep two serving assistant or Group 'C' or Group 'D' employee of Patna High Court with him on deputation as his special Personal Assistant or domestic help. This facility shall remain available to the former Chief Justice at the place where he may have accepted appointment to another post."
3. Substitution of Rule-10B of the "Bihar Domestic Help to Former Chief Justices and Former Judges of High Court (as amended from time to time) Rules, 2019", inserted by the "Bihar Domestic Help to Former Chief Justices and Former Judges of High Court (Amendment) Rules, 2023".- Rule-10B of the said rules shall be substituted as follows:-
3 (cid:464)बहार गजट (असाधारण), 18 फरवर(cid:547) 2025"10B— Notwithstanding anything to the contrary in these Rules, a former Chief Justice or Justice of Patna High Court who has been elevated to the Hon'ble Supreme Court, will have the choice to keep two permanent employees of Patna High Court as domestic help till their services in the Hon'ble Supreme Court and after their superannuation from the Hon'ble Supreme Court.
The aforesaid facility, which is extended to the Former Chief Justice, superannuated from this Court and Former Chief Justice or Former Judge, who has been elevated to the Hon'ble Supreme Court, shall be provided on the same terms and conditions to the surviving spouse of a Former Chief Justice or Former Judge, as the case may be, during the lifetime of the spouse."
