(सं0 पटना 125) पटना, मंगलवार, 18 फरवर(cid:547) 2025 ——— vf/klwpuk 17 Qjojh 2025 laŒ 09/न॰वि॰(RERA-नियमावली)-06/2024-1813/न॰वि॰ एवं आ॰वि॰—भारत सरकार द्वारा भू-सम्पदा (विनियमन और विकास) अधिनियम, 2016 अधिसूचित है। भू-सम्पदा (विनियमन और विकास) अधिनियम, 2016 (2016 का 16) की धारा-84 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और धारा-2 के खंड (छ) के उप खंड-(iv) के अनुसरण में बिहार सरकार निम्नलिखित नियमावली बनाते है :-

(1) यह नियमावली बिहार भू-सम्पदा (विनियमन और विकास) (संशोधन) नियमावली, 2025 कही जायेगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में प्रकाशन की तिथि से प्रवृत होंगे।
2. बिहार भू-सम्पदा (विनियमन और विकास) नियमावली, 2017 के वर्तमान नियम-10(1) को नए नियम-10(1) से निम्नवत प्रतिस्थापित किया जाता है :-
''
(1) प्राधिकरण नियम-9 के अन्तर्गत आवेदन प्राप्त होने पर तीस दिनों के भीतर या तो भू-सम्पदा अभिकर्त्ता को स्वीकृति प्रदान करेगा अथवा अस्वीकृत करेगा, जैसा भी मामला हो, जैसा कि भू-सम्पदा (विनियमन और विकास) अधिनियम, 2016 की धारा-9 की उपधारा-(3) के अन्तर्गत प्रावधान किया गया है। 2 (cid:464)बहार गजट (असाधारण), 18 फरवर(cid:547) 2025 3. बिहार भू-सम्पदा (विनियमन और विकास) नियमावली, 2017 के शेष सभी प्रावधान यथावत प्रभावी रहेंगे। ——— The 17th February 2025 Bihar Real Estate (Regulation and Development) (Amendment) Rules, 2024 No.-09/न॰वि॰(RERA-नियमावली)-06/2024-1813/UD&HD—Real Estate (Regulation and Development) Act, 2016 is notified by the GoI. In exercise of the powers conferred by section 84 and in pursuance of sub-clause (iv) of clause (g) of section 2 of the Real Estate (Regulation and Development) Act, 2016 of Government of India (16 of 2016), the State Government, hereby makes the following rules, namely:
1. Short title and Commencement:–
(1) This rule may be called the Bihar Real Estate (Regulation and Development) (Amendment) Rule, 2024.
(2) It shall be applicable to the whole State of Bihar. (3) It shall come into force on the date of their publication in the Official Gazette.
2. Rule-8 mentioned under Rule- 10(1) of Bihar Real Estate (Regulation and Development) Rules, 2017 is hereby replaced by new Rule – 10(1) as follows :
"10. Grant of registration to the real estate agent-
(1) On receipt of the application under rule 9, the Authority shall within a period of thirty days either grant registration to the real estate agent or reject the application, as the case may be;
Provided that the Authority may grant an opportunity to the real estate agent to rectify the defects in the application within such time period as may be specified by it."
3. Rest provisions of Bihar Real Estate (Regulation and Development) Rules, 2017 shall remain as it is.
