fuokZpu foHkkx ——— vf/klwpuk 28 Qjojh 2025 सं॰ : Exp.-39/2024 (मुजफ्फरपुर)-07—लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग के आदेष संख्या-76/बिहार-लो.स./15/2024/सी.ई.एम.एस.-III दिनांक 04.02.2025 से एतद्द्वारा घोशित किया गया है कि बिहार राज्य के 15- मुजफ्फरपुर लोक सभा निर्वाचन क्षेत्र से बिहार राज्य में लोक सभा के साधारण निर्वाचन, 2024 में निर्वाचन लड़ने वाले अभ्यर्थी सुश्री सबीना खातून, लेलिन सरानी रोड, नियर- काली मन्दिर, लोवर भानू नगर वार्ड नं॰- 43, पोस्ट- सेवक रोड, सिल्लीगोरी, जलपाईगोरी, पष्चिम बंगाल इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद का सदस्य चुने जाने अथवा होने के लिए निरर्हित है (हिन्दी एवं अंग्रेजी में) सर्वसाधारण की जानकारी के लिए प्रकाषित की जाती हैं।

मिथिलेष कुमार साहु, संयुक्त सचिव।2 (cid:464)बहार गजट (असाधारण), 28 फरवर(cid:547) 2025 भारत निर्वाचन आयोग ——— आदेश निर्वाचन सदन, अषोक रोड, नई दिल्ली-110001, दिनांकः- 04 फरवरी, 2025/15 माघ, 1946 (षक) सं. 76/बिहार-लो.स./15/2024/सी.इर्.एम.एस.-III—यतः, बिहार राज्य की 15- मुजफ्फरपुर लोक सभा संसदीय निर्वाचन क्षेत्र के साधारण निर्वाचन 2024 की घोशणा अधिसूचना नं. आ.अ. 112(अ) दिनांक 26.04.2024 के जरिए की गई थी। यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी को, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर निर्वाचन व्यय के अपने लेखे की सही प्रति जिला निर्वाचन अधिकारी को दाखिल करनी होती है; और यतः 15- मुजफ्फरपुर लोक सभा निर्वाचन क्षेत्र के रिटर्निंग अधिकारी द्वारा उक्त निर्वाचन का परिणाम 04 जून, 2024 को घोशित किया गया था। इस प्रकार, निर्वाचन व्यय का लेखा दाखिल करने की अन्तिम तारीख 04 जुलाई, 2024 थी; और यतः, जिला निर्वाचन अधिकारी, मुजफ्फरपुर, बिहार के द्वारा प्रस्तुत संवीक्षा रिपोर्ट और मुख्य निर्वाचन अधिकारी, बिहार द्वारा पत्र सं. EXP- 06/2023-5343 पटना, दिनांक- 19.07.2024 के जरिए अग्रेशित रिपोर्ट के अनुसार सुश्री सबीना खातून जो लोक सभा का साधारण निर्वाचन 2024 के बिहार राज्य के निर्वाचन क्षेत्र 15-मुजफ्फरपुर से लड़ने वाले अभ्यर्थी हैं, विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई भी लेखा दाखिल करने में विफल रही हैं; और, यतः, जिला निर्वाचन अधिकारी, मुजफ्फरपुर, बिहार, और मुख्य निर्वाचन अधिकारी, बिहार की उक्त रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप नियम (5) के अंतर्गत निर्वाचन व्यय प्रस्तुत नहीं करने के लिए सुश्री सबीना खातून को कारण बताओ नोटिस सं. 76/बिहार-लो.स./2024/15/सीईएमएस-III, दिनांक 21.08.2024 जारी किया गया था; और यतः, निर्वाचनों का संचालन नियम 1961 के नियम 89 के उप-नियम (6) के अनुसार, दिनांक 21.08.2024 के उपर्युक्त कारण बताओ नोटिस के जरिए सुश्री सबीना खातून को निदेष दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के अंदर लेखा न प्रस्तुत कर पाने के कारणों को स्पश्ट करते हुए लिखित रूप में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें; और यतः, मुख्य निर्वाचन अधिकारी, बिहार के पत्र संख्या EXP-39/2024 (मुजफ्फरपुर) - 7892 दिनांक 26.12.2024 के द्वारा अग्रेशित जिला निर्वाचन अधिकारी, मुजफ्फरपुर के पत्र संख्या 2384 दिनांक- 30.09.2024 के जरिए आयोग को सूचना दी गई कि उक्त नोटिस अभ्यर्थी़ द्वारा दिनांक 28.09.2024 को प्राप्त किया गया था ; और
यतः, मुख्य निर्वाचन अधिकारी, बिहार, द्वारा दिनांक 26.12.2024 के उपरोक्त पत्र संख्या EXP-39/2024 (मुजफ्फरपुर) - 7892 के जरिए प्रस्तुत की गई अनुपूरक संवीक्षा रिपोर्ट में यह बताया गया है कि सबीना खातून ने न तो कोई भी अभ्यावेदन और न ही अपने निर्वाचन व्यय का लेखा दाखिल किया है। इसके अतिरिक्त उन्होंने भारत निर्वाचन आयोग का सम्यक् नोटिस मिलने के उपरांत उक्त विफलता के लिए न तो कोई कारण बताया है और न ही कोई स्पश्टीकरण दिया है ; और यतः, आयोग का यह समाधान हो गया है कि सुश्री सबीना खातून निर्वाचन खर्चों का लेखा दाखिल करने में विफल रही हैं और उनके पास इस विफलता के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में अनुबंधित किया गया है किः-
''यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा हैः तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाषित आदेष द्वारा उसको निरर्हित घोशित करेगा और ऐसा व्यक्ति उस आदेष की तारीख से तीन वर्श की कालावधि के लिए निरर्हित होगा।
अतः, अब लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा घोशणा करता है कि बिहार राज्य के 15- मुजफ्फरपुर संसदीय निर्वाचन क्षेत्र से लोक सभा के साधारण निर्वाचन, 2024 में निर्वाचन लड़ने वाले अभ्यर्थी सुश्री सबीना खातून, लेलिन सरानी रोड, नियर- काली मन्दिर, लोवर भानू नगर वार्ड नं॰- 43, पोस्ट- सेवक रोड, सिल्लीगोरी, जलपाईगोरी, पष्चिम बंगाल इस आदेष की तारीख से तीन वर्श की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य-क्षेत्र की विधान सभा अथवा विधान परिशद् का सदस्य चुने जाने अथवा होने के लिए निरर्हित है।

ORDER
Nirvachan Sadan, Ashoka Road, New Delhi-110001, Dated : 04th February, 2025/15 Magha, 1946 (Saka) NO.76/ BR-PC/15/2024/CEMS-III—WHEREAS, the General Election to 15-Muzaffarpur Parliamentary Constituency of Bihar, 2024 was announced by Notification No. O.N. 112 (E). dated 26.04.2024
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election has to, within 30 days from the date of election of the returned candidate, lodge a true copy of the account of his election expenses with the District Election Officer; and
WHEREAS, the result of the said election along with 15-Muzaffarpur Parliamentary Constituency was declared by the concerned Returning Officer on 04th June, 2024. Hence, the last date for lodging the account of Election Expenses was 04th July, 2024; and
WHEREAS, as per the scrutiny report submitted by the District Election Officer, Muzaffarpur, Bihar and forwarded by the Chief Electoral Officer, Bihar vide their letter No. EXP-06/2023-5343 Patna dated 19.07.2024, Ms Sabina Khatoon, a contesting candidate from 15-Muzaffarpur Parliamentary Constituency of Bihar in General Election to Lok Sabha, 2024, has failed to lodge account of his election expenses, in the manner, as required under law; and
WHEREAS, on the basis of the reports of the District Election Office, Muzaffarpur, Bihar and the Chief Electoral Officer, Bihar, a Show- Cause notice, 76/BR-PC/15/2024/CEMS-III dated 21.08.2024 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Ms Sabina Khatoon for not lodging the account of Election Expenses; and
WHEREAS, As per sub rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show- Cause Notice, dated 21.08.2024, Ms Sabina Khatoon was directed to submit her representation in writing with explaining the reason for not lodging the account and to lodge account of election expenses within 20 days from the date of receipt of the notice; and,
WHEREAS, the said notice was received by the candidate on 28.09.2024. The acknowledgment receipt has been submitted to the Commission by the District Election Officer, Muzaffarpur, vide its letter no. 2384 dated 30.09.2024 forwarded by C.E.O Bihar vide its letter no. EXP-39/2024 (मुजफ्फरपुर) 7892 dated 26.12.2024; and
WHEREAS, the Chief Election Officer, vide his letter EXP-39/2024 (मुजफ्फरपुर)-7892 dated 26.12.2024 forwarded the supplementary report dated 20.12.2024 wherein it has been reported that Sabina Khatoon has neither submitted any representation nor any statement of account of election expenses. Further, after receipt of the due notice of the Election Commission of India, she has furnished neither any reason nor explanation for the said failure; and,
WHEREAS, the Commission satisfied that Ms. Sabina Khatoon has failed to lodge the account of election expenses and has no good reason or justification for the failure,4 (cid:464)बहार गजट (असाधारण), 28 फरवर(cid:547) 2025 WHEREAS, Section 10A of the Representation of the People Act, 1951 provides that :-
"If the Election Commission is satisfied that a person- (a) has failed to lodge an account of election expenses, within the time and in the manner required by law or under this Act, and
(b) has no good reason or justification for the failure, the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the order";
NOW THEREFORE, in pursuance of Section 10A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Ms. Sabina Khatoon resident of Lelin Sarani Road, Near- Kali Mandir, Lower Bhanu Nagar, Ward No- 43, Post-Sevak Road, SilliGori, Jalpaigori, West Bengal, a contesting candidate from 15-Muzaffarpur Parliamentary Constituency of the State of Bihar in the General Election to the Lok Sabha 2024 to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.
