(सं0 पटना 202) पटना, मंगलवार, 25 माच(cid:91) 2025 गृह विभाग (विषेष शाखा) ——— अधिसूचना 24 मार्च 2025 सं॰ जी/नि॰सु॰अ॰ (नियमावली)-14-06/2021-3417--बिहार राज्य के अन्तर्गत निजी सुरक्षा अभिकरणों के विनियमन हेतु निजी सुरक्षा अभिकरण (विनियमन) अधिनियम, 2005 (केन्द्रीय अधिनियम 29, 2005) की धारा 25 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और बिहार निजी सुरक्षा अभिकरण नियमावली, 2011 (वर्ष 2017 में यथासंशोधित) को अधिक्रांत करते हुए, बिहार सरकार निम्नलिखित नियम बनाती है :-

1. संक्षिप्त नाम और प्रारंभ :-

1. यह नियमावली बिहार निजी सुरक्षा अभिकरण नियमावली, 2025 कहलाएगी। 2. यह राजपत्र में प्रकाषन की तारीख से प्रवृत्त होगी।

2. परिभाषाएँ- इन नियमों में, संदर्भ से जब तक अन्यथा अपेक्षित न हो,-

(क) अधिनियम से अभिप्रेत है निजी सुरक्षा अभिकरण (विनियमन) अधिनियम, 2005; (केन्द्रीय अधिनियम 29, 2005)

(ख) ''अभिकरण'' से अभिप्रेत है निजी सुरक्षा अभिकरण; (ग) ''नियंत्री प्राधिकारी'' से अभिप्रेत है अधिनियम के अधीन घोषित नियंत्री प्राधिकारी; (घ) ''प्रपत्र'' से अभिप्रेत है इस नियमावली के साथ संलग्न प्रपत्र; (ङ) ''अनुज्ञप्ति'' (लाइसेंस) से अभिप्रेत है निजी सुरक्षा अभिकरण (विनियमन) अधिनियम, 2005 के अधीन प्रदत्त अनुज्ञप्ति;

(च) इस नियमावली में अपरिभाषित लेकिन अधिनियम में परिभाषित शब्दों एवं अभिव्यक्तियों के वहीं अर्थ होंगे जो निजी सुरक्षा अभिकरण (विनियमन) अधिनियम, 2005 में उनके लिए क्रमषः नियत हैं। 3. नियंत्री प्राधिकारी :-निजी सुरक्षा अभिकरण (विनियमन) अधिनियम 2005 की धारा-3 द्वारा प्रदत्त अधिकारों के उपयोग के निमिा राज्य सरकार द्वारा गृह विभाग के विषेष सचिव से अन्यून स्तर के पदाधिकारी को इस नियमावली के तहत्‌ नियंत्री प्राधिकारी के रूप में अधिसूचित किया जा सकेगा।

4. अपीलीय प्राधिकार ः-निजी सुरक्षा अभिकरण (विनियमन) अधिनियम 2005 की धारा-14 के आलोक में नियंत्री प्राधिकारी के आदेष के विरूद्ध अपील अपर मुख्य सचिव/प्रधान सचिव, गृह विभाग, बिहार, पटना के समक्ष की जा सकेगी। अपील करने की समयावधि अधिनियम के अन्तर्गत प्रावधानों के अनुसार होगी।2 (cid:464)बहार गजट (असाधारण), 25 माच(cid:91), 2025 5. अनुज्ञप्ति अनुदत्त करने के लिए आवेदन-

(1) राज्य में निजी सुरक्षा का कारोबार करने को इच्छुक प्रत्येक अभिकरण ऑनलाइन माध्यम से प्रपत्र 1 में आवेदन करेगा।

(2) प्रत्येक अभिकरण जब अनुज्ञप्ति को अनुदत्त करने के लिए ऑनलाइन माध्यम से प्रपत्र 1 में आवेदन कर रहा है, तब अपने पूर्ववृत्त के सत्यापन के लिए प्रपत्र 2 को भी संलग्न करेगा।

(3) यदि आवेदक कोई कंपनी, कोई फर्म या कई व्यक्तियों का संगम है तो आवेदन, कंपनी के प्रत्येक स्वत्वधारी या बहुसंख्यक शेयरधारक, भागीदार या निदेशक, जैसे कि वे भी आवेदक हों, के लिए पूर्ववृा सत्यापन से सम्बन्धित प्रपत्र 2 के साथ होगा। इसके अतिरिक्त, कंपनी का प्रत्येक स्वत्वधारी या बहुसंख्यक शेयरधारक, भागीदार या निदेशक, अधिनियम की धारा 7 की उपधारा (2) में अंतर्वलित उपबंधों के संबंध में ब्यौरों को सम्मिलित करते हुए प्रपत्र 3 में एक शपथ पत्र भी संलग्न करेगा।

(4) नियंत्री प्राधिकारी ऑनलाइन माध्यम से प्रपत्र 1, प्रपत्र 2, प्रपत्र 3 की प्राप्ति पर आवेदन की अन्तर्वस्तु और आवेदक की विशिष्टियों का सत्यापन करने के लिए ऐसी जाँच, जो वह आवश्यक समझे, कर सकेगा।

(5) आवेदक कंपनी/अभिकरण के प्रत्येक स्वत्वधारी, बहुसंख्यक शेयरधारक, भागीदार या निदेशक के संदर्भ में अपराध और आपराधिक के इलेक्ट्रॉनिक डाटाबेस जैसे अपराध और आपराधिक ट्रैकिंग नेटवर्क और तंत्र (सीसीटीएनएस), अंतर-संचालन आपराधिक न्याय तंत्र (आईसीजेएस) अथवा राज्य सरकार के चरित्र सत्यापन पोर्टल के माध्यम से प्राप्त अधिकतम 1 (एक) माह पूर्व का पूर्ववृत्त/चरित्र सत्यापन प्रमाण पत्र आवेदन के साथ संलग्न करेगा। अन्य राज्यों में निवास करने वाले आवेदक सम्बन्धित पुलिस प्राधिकार द्वारा निर्गत अधिकतम 1 (एक) माह पूर्व का पूर्ववृत्त/चरित्र सत्यापन प्रमाण पत्र संलग्न कर सकेंगे।

(6) जब कभी किसी आवेदक का पूर्ववृत्त पहले ही किसी अन्य राज्य में सत्यापित कर लिया गया हो और अनुज्ञप्ति प्रदत्त कर दी गई हो, तब नियंत्री प्राधिकारी के लिए यह आवश्यक नहीं होगा कि वह नए सिरे से पूर्ववृत्त का सत्यापन करे, परंतु अनुज्ञप्ति जिसके लिए पूर्ववृत्त सत्यापित किया गया है, वैधता की अवधि के भीतर होनी चाहिए।

(7) आवेदक इलेक्ट्रॉनिक माध्यम से प्रदा अधिनियम की धारा 7 की उपधारा (3) के अधीन यथाविहित अनुज्ञप्ति शुल्क के संदाय से सम्बन्धित साक्ष्य को आवेदन के साथ संलग्न करेगा।

(8) उपनियम (1) में निर्दिष्ट आवेदन की प्राप्ति पर नियंत्री प्राधिकारी आवेदन को उसके द्वारा प्राप्त किए जाने की तारीख उस पर लिखने के पश्चात्‌ आवेदक को इलेक्ट्रॉनिक या डिजिटल अभिस्वी—ति अनुदत्त करेगा।

(9) नियंत्री प्राधिकारी या तो स्वयं या अपने अधिकारी के माध्यम से या किसी अन्य साधन द्वारा अभिकरण द्वारा दिए गए पते पर प्रस्तावित निजी सुरक्षा अभिकरण के कार्यालय परिसर को सत्यापित करेगा।

(10) नियंत्री प्राधिकारी, ऑनलाइन माध्यम से प्रपत्र 1 में आवेदन प्राप्त करने के पश्चात, ऐसी जाँच करने के पश्चात, जैसा वह आवश्यक समझे और अधिनियम के उपबंधों के अनुपालन के पश्चात्‌ प्रपत्र 4 में निजी सुरक्षा अभिकरण को अनुज्ञप्ति अनुदत्त करेगा।

(11) अनुज्ञप्त अभिकरण ऑनलाइन माध्यम से प्राप्त अनुज्ञप्ति के आधार पर व्यवसाय आरंभ कर सकेगा। प्राप्त अनुज्ञप्ति को निजी सुरक्षा अभिकरण अपने कार्यालय में प्रदर्शित करने के लिए बाध्य होगा। (12) अनुज्ञप्ति को अनुदत्त करने के आवेदन को अस्वी—त किए जाने की दशा में नामंजूरी का कोई आदेश नहीं किया जाएगा, जब तक;-

(क) आवेदक को सुने जाने का युक्तियुक्त अवसर न दिया गया हो; (ख) आधार जिन पर अनुज्ञप्ति को नामंजूर किया गया है, आदेश में उल्लिखित न कर दी गयी हो।

(13) नियंत्री प्राधिकारी सभी परिप्रेक्ष्यों से पूर्ण आवेदन प्राप्त होने की तारीख से साठ दिनों के भीतर अनुज्ञप्ति के आवेदन पर आदेश पारित करेगा।

(14) उपर्युक्त सभी प्रक्रियायें ऑन-लाइन माध्यम से निष्पादित की जायेगी।

6. अनुज्ञप्ति अनुदत्त करने की शर्तें-(1) अनुज्ञप्तिधारी, नियंत्री प्राधिकारी द्वारा, यथाविहित, निजी सुरक्षा के संबंध में प्रशिक्षण उसके द्वारा नियत किए गए समय के भीतर सफलतापूर्वक प्राप्त करेगा।

परंतु यदि उस निजी सुरक्षा अभिकरण ने, जिसके लिए अनुज्ञप्ति प्राप्त की गयी हो, पहले ही किसी अन्य राज्य के नियंत्री प्राधिकारी से अनुज्ञप्ति प्राप्त कर ली है, तब अनुज्ञप्तिधारी को प्रशिक्षण की अपेक्षा आवश्यक नहीं होगी। (2) नियंत्री प्राधिकारी अनुज्ञप्तिधारी के प्रशिक्षण के लिए अपेक्षित प्रशिक्षण पाठ्य विवरण के ब्यौरे विरचित करेगा।3 (cid:464)बहार गजट (असाधारण), 25 माच(cid:91), 2025 (3) प्रशिक्षण कम से कम छह कार्य दिवस का होगा। प्रशिक्षण में मोटे तौर पर निम्नलिखित विषय सम्मिलित होंगे, अर्थात्‌ :-

(i) वर्तमान सुरक्षा रूपरेखा (क) वीआईपी सुरक्षा (ख) आंतरिक सुरक्षा (ग) संस्थागत सुरक्षा

(ii) प्राइवेट सुरक्षा अभिकरणों की भूमिका और —त्य

(क) अग्नि शमन (ख) आपदा/आपातकालीन प्रबंधन प्रोटोकॉल (ग) सुरक्षा कर्तव्य (घ) विभिन्न दस्तावेजों की जांच (ङ) सूचना सुरक्षा (च) अभिगम नियंत्रण (छ) विस्फोटक आई.ई.डीएस (ज) एंटी सबोटेज चेक (एएससी) (झ) सुरक्षा संबंधी उपस्कर (ञ) संसूचना उपस्कर (ट) पेट्रोलिंग (ठ) चौकी ड्यूटी

(iii) विधिक उपबंध

(क) प्राइवेट सुरक्षा अभिकरण (विनियमन) अधिनियम, 2005 (2005 का केन्द्रीय अधिनियम

29) और बिहार निजी सुरक्षा अभिकरण नियमावली, 2025

(ख) सुसंगत श्रमिक विधियां

(iv) सुरक्षा अभिकरणों का प्रबंधन

(क) वर्दी (ख) निजी सुरक्षा अभिकरणों के कार्मिकों का प्रशिक्षण (ग) अनुज्ञप्तिधारी द्वारा दस्तावेजों और रिकॉर्डों का रखरखाव (घ) डाटा शेयरिंग प्रोटोकॉल

(v) जनसाधारण, पुलिस और अन्य विभागों के साथ सम्पर्क

(क) जनसाधारण के साथ इंटरफेस (ख) पुलिस और अन्य संबंधित सरकारी विभागों के साथ संपर्क (vi) निजी सुरक्षा कार्मिक-क्या करना है और क्या नहीं करना है (आचरण नियम) (vii) इसके अतिरिक्त गृह विभाग, बिहार, पटना द्वारा विनिर्दिष्ट विषय (4) अनुज्ञप्तिधारी, नियंत्री प्राधिकारी को अनुज्ञप्ति की प्राप्ति के पंद्रह दिनों के भीतर अभिकरण बनाने वाले प्रत्येक व्यक्ति का नाम, माता-पिता का नाम, जन्म तारीख, स्थायी पता, पत्र व्यवहार के लिए पता और प्रधान वृत्ति को सूचित करेगा।

(5) अनुज्ञप्तिधारी, अभिकरण के प्रत्येक स्वत्वधारी या बहुसंख्यक शेयरधारक, भागीदार या निदेशक के पते या अभिकरण के कार्यालय के पते में परिवर्तन या प्रबंधन में परिवर्तन के संबंध में, ऐसे परिवर्तन के तीस दिनों के भीतर नियंत्री प्राधिकारी को सूचना देगा।

(6) अनुज्ञप्तिधारी, नियंत्री प्राधिकारी को निजी सुरक्षा अभिकरण के रूप में कर्तव्यों के निर्वहन में, अभिकरण बनाने वाले व्यक्ति के विरुद्ध या अभिकरण द्वारा नियुक्त या नियोजित निजी सुरक्षा गार्ड या पर्यवेक्षक के विरुद्ध विरचित किए गए किसी आपराधिक आरोप के बारे में तत्काल सूचना देगा और ऐसी संसूचना की एक प्रति उस थाने के भारसाधक अधिकारी को भेजेगा, जहाँ व्यक्ति, जिसके विरुद्ध आरोप लगाया गया है, निवास करता है।

(7) प्रत्येक अनुज्ञप्तिधारी निजी सुरक्षा गार्डों के लिए शारीरिक मानकों और इन नियमों में यथास्थिति, उनकी प्रशिक्षण शर्ते जिन पर अनुज्ञप्ति अनुदत्त की गई है, अपेक्षाओं का पालन करेगा। (8) इन नियमों में यथा उपबंधित के सिवाय, अनुज्ञप्ति अनुदत्त करने के लिए संदत्त फीस अप्रतिदेय होगी।

(9) अनुज्ञप्तिधारी, अनुज्ञप्ति प्राप्ति के छह माह के भीतर अपने क्रिया कलाप प्रारंभ करेगा। (10) क्रिया कलापों के आरंभ किए जाने में, अधिनियम की धारा 9 की उपधारा (3) के अधीन यथा उपबंधित और नियम 13 के अनुसरण में कार्यालय परिसर का स्थापन और पर्यवेक्षकों की नियुक्ति सम्मिलित होगी।4 (cid:464)बहार गजट (असाधारण), 25 माच(cid:91), 2025 (11) प्रत्येक अनुज्ञप्तिधारी सषस्त्र निजी सुरक्षा गार्डों के नियोजन के पूर्व उनके द्वारा धारित शस्त्र अनुज्ञप्ति की वैधता का सत्यापन जारीर्काा प्राधिकार से कराना सुनिष्चित करेगा।

7. अनुज्ञप्ति का नवीकरण-(1) प्रत्येक अभिकरण, नियंत्री प्राधिकारी को प्रपत्र 2 और प्रपत्र 3 के साथ प्रपत्र 1 में, अनुज्ञप्ति की वैधता की अवधि के अवसान होने की तारीख से कम से कम पैंतालीस दिन पूर्व और अधिनियम की धारा 8 की अन्य शर्तों का पालन करने के पश्चात्‌ नवीकरण के लिए ऑनलाइन माध्यम से आवेदन करेगा। (2) यदि आवेदक कोई कम्पनी, कोई फर्म या कोई व्यक्तियों का संगम है तो आवेदन के साथ, कम्पनी के प्रत्येक स्वत्वधारी या बहुसंख्यक शेयरधारक, भागीदार या निदेशक के संदर्भ में, वैसे ही जैसे कि वे भी आवेदक होें, पूर्ववृत्त के सत्यापन के लिए प्रपत्र 2 तथा अधिनियम की धारा 7 की उपधारा (2) में अंतर्वलित उपबंधों के संबंध में ब्यौरों को सम्मिलित करते हुए प्रपत्र 3 में एक शपथ पत्र को भी संलग्न करेगा।

(3) नियंत्री प्राधिकारी, आवेदक के पूर्ववृत्त का उसी रीति से, जैसे कि नियम 5 के उपनियम (4) में उल्लिखित है, सत्यापन करेगा।

(4) नियंत्री प्राधिकारी आवेदन की प्राप्ति के पश्चात्‌ ऐसी जाँच करने के पश्चात्‌ जैसा वह आवश्यक समझे और अधिनियम के उपबंधों के अनुपालन के पश्चात्‌ प्रपत्र 4 में अनुज्ञप्ति के नवीकरण को अनुदत्त करेगा।

(5) उपनियम (1) में उल्लिखित अवधि के भीतर अनुज्ञप्ति के नवीकरण के लिए आवेदन के प्राप्त न होने की दशा में, अनुज्ञप्ति के अवसान के पश्चात, गैर अनुज्ञप्ति प्राप्त अभिकरण माना जाएगा। (6) अनुज्ञप्ति के नवीकरण के लिए आवेदन करने की अवधि के अवसान के पश्चात्‌ अभिकरण अधिनियम की धारा 7 के अनुसार नई अनुज्ञप्ति के लिए आवेदन कर सकेगा।

(7) अनुज्ञप्ति के नवीकरण के लिए प्रभार्य फीस वैसी ही होगी, जैसी अनुज्ञप्ति को अनुदत्त करने के लिए नियम 5 के उपनियम (7) में यथा उल्लिखित हो।

(8) उपनियम (1) में उपदर्शित अवधि के पश्चात्‌ और अनुज्ञप्ति के अवसान होने से पूर्व प्राप्त किए गए आवेदन पर अनुज्ञप्ति के नवीकरण के लिए कार्य नहीं होगा।

(9) नियंत्री प्राधिकारी, सभी प्रकार से पूर्ण आवेदन के प्राप्त होने की तारीख से तीस दिनों के भीतर प्रपत्र-1 में अनुज्ञप्ति के नवीकरण के लिए आवेदन पर आदेश पारित करेगा।

(10) अनुज्ञप्ति नवीकरण की वैधता पहली अनुज्ञप्ति के अवसान होने की तारीख से समझी जाएगी और उसके नवीकरण के तारीख को विचार में लाए बिना पांच वर्ष तक की होगी। विद्यमान अनुज्ञप्ति के अवसान के पश्चात्‌ नियंत्री प्राधिकारी द्वारा आवेदन का विनिश्चय किए जाने की दशा में मध्यवर्ती अवधि वैध अनुज्ञप्ति के अधीन समझी जाएगी।

(11) नियंत्री प्राधिकारी और निजी सुरक्षा अभिकरण, मानव नियंत्रण से परे परिस्थितियों के कारण, जिसमें सिविल या सैनिक अधिकारी के —त्य, राष्ट्रीय आपात, बलवा, दैवी—त्य तक सीमित नहीं हैं, शामिल हैं, हुई देरी के लिए दायी नहीं होंगे।

(12) उपर्युक्त उल्लिखित सभी प्रक्रियायें ऑन-लाइन माध्यम से निष्पादित की जायेगी।

8. अनुज्ञप्ति के नवीकरण के लिए शर्ते.- अनुज्ञप्ति का नवीकरण निम्नलिखित शर्तों के अध्यधीन अनुदत्त किया जाएगा, अर्थात्‌ः

(i) आवेदक, नियंत्री प्राधिकारी के अधिकार क्षेत्र में अपने कारोबार के प्रधान स्थान को बनाए रखेगा। (ii) आवेदक अपने निजी सुरक्षा गार्डों और पर्यवेक्षकों के लिए इस नियमावली के नियम 11 के उपनियम (2) के अधीन अपेक्षित प्रशिक्षण की उपलब्धता सुनिश्चित करना जारी रखेगा। (iii) आवेदक, अनुज्ञप्ति की शर्तों का पालन करना जारी रखेगा। (iv) आवेदक का आपराधिक पूर्ववृत्त न हो, जिसके सत्यापन हेतु आवेदक आवेदन के साथ कंपनी/अभिकरण के प्रत्येक स्वत्वधारी या बहुसंख्यक शेयरधारक, भागीदार या निदेशक के संदर्भ में अपराध और आपराधिक के इलेक्ट्रॉनिक डाटाबेस जैसे अपराध और आपराधिक ट्रैकिंग नेटवर्क और तंत्र (सीसीटीएनएस), अंतर-संचालन आपराधिक न्याय तंत्र (आईसीजेएस) अथवा राज्य सरकार के चरित्र सत्यापन पोर्टल के माध्यम से प्राप्त अधिकतम 1 (एक) माह पूर्व का पूर्ववृत्त/चरित्र सत्यापन प्रमाणपत्र संलग्न करेगा। अन्य राज्यों में निवास करने वाले आवेदक सम्बन्धित पुलिस प्राधिकार द्वारा निर्गत अधिकतम 1 (एक) माह पूर्व का पूर्ववृत्त/चरित्र सत्यापन प्रमाणपत्र संलग्न कर सकेंगे।

9. नियंत्री प्राधिकारी एक वेब पोर्टल बनाने के लिए जिम्मेवार होगा, जिसके माध्यम से अनुज्ञप्त अभिकरण निजी सुरक्षा अभिकरण (विनियमन) अधिनियम एवं इन नियमों के अधीन विहित सूचना एवं अन्य अनुपालन प्रतिवेदन समर्पित करेंगे। यह एक एकल खिड़की प्रणाली होगी।

10. निजी सुरक्षा गार्ड और पर्यवेक्षक के चरित्र और पूर्ववृत्त का सत्यापन.- (1) अभिकरण, किसी व्यक्ति को सुरक्षा गार्ड या पर्यवेक्षक के रूप में नियोजित या नियुक्त करने से पहले स्वयं को निम्नलिखित में से किसी एक या अधिक तरीके से ऐसे व्यक्ति के चरित्र और पूर्ववृत्तियों के बारे में संतुष्ट करेगा :-

(क) व्यक्ति द्वारा प्रस्तुत किए गए चरित्र और पूर्ववृत्त सत्यापन प्रमाण पत्र पर निर्भर होकर परंतु चरित्र और पूर्ववृत्त प्रमाण पत्र वैध हो और अभिकरण के पास किसी अन्य स्रोत से व्यक्ति के चरित्र और पूर्ववृत्त के संबंध में कोई प्रतिकूल रिपोर्ट न हो।

(ख) अपराध और आपराधिक के इलेक्ट्रॉनिक डाटाबेस जैसे अपराध और आपराधिक ट्रैकिंग नेटवर्क और तंत्र (सीसीटीएनएस), अंतर-संचालन आपराधिक न्याय तंत्र (आईसीजेएस) अथवा राज्य सरकार के चरित्र सत्यापन पोर्टल के माध्यम से प्राप्त चरित्र और पूर्ववृत्त सत्यापन प्रमाण पत्र।

(2) जो व्यक्ति सुरक्षा गार्ड या पर्यवेक्षक के रूप में नियोजित या नियुक्त होने की वांछा रखता है, अभिकरण को प्रपत्र 5 में आवेदन करेगा। इसके अतिरिक्त, वह अधिनियम की धारा 10 की उपधारा (2) में अंतर्विष्ट उपबंधों से संबंधित ब्यौरों को सम्मिलित करते हुए प्रपत्र 6 में एक शपथपत्र दाखिल करेगा।

(3) अभिकरण, चरित्र और पूर्ववृत सत्यापन के आधार पर प्रपत्र-7 में एक चरित्र और पूर्ववृत प्रमाणपत्र जारी करेगा और यह प्रमाण पत्र ऐसे अभिकरण द्वारा वापस नहीं लिया जायेगा भले ही वह व्यक्ति अभिकरण का कर्मचारी न रहे।

11. सुरक्षा प्रशिक्षण-

(1) नियंत्री प्राधिकारी, राष्ट्रीय कौशल अर्हता ढांचा (National Skill Quality Framework) के अनुरूप, सुरक्षा गार्डों के प्रशिक्षण के लिए विस्तृत प्रशिक्षण पाठ्यक्रम तैयार करेगा । प्रारंभिक स्तर के लिए यह प्रशिक्षण न्यूनतम 20 दिनों की अवधि में दिया जाने वाला होगा, जिसमें न्यूनतम 100 घंटे की कक्षा में शिक्षण तथा 60 घंटे का फील्ड प्रशिक्षण होगा। भूतपूर्व सैनिकों और पूर्व पुलिस को केवल संघनित पाठ्यक्रम, न्यूनतम 40 घंटे कक्षा में शिक्षण और 16 घंटे फील्ड प्रशिक्षण होगा जो 7 कार्य दिवसों में सम्पन्न होगा।

(2) प्रशिक्षण में निम्न विषय होंगे :-

(क) जनता के बीच आचरण और वर्दी को सही ढंग से धारण करना; (ख) शारीरिक सक्षमता प्रशिक्षण; (ग) शारीरिक सुरक्षा, संपत्ति की सुरक्षा, भवन/अपार्टमेंट की सुरक्षा, कार्मिक सुरक्षा, घरेलू सुरक्षा; (घ) अग्नि शमन; (ङ) भीड़ नियंत्रण; (च) पहचान पत्र, पासपोर्ट तथा स्मार्ट कार्ड सहित पहचान कागजातों की जाँच; (छ) उम्मीदवार को अंग्रेजी अक्षरों तथा अरबी अंकों को पढ़ने और उन्हें समझने योग्य होना चाहिए चाहिए, जैसा कि सामान्यतः पहचान दस्तावेजों, शस्त्र अनुज्ञप्ति, यात्रा दस्तावेजों और सुरक्षा निरीक्षण शीट में आते हैं;

(ज) छुपी हुई विस्फोटक वस्तुओं की पहचान; (झ) प्राथमिक चिकित्सा; (ञ) संकट से निपटना और आपदा प्रबंधन; (ट) रक्षात्मक ड्राइविंग (सशस्त्र गाड़ियों के ड्राइवर के लिए अनिवार्य तथा दूसरों के लिए वैकल्पिक);

(ठ) अवर्जित आयुधों तथा अग्नेयास्त्र का उठाना-रखना और संचालन (वैकल्पिक) (ड) भारतीय दंड संहिता का प्रारंभिक ज्ञान, निजी प्रतिरक्षा का अधिकार, पुलिस स्टेशन में प्राथमिकी दर्ज कराने की प्रक्रिया, आयुध अधिनियम (केवल प्रभावी धाराएँं), विस्फोटक अधिनियम (केवल प्रभावी धाराएँ) (ढ) पुलिस तथा सैन्य बलों के रैंक के बैज; (ण) जनता और पुलिस द्वारा प्रयोग किए जाने वाले विभिन्न शस्त्रों की पहचान; (त) सुरक्षा उपकरण और युक्तियों का उपयोग (उदाहरण के लिए सुरक्षा अलार्म और स्क्रीनिंग उपकरण) और

(थ) नेतृत्व और प्रबंधन (केवल सुपरवाइजरों के लिए)। (द) गृह विभाग द्वारा विनिर्दिष्ट अन्य विषय।

(3) (i) सभी निजी सुरक्षा अभिकरण अनुज्ञप्तिधारकों के लिए उपर्युक्त नियम-6(2) एवं अपने निजी सुरक्षा गार्डों/पर्यवेक्षकों के लिए उपर्युक्त नियम-11(2) में वर्णित विषयाें का प्रशिक्षण दिलाने हेतु सक्षम प्रशिक्षण संस्थान का चयन स्वयं करेंगे तथा उसके नाम एवं पते का उल्लेख प्रपत्र-1 की कंडिका-7 में करेंगे।

(ii) बिहार राज्य में अवस्थित प्रशिक्षण संस्थान या अन्य राज्य द्वारा मान्यता प्राप्त प्रशिक्षण संस्थान से गार्ड/पर्यवेक्षकों को जारी किया गया निर्गत प्रमाण पत्र स्वीकार्य होगा।6 (cid:464)बहार गजट (असाधारण), 25 माच(cid:91), 2025 (iii) बिहार राज्य में अवस्थित सभी अनुज्ञप्त प्रशिक्षण संस्थानों द्वारा गृह विभाग (विशेष शाखा), बिहार, पटना के आदेश ज्ञापांक-7080, दिनांक-08.06.2023 में निहित मानकों एवं इस संबंध में समय-समय पर निर्गत दिशा-निर्देश का अनुपालन सुनिश्चित करना आवश्यक होगा। (4) सुरक्षा गार्ड को नियंत्री प्राधिकारी द्वारा विहित प्रशिक्षण सफलतापूर्वक पूर्ण करना होगा। (5) प्रशिक्षण के पूर्ण होने पर प्रत्येक सफल प्रशिक्षणार्थी को प्रशिक्षण संस्थान द्वारा प्रपत्र 8 में एक प्रमाणपत्र प्रदान करेगा।

(6) अन्य राज्य द्वारा मान्यता प्राप्त प्रशिक्षण संस्थान से गार्ड/पर्यवेक्षक को जारी किया गया प्रशिक्षण प्रमाणपत्र स्वीकार्य होगा, यदि वह प्रमाणपत्र गार्ड/पर्यवेक्षक द्वारा वर्तमान अभिकरण में योगदान के पूर्व जारी किया गया होे।

(7) नियंत्री प्राधिकारी समय-समय पर स्वयं या अपने अधिकारियों के द्वारा प्रशिक्षण संस्थान में प्रषिक्षण हेतु उपलब्ध संसाधनों तथा प्रषिक्षण देने की उनकी सक्षमता का निरीक्षण करेगा। ऐसा निरीक्षण प्रति वर्ष कम से कम दो बार किया जाएगा।

(8) सभी प्रशिक्षण अभिकरण नियंत्री प्राधिकारी को उसके द्वारा विहित की गई रीति में सफल प्रशिक्षणार्थियों की एक सूची प्रस्तुत करेंगे।

(9) प्रशिक्षण पूर्ण होने और रोजगार की अपेक्षा के आधार पर निजी सुरक्षा अभिकरण स्वयं अपने को पदाभिहित कर सकेगें, परन्तु कोई अभिकरण सशस्त्र सेना, अर्ध सैनिक बल या राज्य पुलिस बल के किसी रैंक को अंगी—त नहीं करेगा।

(10) नियंत्री प्राधिकारी या तो स्वयं या अपने अधिकारियों के माध्यम से किसी निजी प्रशिक्षण अभिकरण के निजी सुरक्षा गार्डों और पर्यवेक्षकों को दिए गए प्रशिक्षण और कौशल को सत्यापित करेगा। (11) नियंत्री प्राधिकारी ऐसे सुरक्षा अभिकरणों की अनुज्ञप्ति को जारी रखने या अन्यथा पुनर्विलोकन कर सकेगा जिन्होंने नामावली पर कार्मिकों के प्रशिक्षण की शर्तों का अनुपालन न किया हो। 12. सुरक्षा गार्डों के लिए शारीरिक मानदंड-(1) कोई व्यक्ति सुरक्षा गार्ड के रूप में नियुक्त या नियोजित होने के लिए अर्ह होगा, यदि वह निम्न शारीरिक मानकों को पूरा करता है :

(i) कद 160 से.मी. (महिला 150 से.मी.), वजन, कद-वजन की मानक सारणी के अनुसार, सीना 80 से.मी. जो 04 से.मी. फूलना चाहिए (महिलाओं के लिए लिए सीना माप की कोई न्यूनतम आवश्यकता नहीं है),

(ii) नेत्र –ष्टि -दूर –ष्टि 6/6, निकट –ष्टि 0.6/0.6 चश्मे अथवा इसके बिना, वर्णांधता से मुक्त, सुरक्षा उपकरणों के प्रदर्श में रंगों को विभेद और पहचान करने और अंग्रेजी अक्षरों तथा प्रदर्श में अरबी के अंकों को पढ़ने और उन्हें समझने के योग्य होना चाहिए।

(iii) संहतजानुक और चिपटा पैर से मुक्त व छह मिनट में एक किलोमीटर तक दौड़ने योग्य। (iv) श्रवण दोष से मुक्त हो, सुनने और बोलने की आवाज का उत्तर देने तथा सुरक्षा उपकरणों द्वारा उत्पन्न ध्वनि पर प्रतिक्रिया करने योग्य हो।

(v) अभ्यर्थी तलाशी लेने, वस्तुओं को हाथ में लेने और आवश्यकता पड़ने पर व्यक्तियों को रोकने के लिए बल प्रयोग करने के लिए कुशल और समर्थ हो।

(2) अभ्यर्थी किसी छुआ-छूत की बीमारी अथवा उसके लक्षण से मुक्त हो । वह ऐसी किसी बीमारी से ग्रस्त न हो जिसका उसकी सेवा के दौरान बढ़ने की आशंका हो या जिससे वह सेवा के लिए अनुपयुक्त हो जाए या जिससे जनता के स्वास्थ्य के खतरा उत्पन्न हो जाए।

(3) अभिकरण यह सुनिश्चित करेगा कि इसके पास कार्यरत प्रत्येक निजी सुरक्षा गार्ड की किसी स्वास्थ्य परीक्षा के प्रत्येक 12 माह पश्चात, उसकी अंतिम ऐसी स्वास्थ्य जांच की जाती है ताकि उसके प्रवेश के समय निर्धारित शारीरिक मानदंड का सतत्‌ अनुरक्षण सुनिश्चित किया जा सके। 13. सुपरवाइजरों के लिए उपबंध- (1) अनुज्ञप्त निजी सुरक्षा अभिकरण पंद्रह से अनधिक निजी सुरक्षा गार्डों के कार्य के पर्यवेक्षण के लिए कम से कम एक पर्यवेक्षक को नियोजित करेंगे।

(2) निजी सुरक्षा गार्डाें के विभिन्न परिसरों में सुरक्षा ड्यूटी पर होने तथा एक पर्यवेक्षक द्वारा उनके कार्य का पर्यवेक्षण व्यवहार्य न होने की स्थिति में अधिक संख्या में पर्यवेक्षकों को तैनात करेगा, ताकि कम से कम प्रत्येक छः सुरक्षा गार्डों की सहायता, सलाह और पर्यवेक्षण के लिए एक पर्यवेक्षक उपलब्ध हो।

14. अपील और प्रक्रिया- अधिनियम की धारा 14 की उपधारा (1) के अधीन प्रत्येक अपील प्रपत्र 9 में की जाएगी। अपील अभ्यावेदन पर व्यथित अभिकरण के स्वत्वधारी, भागीदार, निदेषक या उसके द्वारा प्राधि—त अधिवक्ता द्वारा हस्ताक्षर किए जाएंगे तथा उसे अपीलीय प्राधिकार को व्यक्तिगत रूप से प्रस्तुत किया जाएगा या इलेक्ट्रॉनिकी या डिजीटल माध्यम या रजिस्ट्री—त डाक से भेजा जाएगा।

जाने के लिए अपेक्षित रजिस्टर को इलेक्ट्रॉनिक रूप में प्रपत्र 10 में रखा जाएगा।7 (cid:464)बहार गजट (असाधारण), 25 माच(cid:91), 2025 16. फोटो पहचान पत्र-(1) अधिनियम की धारा 17 की उपधारा (2) के अधीन अभिकरण द्वारा जारी प्रत्येक फोटो पहचान पत्र प्रपत्र 11 में होगा।

(2) फोटो पहचान पत्र में पूरे चेहरे का रंगीन फोटो, निजी सुरक्षा गार्ड का पूरा नाम, अभिकरण का नाम तथा उसकी कर्मचारी संख्या होगी, जिसे फोटो पहचान पत्र जारी किया गया है।

(3) फोटो पहचान पत्र में व्यक्ति की अभिकरण में प्रस्थिति और वह तिथि, जिस तक फोटो पहचान पत्र वैध है, स्पष्ट रूप से उपदर्शित होगी। पहचान पत्र में एक QR Code होगा जो अभिकरण के वेबसाईट से जुड़ा होगा तथा जिससे नियोजित कर्मियों की पहचान की जा सकेगी।

(4) फोटो पहचान पत्र को अद्यतन रखा जाएगा और विशिष्टियों में किसी परिवर्तन को उसमें दर्ज किया जाएगा।

(5) निजी सुरक्षा गार्ड को जारी फोटो पहचान पत्र को उसे जारी करने वाले अभिकरण को तब लौटा दिया जाएगा, जब वह निजी सुरक्षा गार्ड उस अभिकरण के नियोजन में नहीं रहता है या उसके द्वारा नियोजित नहीं किया जाता है।

(6) फोटो पहचान पत्र के गुम हो जाना या चोरी हो जाने को उस अभिकरण की जानकारी में तुरंत लाया जाएगा, जिसके द्वारा वह जारी किया गया है।

17. अन्य शर्ते-(1) इस बात के होते हुए भी अभिकरण अपने निजी सुरक्षा गार्ड के लिए ड्यूटी पर यूनिफार्म पहनना बाध्य करे, या न करे, प्रत्येक निजी सुरक्षा अभिकरण अपने सुरक्षा गार्डों को;

(क) अभिकरण को सुभिन्न करने वाला बाजू पर पहनने वाला बैज; (ख) संगठन में उसका पद दर्शाने वाला कंधे या वक्ष का बैज; (ग) सीटी की डोरी से बंधी सीटी और जो बाँयी जेब में रखी जाएगी; (घ) फीते और सूराख सहित जूते; (ङ) सिर पर पहनने की टोपी जिस पर निजी सुरक्षा अभिकरण का सुभेदक चिह्न भी हो सकता है; जारी करेगा और उन्हें पहनना बाध्यकारी करेगा। (2) निजी सुरक्षा गार्ड, जब वह ड्यूटी पर हो, तो उसके द्वारा धारण किए जाने वाले वस्त्र ऐसे होंगे जो उसके दक्षतापूर्ण र्काव्यपालन में बाधा उत्पन्न न करें । विशेषकर, वे न तो बहुत तंग और न ही बहुत ढीले होंगे, जिससे उसकी गतिविधियों या अंगों को मोड़ने में बाधा हो। (3) प्रत्येक निजी सुरक्षा गार्ड अपने साथ एक नोट-बुक और एक लेखन उपकरण रखेगा। (4) प्रत्येक निजी सुरक्षा गार्ड, जब वह सक्रिय सुरक्षा ड्यूटी पर हो, अधिनियम की धारा 17 के अधीन जारी फोटो पहचान पत्र, अपने शरीर पर किसी सहज –श्य स्थान पर कमर से ऊपर बाहरी वस्त्र पर प्रदर्शित करते हुए धारण करेगा।

18. निरसन एवं व्यावृत्तियाँ -(1) निजी सुरक्षा अभिकरण (विनियमन) अधिनियम, 2005 के तहत बनाये गए और अधिसूचना संख्या-पटना 668 दिनांक 17 नवम्बर, 2011 के माध्यम से बिहार गजट के असाधारण अंक में प्रकाषित बिहार निजी सुरक्षा अभिकरण नियमावली, 2011 (वर्ष 2017 में यथासंषोधित) को एतद्‌ द्वारा निरस्त किया जाता है। (2) इस तरह के निरसन के बावजूद, उप-नियम (1) के तहत निरस्त नियमावली के तहत की गई कोई भी कार्रवाई इन नियमों के संबंधित प्रावधानों के तहत वैध रूप से की गई समझी जाएगी।

No. जी/नि॰सु॰अ॰ (नियमावली)-14-06/2021-3417-- In exercise of the powers conferred by section 25 of the Private Security Agencies (Regulation) Act, 2005 (Central Act 29 of 2005) and in supersession of the Bihar Private Security Agency Rules, 2011 (As amended in 2017), the Bihar Government hereby makes the following rules:-

1. Short title and commencement.—

(1) These rules may be called the Bihar Private Security Agency Rules, 2025. (2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. - In these rules, unless the context otherwise requires, -

(a) "Act" means the Private Security Agencies (Regulation) Act, 2005 (Central Act 29 of 2005);

(b) "Agency" means the Private Security Agency; (c) "Controlling Authority" means the controlling authority so declared under the act; (d) "Form" means, a Form appended to these rules; (e) "Licence" means a licence granted under the Private Security Agencies (Regulation) Act, 2005;

(f) words and expressions not defined in these rules but defined in the Act, shall have the same meaning respectively assigned to them in the Private Security Agencies (Regulation) Act 2005.

3. Controlling Authority- An officer not below the rank of special Secretary of the Home Department, Bihar shall be notified as the controlling Authority to exercise the power given under the Section 3 of the Private Security Agencies (Regulation) Act 2005.

4. Appellate Authority- The appeal against the order of the Controlling Authority shall be made to the Additional Chief Secretary/Principal Secretary, Home Department in the light of section 14 of the Private Security Agencies Act 2005. The time limit for making appeal shall be in accordance with the provisions of the Act itself.

5. Application for grant of licence. - (1) Every agency desirous of carrying on the business of private security in the State shall apply in Form 1 through online mode.

(2) Every agency while applying in Form 1 through online medium for grant of licence shall also enclose Form 2 for verification of its antecedents.

(3) In case the applicant is a company, a firm or an association of persons, the application shall be accompanied by Form 2 relating to antecedent verification for each of the proprietor or majority shareholder, partner or director of the company, as the case may be. In addition, every proprietor or majority shareholder, partner or director of the company shall also enclose an affidavit in Form 3 incorporating the details in respect of the provisions contained in sub-section (2) of section 7 of the Act.

(4) On receipt of Form 1, Form 2, Form 3 through online medium, the Controlling Authority may make such inquiries, as it considers necessary to verify the contents of the application and the particulars of the applicant.

(5) The applicant shall enclose with the application an antecedent/character verification certificate obtained through electronic databases of crime and criminals like the Crime and Criminal Tracking Networks and Systems (CCTNS), Interoperable Criminal Justice System (ICJS) or the character verification portal of the State Government, not more than 1 (one) month ago, in respect of each proprietor, majority shareholder, partner or director of the company/agency. Applicants residing in other states will be able to attach antecedents/character verification certificate issued by the concerned police authority of maximum 1 (one) month ago.

(6) Wherever any applicant's antecedents have been verified in any other State earlier and licence is granted, it shall not be necessary for the Controlling Authority to verify the antecedents afresh provided that the licence for which antecedents are verified is under period of validity.

(7) The applicant shall enclose with the application the evidence related to the payment of licence fee as prescribed under sub-section (3) of section 7 of the Act provided through electronic means.

(8) On receipt of the application referred to in sub-rule (1), the Controlling Authority shall after noting thereon the date of receipt by him of the application, grant an electronic or digital acknowledgement to the applicant.

(9) The Controlling Authority shall verify the office premises of the proposed private security agency at the address given by the agency either himself or through his officer or by any other means.

(10) The Controlling Authority, after receiving the application in Form 1 through online medium, after making such inquiry as it may consider necessary and after complying with the provisions of the Act, shall grant licence to the private security agency in Form 4.

(11) The licensed agency can start business on the basis of the licence obtained through online medium. The private security agency will by obliged to display the licence obtained in its office.

(12) In case of rejection of the application for grant of licence, no order of refusal shall be made unless,- (a) the applicant has been given a reasonable opportunity of being heard; and (b) the grounds on which licence is refused is mentioned in the order.

(13) The Controlling Authority shall pass an order within sixty days from the date of receipt of the application, complete in all respects.

(14) All the above mentioned processes shall be carried out in online mode only.

6. Conditions for grant of licence.-(1) The licensee shall successfully undergo a training relating to the private security as prescribed by the Controlling Authority within the time frame fixed by it;

Provided that if the private security agency for which the licence has been obtained has already obtained a licence from the controlling authority of any other State, then the requirement of training to the licensee shall not be necessary.

(2) The Controlling Authority shall frame the detailed training syllabus required for training the licensee.

(3) The training shall be for a minimum period of six working days. The training shall broadly include the following subjects, namely;-

(i) Present security scenario: (a) VIP Security (b) Internal Security (c) Institutional Security;

(ii) Role and Functioning of Private Security Agencies:

(a) Fire Fighting (b) Disaster/ Emergency Management protocol (c) Security Duties (d) Checking of various documents (e) Information security (f) Access Control (g) Explosives, IEDs (h) Anti Sabotage Checks (ASC) (i) Security related equipments (j) Communication Equipments (k) Patrolling (l) Post duties

(iii) Legal provisions:

(a) The Private Security Agencies (Regulation) Act, 2005 (29 of 2005) and Bihar Private Security Agency Rules, 2025.

(b) Relevant Labour Laws

(iv) Management of Security Agencies:

(a) Uniform (b) Training of personnel of private security agencies (c) Documentation and records to be maintained by the licensee (d) Data Sharing Protocol

(v) Interface with public, Police and other departments:

(a) Interface with Public (b) Liaison with police and other concerned Government Departments

(vi) Private Security Personnel – DO's and DON'Ts (Conduct Rules) (vii) Any other subject that the Home Department may Specify.

(4) The licensee shall intimate the name, parentage, date of birth, permanent address, address for correspondence and the principal profession of each person forming the Agency within fifteen days of receipt of the licence to the Controlling Authority. (5) The licensee shall inform the Controlling Authority regarding any change in the address of persons forming the Agency or change of management within thirty days of such change.

(6) The licensee shall immediately intimate to the Controlling Authority about any criminal charge framed against the persons forming the Agency or against a private security guard or supervisor engaged or employed by the Agency, in the course of performance of duties as private security agency. A copy of such communication shall also be sent to the officer in charge of the police station where the person charged against resides.

(7) Every licensee shall abide by the requirements of physical standards for the private security guards and their training as prescribed in these rules as the condition on which the licence is granted.

(8) Save as provided in these rules, the fees paid for the grant of licence shall be non- refundable.

(9) The licensee shall commence its activities within six months of obtaining the licence. (10) Commencement of activities shall include establishment of office premises and engagement of supervisors as provided under sub-section (3) of section 9 of the Act and in accordance with rule 13.

(11) Every licensee shall ensure to verify the validity of the arms licence held by him from the issuing authority before employing armed private security guards.

7. Renewal of licence.— (1) Every Agency shall apply to the Controlling Authority for renewal of the licence in Form I along with Form 2 and Form 3 not less than forty-five days before the date of expiry of the period of validity thereof and after complying other conditions of section 8 of the Act.

(2) If the applicant is a company, a firm or an association of persons, the application shall be accompanied by Form 2 for verification of antecedents in respect of each of the proprietor or majority shareholder, partner or director of the company, as the case may be, and shall also enclose an affidavit in Form 3 incorporating the details in respect of the provisions contained in sub-section (2) of section 7 of the Act. (3) The Controlling Authority shall verify the antecedents of the applicant in the same manner as mentioned in sub-rule (4) of rule 5.

(4) The Controlling Authority, after receiving an application in Form 1 shall grant a renewal of licence in Form 4 after making such enquiry as it considers necessary and after compliance with the provisions of the Act.

(5) In case of non-receipt of the application for renewal of licence within the period mentioned in sub-rule (1), the agency shall be treated as un-licensed agency after the expiry of licence.

(6) After expiry of period of applying for renewal of licence, the Agency may apply for fresh licence as per section 7 of the Act.

(7) The fees chargeable for renewal of the licence shall be the same as for the grant of licence as mentioned in sub-rule (7) of rule 5.

(8) Applications received after the period stipulated in sub-rule (1) and before the expiry of licence shall not be processed for renewal of licence.

(9) The Controlling Authority shall pass an order on application for renewal of licence in Form 1 within thirty days from the date of receipt of application complete in all respects.

(10) The validity of renewed licence shall be counted from the date of expiry of the previous licence and shall be upto a period of five years irrespective of its date of renewal. In case the application is decided by the controlling authority after expiry of the existing licence, the intervening period shall deem to be under valid licence. (11) The Controlling Authority and the Private Security Agencies shall not be liable for delays occurring by reason of circumstances beyond human control, including but not limited to acts of civil or military authority, national emergencies, riot, acts of God.

(12) All the above mentioned processes shall be carried out in online mode only.

8. Conditions for renewal of licence.— The renewal of the licence shall be granted subject to the following conditions, namely:-

(i) The applicant continues to maintain his principal place of business in the jurisdiction of the Controlling Authority;

(ii) The applicant continues to ensure the availability of the training for its private security guards and supervisors required under sub-rule (2) of rule 11 of these rules;

(iii) The applicant continues to adhere to the licence conditions; (iv) The applicant should not have a criminal antecedent, for the verification of which the applicant shall attach an antecedent/character verification certificate obtained through electronic databases of crime and criminals like the Crime and Criminal Tracking Networks and Systems (CCTNS), Interoperable Criminal Justice System (ICJS) or the character verification portal of the state government, maximum 1 (one) month ago, in respect of each proprietor or majority shareholder, partner or director of the company/agency.Applicants residing in other states will be able to attach antecedents/character verification certificate issued by the concerned police authority, maximum 1 (one) month ago.

9. The Controlling Authority shall be responsible for creating a web-Portal through which the licensed agency will submit the information and compliance reports prescribed under the Private Security Regulation Act, 2005 and its rules. It Shall be a single window portal.

10. Verification of character and antecedents of the private security guard and supervisor. - (1) Before any person is employed or engaged as a security guard or supervisor, the Agency shall satisfy itself about the character and antecedents of such person in any one or more of the following manners, namely:-

(a) by relying upon the character and antecedents' verification certificate produced by the person:

Provided that the character and antecedent certificate shall be valid and the Agency does not have any adverse report regarding the person's character and antecedents from any other source;

(b) Character and antecedent verification certificate obtained through electronic databases of crime and criminals like the Crime and Criminal Tracking Networks and Systems (CCTNS), Interoperable Criminal Justice System (ICJS) or the character verification portal of the State Government.

(2) The person desirous of getting employed or engaged as security guard or supervisor shall submit Form 5 to the Agency. In addition, he shall submit an Affidavit in Form 6 incorporating the details in relation to the provisions contained in sub-section (2) of section 10 of the Act.

(3) On the basis of character and antecedents' verification, the Agency shall issue in Form 7, a character and antecedents' certificate and this certificate shall not be taken back by such Agency even if the person ceases to be the employee of that Agency.

11. Security Training- (1) The Controlling Authority shall frame the detailed training syllabus required for training the security guards in accordance with National Skill Qualification Framework. For entry level, this training shall be for a minimum period of hundred hours of classroom instruction and sixty hours of field training, spread over at least twenty working days. The ex-servicemen and former police personnel shall however be required to attend a condensed course only, of minimum forty hours of classroom instructions and sixteen hours of field training spread over at least seven working days.

(2) The training shall include the following subjects, namely:- (a) conduct in Public and correct wearing of uniform; (b) physical fitness training; (c) physical security, security of the assets, security of the building/ apartment, personnel security, household security;

(d) fire fighting; (e) crowd control; (f) examining identification papers including identity cards, passports and smart cards;

(g) should be able to read and understand English alphabets and Arabic numerals as normally encountered in the identification documents, arms licence, travel documents and security inspection sheet; (h) identification of improvised explosive devices; (i) first-Aid; (j) crisis response and disasters management; (k) defensive driving (compulsory for the driver of Armoured vehicle and optional for others);

(l) Handling and operation of non-prohibited weapons and firearms (optional); (m) Rudimentary knowledge of Indian Penal Code, right to private defense, procedure for lodging first information report in the police station, Arms Act (only operative sections); Explosives Act (operative sections);

(n) Badges of rank in police and military forces; (o) Identification of different types of arms in use in Public and Police; (p) Use of security equipments and devices (for example; security alarms and screening equipments); and

(q) Leadership and management (for supervisors only). (r) Any other subject that the Home Department may Specify.

(3) (i) All the Private Security Agencies will select appropriate training institution themselves as per the training prescribe for the licensee in rule 6(2) and for security guards and supervisors in rule 11(2) and will mention its name and address in Para-7 of form 1. (ii) The training Certificates issued to the Guards/supervisors from Training Institutes situated either in Bihar or other States shall be acceptable.

(iii) All licensed training institutes situated in Bihar shall have to ensure the compliance of the standards prescribed in the order no. 7080 dated 08.06.2023 of the Home Department (Special Branch), Bihar, Patna and necessary instructions issued time to time in this regard.

(4) The security guard shall have to successfully undergo the training prescribed by the Controlling Authority.

(5) On completion of the training each successful trainee shall be awarded a certificate in Form 8 by the training institute.

(6) Training certificate issued to the guard/supervisor from any other state recognized training institute will be acceptable if the certificate was issued by the guard/supervisor before joining the present agency.

(7) The Controlling Authority shall inspect the functioning of training facility from time to time either by itself or through its own officers. Normally such inspection shall be conducted at least two times every year.

(8) All the training agencies shall submit a list of successful trainees to the Controlling Authority in the manner prescribed by it.

(9) Based on training completed and requirement of the job, private security agency may have their own designations provided that no agency shall adopt any of the ranks of the armed forces, paramilitary forces or State Police Forces.

(10) The Controlling Authority either by itself or through its officers may verify the training and skills imparted to the private security guards and supervisors of any private training agency.

(11) The Controlling Authority may review the continuation or otherwise of licence of such security agencies which may not have adhered to the conditions of trained personnel on its rolls.

12. Standard of physical fitness for security guards- (1) A person shall be eligible for being engaged or employed as security guard if he fulfils the standards of physical fitness as specified below:-

(i) Height, 160 cms (Female 150 cms), weight according to standard table of height and weight, chest 80 cms with an expansion of 4 cms (for females no minimum requirement for chest measurement).

(ii) Eye sight: Far sight vision 6/6, near vision 0.6/0.6 with or without correction, free from color blindness, should be able to identify and distinguish color display in security equipments and read and understand display in English alphabets and Arabic numerals. (iii) Free from knock knee and flat foot and should be able to run one kilometer in six minutes.

(iv) Hearing: Free from defect; should be able to hear and respond to the spoken voice and the alarms generated by security equipments.

(v) The candidate should have dexterity and strength to perform searches, handle objects and use force for restraining the individuals in case of need. (2) A candidate should be free from evidence of any contagious or infectious disease. He should not be suffering from any disease which is likely to be aggravated by service or is likely to render him unfit for service or endanger the health of the public.

(3) Agency shall ensure that every private security guard working for it undergoes a medical examination after every twelve months from his last such examination so as to ensure his continued maintenance of physical standard as prescribed for the entry level.

13. Provision for Supervisors – (1) There shall be one supervisor to supervise the work of not more than fifteen private security guards.

(2) In case the private security guards are on security duty in different premises and it is not practical to supervise their work by one supervisor, the agency shall depute more number of supervisors so that at least for every six private security guards there is one supervisor available for assistance, advice and supervision. 14. Appeals and procedure – Every appeal under sub-section (1) of section 14 of the Act shall be preferred in Form 9 signed by the aggrieved person or his authorized advocate and presented to the appellate authority in person or in electronic or digital form or sent to him by registered post.

15. Register to be maintained by the Agency - The register required to be maintained under the Act by the Agency shall be maintained electronically in Form 10.

16. Photo identity card—

(1) Every photo identity card issued by the Agency under sub-section (2) of section 17 of the Act shall be in Form 11.

(2) The photo identity card shall convey a full-face image in colour, full name of the private security guard, name of the Agency and the employee number of the individual to whom the photo identity card is issued.

(3) The photo identity card shall clearly indicate the individual's position in the Agency and the date up to which the photo-identity card is valid. The identity card shall carry a QR code which shall link to the website of the company where the employee can be verified.

(4) The photo identity card shall be maintained up to date and any change in the particulars shall be entered therein.

(5) The photo identity card issued to the private security guard shall be returned to the Agency issuing it, once the private security guard is no longer engaged or employed by it.

(6) Any loss or theft of photo identity card shall be immediately brought to the notice of the Agency that issued it.

17. Other conditions—(1) Notwithstanding whether the Agency mandates its private security guards to put on uniform while on duty or not, every private security agency shall issue and make it obligatory for its security guards to put on:

(a) an arm badge distinguishing the Agency; (b) shoulder or chest badge to indicate his position in the organization; (c) whistle attached to the whistle cord and to be kept in the left pocket; (d) shoes with eyelet and laces; (e) a headgear which may also carry the distinguishing mark of the Agency.

(2) The clothes wear by the private security guard while on active duty shall be such that they do not hamper in his efficient performance. In particular they shall neither be too tight nor too loose as to obstruct movement or bending of limbs.

(3) Every private security guard shall carry a notebook and a writing instrument with him.

(4) Every private security guard while on active security duty shall wear and display photo-identity card issued under section 17 of the Act, on the outer most garment above waist level on his person in conspicuous manner.

18. Repeals and Savings - (1) The Bihar Private Security Agencies Rules, 2011 made under the Private Security Agencies (Regulation) Act, 2005 and published in the extraordinary issue of the Bihar Gazette vide notification No. Patna 668 dated November 17, 2011 (As amended in 2017), are hereby repealed.

(2) Notwithstanding such repeal, any action taken under the rules repealed under sub- rule (1) shall be deemed to have been validly taken under the relevant provisions of these rules.
