सी0/एल0ए0-2/2020/5630/जे0—विधिक सेवा प्राधिकरण अधिनियम, 1987 (1987 का केन्द्रीय अधिनियम-39) की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल, उच्च न्यायालय पटना के मुख्य न्यायाधीश के परामर्श से निम्नलिखित नियमावली बनाते हैं, यथाः-
1. संक्षिप्त नाम, विस्तार एवं प्रारंभ ।-
(1) यह नियमावली बिहार राज्य विधिक सेवा प्राधिकार अधिकारी एवं कर्मचारी (भर्ती एवं सेवा शर्तें) नियमावली, 2025 कही जा सकेगी ।
(2) यह नियमावली बिहार राज्य विधिक सेवा प्राधिकार, उच्च न्यायालय विधिक सेवा समिति, पटना, चलंत लोक अदालत, जिला विधिक सेवा प्राधिकार (स्थायी लोक अदालत सहित) एवं अनुमंडल विधिक सेवा समिति की, स्थापना के अधिकारियों (गैर-न्यायिक) एवं कर्मचारियों पर लागू हाेंगी ।
(3) यह बिहार राजपत्र (गजट) में प्रकाशन की तिथि से प्रवृत्त होंगी ।
2. परिभाषाएँ।-
(i) इन नियमावली में, जब तक कि संदर्भ से अन्यथा अपेक्षित न होः-
(क) ''अधिनियम'' से अभिप्रेत है, विधिक सेवा प्राधिकरण अधिनियम, 1987(1987 की केन्द्रीय अधिनियम-39) ।
(ख) ''नियुक्ति प्राधिकारी'' से अभिप्रेत है, बिहार राज्य विधिक सेवा प्राधिकार, उच्च न्यायालय विधिक सेवा समिति एवं जिला विधिक सेवा प्राधिकार, अनुमंडल विधिक सेवा समिति यथास्थिति जो भी हो ।(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 2 (ग) ''बिहार राज्य विधिक सेवा प्राधिकार नियमावली, 1996'' से अभिप्रेत है, बिहार राज्य विधिक सेवा प्राधिकार नियमावली, 1996 ।
(घ) ''बिहार राज्य विधिक सेवा प्राधिकार विनियमन, 1998'' से अभिप्रेत है, बिहार राज्य विधिक सेवा प्राधिकार विनियमन, 1998 ।
(ङ) ''अध्यक्ष'' से अभिप्रेत है, उच्च न्यायालय विधिक सेवा समिति या जिला विधिक सेवा प्राधिकार या अनुमंडल विधिक सेवा समिति के अध्यक्ष ।
(च) ''विभागीय पदोन्नति समिति'' से अभिप्रेत है, नियम 15 के अन्तर्गत गठित विभागीय पदोन्नति समिति ।
(छ) ''जिला प्राधिकार'' से अभिप्रेत है, अधिनियम की धारा-9 के अन्तर्गत गठित जिला विधिक सेवा प्राधिकार ।
(ज) ''कर्मचारी'' से अभिप्रेत है, बिहार राज्य विधिक सेवा प्राधिकार के कर्मचारी या बिहार राज्य विधिक सेवा प्राधिकार, उच्च न्यायालय विधिक सेवा समिति, चलंत लोक अदालत, जिला विधिक सेवा प्राधिकार, स्थायी लोक अदालत (जनोपयोगी सेवाएँ) और अनुमंडल विधिक सेवा समिति के कर्मचारी ।
(झ) ''परीक्षा'' से अभिप्रेत है, इन नियमावली के अन्तर्गत भर्ती के लिए प्रतियोगिता परीक्षा ।
() ''कार्यकारी अध्यक्ष'' से अभिप्रेत है, बिहार राज्य विधिक सेवा प्राधिकार के कार्यकारी अध्यक्ष ।
(ट) ''सरकार'' से अभिप्रेत है, बिहार सरकार ।
(ठ) ''उच्च न्यायालय'' से अभिप्रेत है, पटना उच्च न्यायालय ।
(ड) ''उच्च न्यायालय विधिक सेवा समिति'' से अभिप्रेत है, अधिनियम की धारा-8-ए के अन्तर्गत गठित पटना उच्च न्यायालय विधिक सेवा समिति । (ढ़) "न्यायिक पदाधिकारी" से अभिप्रेत है, बिहार राज्य विधिक सेवा प्राधिकार, उच्च न्यायालय विधिक सेवा समिति, जिला विधिक सेवा प्राधिकार एवं अनुमंडल विधिक सेवा समिति में प्रतिनियुक्ति पर पदस्थापित बिहार उच्च न्यायिक सेवा एवं बिहार न्यायिक सेवा के सेवारत/सेवानिवृत्त अधिकारी ।
(ण) "अधिकारी" से अभिप्रेत है, बिहार राज्य विधिक सेवा प्राधिकार, उच्च न्यायालय विधिक सेवा समिति, चलंत लोक अदालत, जिला विधिक सेवा प्राधिकार, स्थायी लोक अदालत (जनोपयोगी सेवाएँ) और अनुमंडल विधिक सेवा समिति में पदस्थापित
अधिकारी (गैर न्यायिक) या अन्य सरकारी विभाग से समावेशी/प्रतिनियुक्ति द्वारा बिहार राज्य विधिक सेवा प्राधिकार की सेवाओं में कोई पद धारण करने वाला अधिकारी ।
(त) ''सदस्य सचिव'' से अभिप्रेत है, बिहार राज्य विधिक सेवा प्राधिकार के सदस्य सचिव ।
(थ) ''चलंत लोक अदालत'' से अभिप्रेत है, विधि विभाग, बिहार सरकार के ज्ञापांक 863/जे0, दिनांक 10.03.2006 के द्वारा स्थापित चलंत विधिक सेवा इकाई । (द) ''मुख्य संरक्षक'' से अभिप्रेत है, पटना उच्च न्यायालय के मुख्य न्यायाधीश । (ध) ''स्थायी लोक अदालत'' से अभिप्रेत है, अधिनियम की धारा 22-बी उपधारा-1
के अन्तर्गत गठित स्थायी लोक अदालत (जनोपयोगी सेवाएँ) ।
(न) ''पद'' से अभिप्रेत है, राज्य सरकार के द्वारा स्वीकृत पदाधिकारी एवं कर्मचारी का पद ।
(प) ''नियमावली'' से अभिप्रेत है, बिहार राज्य विधिक सेवा प्राधिकार अधिकारी एवं कर्मचारी (भर्ती एवं सेवा शर्त्तें) नियमावली, 2025 ।(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 3 (फ) ''सेवा'' से अभिप्रेत है, बिहार राज्य विधिक सेवा प्राधिकार, उच्च न्यायालय विधिक सेवा समिति, चलंत लोक अदालत, जिला विधिक सेवा प्राधिकार, स्थायी लोक
अदालत (जनोपयोगी सेवाएँ) और अनुमंडल विधिक सेवा समिति के पदाधिकारी एवं कर्मचारी की सेवाएँ ।
(ब) ''सचिव'' से अभिप्रेत है, उच्च न्यायालय विधिक सेवा समिति, जिला विधिक सेवा प्राधिकार और अनुमंडल विधिक सेवा समिति के सचिव ।
(भ) ''राज्य प्राधिकार'' से अभिप्रेत है, अधिनियम की धारा 6 के अन्तर्गत गठित बिहार राज्य विधिक सेवा प्राधिकार ।
(म) ''अनुमंडल विधिक सेवा समिति'' से अभिप्रेत है, अधिनियम की धारा-11ए के अन्तर्गत गठित अनुमंडल विधिक सेवा समिति ।
(ii) वैसे अन्य सभी शब्द और अभिव्यक्ति जिनका उपयोग किया गया है, लेकिन इन नियमावली में परिभाषित नहीं किया गया है, उनका वही अर्थ होगा जो क्रमशः विधिक सेवा प्राधिकरण अधिनियम, 1987, बिहार राज्य विधिक सेवा प्राधिकार नियमावली, 1996 एवं बिहार राज्य विधिक सेवा प्राधिकार विनियमन, 1998, समय-समय पर संशोधित, में निहित है । 3. सेवा का गठन।-सेवा में निम्नलिखित व्यक्ति सम्मिलित होंगे-
(i) सभी अधिकारी एवं कर्मचारी जो इन नियमावली के प्रारंभ में बिहार राज्य विधिक सेवा प्राधिकार, उच्च न्यायालय विधिक सेवा समिति, चलंत लोक अदालत, जिला विधिक सेवा प्राधिकार, स्थायी लोक अदालत (जनोपयोगी सेवाएँ) एवं अनुमंडल विधिक सेवा समिति के नियुक्त कर्मी है, को इन नियमावली के अन्तर्गत नियुक्त किया गया माना जायेगा और इन नियमावली के शुरू होने से पहले उनके द्वारा की गई सेवा को उच्चतर गे्रड में पदोन्नति के लिए पात्रता तय करने के लिए ध्यान में रखा जायेगा ।
(ii) अधिकारी (अराजपत्रित) तथा कर्मचारियों की सेवा में नई नियुक्ति भर्त्ती इस नियमावली के प्रावधानों के अनुसार किया जायेगा ।
4. पात्रता मानदण्ड।-सेवा या पद पर नियुक्ति के लिए एक उम्मीदवारः-
(क) भारत का नागरिक होना चाहिए;
(ख) सीधी भर्ती के लिए उम्मीदवार की आयु उस वर्ष की 01 अगस्त को 18 वर्ष से कम नहीं होनी चाहिए जिसमें भर्ती की प्रक्रिया शुरू हुई थी । विभिन्न श्रेणियों की ऊपरी आयु सीमा बिहार सरकार द्वारा समय-समय पर जारी आदेश/अधिसूचना/संकल्प/परिपत्र/सूचना आदि के अनुसार होगी ।
(ग) प्रतियोगिता परीक्षा में बैठने वाले उम्मीदवार को राज्य प्राधिकार द्वारा निर्धारित शर्त्तों का पालन करना होगा ।
(घ) कर्मचारी को अन्य संगठन/विभाग में परीक्षा/चयन में बैठने के लिए नियुक्ति प्राधिकारी की पूर्वानुमति प्राप्त करनी होगी ।(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 4 5. आरक्षण।-
(i) अनुसूचित जाति, अनुसूचित जनजाति, पिछड़ा वर्ग, अति पिछड़ा वर्ग, राज्य के आर्थिक रूप से कमजोर वर्ग के सदस्यों के पक्ष में नियम-7 में दी गई अनुसूची के अनुसार पदों की विभिन्न श्रेणियों में आरक्षण, महिलाओं और विकलांग व्यक्तियों के लिए क्षैतिज आरक्षण और अन्य के लिए आरक्षण श्रेणियाँ, यदि कोई हो, राज्य सरकार द्वारा समय-समय पर निर्गत परिपत्रों/अधिसूचनाओं अथवा बिहार पदों एवं सेवाओं को रिक्तियों में आरक्षण (अनुसूचित जाति, अनुसूचित जनजाति एवं अन्य पिछड़े वर्ग) अधिनियम, 1991 के अनुसार होगी ।
(ii) निम्नवर्गीय लिपिक के प्राधिकृत बल का 10 प्रतिशत पद ''बिहार उत्कृष्ट खिलाड़ियों की सीधी नियुक्ति नियमावली, 2023'' में विहित प्रक्रिया के अनुसार उत्कृष्ट खिलाड़ियों की नियुक्ति द्वारा भरा जायेगा, ऐसे सरकारी सेवक जिनकी सेवाकाल में मृत्यु हो गई हो, के आश्रितों पर, सीधी भर्ती कोटा के शेष 75 प्रतिशत पद के विरूद्व अपेक्षित मानदंड पूरा करने पर, अनुकम्पा के आधार पर नियुक्ति हेतु विचारण किया जा सकेगा । 6. अयोग्यता।-
(i) किसी उम्मीदवार की ओर से किसी अनुचित तरीके से अपनी उम्मीदवारी के लिए समर्थन प्राप्त करने का कोई भी प्रयास करने से नियुक्ति प्राधिकारी द्वारा परीक्षा/चयन में बैठने के लिए अयोग्य घोषित किया जा सकता है ।
(ii) केन्द्र या राज्य सरकार द्वारा या केन्द्र या राज्य सरकार के अधीन या नियंत्रण वाले स्थानीय प्राधिकार या निगम से बर्खास्त किए गए व्यक्ति नियुक्ति के पात्र नहीं होंगे । (iii) एक पुरूष उम्मीदवार जिसकी एक से अधिक पत्नियाँ जीवित हैं या एक महिला उम्मीदवार जिसने ऐसे व्यक्ति से विवाह किया है जिसकी पहले से ही एक जीवित पत्नी है, नियुक्ति के पात्र नहीं होंगे ।
7. वर्गीकरण और भर्ती का तरीका।-
सेवा का वर्गीकरण, राज्य विधिक सेवा प्राधिकार, चलंत लोक अदालत, उच्च न्यायालय विधिक सेवा समिति, जिला विधिक सेवा प्राधिकार, स्थायी लोक अदालत (जनोपयोगी सेवाएँ) एवं अनुमंडल विधिक सेवा समिति के अधिकारियों और कर्मचारियों के लिए नियुक्ति का तरीका एवं सेवा की पात्रता, नीचे दी गई अनुसूची के अनुरूप होगी,
परन्तु, राज्य सरकार समय-समय पर मुख्य संरक्षक के परामर्श से सेवा में शामिल पदों की संख्या को स्थायी या अस्थायी आधार पर जोड़ या घटा सकती है । अनुसूची इस प्रकार हैः-(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 5

09- सीधी भर्ती की प्रक्रिया ।-
(i) सीधी भर्ती के मामले में निम्नलिखित प्रक्रिया का पालन किया जायेगाः-
(क) विज्ञापन निर्गत करने या कार्यकारी अध्यक्ष द्वारा निर्धारित अन्य प्रक्रिया के बाद आवेदन आमंत्रित किया जायेगा ।
(ख) प्रतियोगिता परीक्षा से संबंधित प्रक्रिया और पाठ्यक्रम कार्यकारी अध्यक्ष द्वारा या
समय-समय पर निर्देशों के अनुसार निर्धारित किया जाएगा ।
(ii) जहाँ समूह 'ख' एवं 'ग' में किसी पद को सीधी भर्ती के माध्यम से भरना आवश्यक हो, कार्यकारी अध्यक्ष एक चयन समिति का गठन करेगा जिसमें सदस्य सचिव और राज्य प्राधिकार या जिला प्राधिकार के दो अधिकारी शामिल होंगे । चयन समिति लिखित परीक्षा और साक्षात्कार में उम्मीदवारों के पात्रता के आधार पर, जैसा भी मामला हो, योग्यता के क्रम में उम्मीदवारों की एक सूची तैयार करेगी और इसे कार्यकारी अध्यक्ष के अनुमोदन के लिए अपनी अनुशंसा के साथ अग्रसारित करेगी । कार्यकारी अध्यक्ष द्वारा इस प्रकार की स्वीकृति प्रदान किये जाने के बाद नियम-7 में निर्धारित सेवा के पदों पर सभी नियुक्तियाँ तथा राज्य सरकार द्वारा समय-समय पर स्वीकृत अन्य सभी पदों पर नियुक्ति प्राधिकारी द्वारा उक्त अनुमोदित सूची से की जायेगी ।
(iii) सीधी भर्ती की चयन सूची परिणाम घोषित होने की तिथि से एक वर्ष की अवधि के लिए वैध होगी और इस अवधि के भीतर किसी भी कारण से रिक्त या रिक्त होने वाले किसी भी विज्ञापित पद को प्रतीक्षारत उम्मीदवारों की सूची से यदि कोई हो, योग्यतानुसार भरा जाएगा । नियुक्ति के अनुमोदन के मामले में कार्यकारी अध्यक्ष का निर्णय अंतिम होगा ।
10- परिवीक्षा।-
(i) सीधी भर्ती से नियुक्त सरकारी सेवक 01 (एक) वर्ष तक परिवीक्षा पर रहेंगे । परिवीक्षा अवधि में सेवा संतोषजनक नहीं होने पर उसे एक और वर्ष के लिए विस्तारित किया जा सकेगा । विस्तारित अवधि में भी सेवा संतोषजनक नहीं रहने पर सेवा समाप्त की जा सकेगी।
11. विभागीय परीक्षा।-विभागीय परीक्षा राजस्व पर्षद द्वारा संचालित की जायेगी। विभागीय परीक्षा का पाठ्यक्रम वहीं होगा जो केन्द्रीय परीक्षा समिति, राजस्व पर्षद, पटना द्वारा विभिन्न सेवा संवर्गो के लिए निर्धारित की जायेगी । विभागीय परीक्षा अथवा अन्य परीक्षा से विमुक्ति के लिए सामान्य प्रशासन विभाग द्वारा निर्धारित मापदंड लागू होगा ।(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 13 12. सम्पुष्टि।-परिवीक्षाधीन व्यक्ति परिवीक्षा अवधि की संतोषजनक समाप्ति तथा विभागीय परीक्षा की उर्त्तीणता के बाद सम्पुष्ट किया जायेगा
13. प्रशिक्षण।- परिवीक्षा के दौरान सीधी भर्ती अथवा पदोन्नति द्वारा नियुक्त व्यक्ति से ऐसे प्रशिक्षण लेने की अपेक्षा की जायेगी जो माननीय कार्यकारी अध्यक्ष, बिहार राज्य विधिक सेवा प्राधिकार द्वारा निर्धारित किया जायेगा ।
14. पदोन्नति।-जहाँ किसी पद को प्रोन्नति के माध्यम से भरा जाना अप्रेक्षित हो, वहाँ कार्यकारी अध्यक्ष द्वारा गठित विभागीय प्रोन्नति समिति द्वारा वरिष्ठता-सह-योग्यता के आधार पर पदोन्नति दी जाएगी और उक्त समिति निम्नलिखित के लिए उपयुक्तता पर विचार करने के लिए अपनी स्वयं की प्रक्रिया तैयार कर सकेगी ।
15. विभागीय पदोन्नति समिति।-पदोन्नति के लिए कार्यकारी अध्यक्ष द्वारा गठित की जाने वाली एक विभागीय पदोन्नति समिति होगी जिसमें तीन सदस्य होंगे और एक सदस्य कम से कम जिला न्यायाधीश के पद और अन्य सदस्य अपर जिला एवं सत्र न्यायाधीश एवं बिहार न्यायिक सेवा (वरिष्ठ कोटि) के अधिकारी होंगे । 16. पदोन्नति के लिए कालावधि।-इसके संबंध में राज्य सरकार (सामान्य प्रशासन विभाग, बिहार, पटना) द्वारा समय-समय पर निर्गत अधिसूचना/परिपत्र/नियमावली लागू होेंगे ।
17. वरीयता।-
(1) सेवा के कर्मचारियों की परस्पर सेवाओं में किसी भी पद पर निरंतर सेवा अवधि के आधार पर वरीयता निर्धारित किया जाएगाः
परन्तु सीधी भर्ती द्वारा नियुक्त सेवा के सदस्यों की दशा में वरीयता नियत करने में नियुक्ति प्राधिकारी द्वारा निर्धारित योग्यता के क्रम में कोई व्यवधान नहीं डाला जायेगा । परन्तु यह और कि सेवा दो या दो से अधिक सदस्यों की एक ही तिथि को समान पद पर नियुक्त होने की स्थिति में उनकी वरीयता निम्नानुसार निर्धारित की जाएगीः- (क) पदोन्नति द्वारा नियुक्त सेवा का सदस्य सीधी भर्ती या स्थानान्तरण द्वारा नियुक्त
सदस्य से वरिष्ठ होगा;
(ख) सीधी भर्ती द्वारा नियुक्त सेवा का सदस्य स्थानान्तरण द्वारा नियुक्त सदस्य से
वरिष्ठ होगा;
(ग) स्थानान्तरण द्वारा नियुक्त सेवा के सदस्यों के मामले में, वरिष्ठता उस विभाग में ऐसे सदस्य की वरिष्ठता के अनुसार निर्धारित की जाएगी जहाँ से उन्हें
प्रतिनियुक्ति के लिए भेजा गया था या स्थानान्तरण किया गया था;
(2) पदक्रम सूची में परस्पर वरिष्ठता के संबंध में किसी भी विवाद के संबंध में कार्यकारी अध्यक्ष का निर्णय अंतिम होगा ।
(3) राज्य प्राधिकार, उच्च न्यायालय विधिक सेवा समिति, जिला विधिक सेवा प्राधिकार, स्थायी लोक अदालत (जनोपयोगी सेवाएँ), अनुमंडल विधिक सेवा समिति में पूर्व से नियमित आधार पर कार्यरत कर्मियों के लिए, पदोन्नति और अन्य वित्तीय लाभ के संबंध में उनकी नियुक्ति की तिथि से उक्त नियमावली उन पर प्रभावी होगा ।
18. कर्मचारियों का स्थानान्तरण।-
(i) जिला विधिक सेवा प्राधिकार, स्थायी लोक अदालत (जनोपयोगी सेवाएँ) एवं अनुमंडल विधिक सेवा समिति के अधीन अधिकारियों और कर्मचारियों की सेवाएँ जिला विधिक सेवा प्राधिकार के अध्यक्ष के अनुमोदन से राज्य प्राधिकार को सूचना के अधीन स्थानान्तरण योग्य होगी । (ii) जिला विधिक सेवा प्राधिकार, स्थायी लोक अदालत (जनोपयोगी सेवाएँ) एवं अनुमंडल विधिक सेवा समिति के अधीन अधिकारियों और कर्मचारियों का किसी अन्य जिला विधिक सेवा प्राधिकार, स्थायी लोक अदालत (जनोपयोगी सेवाएँ) और अनुमंडल विधिक सेवा समिति को, कार्यकारी अध्यक्ष के अनुमोदन से पारस्परिक स्थानान्तरित किया गया जाएगा ।(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 14 19. विस्तार।- सामान्य प्रशासन विभाग के संकल्प ज्ञापांक 10000 दिनांक 10.07.2015 द्वारा राज्य सरकार के विभिन्न विभागों/कार्यालयाें से सेवानिवृत सरकारी सेवकों की सेवानिवृति के उपरान्त संविदा नियोजन की प्रक्रिया निर्धारण के आधार पर संविदा नियोजन की जायेगी । सेवानिवृति के पश्चात् कर्मचारियों/पदाधिकारियों को पुनर्नियोजित करने की शक्ति माननीय कार्यकारी अध्यक्ष, बिहार राज्य विधिक सेवा प्राधिकार में निहित होगी । 20. अधीक्षण एवं नियंत्रण।-इन नियमावली के अधीन समस्त अधिकारी एवं कर्मचारी बिहार राज्य विधिक सेवा प्राधिकार के अधीक्षण और नियंत्रण के अधीन होंगे ।
21. सेवा की अन्य शर्ते।-
(1) अनुशासन, दण्ड और अपील के मामलों में अधिकारी व कर्मचारी, बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण व अपील) नियमावली, 2005 (समय-समय पर यथा संशोधित) से शासित होंगे ।
(2) बिहार राज्य सेवक (वर्गीकरण, नियंत्रण व अपील) नियमावली, 2005 (समय-समय पर यथा संशोधित) से नियम-24 के उप- नियम-(1) के खण्ड-(सी) अथवा खण्ड-(डी) के अधीन आदेश निर्गत करने में सक्षम प्राधिकार और अपीलीय प्राधिकार भी इन नियमों के परिशिष्ट-ए में निर्दिष्ट किए जायेंगे एवं अपील में जारी किया गया आदेश अन्तिम होगा । (3) वेतन, अवकाश, पेंशन, सेवानिवृत्ति, सुनिश्चित वृत्ति उन्ययन हेतु प्रावधान एवं अन्य मामलों, जिन्हें इन नियमों में स्पष्ट रूप से प्रावधानित नहीं किया गया है, के संबंध में राज्य प्राधिकार, उच्च न्यायालय विधिक सेवा समिति, चलंत लोक अदालत के अधिकारी एवं कर्मचारी, पटना उच्च न्यायालय अधिकारी एवं कर्मचारीवृन्द (भर्ती, नियुक्ति, पदोन्नति एवं सेवा तथा आचरण की अन्य शर्ते) नियमावली, 2021 द्वारा शासित होंगे ।
(4) इसी प्रकार, उन मामलों के लिए, जिन्हें इन नियमों में स्पष्ट रूप से प्रावधानित नहीं किया गया हैै, बिहार सिविल कोर्ट अधिकारी एवं कर्मचारीवृन्द (भर्ती, पदोन्नति, स्थानान्तरण एवं अन्य सेवा शर्त्तें) नियमावली, 2022 जिला विधिक सेवा प्राधिकार, स्थायी लोक अदालत(जनोपयोगी सेवाएँ) एव अनुमंडल विधिक सेवा समिति, के अधिकारी एवं कर्मचारियों पर लागू होंगे ।
22. शिथिलीकरण की शक्ति।- जहाँ मुख्य संरक्षक इस बात से संतुष्ट हों कि इन नियमों में से किसी नियम का प्रवर्तन किसी विशिष्ट मामलों में कठिनाई उत्पन्न करता है तो वह, आदेश द्वारा, उस विशिष्ट नियम को, उस सीमा तक एवं ऐसे अपवादों एवं शर्तें के अधीन जैसाकि आवश्यक हों, छोड़ देगा अथवा शिथिल कर देगा । परन्तु यह कि जब कभी मुख्य संरक्षक द्वारा ऐसी शिथिलता प्रदान की जायेगी तो राज्य सरकार को इसे सुचित किया जाएगा ।
23. व्यावृत्ति।-
(1) इस नियमों के प्रारंभ होने के पूर्व मुख्य न्यायाधीश (मुख्य संरक्षक), कार्यकारी अध्यक्ष द्वारा जारी समस्त अधिसूचनाएँ दिये गये समस्त आदेशों, की गर्ई समस्त नियुक्तियाँ एवं प्रयोग की गई समस्त शक्तियों को क्रमशः इन नियमों के अधीन जारी किया गया/ दिया गया, एवं प्रयोग किया गया, माना जायेगा ।
(2) बिहार राज्य विधिक सेवा प्राधिकार नियमावली, 1996 अथवा बिहार राज्य विधिक सेवा प्राधिकार विनियमन, 1998 कोई असंगतता के मामलों में, इन नियमों के प्रावधान प्रभावी होंगे।
(3) यदि किसी बिन्दु पर यह नियमावली बिहार राज्य विधिक सेवा प्राधिकार नियमावली, 1996 अथवा बिहार राज्य विधिक सेवा प्राधिकार विनियमन, 1998 मौन है तो वहाँ बिहार सरकार के सुसंगत नियम/विनियम/संकल्प/अधिसूचनाएँ इत्यादि लागू होंगे ।
24. अनुकम्पा के आधार पर नियुक्ति।-सामान्य प्रशासन विभाग, बिहार सरकार द्वारा समय-समय पर निर्गत अद्यतन/संशोधित दिशा-निर्देश एवं मार्गदर्शन के आलोक में अनुकम्पा नियुक्ति की जायेगी ।(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 15 25. निर्वचन।-यदि इन नियमावली के किसी प्रावधान की विवेचन के संबंध में कोई संदेह उत्पन्न होता है तो वहाँ मुख्य संरक्षक का निर्णय अन्तिम होगा ।

The 2nd September 2025 THE BIHAR STATE LEGAL SERVICES AUTHORITY OFFICERS AND EMPLOYEES (RECRUITMENT & SERVICE CONDITIONS) RULES, 2025
No.C/LA.-02/2020/5630—In exercise of the powers conferred by Section 28 of the Legal Services Authorities Act, 1987 (Central Act 39 of 1987), the Governor of Bihar, in consultation with the Chief Justice of the High Court of Patna, hereby makes the following rules, namely:-
1. SHORT TITLE EXTENT AND COMMENCEMENT:-
(1) These rules may be called The Bihar State Legal Services Authority Officers and Employees (Recruitment & Condition of Service) Rules, 2025.
(2) These Rules shall apply to all the Officers (Non- Judicial) and Employees of the establishment of, The Bihar State Legal Services Authority, Patna High Court Legal Services Committee, Mobile Lok Adalat, District Legal Services Authority (including Permanent Lok Adalat for Public Utility Services) and Sub-Divisional Legal Services Committee.
(3) It shall come into force from the date of publication in the Bihar Official Gazette.
2. DEFINITIONS:-
(i) In these rules, unless the context otherwise requires :-
(a) "Act" means the Legal Services Authorities Act, 1987 (Central
Act 39 of 1987);
(b) "Appointing Authority" means the Bihar State Legal Services Authority or High Court Legal Services Committee or District Legal Services Authority or Sub-Divisional Legal services Committee, as may be specified in these rules.
(c) "Bihar State Legal Services Authority Rules, 1996" means The
Bihar State Legal Services Authority Rules 1996.
(d) "Bihar State Legal Services Authority Regulations, 1998" means
Bihar State Legal Services Authority Regulations 1998.
(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 202516 (e) "Chairperson/Chairman" means the Chairperson/Chairman of High Court Legal Services Committee or District Legal Services Authority or Sub-Divisional Legal services Committee.
(f) "Departmental Promotion Committee" means a Departmental
Promotion Committee constituted under Rule 15 in these rules;
(g) "District Authority" means District Legal Services Authority
constituted under Section 9 of the Act;
(h) "Employee" means an employee of the Bihar State Legal Services Authority or an employee for the Bihar State Legal Services Authority, High Court Legal Services Committee, Mobile Lok Adalat, District Legal Services Authority, Permanent Lok Adalat (Public Utility Services) and Sub-Divisional Legal Services Committee;
(i) "Examination" means the competitive examination for
recruitment conducted under these Rules;
(j) "Executive Chairman" means the Executive Chairman of the
Bihar State Legal Services Authority;
(k) "Government" means the Government of Bihar; (l) "High Court" means the Patna High Court; (m) "High Court Legal Services Committee (HCLSC)" means the Patna High Court Legal Services Committee constituted under Section 8A of the Act;
(n) "Judicial Officer" means serving/retired officers of Bihar Superior Judicial Services and Bihar Judicial Services posted on deputation at Bihar State Legal Services Authority, High Court Legal Services Committee, District Legal Services Authorityand Sub-Divisional Legal Services Committee.
(o) "Officer" means officers (non-Judicial) posted at Bihar State Legal Services Authority, High Court Legal Services Committee, Mobile Lok Adalat, District Legal Services Authority, Permanent Lok Adalat (Public Utility Services) and Sub-Divisional Legal Services Committee or an officer holding any post in the services of the Bihar State Legal Services Authority by absorption/deputation from other Government Department; (p) "Member Secretary" means the Member Secretary of the Bihar
State Legal Services Authority;
(q) "Mobile Lok Adalat" means Mobile Legal Services Unit established by Law Department, Govt. of Bihar vide Memo no. 863/J dated 10.03.2006;
(r) "Patron-in-Chief" means the Chief Justice of the Patna High
Court;
(s) "Permanent LokAdalat" means Permanent LokAdalat (Public utility Service) established under sub-section (1) of Section 22B of the Act;
(t) "Post" means post of the officers and employees as sanctioned by
the state Government;
(u) "Rules" means Bihar State Legal Services Authority Officers and
Employees (Recruitment & Service Conditions) Rules, 2025(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 17 (v) "Service" means service under the Bihar State Legal Services Authority, High Court Legal Services Committee, Mobile Lok Adalat, District Legal Services Authority, Permanent Lok Adalat (Public Utility Services) and Sub-Divisional Legal Services Committee Officers and Employees service;
(w) "Secretary" means Secretary of High Court Legal Services Committee, District Legal Services Authority, and Sub-Divisional Legal Services Committee;
(x) "State Authority" means Bihar State Legal Services Authority
constituted under Section 6 of the Act;
(y) "Sub-Divisional (Taluk) Committee" means Sub-Divisional Legal Services Committee constituted under Section 11A of the Act;
(ii) All other words and expressions used herein but not defined in these rules shall have the same meaning as respectively assigned to them in the Legal Services Authorities Act, 1987, Bihar State Legal Services Authority Rules, 1996 and Bihar State Legal Services Authority Regulations, 1998, as amended from time to time.
3. CONSTITUTION OF SERVICE:-
The service shall consist of the following persons:-
(i) All officers and employees who, at the commencement of these Rules are regular employee of Bihar State Legal Services Authority, High Court Legal Services Committee, Mobile LokAdalat, District Legal Services Authority, Permanent LokAdalat(Public Utility Services) and Sub- Divisional Legal Services Committee shall be deemed to have been appointed under these rules and the service rendered by them before commencement of these Rules shall be taken into account for deciding the eligibility for promotion to higher grade.
(ii) New recruitment of Officers (Non-Gazetted) and employees will be done in accordance with the provisions of these rules.
4. ELIGIBILITY CRITERIA:-
(i) A candidate for appointment to service or post :-
(a) Must be citizen of India. (b) Candidate for direct recruitment must not be below 18 years of age on the 1st August of the year in which the process of recruitment initiated. The upper age limit of different categories shall be in accordance with the Orders/Notification/ Resolution/ Circulars/Notices etc issued by the by State Government of Bihar from time to time.
(c) The candidate appearing in competitive examination must comply the conditions prescribed by the State Authority.
(d) Employee must obtain prior permission of the Appointing Authority to appear for the examination/ selection in other organization/department.
5. RESERVATION: -
(i) Reservation to various categories of posts as per schedule given in Rule 7 in favour of members of Scheduled castes, Scheduled Tribes, Backward Classes, Extremely Backward Classes, Economically Weaker Section of the state, Horizontal reservation for women and Persons with disabilities(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 18 and reservation for other categories, if any, shall be in accordance with circulars/notices issued by the State Government from time to time in pursuance of Bihar Reservation of Vacancies in Posts and Services (for Scheduled Casts and Scheduled Tribes and other Backward Classes) Act, 1991.
(ii) 10 percent of the sanctioned strength of Lower Division Clerk will be filled by appointing outstanding sportspersons as per the procedure prescribed in the Bihar Outstanding Sportspersons Appointment Rules, 2023.The dependents of such government servants who died during service, may be considered for appointment on compassionate grounds against the remaining 75 percent posts of direct recruitment quota, on fulfilling the requisite criteria.
6. DISQUALIFICATION: -
i) Any attempt on the part of a candidate to obtain support for his candidature by any unfair means may be held by the Appointing Authority to disqualify him for appearing in the examination/selection.
ii) A person dismissed by the Central or State Government or by a Local Authority or Corporation, owned or controlled by the Central or State Government, shall not be eligible for appointment.
iii) A male candidate who has more than one wife alive or a female candidate who has married a person already having a wife alive shall not be eligible for appointment.
7. CLASSIFICATION AND MODE OF APPOINTMENT:-
The classification of service, the Mode of Appointment and eligibility of service for Officers & Staff of State Legal Services Authority, Permanent Lok Adalat for Public Utility Services, Mobile Legal Services Unit, High Court Legal Services Committee, District Legal Services Authority and Sub-Divisional Legal Services Committee will be as per schedule given below,
But, the State Government may from time to time add or reduce the number of posts included in the service either on a permanent basis or temporary basis after consultation with the Patron in Chief. The Schedule is as under:-

(i) In case of direct recruitment following procedure shall be followed:-
(a) Application shall be called for after issuance of advertisement or other procedure as may be prescribed by Executive Chairman. (b) The procedure and syllabus relating to the Competitive Examination shall be prescribed by the Executive Chairman or as per directions from time to time.
(ii) Where any post in Group B or C is required to be filled up by way of direct recruitment, the Executive Chairman shall constitute a Selection Committee comprising of Member Secretary and any two officers from State Authority or District Authority. The Selection Committee on the basis of performance of candidates in the written examination and interview, as the case may be, shall prepare a list of candidates in order of merit and forward the same with its recommendation to the Executive Chairman for his approval. After such approval is granted by the Executive Chairman, all appointments to the posts in Service as set out in Rule 7 and all other posts sanctioned by the State Government from time(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 26 to time, shall be made from the said approved list by the appointing Authority.
iii) The select list of direct recruitment shall be valid for a period of one year from the date of declaration of results and any advertised post remaining unfilled or falling vacant due to any reason within this period, shall be filled from the candidates from the waiting list, if any, as per merit. The decision of Executive Chairman in the matter of approval for appointment shall be final.
10. PROBATION:-Government servants appointed through direct recruitment will be on probation for 01(one) year. If the service is not satisfactory during the probation period, it can be extended for one more year. If the service is not satisfactory even in the extended period, the service can be terminated.
11. DEPARTMENTAL EXAMINATION:-Departmental examination will be organized by the Board of Revenue. The syllabus of departmental examination will be same as prescribed for various service cadres by the Central Examination Committee, Board of Revenue, Patna. The criteria prescribed by the General Administration Department, regarding the exemption from departmental examination or any such examination shall also be applicable here.
12. CONFIRMATION:-The services of probationer shall be confirmed only after successful completion of the probation period, including the extended period, if any, and passing of the departmental examination.
13. TRAINING:-Person appointed through direct recruitment or through promotion shall be expected to undergo such training as prescribed or determined by the Hon'ble Executive Chairman, Bihar State Legal Services Authority.
14. PROMOTION:-Where a post is required to be filled up by way of promotion, it shall be made on the basis of seniority-cum-merit by a Departmental Promotion Committee constituted by the Executive Chairman and the said Committee may device its own procedure for considering suitability for promotion.
15. DEPARTMENTAL PROMOTION COMMITTEE:-There shall be a Departmental Promotion Committee to be constituted by the Executive Chairman for promotion consisting of three members and one member at least the rank of District Judge and other members being officer of rank of the Additional District & Sessions Judge and Bihar Judicial Service (Senior Division).
16. 'KALAWADHI' FOR PROMOTION:-In this regards Notification/ Circular/ Rules issued by the State Government (General Administration Department, Bihar, Patna) from time to time shall be applicable.
17. SENIORITY:-
1) Seniority, inter se of employees of Service shall be determined by the length of continuous service on any post in the Service:
Provided that in the case of members of Service appointed by direct recruitment, the order of the merit determined by the appointing authority shall not be disturbed in fixing the seniority; Provided further that in the case of two or more members of Service being appointed to a similar post on the same date, their seniority shall be determined as follows:-
(a) a member of Service appointed by promotion shall be senior to a member appointed by direct recruitment or transfer;
(b) a member of Service appointed by direct recruitment shall be senior to a member appointed by transfer;
(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 202527 (c) in the case of a members of Service appointed by transfer, seniority shall be determined according to the seniority of such member in the department from which they were sent for deputation or transferred;
(2) The decision of the Executive Chairman with regard to any dispute regarding inter-se seniority in the gradation list shall be final.
(3) For employees who are already working in the State Authority, High Court Legal Services Committee, District Legal Services Authority, Permanent Lok Adalat for Public Utility Services, and Sub-Division Legal Services Committee on regular basis, the Rules, with respect to promotion and other financial benefits will become applicable on them from the date of their appointment. 18. TRANSFER OF EMPLOYEES:-
(i) The services of the officers and employees under the District Legal Services Authorities, Permanent Lok Adalats for Public Utility Services and Sub-Divisional Legal Services Committees shall be transferable within the District with the approval of Chairman of District Authority under intimation to State Authority.
(ii) The officers and employees under the District Legal Services Authorities, Permanent Lok Adalats for Public Utility Services and Sub-Divisional Legal Services Committees to any other District Legal Services Authorities, Permanent Lok Adalats and Sub-Divisional Legal Services Committees shall be mutually transferred with the approval of Executive Chairman.
19. EXTENSION:-As per the General Administration Department's Resolution Memo 10000 dated 10. 07.2015, the contract employment will be engaged only on the basis of the procedure prescribed for contract employment, after retirement of retired government servants from various departments /offices of the State Government. The re-employment of employees/officials will be done by the Hon'ble Executive Chairman, Bihar State Legal Services Authority.
20. SUPERINTENDENCE AND CONTROL:- All Officers and Employees governed by these Rules shall be subject to superintendence and control of the Bihar State Legal Services Authority.
21. OTHER CONDITIONS OF SERVICE:-
(1) In matters relating to discipline, penalties and appeals, the officers and employees (as amendment from time to time) shall be governed by Bihar Government Servants (Classification, Control and Appeal) Rules, 2005.
(2) The authority competent to pass an order under clause (c) or clause (d) of sub rule (1) of rule 24 of the Bihar Government Servants (Classification, Control and Appeal) Rules, 2005 and appellate authority shall also be specified in Rule-8 to these rules and Order passed in appeal shall be final. (3) In respect of pay, leave, pension, superannuation, provision for Assured Career Progression and all other matters, not expressly provided for in these rules, the Officers and Employees of State Authority, High Court Legal Services Committee and Mobile Lok Adalat shall be governed by Patna High Court Officers and Staff (Recruitment, Appointment, Promotion and other Condition of Service and Conduct) Rules, 2021. (4) Similarly, for matters, not expressly provided for in these Rule, Bihar Civil Court Officers and Staff (Recruitment, Promotion, Transfer and other(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 28 Services Conditions) Rules 2022 shall be applicable to Officers and Employees of District Authority, Permanent Lok Adalat (Public Utility Services) and Sub-Divisional Legal Services Committee.
22. POWER OF RELAXATION:-Where the Patron-in-Chief is satisfied that operation of any of these rules causes undue hardship in any particular case, he may, by order, dispense with or relax the particular rule to such an extent and subject to such exceptions and conditions, as may be deemed necessary.
Provided that as and when any such relaxation is granted by the Patron-in-Chief, the State Government shall be informed of the same.
23. SAVINGS :-
(1) All notifications issued, orders passed, appointments made or powers exercised by the Chief Justice (Patron-in-chief), Executive Chairman or Chairperson prior to the commencement of these rules shall be deemed to have been issued, passed, made and exercised respectively under the provision of these rules.
(2) In case of any inconsistency with Bihar State Legal Services Authority Rules, 1996 or Bihar State Legal Services Authority Regulations, 1998, the provision of these rules shall prevail.
(3) If on any point, this rule, Bihar State Legal Services Authority Rules, 1996 and Bihar State Legal Services Authority Regulations, 1998, is silent then the relevant Rules/Regulations/Resolutions/Notifications etc of Bihar Government shall be applicable.
24. APPOINTMENT ON COMPASSIONATE GROUND:-The appointment on compassionate grounds will be done in the view of updated/revised guidelines and guidance issued from time to time by the General Administration Department, Government of Bihar.
25. INTERPRETATION.-If any doubt arises as to the interpretation of any of the provision of these rules, the decision of the Patron-in Chief shall be final.
