सं॰ 26/नि0नि0-19-01/2023, सा0प्र0 16516--भारत के संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल में संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैं :-
1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ। (i) यह नियमावली
कही जा सकेगी। (ii) इसका विस्तार संपूर्ण बिहार राज्य में होगा।
(iii) यह तुरंत प्रवृत्त होगी।
उक्त नियमावली के नियम-3 के उपनियम (क) को निम्नवत् प्रतिस्थापित किया जाता है- ''(क) इस नियमावली के अंतर्गत निम्नांकित अर्हता प्राप्त खिलाड़ी राज्य सरकार की सेवा में उत्कृष्ट खिलाड़ी की श्रेणी में नियुक्ति के पात्र होंगेः-
(i) जो बिहार राज्य के मूल निवासी हों।2 (cid:464)बहार गजट (असाधारण), 3 िसत(cid:224)बर 2025 (ii) पदक विजेता की सीधी भर्ती के लिये निर्धारित पे-बैंड/स्केल एवं वेतन स्तर तथा उसके लिये निर्धारित न्यूनतम खेल अर्हताः-
| (i) | पीबी-II(9300-34800) गे्रड पे-5400 | 9 | ओलम्पिक खेलों मे ं स्वर्ण/रजत/कांस्य पदक विजेता या एशियन गेम्स/कॉमनवेल्थ गेम्स में स्वर्ण पदक विजेता। |
| (ii) | पीबी-II(9300-34800) गे्रड पे-4600 | 7 | ओलम्पिक खेलों मे ं सहभागिता या एशियन गेम्स/कॉमनवेल्थ गेम्स में रजत/कांस्य पदक विजेता। |
| (iii) | पीबी-II(9300-34800) गे्रड पे-4200 | 6 | सहभागिता या ं 1. एशियन गेम्स/कॉमनवेल्थ गेम्स मे नेशनल गेम्स/सीनियर नेशनल चैम्पियनशिप में स्वर्ण/रजत पदक विजेता। 2. केवल वैसे गेम्स जो ओलम्पिक गेम्स/एशियन गेम्स/कॉमनवेल्थ गेम्स में शामिल है। |
| (iv)(क) | पीबी-I (5200-20200) गे्रड पे-1800/1900/ 2000 | 1/2 | 1. नेशनल गेम्स/सीनियर नेशनल चैम्पियनशिप में कांस्य पदक विजेता। (क) नियुक्ति हेतु आवेदन 18 वर्ष की उम्र होने के उपरान्त ही की जा सकेगी। (ख) व्यक्तिगत स्पर्धा में न्यूनतम 16 प्रतिभागी एवं दलीय स्पर्धा में संबंधित खेल से कम से कम 8 दल भाग लिये हों। 3. केवल वैसे गेम्स जो ओलम्पिक गेम्स/एशियन गेम्स/कॉमनवेल्थ गेम्स में शामिल है। |
| (iv) (ख) | |||
| पीबी-I(5200-20200) गे्रड पे-1800/1900/ | 1/2/ | 1. अर्हताएँ- (क) नेशनल गेम्स में व्यक्तिगत स्पर्धा में प्रथम आठ या क्वार्टर फाईनलिस्ट एवं दलीय स्पर्धा मे ं सेमीफाईनलिस्ट, सीनियर नेशनल चैम्पियनशिप मे ं व्यक्तिगत स्पर्धा में प्रथम छः या क्वार्टर फाईनलिस्ट एवं दलीय स्पर्धा में सेमीफाईनलिस्ट। (ख) व्यक्तिगत स्पर्धा में न्यूनतम 16 प्रतिभागी एवं दलीय स्पर्धा में संबंधित खेल से कम से कम 8 दल भाग लिये हों। (ग) केवल वैसे गेम्स जो ओलम्पिक गेम्स/एशियन गेम्स/कॉमनवेल्थ गेम्स में शामिल हैं। 2. बिहार में खेल उत्कृष्टता को बढ़ावा देने और उत्कृष्ट खिलाड़ियों को रोजगार के समान अवसर प्रदान करने के उद्देश्य से मेधावी खिलाड़ियों की नियुक्ति ट्रायल/परीक्षण के आधार पर की जाएगी। उससे संबंधित प्रावधान निम्नवत् होगीः (क) अर्हताः खेल विधा बिहार राज्य की प्राथमिकता खेलों की सूची में शामिल होनी चाहिए। (ख) चयन की यह प्रक्रिया केवल उन खेल विधाओं पर लागू होगी, जिनमे पिछले तीन वर्षों के ं दौरान अन्य किसी माध्यम से इस योजना के अंतर्गत कोई लाभार्थी नहीं रहा हो। (ग) इस प्रक्रिया के अंतर्गत अंतिम नियुक्ति परीक्षण प्रदर्शन, शारीरिक दक्षता एवं संबंधित सेवा नियमों पर निर्भर करेगी। |
| (घ) एथलीटों के लिए पात्रताः केवल वही एथलीट आवेदन के लिए पात्र हो गे, जिन्होंने संबंधित ं खेल विधा में युवा मामले और खेल मंत्रालय द्वारा मान्यता प्राप्त राष्ट्रीय खेल संघो द्वारा ं आयोजित सीनियर राष्ट्रीय चैंपियनशिप मे भाग ं लिया हो तथा मान्यता प्राप्त संघ उस खेल विधा के अंतर्राष्ट्रीय संघ से संबद्ध हों। | |||
| (iv)(ग) विशेष मामलों में उत्कृष्ट खिलाड़ियों की भर्ती। | चयन समिति को इस प्रावधान के तहत उन खिलाड़ियों की भर्ती/चयन पर विचार करने का विवेकाधिकार होगा, जिन्होंने असाधारण प्रदर्शन कर देश का गौरव बढ़ाया हो। ऐसी भर्ती/चयन के कारणों को विधिवत् रूप से अभिलेखित किया जाएगा तथा ऐसे चयनित खिलाड़ियों के लिए वेतनमान का निर्धारण भी चयन समिति द्वारा किया जाएगा। |
नोट- (i). पारा खेल विधा के लिए उपरोक्त अर्हता प्रभावी होगी।
(ii) किसी भी आमंत्रण/मेमोरियल/गैरआधिकारिक चैम्पियनशीप/प्रतिस्पर्धा को मान्यता नहीं दी जायेगी। (iii),(iv) और (v) उक्त नियमावली के नियम-7 के उपनियम (iii),(iv) और (v) को निम्नवत् प्रतिस्थापित किया जाता है- (iii)- किसी एक खेल विधा में (अपवाद एथलेटिक्स), एक वर्ष में पाँच पुरूष एवं पाँच महिला उत्कृष्ट खिलाड़ियों की नियुक्ति की जायेगी। (iv)- दलीय स्पर्धा में यदि टीम के सभी सदस्य जिनके पास आवश्यक योग्यता है, नियुक्ति/चयन हेतु आवेदन प्रस्तुत करते हैं, तो चयन समिति टीम के सभी सदस्यों की नियुक्ति/चयन पर विचार करेगी। ऐसे मामलाें में प्रति खेल/प्रति वर्ष खिलाड़ियों की संख्या पर कोई प्रतिबंध नहीं होगा। (v)- पारा खिलाड़ियों के लिए आयोजित मान्यता प्राप्त सभी खेल विधाओं को एक ही खेल विधा मानते हुए नियुक्ति के लिए समेकित रूप से विचार किया जायेगा एवं राज्य सरकार के सामान्य प्रशासन विभाग द्वारा समय-समय पर पारा खिलाड़ियों के लिए निर्धारित कोटा के अनुसार अनुमान्य रिक्त पदों पर उत्कृष्ट पारा खिलाड़ियों की नियुक्ति की जायेगी। पारा खिलाड़ियों की नियुक्ति पुलिस सम्वर्ग में नहीं होगी।

No.-26/Ni.Ni-19-01/2023, GAD-16516--In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar is hereby pleased to make the following rules for amendment of "The Bihar Outstanding Sportspersons Direct Appointment (Amendment) Rules, 2023" :-
1. Short title, extent and commencement:-
(i) These Rules may be called as "The Bihar Outstanding Sportspersons Direct Appointment (Second Amendment) Rules, 2025"
(ii) It shall extend to the whole State of Bihar. (iii) It shall come into force from the date of its publication in the official gazette.
2. Amendment in the Rule-03 (a) of The Bihar Outstanding Sportspersons Direct Appointment (Amendment) Rules, 2023 is as under:-
"(a) Under these rules, the Sportspersons having the following qualifications shall be suitable for appointment in the category of outstanding Sportsperson under the service of the State Government, Who

(b) There shall be minimum 16 participants in 'Individual event' and in 'Team event" at least 8 teams must have participated from the respective games. (c) Only those games which are included in Olympic games/ Asian Games/ Commonwealth Games. 2. In order to promote sporting excellence in Bihar and provide fair opportunities for employment to outstanding athletes, recruitment of meritorious sportspersons shall be undertaken through an open trial basis, subject to the following provisions: Eligible Disciplines: (a) The sports discipline must be included in the Priority Games list of the State of Bihar. (b) This mode of selection shall be applicable only for those Sports disciplines which have no beneficiary under this scheme through other modes for the preceding three years. (c) It does not imply direct recruitment. Final appointment under this mode shall depend on trial performance, fitness evaluations, and relevant service rules. (d) Eligibility Criteria for Athletes: Only those athletes who have participated in the Senior National Championships organised by National Federations recognised by Ministry of Youth Affairs and Sports and affiliated to their respective International Federation in the concerned discipline shall be eligible to apply. | |

(ii) Invitation/memorial/non official championships/competitions shall not be recognized for recruitment purposes.
3. Amendment in the Rule-7(iii),(iv)&(v) of The Bihar Outstanding Sportspersons Direct Appointment (Amendment) Rules, 2023 is as under:
Rule-7(iii)-Except Athletics, in any other individual event, not more than five male and five female outstanding sportspersons would be appointed in a year. Rule-7(iv)- In team events, if all the team members having requisite qualifications submit their applications for appointment, the selection committee shall consider all such persons for recruitment. In such, case there will not be any bar on number of players/per games/per year. Rule-7(v)- For appointment of Para Sportspersons, all the sports and games included in Para games shall be treated as one sport discipline. They would be appointed against vacant posts as per their quota fixed time to time by the General Administration Department of the State Government. As a rule, Para Sports outstanding Sportspersons shall not be appointed in police department.
