(सं0 पटना 1453) पटना, बुधवार, 3 िसत(cid:224)बर 2025 foKku] izkoSf/kdh ,oa rduhdh f'k{kk foHkkx ———— vf/klwpuk 2 flrEcj 2025 I —भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल एतद् द्वारा बिहार अभियंत्रण शिक्षा सेवा नियमावली, 2020 में संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैः-
1.
कहीं जा (1) यह नियमावली सकेगी।
(2) इसका विस्तार संपूर्ण बिहार राज्य में बिहार सरकार के विज्ञान, प्रावैधिकी एवं तकनीकी शिक्षा विभाग के अधीनस्थ राजकीय अभियंत्रण महाविद्यालय तक रहेगा।
(3) यह राजपत्र में प्रकाशन की तिथि से प्रवृत्त होगी।
2.
(1.) उक्त नियमावली के नियम-9 के उप नियम-(4) को निम्नवत प्रतिस्थापित किया जायेगा।- "(4) इस सेवा के सदस्यों को उच्चतर पदों पर प्रोन्नति, विभागीय प्रोन्नति समिति की अनुशंसा से देय होगी। विभागीय प्रोन्नति समिति की संरचना निम्नवत होगीः-
(i) विकास आयुक्त, बिहार, पटना। - अध्यक्ष - सदस्य (ii) सचिव/प्रधान सचिव/अपर मुख्य सचिव,
सहकारिता विभाग, बिहार, पटना।
- सदस्य (iii) सचिव/प्रधान सचिव/अपर मुख्य सचिव,
पशुपालन एवं मत्स्य विभाग, बिहार, पटना।
- सदस्य (iv) सचिव/प्रधान सचिव/अपर मुख्य सचिव,
वन एवं पर्यावरण विभाग, बिहार, पटना।
- सदस्य (v) सचिव/प्रधान सचिव/अपर मुख्य सचिव,
प्रशासी विभाग, बिहार, पटना।(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 2 - सदस्य (vi) वित्त विभाग, बिहार, पटना का एक प्रतिनिधि, जो संयुक्त सचिव से अन्यून स्तर का हों। - सदस्य (vii) सामान्य प्रशासन विभाग, बिहार, पटना का एक पदाधिकारी, जो संयुक्त सचिव से अन्यून स्तर का हों। - सदस्य (viii) सामान्य प्रशासन विभाग, बिहार, पटना द्वारा मनोनित अनुसूचित जाति/अनुसूचित जनजाति के एक पदाधिकारी, जो संयुक्त सचिव से अन्यून स्तर का हों।
- सदस्य (ix) सामान्य प्रशासन विभाग, बिहार, पटना द्वारा मनोनित अल्पसंख्यक समुदाय
का एक पदाधिकारी, जो संयुक्त सचिव से अन्यून स्तर का हों।
- सदस्य (x) अखिल भारतीय तकनीकी शिक्षा परिषद, नई दिल्ली के प्रावधानों के अनुरूप तीन विशेषज्ञ, जिनमें से संबंधित विषय के दो विशेषज्ञ, जो विभाग द्वारा मनोनित किया जाएगा।
(2.) उक्त नियमावली के नियम-9 के उप नियम-(4) के बाद उप नियम (5), (6) एवं (7) निम्नवत् जोड़ा जायेगा।- ''(5) बिहार लोक सेवा आयोग (कार्यसीमन) विनियमावली, 1957 के विनियम-7(स) में विहित प्रावधान के आलोक में सेवा के उच्चतम वेतनमान के पद पर प्रोन्नति हेतु विभागीय प्रोन्नति समिति बिहार लोक सेवा आयोग के सदस्य की अध्यक्षता में गठित की जायेगी। (6) विभागीय प्रोन्नति समिति, सामान्य प्रशासन विभाग, बिहार, पटना एवं अखिल भारतीय तकनीकी शिक्षा परिषद द्वारा निर्धारित मापदण्डों के आधार पर प्रोन्नति के प्रस्तावों की जाँच कर अपनी अनुशंसा उपलब्ध करायेगी। (7) विभागाीय प्रोन्नति समिति की संरचना, समय-समय पर सरकार द्वारा किये गए संशोधन आदेश से, आच्छादित होगी एवं ऐसे आदेश के निर्गत की तिथि से प्रभावी होगी।''

उक्त नियमावली के नियम-10 को निम्नरूपेण प्रतिस्थापित किया जायेगा।-
"10.
(1) इस सेवा के सदस्यों की नियुक्ति, प्रोन्नति, पदस्थापन, स्थानान्तरण, सेवा सम्पुष्टि, वरीयता सूची का संधारण एवं स्थापना संबंधी सभी कार्य नियुक्ति प्राधिकार के नियंत्रणाधीन होगा।
(2) (क) I इस सेवा के सीधी भर्त्ती से नियुक्त कर्मियों को बिपार्ड द्वारा आयोजित 02 (दो) सप्ताह का प्रवेशकालीन प्रशिक्षण करना अनिवार्य होगा। (II) परिवीक्षा अवधि में सहायक प्राध्यापक, सह-प्राध्यापक, प्राध्यापक एवं प्राचार्य को 02 (दो) सप्ताह का कोषागार प्रशिक्षण प्राप्त करना अनिवार्य होगा। कोषागार प्रशिक्षण संबंधित जिला कोषागार पदाधिकारी द्वारा दी जाएगी। (III) बिहार लोक सेवा आयोग की अनुशंसा से सीधी भर्ती से नियुक्त सहायक प्राध्यापक, सह-प्राध्यापक, प्राध्यापक एवं प्राचार्य की सेवा निम्न अपेक्षाएँ पूरी करने के उपरान्त सम्पुष्ट की जा सकेगी-
(i) यथानिर्धारित प्रवेशकालीन प्रशिक्षण के सभी चरण को सफलतापूर्वक पूरा करना, जिसमें इन चरणों में संबंधित प्रशिक्षण संस्थान द्वारा यथानिर्धारित परीक्षा/Assignment पूरा करना सम्मिलित होगा.,
(ii) संबंधित सेवा/संवर्गीय नियमावली में यथानिर्धारित अन्य अपेक्षाओं को पूरा
करना।
(iii) अखिल भारतीय तकनीकी शिक्षा परिषद् द्वारा यथानिर्धारित 8 (आठ) Online modules of MOOCs in SWAYAM अथवा कोई अन्य निर्धारित अपेक्षा पूरा करना।
(IV) सेवा सम्पुष्टि के संबंध में उत्पन्न किसी कठिनाई/शंका का निराकरण विभाग द्वारा आवश्यकतानुसार वित्त विभाग, सामान्य प्रशासन विभाग अथवा विधि विभाग के परामर्श से किया जा सकेगा। (ख) उपरोक्त उपनियम-(2)(क) के प्रावधान इस संशोधन की तिथि के उपरान्त नियुक्त कर्मियों पर लागू होंगे।"
(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 2025 3 The 2nd September 2025No. (i) —In exercise of the powers conferred by the provision to Article 309 of the Constitution of India, the Governor of Bihar, hereby is pleased to amend the Bihar Engineering Education Service Rules, 2020. For this purpose of following rules are made:-
1. Short Title, Extent and Commencement.-
(i) These rules shall be known as Bihar Engineering Education Service (Second Amendment) Rules, 2025.
(ii) It shall extend to the Government Engineering Colleges under the Department of Science, Technology and Technical Education, Government of Bihar, in the whole state of Bihar.
(iii) It shall come into force from the date of its publication in the official gazette.
2. Amendment in rule 9 of the Bihar Engineering Education Service Rules, 2020.-
(1) Sub-rule (4) of rule-9 of the said rule shall be substituted as follows:-
"(4) Promotion to higher posts to the members of this service shall be done on the recommendation of the Departmental Promotion Committee. The composition of the Departmental Promotion Committee shall be as follows:-
(i) Development commissioner, Bihar, Patna. -Chairman (ii) Secretary/Principal Secretary/Additional Chief Secretary, -Member Co-operative Department, Bihar, Patna. (iii) Secretary/Principal Secretary/Additional Chief Secretary, -Member Animal Husbandry and Fisheries Department, Bihar, Patna (iv) Secretary/Principal Secretary/Additional Chief Secretary, - Member Forest and Environment Department, Bihar, Patna. (v) Secretary/Principal Secretary/Additional Chief Secretary, -Member Department of Science, Technology and Technical Education, Bihar, Patna (vi) A representative of the Finance Department, Bihar, Patna, - Member not below the rank of Joint Secretary. (vii) An officer of the General Administration Department, - Member Bihar, Member Patna, not below the rank of Joint Secretary. (viii) An officer of SC/ST, not below the rank of Joint -Member Secretary to be nominated by General Administration Department, Bihar, Patna. (ix) An officer from the minority community not below the - Member rank of Joint Secretary, nominated by the General Administration Department, Bihar, Patna. (x) Three experts as per the Provisions of the All India Council-Member for Technical Education, New Delhi, out of which two shall be experts in the concerned subject, to be nominated by the Department. (2.) Sub-rule (5), (6) and (7) shall be added after Sub-rule (4) of rule-9 of the said rule as follows:-
"(5) In the light of the provision contained in Regulation-7 (c) of Bihar Public Service Commission (Limitation of Work) Regulation, 1957, a Departmental Promotion Committee shall be constituted under the chairmanship of a Member of Bihar Public Service Commission for promotion to the post of highest pay scale of the service.
(cid:464)बहार गजट (असाधारण) 3 िसत(cid:224)बर 20254 (6) The Departmental Promotion Committee shall examine the promotion proposals on the basis of the criteria prescribed by the General Administration Department, Bihar, Patna and All India Council of Technical Education and submit its recommendation. (7) The composition of the Departmental Promotion Committee shall be governed by such orders as may be amended by the Government from time to time and shall be effective from the date of issue of such orders."
3. Substitution of rule 10 of the Bihar Engineering Education Service Rules, 2020.- Rule 10 of Bihar Engineering Education Service Rules, 2020 shall be substituted as follows:- "10. Control of Establishment related matters.- (1) Appointment, Promotion, posting, transfer, confirmation of service, maintenance of seniority-list and all matters related to establishment shall be under the control of the Appointing Authority. (2) (A) (I) Directly recruited officers to the Service will be required to undergo 02 (two) weeks induction training organized by the BIPARD.
(II) Treasury Training:- It shall be compulsory for Assistant Professor, Associate Professor, Professor and Principal to undergo treasury training for 02 (two) weeks during the probation period. Treasury training shall be given by the concerned District Treasury Officer.
(III) Service Confirmation :- The service of Assistant Professor, Associate Professor, Professor and Principal appointed by direct recruitment on the recommendation of Bihar Public Service Commission can be confirmed after fulfilling the following requirements -
(i) Successfully completing all the stages of induction training as prescribed which shall include passing of tests / assignments as prescribed by the concerned Training Institute in these stages.
(ii) Fulfill other requirements as prescribed in the relevant service/cadre rules. (iii) Fulfilling 8 (Eight) Online modules of MOOCs in SWAYAM or any other requirement as prescribed by All India Council for Technical Education.
(IV) Resolution of Difficulty related to Service Confirmation:- Any difficulty/doubt arising in relation to service confirmation can be resolved by the Department in consultation with the Finance Department, General Administration Department or Law Department as required.
(B) The provisions of sub-section (2)(A) above shall apply to employees appointed after the date of this amendment.
