एस0 ओ0 157, (cid:465)दनांक 17 सित(cid:817)बर 2025--बिहार माल और सेवा कर अधिनियम, 2017 (बिहार अधिनियम- 12, 2017) की धारा 9 की उप-धारा (3) और उप-धारा (4), धारा 11 की उप-धारा (1), धारा 15 की उप- धारा (5) और धारा 148 के तहत (cid:366)द(cid:797)त श(cid:304)(cid:389)यों का (cid:366)योग करते (cid:352)ए, बिहार राज्यपाल, इस बात से संतु(cid:829)ट होते (cid:352)ए कि ऐसा करना जनहित म(cid:336) आव(cid:827)यक है और जीएसटी प(cid:303)रषद की सिफा(cid:303)रशों के आधार पर, एत(cid:797)(cid:554)ारा, वाणि(cid:475) - कर विभाग की अधिसूचना सं(cid:783)या 12/2017 रा(cid:789)य-कर (दर) दिनांक 29 जून, 2017 जिसे बिहार गजट असाधारण अंक सं(cid:421)ा 555, दिनांक 29 जून, 2017 (cid:554)ारा (cid:366)काशित किया गया था, म(cid:336) और आगे भी नि(cid:635)लि(cid:304)खत संशोधन करते ह(cid:339), यथा:-
उ(cid:389) अधिसूचना म(cid:336),- (क) सारणी म(cid:336),-
(i) (cid:354)म सं(cid:421)ा 18 के सम(cid:407), (cid:721)ंभ (3) म(cid:336), खंड (ख) के प(cid:686)ात्, नि(cid:635)लि(cid:304)खत (cid:729)(cid:700)ीकरण अंतः (cid:725)ापित किया जाएगा, अथा(cid:330)त्:-
"(cid:729)(cid:700)ीकरण.- इस (cid:366)वि(िcid:700) म(cid:336) निहित कोई भी बात नि(cid:635)लि(cid:304)खत पर लागू नही ं होगी:

(ख) पैरा 2 म(cid:336),
(i) खंड (जैडई) के (cid:725)ान पर नि(cid:635)लि(cid:304)खत को अंत: (cid:725)ापित किया जाएगा, अथा(cid:330)त्:-
"(जैडई) 'माल प(cid:303)रवहन एज(cid:336)सी' से ता(cid:523)य(cid:330) ऐसे किसी (cid:681)(cid:304)(cid:389) से है जो सड़क माग(cid:330) से माल के प(cid:303)रवहन के संबंध म(cid:336) सेवा (cid:366)दान करता है और किसी भी नाम से माल भेजने का नोट जारी करता है, कि(cid:566)ु इसम(cid:336) शामिल नही ं है:-
(i) कोई इले(cid:387)(cid:332) ॉनिक कॉमस(cid:330) ऑपरे टर जिसके (cid:554)ारा (cid:725)ानीय वितरण की सेवाएं (cid:366)दान की जाती ह(cid:339),
(ii) कोई इले(cid:387)(cid:332) ॉनिक कॉमस(cid:330) ऑपरे टर जिसके मा(cid:559)म से (cid:725)ानीय वितरण की सेवाएं (cid:366)दान की जाती ह(cid:339)";
(ii) खंड (जैडएफए) के प(cid:686)ात् नि(cid:635)लि(cid:304)खत खंड अंत: (cid:725)ापित किया जाएगा, अथा(cid:330)त्:-
"(जैडएफबी) ऊपर तालिका म(cid:336) (cid:354)म सं(cid:421)ा 36ग और 36घ की (cid:366)वि(िcid:700)यों के (cid:366)योजनों के लिए, 'समूह' का अथ(cid:330) ऐसे (cid:681)(cid:304)(cid:389)यों का समूह है जो बीमा (cid:366)ा(cid:593) करने के अलावा एक समान उ(cid:542)े(cid:692) से या एक समान आथि(cid:330)क गतिविधि म(cid:336) संल(cid:432) होने के लिए एक साथ आते ह(cid:339), और इसम(cid:336) शामिल ह(cid:339):
क. नियो(cid:389)ा-कम(cid:330)चारी समूह, जहाँ मा(cid:720)र/समूह पॉलिसीधारक और समूह के सद(cid:735)ों के बीच, लागू कानूनों के अनुसार, नियो(cid:389)ा-कम(cid:330)चारी संबंध वि(cid:552)मान हो;
ख. गैर-नियो(cid:389)ा-कम(cid:330)चारी समूह, जहाँ बीमा के अलावा अ(cid:586) सेवाओं/गतिविधियों के लिए मा(cid:720)र/समूह पॉलिसीधारक और समूह के सद(cid:735)ों के बीच (cid:729)(cid:700) संबंध वि(cid:552)मान हो।";
(iii) खंड (जैडजी) के बाद, नि(cid:635)लि(cid:304)खत खंड अंत: (cid:725)ापित किया जाएगा, अथा(cid:330)त्: -
"(जैडजीए) '(cid:738)ा(cid:726) बीमा (cid:681)वसाय' का अथ(cid:330) ऐसे अनुबंधों का काया(cid:330)(cid:587)यन है जो (cid:349)(cid:427)ता लाभ या चिकि(cid:534)ा, श(cid:670) चिकि(cid:534)ा या अ(cid:729)ताल (cid:681)य लाभ, चाहे वे आंत(cid:303)रक रोगी हों या बा(cid:744) रोगी, या(cid:361)ा कवर और (cid:681)(cid:304)(cid:389)गत दुघ(cid:330)टना कवर (cid:366)दान करते ह(cid:339);"।
2. यह अधिसूचना दिनांक 22 सितंबर, 2025 से लागू होगी।
[(सं०सं० बि(cid:354)ी-कर/जीएसटी/विविध -21/2017 (खंड-21) 16] बिहार-रा(cid:475)पाल के आदेश से, संजय कु मार सिंह, रा(cid:475) कर आयु(cid:779)त-सह-सचिव।3 (cid:464)बहार गजट (असाधारण), 17 िसत(cid:224)बर 2025 एस॰ ओ॰ 157, दिनांक 17 सितम्बर, 2025 का अंग्रेजी में निम्नलिखित अनुवाद बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाषित किया जाता है जो भारतीय संविधान के अनुच्छेद 348 के खण्ड (3) के अधीन अंग्रेजी भाषा में प्राधिकृत पाठ समझा जाय।

Notification No. 16/2025- State Tax (Rate)
S.O. 157, Date The 17th September 2025-- In exercise of the powers conferred by sub- sections (3) and (4) of section 9, sub-section (1) of section 11, sub-section (5) of section 15 and section 148 of the Bihar Goods and Services Tax Act, 2017 (12 of 2017), the Governor of Bihar, on being satisfied that it is necessary in the public interest so to do, on the recommendations of the Council, hereby makes the following further amendments in the notification of the Commercial Taxes Department, Notification No. 12/2017- State Tax (Rate), dated the 29th June, 2017, published in the Bihar Gazette, Extraordinary, vide number 555, dated the 29th June, 2017, namely:-
In the said notification,- (a) In the table, -
(i) against serial number 18, in column (3), after clause (b), the following explanation shall be inserted, namely:- "Explanation. - Nothing contained in this entry shall apply to:
(i) local delivery services provided by an Electronic Commerce
Operator; or
(ii) local delivery services provided through an Electronic Commerce Operator.";
(ii) after serial number 36B and the entries relating thereto, the following serial numbers and entries relating thereto shall be inserted, namely: -

(i) for clause (ze), the following shall be substituted, namely: -
"(ze)'goods transport agency' means any person who provides service in relation to transport of goods by road and issues a consignment note by whatever name called, but does not include
(i) an electronic commerce operator by whom the services of local delivery are provided,
(ii) an electronic commerce operator through whom the services of local delivery are provided";
(ii) after clause (zfa), the following clause shall be inserted, namely:-
"(zfb) For the purposes of entries at serial numbers 36C and 36D in the table above, 'group' means group of persons who join together with a commonality of purpose or for engaging in a common economic activity, other than availing insurance, and includes:
a. Employer– employee groups, where an employer-employee relationship exists between the master/group policyholder and the members of the group in accordance with the applicable laws;
b. Non employer– employee groups, where a clearly evident relationship exists between the master/group policyholder and the members of the group, for services/ activities other than insurance.";
(iii) after clause (zg), the following clause shall be inserted, namely: -
"(zga) 'health insurance business' means the effecting of contracts which provide for sickness benefits or medical, surgical or hospital expense benefits, whether in-patient or out-patient, travel cover and personal accident cover;".
2. This notification shall come into force with effect from the 22nd day of September, 2025.
