(सं0 पटना 1525) पटना, बुधवार, 17 िसत(cid:224)बर 2025 वाणिज्य-कर विभाग ——— अधिसूचना एस० ओ० 160, िदनांक 17 (cid:871)सत(cid:224)बर 2025--बिहार माल और सेवा कर अधिनियम, 2017 (िबहार अिधिनयम- 12, 2017) की धारा 54 की उप-धारा (6) द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:7263)ए, बिहार राज्यपाल, परिषद् की सिफारिशों पर, पंजीकृ त (cid:7390)क्तियों की निम्नलिखित (cid:7088)ेणी को अधिसूचित करते हैं , जिन्हें उक्त अधिनियम के अधीन अनंतिम आधार पर प्रतिदाय की अनुमति नह(cid:7277) दी जाएगी, अर्थात्:–
(क) कोई भी (cid:7390)क्ति, जिसने बिहार माल और सेवा कर नियमावली, 2017 के नियम 10ख के अधीन आधार प्रमाणीकरण नह(cid:7277) कराया है;
(ख) कोई भी (cid:7390)क्ति, जो नीचे दी गई सारणी के स्तंभ (2) में विनि(cid:7416)र्दष्ट अध्याय या शीर्षक या उप-शीर्षक या टैरिफ मद के अंतर्गत आने वाली, स्तंभ (3) में विनि(cid:7416)र्दष्ट विवरण वाली वस्तुओं की आपू(cid:7414)र्त में लगा (cid:7263)आ है:

स्पष्टीकरण.-
(i) इस अधिसूचना में, "टैरिफ मद", "उप-शीर्ष", "शीर्ष", और "अध्याय" से, सीमा शुल्क टैरिफ अधिनियम, 1975 (1975 का 51) की प्रथम अनुसूची में यथा विनि(cid:7416)र्दष्ट (cid:7059)मश: कोई टैरिफ मद, शीर्ष, उप-शीर्ष और अध्याय अभिप्रेत है;
(ii) उक्त सीमाशुल्क टैरिफ अधिनियम, 1975 (1975 का 51) की प्रथम अनुसूची, जिसमें भाग और अध्याय टिप्पण और प्रथम अनुसूची के साधारण स्पष्टीकारक टिप्पण सम्मिलित हैं, के निर्वचन के लिए नियम, यथासंभव, इस अधिसूचना के निर्वचन के लिए लागू होंगे। यह अधिसूचना 1 अक्टूबर, 2025 से प्रभावी होगी।

एस॰ ओ॰ 160, दिनांक 17 सितम्बर, 2025 का अंग्रेजी में निम्नलिखित अनुवाद बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाषित किया जाता है जो भारतीय संविधान के अनुच्छेद 348 के खण्ड (3) के अधीन अंग्रेजी भाषा में उसका प्राधिकृत पाठ समझा जाय।

S.O. 160, Dated 17th September 2025-- In exercise of the powers conferred by sub- section (6) of section 54 of the Bihar Goods and Services Tax Act, 2017 (Bihar Act 12, 2017), the Governor of Bihar on the recommendations of the Council, hereby notifies the following category of registered persons who shall not be allowed refund on provisional basis under the said Act, namely : –
(a) Any person, who has not undergone Aadhaar authentication under rule 10B of the Bihar Goods and Services Tax Rules, 2017;
(b) Any person, who is engaged in the supply of the goods bearing description specified in column (3), falling under Chapter or heading or sub-heading or tariff item specified in column (2), of the Table below:

(i) In this notification, "tariff item", "heading", "sub-heading" and "Chapter" shall mean respectively a tariff item, heading, sub-heading,3 (cid:464)बहार गजट (असाधारण), 17 िसत(cid:224)बर 2025 and Chapter as specified in the First Schedule to the Customs Tariff Act, 1975 (51 of 1975);
(ii) The rules for the interpretation of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), including the Section and Chapter Notes and the General Explanatory Notes of the First Schedule shall, so far as may be, apply to the interpretation of this notification.
2. This notification shall come into force with effect from the 1st day of October, 2025.
