सेवा में, महालेखाकार, बिहार, वीरचन्द्र पटेल पथ, पटना। द्वारा :- वित्त विभाग। विषय :- मंत्री परिषद की बैठक दिनांक-09.09.2025 के मद संख्या-14 में दी गयी स्वीकृति के आलोक में राजस्व एवं भूमि सुधार विभाग के अन्तर्गत क्षेत्रीय कार्यालयों हेतु राजस्व कर्मचारी के 3303 अतिरिक्त पदों के सृजन, वेतनमान तथा स्थापना एवं प्रतिबद्ध व्यय अन्तर्गत अनुमानित वार्षिक व्यय-131,74,21,368/-(एक सौ इक्कतीस करोड़ चौहत्तर लाख इक्कीस हजार तीन सौ अड़सठ) रूपये मात्र की स्वीकृति के संबंध में।

आदेश- स्वीकृत।

दिनांक 10 सितम्बर 2025 राजस्व एवं भूमि सुधार विभाग, बिहार, पटना के अन्तर्गत प्रत्येक हल्कावार पूर्व से सृजित 4045 पदों के अतिरिक्त विभागीय स्वीकृत्यादेश सं0-462(4)/रा0, दिनांक-29.06.2010 द्वारा पंचायतों के क्षेत्राधिकार को हल्का मानकर हल्कों का सृजन एवं राजस्व कर्मचारी के 4418 पदों का सृजन किया गया। तदुपरान्त पटना सदर अंचल के विभाजन से चार अंचलों यथा-पटना सदर अंचल, पाटलिपुत्र अंचल, पटना सिटी अंचल एवं दीदारगंज अंचल के सृजन के उपरांत उक्त कार्यालयों हेतु विभागीय स्वीकृत्यादेश सं0-694(3)/रा0, दिनांक-25.11.2024 द्वारा राजस्व कर्मचारी के कुल 9 पदों का सृजन किया गया। उक्त पद सृजन के फलस्वरूप सम्प्रति राजस्व कर्मचारी के कुल 8472 स्वीकृत पद हैं।

2. राजस्व कर्मचारियों के पद सृजन का आधार केवल ग्राम पंचायत/हल्का की संख्या का आकलन ही रहा है। बड़े हल्कों में जमाबंदी की संख्या अत्यधिक होने के कारण राजस्व कर्मचारियों द्वारा कार्य करने में कठिनाई हो रही है। साथ ही इनके द्वारा नगर निकायों के भूमि की जमाबंदी संबंधी कार्यों का भी निष्पादन किया जाता है एवं नगर निकायों के हल्कों में भी जमाबंदी की संख्या अधिक होने के कारण राजस्व संबंधी कार्यों में वृद्धि हुई है। अतः राजस्व कर्मचारियों के स्वीकृत बल मे वृद्धि करने हेतु 5103 हल्कों में प्रति हल्का एक (01) तथा 3336 हल्कों में प्रति हल्का दो (02) अर्थात्‌ (5103X13336X2) कुल-11775 राजस्व कर्मचारी के पद हो जाएंगे।

3. उपर्युक्त के आलोक में हल्का पुनर्निधारण के आधार पर राजस्व संबंधी कार्यों के त्वरित निष्पादन हेतु राजस्व कर्मचारी के निम्नांकित अतिरिक्त पदों का अनुमान्य वेतनमान सहित सृजन तथा अनुमानित वार्षिक व्यय की स्वीकृति प्रदान की गयी है :-

4. उक्त अतिरिक्त सृजित पदों का अनुमानित वार्षिक व्यय ₹131,74,21,368/-(एक सौ इक्कतीस करोड़ चौहत्तर लाख इक्कीस हजार तीन सौ अड़सठ) रूपये मात्र संभावित है (व्यय विवरणी परिशिष्ट 'क' एवं जिलावार राजस्व कर्मचारी के कुल पदों की संख्या की विवरणी परिशिष्ट 'ख' संलग्न है)

5. उक्त पदों के सृजन पर होनेवाले व्यय की राशि का भुगतान स्थापना एवं प्रतिबद्ध व्यय अन्तर्गत मांग सं0-40, मुख्य शीर्ष-2029-भू-राजस्व, लघुशीर्ष 104-सरकारी संपदाओं का प्रबन्ध, उपशीर्ष 0001-राजस्व प्रशासन पर व्यय, विपत्र कोड-40-2029001040001 के अन्तर्गत विकलनीय होगा।

6. प्रस्ताव में प्रशासी पदवर्ग समिति की स्वीकृति प्राप्त है। 7. प्रस्ताव में दिनांक-09.09.2025 को मंत्री परिषद की बैठक के मद संख्या-14 में स्वीकृति प्राप्त है।

पटना, दिनांक 3 सितम्बर 2025 विषयः- ERSS मिरर साईट कमांड एवं कंट्रोल सेंटर, गयाजी के संचालन हेतु आवश्यक 132 पदों की स्वीकृति। आदेशः- स्वीकृत।7 (cid:464)बहार गजट, 17 सितम्बर 2025 आपात अनुक्रिया एवं सहयोग प्रणाली (ERSS) अत्याधुनिक एवं एकीकृत प्रणाली पर आधारित सरकार की एक महत्वाकांक्षी परियोजना है। परियोजना के सुचारू रूप से क्रियान्वयन हेतु मानव संसाधान एक महत्वपूर्ण घटक है। इस परियोजना का कमांड एवं कंट्रोल सेंटर, पटना में संचालित है, जिसके लिए विभागीय स्वीकृत्यादेश संख्या-1509, दिनांक-01. 02.2023 द्वारा विभिन्न पुलिस संवर्गीय 391 पद सृजित किया गया है।

ERSS परियोजना के विस्तृत प्रतिवेदन में One Secondary Command & Control Centre, Probably Gaya District Based on the Feasibility तथा इसके कार्य प्रणाली का उल्लेख किया गया है। अपर मुख्य सचिव, गृह विभाग की अध्यक्षता में दिनांक-05.07.2023 को ERSS परियोजना के क्रियान्वयन हेतु आहूत बैठक वृत्त की कंडिका 06 में Secondary Centre of ERSS स्थापित किये जाने का निदेश दिया गया है :-''Secondary Command & Control centre other than Patna with 20% of operational capacity of Primary CCC will be estabilished at Gaya, Both will be operated concurrently."

3.20% Capacity वाले Mirror Site ERSS Command & Control Centre, Gaya के क्रियान्वयन हेतु वर्तमान में कार्यरत Command & Control Centre, Patna के तर्ज पर निम्नांकित मानव बल के सृजन हेतु पुलिस मुख्यालय द्वारा प्रस्ताव प्राप्त है :-

6. स्थायी पद सृजन के उपरान्त उक्त मानव बल पर अनुमानित वार्षिक व्यय रू0 8,06,61,774/-(आठ करोड़ छः लाख इकसठ हजार सात सौ चौहत्तर) रूपये मात्र होगा। इस राशि की निकासी मुख्य शीर्ष-2055 पुलिस, उप-मुख्य शीर्ष 00, लघु शीर्ष-114-बेतार एवं कम्प्यूटर, उप शीर्ष-0001-संकेत, विपत्र कोड-22-2055.00.114.0001 के अन्तर्गत उपबंधित राशि से की जायेगी। इससे संबंधित सभी व्यय के निकासी एवं व्ययन पदाधिकारी पुलिस अधीक्षक, वितंतु, बिहार, पटना होंगे तथा इस राशि की निकासी सचिवालय कोषागार सिंचाई भवन, पटना से की जायेगी।

7. उपर्युक्त पर मंत्रिपरिषद्‌ की स्वीकृति प्राप्त है। 8. उक्त पर संयुक्त आयुक्त-सह-वरीय आंतरिक वित्तीय सलाहकार की सहमति प्राप्त है।

बिहार राज्य धार्मिक न्यास पर्षद्‌

सं॰ 21--श्री षिव पार्वती मंदिर, ग्राम-हिलालपुर मदारपुर, अँचलथाना-हाजीपुर, जिला- वैषाली, पर्षद में निबंधित एक सार्वजनिक धार्मिक न्यास है, जिसकी निबंधन सं0-4161 है।

इस न्यास की सुव्यवस्था हेतु पर्षदीय अधिसूचना पत्रांक-1759, दिनांक-30.11.2019 द्वारा अँचल पदाधिकारी, हाजीपुर, को पदेन अध्यक्ष बनाते हुये, 09 सदस्यों की एक न्यास समिति का गठन अस्थायी रूप से 01 वर्ष के लिये किया गया था, जिसके द्वारा पर्षद में नियमानुसार न्यास की आय-व्यय की विवरणी, पर्षद शुल्क आदि कभी प्रस्तुत नहीं किया गया। समिति का कार्यकाल भी समाप्त हो चुका है।

चुंकि कार्यरत न्यास समिति का कार्यकाल समाप्त हो चुका है, तत्पष्चात्‌ माननीय पटना उच्च न्यायालय के द्वारा C.W.J.C. No.-17322/22 में दिये दिषा-निर्देष के आलोक में नवीन न्यास समिति गठन हेतु जिला पदाधिकारी, वैषाली, से पर्षदीय पत्रांक-2884, दिनांक-18.02.2025 के द्वारा नामों का प्रस्ताव की मांग की गयी।

जिला पदाधिकारी, वैषाली, के पत्र सं0-563, दिनांक-11.03.2025 द्वारा नवीन न्यास समिति के गठन हेतु नामों की सूची पर्षद को प्राप्त हुई। उक्त प्रस्ताव में नामित व्यक्तियों का आपराधिक/निरोर्धात्मक कार्रवाई से संबंधित ब्योरा नहीं होने के संबंध में सूचित किया गया है।

अतः उपर्युक्त परिस्थिति में मैं, अंजनी कुमार सिंह, प्रशासक, बिहार हिन्दू धार्मिक न्यास अधिनियम 1950 की धारा 81 (ख) सह पठित धारा 8 क के अन्तर्गत प्रदत्त शक्तियों का प्रयोग करते हुए इस न्यास के सम्यक विकास एवं संचालन के लिए अधिनियम की धारा 32 के तहत प्राप्त प्रावधानों का प्रयोग करते हुए ''श्री षिव पार्वती मंदिर, ग्राम-हिलालपुर मदारपुर, अँचलथाना-हाजीपुर, जिला-वैषाली''की सम्पत्तियों की सुरक्षा, बेहतर प्रबंधन तथा सम्यक्‌ विकास हेतु निम्नलिखित योजना का निरूपण तथा इसे मूर्त्त रूप देने के लिए जिला पदाधिकारी, वैषाली द्वारा प्रस्तावित नामों में से निम्नांकित व्यक्तियों की न्यास समिति का गठन करता हूँ :-

योजना

1. बिहार हिन्दू धार्मिक न्यास अधिनियम, 1950 की धारा-32 के तहत निरूपित इस योजना का नाम ''श्री षिव पार्वती मंदिर, ग्राम-हिलालपुर मदारपुर, अँचलथाना-हाजीपुर, जिला- वैषाली,'' योजना होगा और इसके कार्यान्वयन एवं संचालन के लिए गठित न्यास समिति का नाम ''श्री षिव पार्वती मंदिर, ग्राम-हिलालपुर मदारपुर, अँचलथाना-हाजीपुर, जिला- वैषाली, न्यास समिति '' होगी, जिसमें न्यास की समग्र चल-अचल सम्पत्तियों के संधारण एवं संचालन का अधिकार रहेगा।

2. न्यास समिति न्यास के सुचारू प्रबंधन के साथ-साथ पूजा-अर्चना, राग-भोग, अतिथि-सेवा आदि समस्त धार्मिक आचारों का सम्यक संचालन सुनिष्चित करेगी।

3. न्यास की समग्र आय के लेखा का सम्यक्‌ संधारण किया जायेगा और समीप के किसी राष्ट्रीयकृत बैंक में न्यास के नाम से खाता खोलकर (यदि पूर्व से न्यास के नाम से खाता संचालित हो, तो उसमें) जमा किया जायेगा तथा आवष्यकतानुसार राषि निकासी कर व्यय किया जायेगा। खाते का संचालन अध्यक्ष/सचिव में से कोई एक व्यक्ति तथा कोषाध्यक्ष अर्थात 02 व्यक्तियों के संयुक्त हस्ताक्षर से हीं किया जायेगा।

4. मठ/मंदिर परिसर में जगह-जगह भेंटपात्र रखे जायेंगे, जिसमें दान एवं चढ़ावे की राषि डाली जायेगी, जो निर्धारित तिथि को न्यास समिति द्वारा अधिकृत दो सदस्यों के समक्ष खोली जायेगी और सही गणना कर प्राप्त राषि को बैंक में जमा किया जायेगा।

5. दाताओं से प्राप्त होने वाले राषि के लिए उन्हें रसीद दी जायेगी और सत्यापित पंजी में दर्ज कर उन्हें बैंक में जमा की जायेगी।

6. मठ परिसर में स्वच्छता एवं पवित्रता का विषेष ख्याल रखा जायेगा और मठ की गरिमा को अक्षुण्ण रखा जायेगा। महिला दर्षनार्थियों की सुविधा का विषेष ध्यान रखा जायेगा।26 (cid:464)बहार गजट, 17 सितम्बर 2025 7. न्यास समिति द्वारा मठ/मन्दिर के पुजारी की अर्हता का निर्धारण एवं नियुक्ति की जायेगी एवं उनके वेतन का भुगतान न्यास कोष से होगा।

8. न्यास समिति यह सुनिष्चित करेगी कि मठ/मन्दिर परिसर में भक्तों का शोषण नहीं हो और पूजा के नाम पर उनसे जबरन बसूली नहीं हो।

9. न्यास समिति, बिहार हिन्दू धार्मिक न्यास अधिनियम एवं उप विधि में वर्णित नियमों का अनुपालन करते हुए बजट, आय-व्यय विवरणी, अंकेक्षित प्रतिवेदन, कार्यवृत आदि का पर्षद को सम्यक प्रेषण करेगी।

10. न्यास समिति के कोई सदस्य यदि न्यास हित के प्रतिकूल कार्य करेंगे या न्यास की परिसम्पत्तियों से प्रत्यक्ष या परोक्ष लाभ उठाते हुए पाये जायेंगे अथवा आपराधिक पृष्टभूमि के होंगे और स्थानीय नहीं होगें तो उनके सदस्य बने रहने की अह्‌र्ता समाप्त हो जायेगी।

11. न्यास की आय-व्यय में आर्थिक शुचिता एवं पारदर्षिता रखना न्यास समिति की असली कसौटी होगी। 12. अध्यक्ष की अनुमति से सचिव प्रत्येक तिमाही में बैठक बुलायेंगे। बैठक की अध्यक्षता, अध्यक्ष करेंगे और निर्णय बहुमत के आधार पर होगा। अध्यक्ष की अनुपस्थिति में उपाध्यक्ष द्वारा बैठक की जायेगी एवं बैठक के उपरान्त बैठक में लिए गये निर्णय से न्यास समिति के अध्यक्ष को भी अवगत कराया जायेगा।

13. सचिव, समिति द्वारा पारित प्रस्तावों/निर्णयों को मूर्त्त रूप देने के लिए उत्तरदायी होंगे और कोषाध्यक्ष आय-व्यय के लेखा संधारण एवं पर्यवेक्षण के उत्तरदायी होंगे।

14. जिन विषयों का उल्लेख इस योजना में नहीं हो और मठ के हित में आवष्यक हो, तो उन बिन्दुओं पर न्यास समिति की बैठक में प्रस्ताव पारित कर पर्षद के पास अनुमोदन हेतु भेजेगी।

15. गोवंष एवं अन्य पशुओं और उनके प्रति होने वाली क्रुरता, पशु क्रुरता निवारण अधिनियम 1960 की धारा-11, एवं भारतीय दंड संहिता की धारा-428 व 429 के तहत दंडनीय अपराध है। अतः न्यास/मंदिर/मंठ आदि में रहने वाले गोवंष एवं अन्य पशुओं (गोवंष/गोधन) को बेसहारा खुला छोड़ना/भोजन नहीं देना/ऐसा कोई कार्य करना जिससे किसी पशु के प्रति क्रुरता एवं परिणाम वध/मृत्यु होता हो या ऐसे कार्यो को बढ़ावा मिलता हो ऐसा कोई कार्य कोई भी न्यासधारी/सेवायत/महंत या न्यास समिति के सदस्यों द्वारा नहीं किया जायेगा।

16. इस योजना में परिवर्तन, परिवर्द्धन या संषोधन तथा आकस्मिक रिक्तियों की पूर्ति का अधिकार पर्षद में निहित होगा।

17. न्यास समिति द्वारा अपने कार्यकलापों, आय-व्यय एवं न्यास में किये गये विकास के कार्यो से प्रत्येक तीन माह पर पर्षद को अवगत कराना आवष्यक है।

18. न्यास समिति के उपाध्यक्ष, सचिव, कोषाध्यक्ष एवं सदस्योें को अधिसूचना की तिथि से एक माह के अन्दर नोटरीकृत स्व-घोषणा हलफनामा पर्षद में दाखिल करना अनिवार्य है कि वे उसी क्षेत्र के निवासी है, उनका कोई आपराधिक इतिहास नहीं है और यदि विषय-वस्तु गलत है, तो वह कानून के अनुसार 'बोर्ड' द्वारा दंडनीय होगें।

उपरोक्त वर्णित न्यास समिति का कार्य-काल अधिसूचना निर्गत होने की तिथि से 05 वर्ष का होगा। उक्त आदेष के आलोक मेें राजस्व अभिलेख में संबंधित भूमि ''श्री षिव पार्वती मंदिर, ग्राम-हिलालपुर मदारपुर, अँचलथाना-हाजीपुर, जिला-वैषाली,'' के नाम से ही रहेगा, इसमें किसी प्रकार को कोई परिवर्तन नहीं किया जायेगा। नोटः-1) न्यास समिति/पदाधिकारी/सदस्य को न्यास की कोई भी सम्पत्ति/भूमि का हस्तान्तरण/ बदलैन/विक्रय/पट्‌टा/लीज आदि पर देने या किसी प्रकार से न्यास सम्पत्ति का दुरूपयोग करने का अधिकार नहीं होगा। अगर वे ऐसा करते हैं तो शुन्य वो अवैध होगा तथा न्यास समिति के विरूद्ध विधि-सम्मत कार्रवाई की जा सकती है।
