स०सं0-01/स्था० क्षे०-492/2025-1452—भारत के संविधान के अनुच्छेद-309 के परन्तुक के अधीन प्रदत शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार ईख पर्यवेक्षक संवर्ग में भर्ती, प्रोन्नति एवं सेवा शर्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते है :-

।ः-

(i) यह नियमावली ''बिहार ईख पर्यवेक्षक संवर्ग (भर्ती, प्रोन्नति एवं सेवा शर्ते) नियमावली, 2025''कही जा सकेगी।

(ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (iii) यह राजकीय गजट में प्रकाशन की तिथि से प्रवृत होगा।

से अभिप्रेत है बिहार ईख पर्यवेक्षकों का संवर्ग;

(i) से अभिप्रेत है बिहार राज्य, (ii) से अभिप्रेत है बिहार के राज्यपाल; (iii) से अभिप्रेत है बिहार सरकार; (iv) से अभिप्रेत है बिहार सरकार का गन्ना उद्योग विभाग; (v) (vi) से अभिप्रेत है बिहार ईख पर्यवेक्षक का संवर्ग, (vii) से अभिप्रेत है बिहार कर्मचारी चयन आयोग; (viii) से अभिप्रेत है बिहार ईख पर्यवेक्षक संवर्ग में नियुक्त होकर कार्यरत व्यक्ति; (ix) 'प्राधिकार' से अभिप्रेत है ईखायुक्त, बिहार;

(i) यह एक राज्य स्तरीय सवंर्ग होगा। गन्ना उद्योग विभाग इसका नियंत्री विभाग होगा। (ii) इस संवर्ग की संरचना निम्नवत्‌ होगीः-

(iii) इस संवर्ग का स्वीकृत बल एवं वेतनमान/वेतनस्तर वहीं होगा, जैसा समय-समय पर इस संवर्ग के लिए राज्य सरकार द्वारा स्वीकृत किया जाएगा। (i) इस संवर्ग के ईख पर्यवेक्षक के पद पर नियुक्ति आयोग द्वारा प्रतियोगिता परीक्षा के आधार पर अनुषंसित अभ्यर्थियों की सीधी भर्ती से होगी। (ii) प्रत्येक वर्ष 1 ली अप्रैल को कोटि में स्वी—त पदों के विरूद्ध सीधी नियुक्ति के लिए रिक्त पदों की गणना की जायेगी और 30 अप्रैल तक रिक्तियों की आरक्षण कोटिवार अधियाचना विभाग द्वारा, सक्षम प्राधिकार के माध्यम से, आयोग को प्रेषित कर दी जाएगी।

(iii) सीधी नियुक्ति के लिए न्यूनतम शैक्षणिक योग्यता मान्यता प्राप्त कृषि विश्वविद्यालय संस्थान/केन्द्रीय विश्वविद्यालय (कृषि संकाय) से कृषि विज्ञान में स्नातक की डिग्री होगी। (iv) आवेदन आमंत्रित करने वाले वर्ष के पहली अगस्त को न्यून्तम आयु 21 (इक्कीस) वर्ष होगी और अधिकतम उम्र सीमा वही होगी जो सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी भर्ती के लिए समय-समय पर विनिश्चित की जाय। (v) ।- सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी नियुक्ति के लिए, समय-समय पर, अवधारित आरक्षण प्रावधान लागू होंगे।

(vi) प्रतियोगिता परीक्षा के विषय तथा पाठ्यक्रम का निर्धारण आयोग द्वारा विभाग के परामर्श से किया जायेगा।

- (i) सेवा में सीधी भर्ती से नियुक्त प्रत्येक सदस्य पदग्रहण की तिथि से एक वर्ष के लिए परिवीक्षा पर रहेगा। परिवीक्षा अवधि में सेवा संतोषजनक नहीं रहने पर इसे अभिलिखित किये जाने वाले कारणों से एक और वर्ष तक विस्तारित किया जा सकेगा। विस्तारित अवधि में भी सेवा संतोषप्रद नहीं पाया जाय तो ऐसे सदस्यों की सेवा समाप्त की जा सकेगी। - बिहार ईख पर्यवेक्षक संवर्ग में नियुक्त सदस्यों को बिहार सरकारी सेवकों की परिवीक्षा अवधि नियमावली, 2024 में यथानिर्धारित प्रशिक्षण प्राप्त करना होगा। ।-सीधी भर्ती से नियुक्त सदस्यों को केन्द्रीय परीक्षा समिति, राजस्व पर्षद, बिहार द्वारा यथानिर्धारित विभागीय परीक्षा में उत्तीर्ण होना अनिवार्य होगा। विभागीय परीक्षा के विषय, पाठ्‌यक्रम एवं प्रक्रिया का निर्धारण केन्द्रीय परीक्षा समिति, राजस्व पर्षद द्वारा विभाग के परामर्श एवं सामान्य प्रशासन विभाग की सहमति से किया जाएगा। ।- परिवीक्षा अवधि पूरी करने, विभागीय परीक्षा में उत्तीर्णता प्राप्त करने, विनिश्चित प्रशिक्षण कार्यकम के संतोषप्रद रूप से पूर्ण किये जाने तथा सेवा स्वच्छ पाये जाने पर सीधी नियुक्ति के सदस्यों की सेवा संपुष्ट की जाएगी।

।-सदस्यों की वरीयता का अवधारण सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्धारित नीति के आलोक में की जाएगी।

(i) इस नियमावली के नियमों का निर्वचन विभाग द्वारा, आवश्यकतानुसार सामान्य प्रशासन विभाग, विधि विभाग अथवा वित्त विभाग के परामर्श से, किया जा सकेगा।

(ii) विभाग, विधि विभाग के परामर्श से, इस नियमावली के किसी नियम को लागू करने में आने वाली कठिनाई का निराकरण, राजपत्र में समुचित आदेश, जो इस नियमावली के प्रावधानों से असंगत न हो, के प्रकाशन द्वारा, कर सकेगा।

(iii) जिन विषयों का प्रावधान इस नियमावली में नहीं किया गया है, उनके सम्बन्ध में समकक्ष स्तर के कर्मियाें के लिए राज्य सरकार द्वारा तत्समय प्रवृत संहिता/नियमावली/ संकल्प/अनुदेश में किये गये प्रावधान इस सेवा के संदर्भ में लागू माने जायेंगे।3 (cid:464)बहार गजट (असाधारण), 24 िसत(cid:224)बर 2025 -

(i) इस संवर्ग के कर्मियों की नियुक्ति/सेवा शर्त संबंधी पूर्व में निर्गत सभी परिपत्र/अनुदेश/ संकल्प एतद्‌ द्वारा निरसित किये जाते हैं।

(ii) ऐसे निरसन के होते हुए भी, पूर्व निर्गत परिपत्र/अनुदेश/संकल्प के अधीन किया गया कुछ भी, या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया, या की गयी समझी जायेगी मानो यह नियमावली उस दिन प्रवृत्त थी, जिस दिन वैसा कुछ किया गया या वैसी कोई कार्रवाई की गयी थी।

No. 01/Estb.fild-492/2025-1452—In exercise of the powers conferred under the proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following rules to regulate the Bihar Sugarcane Supervisor Cadre (Recruitment, Promotion and Service Conditions):-

1. Short title, extent and commencement.—

(i) These rules may be called "Bihar Sugarcane Supervisor Cadre (Recruitment, Promotion and Service Conditions) Rules, 2025".

(ii) It shall extend to the whole of the State of Bihar. (iii) It shall come into force from the date of its publication in the Official Gazette.

2. Definitions.-In these rules, unless the context otherwise requires.—

(i) 'State' means the State of Bihar, (ii) 'Governor' means the Governor of Bihar; (iii) 'Government' means the Government of Bihar; (iv) 'Department' means the Sugar Industry Department of the Government of Bihar;

(v) 'Bihar Sugarcane Supervisor Cadre' means the cadre of Sugarcane Supervisors of Bihar;

(vi) 'Cadre' means the cadre of Bihar Sugarcane Supervisor, (vii) 'Commission' means the Bihar Staff Selection Commission; (viii) 'Member' means a person appointed and working in the Bihar Sugarcane Supervisor Cadre;

(ix) 'Appointment' 'Authority' means the Commissioner of Bihar;

3. Cadre Control.—

(i) It will be a state level cadre. Sugarcane Industry Department will be its controlling department.

as approved by the State Government for this cadre from time to time.

4. Direct Recruitment.—

(i) Appointment to the post of Sugarcane Supervisor of this cadre shall be made by direct recruitment of the candidates recommended by the Commission on the basis of competitive examination.

(ii) The vacant posts for direct recruitment against the sanctioned posts in the category shall be calculated on 1st April every year and the requisition for4 (cid:464)बहार गजट (असाधारण), 24 िसत(cid:224)बर 2025 reservation category wise vacancies shall be sent by the Department to the Commission through the competent authority by 30th April.

(iii) Educational Qualification.— The minimum educational qualification for direct recruitment shall be Bachelor's Degree in Agricultural Science from a recognized Agricultural University Institute/Central University (Faculty of Agriculture).

(iv) Age limit.— The minimum age shall be 21 (twenty one) years as on 1st August of the year in which applications are invited and the maximum age limit shall be the same as may be determined by the General Administration Department from time to time for direct recruitment to the State Government services.

(v) Reservation.— The reservation provisions as determined by the General Administration Department, from time to time, for direct appointment to the State Government services shall apply.

(vi) The subjects and syllabus of the competitive examination will be decided by the Commission in consultation with the department.

5. Probation.— Every member appointed to the Service by direct recruitment shall be on probation for one year from the date of joining. If the service is not found satisfactory during the probation period, it may be extended by one more year for reasons to be recorded in writing. If the service is not found satisfactory even in the extended period then the services of such members can be terminated.

6. Training.— Members appointed in the Bihar Sugarcane Supervisor Cadre shall be trained as per the Bihar Government Servants Probation Period Rules, The training as prescribed will have to be completed in 2024.

7. Departmental Examination.— It will be compulsory for the members appointed through direct recruitment to pass the departmental examination as prescribed by the Central Examination Committee, Revenue Board, Bihar. The subjects, syllabus and procedure of the departmental examination will be determined by the Central Examination Committee, This will be done by the Revenue Board in consultation with the department and with the consent of the General Administration Department.

8. Confirmation.— The service of direct appointment members will be confirmed after completing the probation period, passing the departmental examination, satisfactorily completing the prescribed training program and on their service being found clean.

9. Determination of seniority.— The seniority of the members shall be determined in the light of the policy laid down by the General Administration Department from time to time.

10. Miscellaneous.—

(i) The rules of these rules may be interpreted by the Department, as necessary, in consultation with the General Administration Department, Law Department or Finance Department.

(ii) The Department may, in consultation with the Law Department, remove any difficulty arising in the application of any rule of these rules by publishing appropriate order in the Official Gazette, not inconsistent with the provisions of these rules.

(iii) In respect of matters for which provision has not been made in these rules, the provisions made by the State Government in the Code/Rules/Resolutions/Instructions for the time being in force for employees of equivalent level shall be deemed to be applicable in reference to this service.

11. Repeal and avoidance.—

(i) All circulars/instructions/resolutions issued earlier regarding appointment/ service conditions of the personnel of this cadre are hereby repealed.

(ii) Notwithstanding such repeal, anything done or any action taken under the earlier issued circular/instruction/resolution shall be deemed to have been done or taken under these rules as if these rules were in force on the day on which such thing was done or any action was taken.
