(सं0 पटना 1590) पटना, सोमवार, 6 अ(cid:200)तूबर 2025 ———— vf/klwpuk 4 vDrwcj 2025 1996—भारत के संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल राज्य के सैनिक कल्याण निदेशालय में निदेशक एवं सहायक निदेशक तथा जिला सैनिक कल्याण कार्यालयों में जिला सैनिक कल्याण पदाधिकारी एवं सहायक जिला सैनिक कल्याण पदाधिकारी के पदों पर पूर्व सैन्य पदाधिकारियों की भर्त्ती एवं सेवा शर्त्तो को विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैं :-

कही जा सकेगी। (1) यह नियमावली '' (2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में प्रकाशन की तिथि से प्रवृत्त होगी।

2. इस नियमावली में जब तक किसी संदर्भ में अन्यथा अपेक्षित न हो;

(क) ''राज्य'' से अभिप्रेत है बिहार राज्य ; (ख) ''राज्य सरकार'' से अभिप्रेत है बिहार सरकार ; (ग) ''विभाग'' से अभिप्रेत है गृह विभाग, बिहार ; (घ) ''नियुक्ति प्राधिकार'' से अभिप्रेत है बिहार कार्यपालिका नियमावली, 1979 में यथा प्रावधानित नियुक्ति प्राधिकार;

(ङ) ''सैनिक कल्याण निदेशालय'' से अभिप्रेत है गृह विभाग, बिहार सरकार के अधीन सैनिकों, पूर्व सैनिकों और उनके विधवाओं/आश्रितों के कल्याणार्थ गठित निदेशालय ;

(च) जिला सैनिक कल्याण कार्यालय से अभिप्रेत है राज्य के प्रत्येक जिला में अवस्थित जिला सैनिक कल्याण कार्यालय ;

(छ) ''केन्द्रीय सैनिक बोर्ड'' से अभिप्रेत है रक्षा मंत्रालय, भारत सरकार के अधीन गठित केन्द्रीय सैनिक बोर्ड ;

(ज) ''पूर्व सैन्य पदाधिकारी'' से अभिप्रेत है भारत के सशस्त्र सैन्य बलों, यथा-सेना, नौसेना तथा वायु सेना के ब्रिगेडियर/कर्नल/लेफ्टिनेन्ट कर्नल एवं समतुल्य रैंक के अवकाश प्राप्त/सेवानिवृत्त/कमीशंड पदाधिकारी, जिन्हें पूर्व सैनिक का दर्जा प्राप्त है ;

2 (झ) ''निदेशक'' से अभिप्रेत है राज्य सरकार, गृह विभाग के अधीन सैनिक कल्याण निदेशालय के निदेशक ;

() ''सहायक निदेशक'' से अभिपे्रत है राज्य सरकार गृह विभाग के अधीन सैनिक कल्याण निदेशालय के सहायक निदेशक ;

(ट) ''जिला सैनिक कल्याण पदाधिकारी'' से अभिप्रेत है राज्य में अवस्थित जिला सैनिक कल्याण कार्यालयों के कार्यालय प्रधान ;

(ठ) सहायक जिला सैनिक कल्याण पदाधिकारी से अभिप्रेत है राज्य में अवस्थित जिला सैनिक कल्याण कार्यालयों के कार्यालय उप प्रधान ;

(ड) ''चयन समिति'' से अभिप्रेत है नियम-4 (ख) के प्रावधान के अधीन गठित समिति ;

3. -

निर्धारित किया जाय।

(ख) इस संवर्ग के सभी पदों पर पूर्व सैन्य पदाधिकारियों की नियुक्ति की जायेगी। परन्तु पूर्व सैन्य पदाधिकारियों की अनुपलब्धता के कारण पद/पदों के रिक्त रहने की स्थिति में राज्य सरकार द्वारा भारतीय प्रशासनिक सेवा/बिहार प्रशासनिक सेवा/बिहार सचिवालय सेवा के समकक्ष स्तर के पदाधिकारियों की प्रतिनियुक्ति या अतिरिक्त प्रभार उक्त पद/पदों पर की जा सकेगी। 4. - (क) पूर्व सैन्य पदाधिकारियों की नियुक्ति इस संवर्ग के पदों पर इस नियम के उपनियम (ख) में उल्लिखित चयन समिति की अनुशंसा के आधार पर की जायेगी।

(ख) सैनिक कल्याण निदेशालय में निदेशक एवं सहायक निदेशक तथा जिला सैनिक कल्याण कार्यालय में जिला सैनिक कल्याण पदाधिकारी एवं सहायक जिला सैनिक कल्याण पदाधिकारी के पदों पर नियुक्ति हेतु चयन समिति का गठन निम्न रूपेण किया जायेगा :-

अध्यक्ष सदस्य

(i) मुख्य सचिव, बिहार, पटना - (ii) अपर मुख्य सचिव/प्रधान सचिव/सचिव,

गृह विभाग, बिहार -

सदस्य

(iii) राज्य सरकार द्वारा मनोनीत तीन (3) सदस्य -

(जो संयुक्त सचिव से अन्यून पंक्ति के होंगे और इनमें कम से कम एक सदस्य अनुसूचित जाति या अनुसूचित जनजाति तथा एक अल्पसंख्यक वर्ग के प्रतिनिधि होंगे)

सदस्य

(iv) पूर्व-सैनिक कल्याण विभाग, रक्षा मंत्रालय,

भारत सरकार के प्रतिनिधि-

सदस्य

(v) सचिव, केन्द्रीय सैनिक बोर्ड अथवा उनके

प्रतिनिधि -

(vi) निदेशक, सैनिक कल्याण निदेशालय - सदस्य-सचिव (ग) राज्य सरकार उपलब्ध रिक्तियों के विरूद्ध केन्द्रीय सैनिक बोर्ड से नियुक्ति हेतु पूर्व सैन्य पदाधिकारियों के नामों के पैनल के लिए अनुरोध करेगी। सचिव, केन्द्रीय सैनिक बोर्ड तीनों सेवाओं के मुख्यालयों से पदाधिकारियों के नाम प्राप्त करेंगे अथवा यथोचित रीति से पैनल का गठन करेंगे एवं राज्य सरकार को उपलब्ध करायेंगे।

(घ) चयन समिति द्वारा केन्द्रीय सैनिक बोर्ड के माध्यम से प्राप्त पूर्व सैन्य पदाधिकारियों के नामों के उपर्युक्त पैनल से रिक्त पदों पर नियुक्ति हेतु विचार किया जायेगा।

(ङ) राज्य सरकार, यदि स्थानीय स्तर पर कोई पूर्व सैन्य पदाधिकारी उपलब्ध हों, तो उनके नाम को पैनल में शामिल करने की अनुशंसा केन्द्रीय सैनिक बोर्ड से कर सकेगी।

(च) प्रस्तावित पदों पर चयन/नियुक्ति हेतु पात्रता मानदंड एवं प्रक्रिया का निर्धारण निम्न प्रकार होगाः-(cid:464)बहार गजट (असाधारण) 6 अ(cid:200)तूबर 2025 (क) अन्तर्वीक्षा - (ख) सेवा इतिहास -

अंक उपरोक्त वर्णित कंडिका (i) से (vii) के पुरस्कार विजेताओं के लिए एक ही श्रेणी में एक बार या उससे अधिक बार पुरस्कार प्राप्त करने की स्थिति में भी विजेताओं को मात्र निर्धारित अधिकतम अंक ही प्राप्त होगा। 5.

(क) निदेशक के पद के लिए भूतपूर्व ब्रिगेडियर या नौसेना/वायु सेना के समतुल्य रैंक के पूर्व पदाधिकारी का चयन प्राथमिकता के आधार पर किया जायेगा। ब्रिगेडियर या समतुल्य रैंक के पदाधिकारी के अनुपलब्ध होने की स्थिति में कर्नल या नौसेना/वायु सेना के समतुल्य रैंक के पूर्व पदाधिकारी का चयन किया जा सकेगा।

(ख) सहायक निदेशक के पद के लिए भूतपूर्व कर्नल रैंक या नौसेना/वायु सेना के समतुल्य रैंक के पूर्व पदाधिकारी का चयन प्राथमिकता के आधार पर किया जायेगा।

(ग) जिला सैनिक कल्याण पदाधिकारी के पदों के लिए भूतपूर्व कर्नल रैंक या नौसेना/वायु सेना के समतुल्य रैंक के पूर्व पदाधिकारी का चयन प्राथमिकता के आधार पर किया जायेगा।(cid:464)बहार गजट (असाधारण) 6 अ(cid:200)तूबर 2025 4 (घ) सहायक जिला सैनिक कल्याण पदाधिकारी के पदों के लिए भूतपूर्व लेफ्टिनेंट कर्नल रैंक या नौसेना/वायु सेना के समतुल्य रैंक के पूर्व पदाधिकारी का चयन प्राथमिकता के आधार पर किया जायेगा।

(ङ) भूतपूर्व सैन्य अधिकारी की अनुपलब्धता की स्थिति में भूतपूर्व सैनिक की विधवा/आश्रित को इन पदों के लिए विचार किया जा सकता है। बशर्ते इन पदों की योग्यता के लिए उन्हें निम्नलिखित अतिरिक्त मानदंडों को पूरा करना आवश्यक होगा :- (i) (कक) - न्यूनतम 55 वर्ष रिक्ति वर्ष की पहली जनवरी को। (कख) केंद्र/राज्य सरकार द्वारा मान्यता प्राप्त विश्वविद्यालय से स्नातकोत्तर उत्तीर्ण। (कग) -किसी केन्द्र/राज्य सरकार के संगठन/ सार्वजनिक उपक्रम में कम से कम निदेशक/समकक्ष के पद पर कार्य किया हो और सातवें केन्द्रीय वेतन आयोग में वेतन न्यूनतम वेतन स्तर 13 के बराबर हो।

(ii) (कक) - न्यूनतम 50 वर्ष रिक्ति वर्ष की पहली जनवरी को। (कख) केन्द्र/राज्य सरकार द्वारा मान्यता प्राप्त विश्वविद्यालय से स्नातक उत्तीर्ण। (कग) - केन्द्र/राज्य सरकार के संगठन/ सार्वजनिक उपक्रम में कम से कम संयुक्त निदेशक/समकक्ष के पद पर कार्य किया हो और सातवें केन्द्रीय वेतन आयोग में वेतन न्यूनतम वेतन स्तर 12 के बराबर हो।

(iii) सैन्य उपक्रमों में कार्यानुभव वाले विधवा/आश्रित को प्राथमिकता दी जा सकेगी। -

(क) किसी भी रिक्ति वर्ष की पहली जनवरी सभी पदों के लिए आवेदकों की पात्रता की गणना के लिए महत्वपूर्ण तिथि होगी।

(ख) निदेशक के पद पर नियुक्ति हेतु अधिकतम आयु सीमा रिक्ति वर्ष की पहली जनवरी के आधार पर 60 वर्ष होगी।

(ग) सहायक निदेशक के पद पर नियुक्ति हेतु अधिकतम आयु सीमा रिक्ति वर्ष की पहली जनवरी के अनुसार 59 वर्ष होगी।

(घ) जिला सैनिक कल्याण पदाधिकारी एवं सहायक जिला सैनिक कल्याण पदाधिकारी के पदों पर नियुक्ति हेतु अधिकतम आयु सीमा रिक्ति वर्ष की पहली जनवरी के अनुसार 59 वर्ष होगी।

(क) निदेशक, सैनिक कल्याण निदेशालय का कार्यकाल 5 वर्षों का होगा। 5 वर्षों के उपरान्त राज्य सरकार द्वारा सेवा संतोषजनक पाये जाने पर इनकी सेवा विस्तार अधिकतम 65 वर्षों की आयु तक बढ़ायी जा सकेगी।

(ख) सहायक निदेशक, सैनिक कल्याण निदेशालय का कार्यकाल 5 वर्षों का होगा। 5 वर्षों के उपरान्त राज्य सरकार द्वारा सेवा संतोषजनक पाये जाने पर इनकी सेवा विस्तार अधिकतम 65 वर्षों की आयु तक बढ़ायी जा सकेगी।

(ग) जिला सैनिक कल्याण पदाधिकारी एवं सहायक जिला सैनिक कल्याण पदाधिकारी का कार्यकाल 5 वर्षों का होगा। 5 वर्षों के उपरान्त राज्य सरकार द्वारा सेवा संतोषजनक पाये जाने पर इनकी सेवा विस्तार अधिकतम 65 वर्षों की आयु तक बढ़ायी जा सकेगी।

(क)

सैनिक कल्याण निदेशालय के निदेशक, सहायक निदेशक और जिला सैनिक कल्याण कार्यालय के जिला सैनिक कल्याण पदाधिकारी तथा सहायक जिला सैनिक कल्याण पदाधिकारी के रूप में नियुक्त भूतपूर्व सैन्य पदाधिकारियों की स्थिति निम्न प्रकार होगीः- निदेशक, जिन्हें निदेशालय के स्वतंत्र प्रमुख का दर्जा (Status) प्राप्त होगा तथा राज्य सरकार के अन्य विभागों के सदृश प्रशासनिक एवं वित्तीय शक्तियां प्राप्त होंगी। उन्हें पदेन अपर सचिव का दर्जा (Status) प्राप्त होगा।

(ख)

ः- सहायक निदेशक, सैनिक कल्याण निदेशालय में पदस्थापित होंगे। उन्हें पदेन संयुक्त सचिव का दर्जा (Status) प्राप्त होगा। वे सीधे निदेशक, सैनिक कल्याण निदेशालय के अधीन कार्य एवं रिपोर्ट करेंगे।

(ग)

ः- जिला सैनिक कल्याण पदाधिकारी को जिला प्रशासन के अन्य कार्यालय प्रधानों की भाँति प्रशासनिक और वित्तीय शक्तियाँ प्राप्त होंगी। उन्हें पदेन संयुक्त सचिव का दर्जा (Status) प्राप्त(cid:464)बहार गजट (असाधारण) 6 अ(cid:200)तूबर 2025 5 होगा। वे सीधे राज्य के निदेशक, सैनिक कल्याण निदेशालय के अधीन कार्य करेंगेे। वे अध्यक्ष, जिला सैनिक बोर्ड (जिला पदाधिकारी) को रिपोर्ट करेंगे। किंतु सहायक जिला सैनिक कल्याण पदाधिकारी संबंधित जिला सैनिक कल्याण पदाधिकारी के अधीन कार्य करेंगे तथा उन्हें पदेन उप सचिव का दर्जा (Status) प्राप्त होगा।

- बिहार राज्य में प्रवृत्त बिहार आरक्षण अधिनियम के प्रावधान लागू होंगे। - बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 एवं समय-समय पर सरकार द्वारा अधिसूचित/जारी किये जाने वाले प्रावधान इस संवर्ग के सदस्यों पर लागू होंगे। - इस नियमावली या इसके अधीन जारी किये गये आदेशों से अनाच्छादित मामलों के संबंध में, इस संवर्ग के सदस्य राज्य सरकार के समुचित स्तर के कार्मिकों के संबंध में लागू नियम, विनियमों और आदेशों द्वारा शासित होंगे। - इस नियमावली के कार्यान्वयन में होने वाली कठिनाइयों के निराकरण के लिए समय-समय पर सरकार अधिसूचना द्वारा यथा आवश्यक ऐसे सामान्य या विशेष निदेश विधि विभाग/वित्त विभाग/सामान्य प्रशासन विभाग के परामर्श के पश्चात्‌ जारी कर सकेगी, जो अधिनियम एवं इस नियमावली के प्रावधानों से संगत हो।

- (क) एतद्‌ द्वारा ''बिहार पूर्व सैनिक पदाधिकारी सेवा नियमावली, 2016'', इसके तहत निर्गत ''बिहार सैनिक कल्याण निदेशक तथा जिला सैनिक कल्याण पदाधिकारी चयन विनियमावली, 2017'' एवं अन्य अधिसूचना/ संकल्प/परिपत्र आदि निरसित किये जाते हैं।

(ख) ऐसे निरसन के होते हुये भी उक्त अधिसूचना/संकल्प द्वारा या उसके अधीन की गई कार्रवाई इस नियमावली के अधीन प्रदत्त शक्तियों के प्रयोग में की गई समझी जायेगी, मानो यह नियमावली उस दिन प्रवृत्त थी, जिस दिन ऐसा कार्य किया गया या ऐसी कार्रवाई की गयी थी।

The 4th October 2025 SKN/01/09/2011/1997—In exercise of the powers conferred under the proviso to Article 309 of the Constitution of India, the Governor of Bihar, is hereby pleased to make the following Rules to regulate the recruitment and service conditions of Ex-Servicemen Officers to the posts of Director, Assistant Director in Sainik Kalyan Nideshalaya and District Sainik Welfare Officers and Assistant District Sainik Welfare Officers in the District Sainik Welfare Offices of the State :-

1. Short title, extent and commencement.

(1) These Rules may be called as "The Bihar Ex-Servicemen Officer Service Rules, 2025".

(2) It shall extend to whole of the State of Bihar. (3) It shall come into force from the date of publication in the official Gazette.

2. Definitions. In these Rules, unless the context otherwise requires :-

(a) "State" means the State of Bihar; (b) "State Government" means the Government of Bihar; (c) "Department" means Home Department, Bihar; (d) "Appointment Authority" means Appointment authority as provided in the Bihar Executive Rules, 1979 ;

6 (e) "Sainik Kalyan Nideshalaya" means the Nideshalaya constituted under Home Department, Govt of Bihar for the welfare of the servicemen, Ex- servicemen and their widows/dependents ;

(f) "Zila Sainik Kalyan Karyalaya" means the Zila Sainik Kalyan Karyalaya constituted in every district of the state;

(g) "Kendriya Sainik Board" means Kendriya Sainik Board (KSB) constituted under the Ministry of Defence, Government of India;

(h) "Ex-servicemen Officers" means retired commissioned officers of the rank of Brigadier/ Colonel/ Lieutenant Colonel and equivalent rank of Indian Armed Forces viz Army, Navy and Air Force; who have the status of Ex servicemen.

(i) "Director" means Director of Sainik Kalyan Nideshalaya under Home Department, Government of Bihar;

(j) "Assistant Director" means Assitant Director of Sainik Kalyan Nideshalaya under Home Department, Bihar;

(k) "District Sainik Welfare Officer" means Head of the office of District Sainik Welfare situated in the districts of the State;

(l) "Assistant District Sainik Welfare Officer" means Deputy Head of the office of District Sainik Welfare situated in the districts of the State;

(m) "Selection Committee" means Selection committee constituted under the provision of Rules 4(b);

3. Constitution of the Cadre.

(iii) Assistant Director -do- Gazetted - (iv) Director -do- Gazetted - (b) Ex-servicemen Officers will be appointed to all the posts in this cadre : Provided in case of remaining vacant posts due to non-availability of Ex-servicemen officers, deputation/ additional charge may be given to the officers of Indian Administrative Service/Bihar Administrative Service/ Bihar Secretariat Service of equivalent rank, by the State Government. 4. Recruitment.

(a) The appointment of Ex-servicemen Officers in this cadre shall be made on the basis of recommendations of the Selection Committee mentioned in sub rule (b) of this rule.

(b) Constitution of the Selection Committee for appointment for the post of Director and Assistant Director in the Sainik Kalyan Nideshalaya and to the posts of District Sainik Welfare Officers and Assistant District Sainik Welfare Officers in the offices of the District Sainik Welfare shall be made as follows :-

(i) Chief Secretary, Bihar, Patna - Chairman Member (ii) Additional Chief Secretary/ Principal

Bihar

(iii) Three members nominated by the State

representative (vi) Director of Sainik Kalyan Nideshalya - Member - Secretary (c) The State Government shall request for panel of names of ex-servicemen officer for the appointment against available vacancies to the Secretary, Kendriya Sainik Board. The Secretary, Kendriya Sainik Board shall obtain the names of officers for panel from the Headquarters of the three services or constitute panels in appropriate manner and make it available to the State Government.

(d) The appointment on the vacant post shall be considered by the Selection Committee, from the aforesaid panel of names of Ex-servicemen officers obtained from the Kendriya Sainik Board.

(e) The State Government may recommend the names of local Ex-servicemen officers, if available, to the Secretary, Kendriya Sainik Board for inclusion of their names in the panel.

-01 Mark - Every Course - Every Instructor grading -01 Addl Mark In case of receipt of one or more than one award in same category mentioned in Para (i) to (vii) above, the awardee shall receive only maximum assigned marks.

5. Qualifications.

(a) Ex-servicemen officer of the rank of Brigadier or equivalent ranks of Navy or Air force will be selected on priority basis for the post of Director. In case of non availability of the officers of the rank of Brigadier or equivalent rank, officers of the rank of Colonel or equivalent rank in Navy and Air force may be selected.

(b) Ex-servicemen officer of the rank of Colonel or equivalent ranks of Navy or Air force will be selected on priority basis, for the posts of the Assistant Director.

(c) Ex-servicemen officer of the rank of Colonel or equivalent ranks of Navy or Air force will be selected on priority basis, for the posts of the District Sainik Welfare Officer.

(d) Ex-servicemen officer of the rank of Lieutenant Colonel or equivalent ranks of Navy or Air force will be selected on priority basis, for the posts of the Assistant District Sainik Welfare Officer.

(e) A widow/dependent of ESM may be considered for these posts in case of non availability of an ESM officer. They should however meet the following additional criteria to be eligible for the post :-

(i) For the Post of Director, Sainik Kalyan Nideshalay.

(aa) Age. Minimum 55 years as on 1st January of the vacancy year. (ab) Educational Qualification. Post-Graduate from a

University recognized by Central/State Govt.

(ac) Experience. Should have undertaken duties in a post of not less than Joint Director/equivalent in a Central/ State Govt Organisation/ PSUs and last pay drawn should have been equivalent to at least Pay Level 13 of 7th Central Pay Commission (CPC).

(ii) For the Post of Assistant Director or District Sainik Welfare Officer or Assistant District Sainik Welfare Officer.

(aa) Age. Minimum 50 years as on 1st January of the vacancy

year.

(ab) Educational Qualification. Graduate from a University

recognized by Central/State Govt.

(ac) Experience. Should have undertaken duties in a post of not less than Director/ equivalent in a Central/ State Govt Organisation/ PSUs and last pay drawn should have been equivalent to at least Pay Level 12 of 7th Central Pay Commission (CPC).

(iii) Preference may be given to widows/dependents who have experience in Defence organizations.

6. Age.

(a) 1st January of any vacancy year will be the crucial date of reckoning for the eligibility of the applicants for all posts.

(b) The maximum age limit for the appointment to the post of Director shall be 60 years as on 1st January.

(c) The maximum age limit for the appointment to the post of Assistant Director shall be 59 years as on 1st January.

(d) The maximum age limit for the appointment to the post of District Sainik Welfare Officer and Assistant District Sainik Welfare Officer shall be 59 years as on 1st January.

7. Tenure of Service.

(a) The tenure of the Director, Sainik Kalyan Nideshalaya will be 5 years. After 5 years, if the service is found satisfactory by the State Government, their service may be extended up to a maximum age of 65 years.

(b) The tenure of the Assistant Director, Sainik Kalyan Nideshalaya will be 5 years. After 5 years, if the service is found satisfactory by the State Government, their service may be extended up to a maximum age of 65 years.

(c) The tenure of the District Sainik Welfare Officer and Assistant District Sainik Welfare Officer will be 5 years. After 5 years, if the service is found satisfactory by the State Government, their service may be extended up to a maximum age of 65 years.

8. Designation and Status of Director, Assistant Director, District Sainik Welfare Officer and Assistant District Sainik Welfare Officer. - The status of ESM officers appointed as Director and Assistant Director of Sainik Kalyan Nideshalay and District Sainik Welfare Officer and Assistant District Sainik Welfare Officer of Zila Sainik Kalyan Karyalaya shall be as follows :-

(a) Director, Sainik Kalyan Nideshalaya. The Director who will have the status of an independent head of the Directorate and will have administrative and financial powers similar to other departments of the State Government. He/She will have the status of an ex-officio Additional Secretary.

(b) Assistant Director, Sainik Kalyan Nideshalaya. Assistant Director, Sainik Kalyan Nideshalaya will have the status of an ex-officio Joint Secretary. He/She will work and report directly under the Director, Sainik Kalyan Nideshalaya.

10 (c) District Sainik Welfare Officer and Assistant District Sainik Welfare Officer. The District Sainik Welfare Officer and Assistant District Sainik Welfare Officer will have administrative and financial powers like other office heads of the district administration. He/She will have the status of an ex-officio Joint Secretary. They will work directly under the Director, Sainik Kalyan Nideshalaya. He/She would report to the Chairman, District Sainik Board (District Magistrate) But Assistant District Sainik Welfare Officer will work under the District Sainik Welfare Officer and He/She will have the status of an ex-officio Deputy Secretary.

9. Reservation. The provisions of the Bihar Reservation Act enforced in the State of Bihar shall apply.

10. Disciplinary Action. The provisions of Bihar Government service (Classfication, Control and Appeal) Rules, 2005 and provisions to be notified/issued by the Government, from time to time, shall be applicable to the members of this cadre.

11. Residuary Matters. With regard to matters not specifically covered by the orders, issued under these Rules, the members of the Cadre shall be governed by the Rules, Regulations and Orders applicable in respect of the personnel of appropriate level of the State Government.

12. Removal of difficulties. The Government may, after consultation of the Law Department/Finance Department/ General Administration Department, from time to time, issue such general or special direction as may be necessary to remove difficulties arising in the implementation of these Rules which is consistent with the provisions of the Act and these Rules.

13. Repeal & Savings.

(a) All notifications/resolutions issued earlier with respect to the "Bihar Ex- Serviceman Officers Rules, 2016", Director, Sainik Kalyan Nideshalaya Bihar and District Sainik Welfare Officers selection regulation, 2017 are hereby repealed.

(b) Notwithstanding such repeal, anything done or any action taken in exercise of any power conferred by or under the said notifications/resolutions shall be deemed to have been done or taken in exercise of the powers conferred by or under these rules as if these rules were in force on that day on which such thing or action was done or taken.
