सं. 576/एि(cid:200)जट/2025/एसडीआर/ख(cid:7003)ड-I—यतः नर्ना(cid:330)चन आयोग के (cid:366)ेस नोट (cid:366)ेस नोट सं. ईसीआई/ पीएन/316/2025 और सं. ईसीआई/पीएन/317/2025 दोनों नदनांक 06 अ(cid:387)ू बर, 2025 के (िcid:303)रए घोनषत नबहार र्नधान सभा के र्त(cid:330)मान साधारण नर्ना(cid:330)चन र्एं 7 रा(cid:475)ों के 8 र्नधानसभा नर्ना(cid:330)चन (cid:407)े(cid:361)ों (अनुल(cid:432)क के अनुसार) के उपचुर्नाों के नलए काय(cid:330)(cid:354)म की घोषणा कर दी गई है; और

2. यतः , लोक (cid:366)नतनननध(cid:533) अनधननयम 1951 (सं(cid:407)ेप म(cid:336) लो.(cid:366). अनधननयम, 1951) की धारा 126क म(cid:336) यह र्ननननद(cid:330)(cid:700) नकया गया है नक "(1) कोई भी (cid:681)(cid:304)(cid:389) कोई ननग(cid:330)म मत र्स(cid:337)(cid:407)ण नही ं करे गा और नकसी ननग(cid:330)म मत र्स(cid:337)(cid:407)ण के प(cid:303)रणाम का, ऐसी र्अनध के दौरान ोि नर्ना(cid:330)चन आयोग (cid:554)ारा इस संबंध म(cid:336) अनधसूनचत की ािए, न(cid:366)ंट या इले(cid:387)(cid:332) ॉननक मीनडया के मा(cid:559)म से (cid:366)कान या (cid:366)चार या नकसी भी (cid:366)कार की अ(cid:586) रीनत म(cid:336) (cid:366)सार नही ं करे गा।

(2) नर्ना(cid:330)चन आयोग, उपधारा (1) के (cid:366)योनि के नलए, नन(cid:635)नल(cid:304)खत को (cid:559)ान म(cid:336) रखते (cid:352)ए साधारण आदे (cid:554)ारा तारीख और समय अनधसूनचत करे गा, अा(cid:330)त :-

(क) साधारण नर्ना(cid:330)चन की दा म(cid:336),र् ह र्अनध मतदान के पहले नदन के संबंध म(cid:336) मतदान के नलए ननयत समय के आरं भ होने से ु(cid:348) होगी और सभी रा(cid:475)ों और संघ रा(cid:475) (cid:407)े(cid:361)ों म(cid:336) मतदान समा(cid:593) होने के आधे घंटे तक ािरी रहेगी;

(ख) नकसी उप-नर्ना(cid:330)चन या एक सा कराए ािने र्ाले अनेक उप-नर्ना(cid:330)चनों की दा म(cid:336) र्ह र्अनध मतदान के पहले नदन से ही मतदान के नलए ननयत समय के आरं भ होने से ु(cid:349) होगी और मतदान समा(cid:593) होने के प(cid:686)ात् आधे घंटे तक ािरी रहेगी:

परं तु नभ(cid:580)-नभ(cid:580) नदनों पर एक सा कराए ािनेर् ाले अनेक उप-नर्ना(cid:330)चनों की दा म(cid:336),र् ह र्अनध मतदान के पहले नदन के संबंध म(cid:336) मतदान के नलए ननयत समय के आरं भ होने से ु(cid:349) होगी और अंनतम मतदान समा(cid:593) होने के प(cid:686)ात आधे घंटे तक ािरी रहेगी।

(3) कोई (cid:681)(cid:304)(cid:389), ोि इस धारा के उपबंधों का उ(cid:671)ंघन करे गा ऐसी र्अनध के कार्राास से, ोि दोर् ष(cid:330) तक की हो सके गी या ुिमा(cid:330)ने से या दोनों से, दं डनीय होगा।"

3. अब, इसनलए, लोक (cid:366)नतनननध(cid:533) अनधननयम, 1951 की धारा 126क की उपधारा (1) के अधीन (cid:304)(cid:389)यों का (cid:366)योग करते (cid:352)ए नर्ना(cid:330)चन आयोग उ(cid:389) धारा की उप-धारा (2) के उपबंधों के (cid:778)न(cid:700)गत, 6 नव(cid:638)र, 2025 (गु(cid:348)वार) को पूवा(cid:330)(cid:741) 7:00 बजे तथा 11 नव(cid:638)र, 2025 (मंगलवार) को अपराहन 6:30 बेि के बीच की र्अनध को, ऐसी र्अनध के (cid:349)प म(cid:336) अनधसूनचत करता है नसिके दौरान ऊपर उ(cid:304)(cid:671)(cid:304)खत साधारण र्एं उप-नर्ना(cid:330)चनों के संदभ(cid:330) म(cid:336) नकसी भी (cid:366)कार के ए(cid:304)(cid:426)ट पोल का आयोनि करने ता न(cid:366)ंट या इले(cid:387)(cid:332) ॉननक मीनडया (cid:554)ारा इसके प(cid:303)रणाम के (cid:366)कान या (cid:366)चार र्अा नकसी भी अ(cid:586) तरीके से उसका (cid:366)चार-(cid:366)सार करने पर (cid:366)नतबंध होगा।

4. यह भी (cid:729)(cid:700) नकया ािता है नक लोक (cid:366)नतनननध(cid:533) अनधननयम, 1951 की धारा 126(1) (ख) के अधीन उपयु (cid:330)(cid:389) साधारण र्एं उप-नर्ना(cid:330)चनों के संबंध म(cid:336) मतदान की समा(cid:304)(cid:593) के नलए ननयत समय पर समा(cid:593) होनेर् ाली 48 घंटों कीर्अनध के दौरान नकसी भी इले(cid:387)(cid:332) ाननक मीनडया म(cid:336) नकसी भी ओनपननयन पोल या नकसी अ(cid:586) मतदान र्स(cid:337)(cid:407)ण के प(cid:303)रणामों सनहत नकसी भी (cid:366)कार के नर्ना(cid:330)चन संबंधी मामले के (cid:366)द(cid:330)न पर (cid:366)नतबंध होगा।

NOTIFICATION

No.576/EXIT/2025/SDR-Vol. I—Whereas, the schedule for the current general election to the Legislative Assembly of Bihar and bye-elections to 8 Assembly Constituencies in 7 States (as per annexure) has been announced by the Election Commission vide Press Notes No. ECI/PN/316/2025 and No. ECI/PN/317/2025 both dated 6th October, 2025; and

2. Whereas, Section 126A of the Representation of the People Act, 1951(in short R.P. Act, 1951) specifies that "(1) No person shall conduct any exit poll and publish or publicise by means of the print or electronic media or disseminate in any other manner, whatsoever, the result of any exit poll during such period, as may be notified by the Election Commission in this regard.

(2) For the purposes of sub-section (1), the Election Commission shall, by a general order.notify the date and time having due regard to the following, namely:

(a) in case of a general election, the period may commence from the beginning of the hours fixed for poll on the first day of poll and continue till half an hour after closing of the poll in all the States and Union territories:

(b) In case of a bye-election or a number of bye-elections held together, the period may commence from the beginning of the hours fixed for poll on and from the first day of poll and continue till half an hour after closing of the poll;

Provided that in case of a number of bye-elections held together on different days, the period may commence from the beginning of the hours fixed for poll on the first day of poll and continue till half an hour after closing of the last poll.

(3) Any person who contravenes the provisions of this section shall be punishable with imprisonment for a term which may extend to two years or with fine or with both"

3. Now, therefore, in exercise of the powers under sub-Section (1) of Section 126A of the R.P. Act, 1951, the Election Commission, having regard to the provisions of sub-Section (2) of the said Section, hereby notifies the period between 7:00 A.M on 6th November, 2025 (Thursday) and 6:30 PM on 11th November, 2025 (Tuesday) as the period during which conducting and publishing or publicizing exit poll by means of the print or electronic media or dissemination in any other manner whatsoever, the result of any exit poll in connection with the aforesaid General and bye elections, shall be prohibited.

4. It is further clarified that under Section 126(1)(b) of the R.P. Act, 1951, displaying any election matter including results of any opinion poll or any other poll survey, in any electronic media, would be prohibited during the period of 48 hours ending with the hours fixed for the conclusion of the poll in connection with the aforesaid general and bye-elections.
