(सं0 पटना 58) पटना, वृह(cid:232)पितवार, 15 जनवर(cid:547) 2026 मद्य निषेध, उत्पाद एवं निबंधन विभाग ———— अधिसूचना 13 जनवरी 2026 —आनन्द विवाह (संशोधन) अधिनियम, 2012 की धारा 6 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल निम्नलिखित नियमावली बनाते हैं- - (क) यह नियमावली ''बिहार आनन्द कारज विवाह निबंधन नियमावली, 2025'' कही जायेगी। (ख) इसका क्षेत्राधिकार सम्पूर्ण बिहार राज्य में होगा। (ग) यह नियमावली अधिसूचना निर्गत किये जाने की तिथि से प्रभावी होगी। - इस नियमावली में, जब तक प्रसंगवश अन्यथा अपेक्षित न हो-

(क) ʻʻअधिनियमʼʼ से अभिप्रेत है आनन्द विवाह अधिनियम, 1909। (ख) ''विवाह'' से अभिप्रेत है अधिनियम के प्रावाधानान्तर्गत सिख समुदाय में प्रचलित आनन्द कारज रीति से सम्पन्न विवाह। (ग) ''विवाह निबंधक'' से अभिप्रेत है निबंधन अधिनियम, 1908 (1908 का अधिनियम सं0-16) की धारा-6 अन्तर्गत नियुक्त अवर निबंधक।

(घ) ''अपीलीय प्राधिकार'' से अभिप्रेत है निबंधन अधिनियम, 1908 (1908 का अधिनियम सं0-16) की धारा-8 अन्तर्गत नियुक्त सहायक निबंधक महानिरीक्षक।

(च) निबंधन महानिरीक्षक से अभिप्रेत है निबंधन अधिनियम, 1908 (1908 का अधिनियम सं0-16) की धारा-3 अन्तर्गत नियुक्त निबंधन महानिरीक्षक। -इस नियमावली के प्रयोजनार्थ अपने-अपने क्षेत्रधिाकार के अन्तर्गत प्रत्येक अवर निबंधक एवं प्रत्येक जिला अवर निबंधक आनन्द कारज विवाह के निबंधक के अधिकार का प्रयोग एवं इसके कर्त्तव्यों का निर्वहन करेगा।(cid:464)बहार गजट (असाधारण) 15 जनवरी 2026 2 - (1) आनन्द कारज विवाह के पक्षकारों द्वारा नियम-08 में निर्दिष्ट शुल्क का भुगतान कर जिला अवर निबंधक या अवर निबंधक के कार्यालय में इस उद्देश्य के लिए रखे गए आनन्द कारज विवाह पंजी में विवाह से संबंधित विवरण दर्ज कराए जा सकते हैं।

(2) विवाह के निबंधन के लिए आवेदन इस नियम की अनुसूची में संलग्न प्रपत्र ''क'' में उस जिला अवर निबंधक या अवर निबंधक को किया जायेगा, जिसके क्षेत्राधिकार में विवाह अनुष्ठापित हुआ हो या जिसके क्षेत्राधिकार में पति स्थायी या अस्थायी रूप से निवास करता हो।

(3) विवाह निबंधन के आवेदन के साथ पक्षकार अपना आवासीय प्रमाण-पत्र, उम्र प्रमण-पत्र एवं आनन्द कारज विवाह के संपन्न होने से संबंधित प्रमाण-पत्र अनिवार्य रूप संलग्न करेंगे। आवेदन प्रस्तुत करने वाला व्यक्ति को आवेदन के लिए निम्नलिखित प्रपत्र में प्राप्ति रसीद दी जाएगी, जो टंकित या कम्प्यूटर जनित होगा-

बिहार आनन्द कारज विवाह निबंधन नियमावली, 2025 के तहत्‌--------------- (पति) तथा --------- ---- (पत्नी) के विवाह निबंधन के लिए प्रस्तुत आवेदन क्रमांक ----------/वर्ष--------- प्राप्त किया। दिनांक- -------------------------------- (हस्ताक्षर)

(विवाह निबंधक) -

(1) आनन्द कारज विवाह पंजी विभागीय साफ्टवेयर में तथा एक सौ पन्नों का बंधित जिल्द में भी होगा, जिसके पृष्ठ लगातार क्रमांकित होंगे जिसे जिला अवर निबंधक या अवर निबंधक द्वारा संधारित किया जायेगा।

(2) जिला अवर निबंधक या अवर निबंधक द्वारा प्रत्येक विवाह पंजी के आमुख पृष्ठ पर अपने हस्ताक्षर से पृष्ठों की संख्या को प्रमाणित किया जायेगा।

(3) प्रत्येक कैलेंडर वर्ष की समाप्ति पर, जिला अवर निबंधक या अवर निबंधक वर्ष के दौरान निबंधित आवेदनों की संख्या सत्यापित करेगा और जब भी ऐसी पंजी प्रविष्टियों से पूर्ण हो जाएगी तो जिला अवर निबंधक या अवर निबंधक द्वारा उस विशिष्ट पंजी में निबंधित आवेदनों की संख्या सत्यापित की जायेगी।

(4) जिला अवर निबंधक या अवर निबंधक द्वारा प्रयुक्त पंजियाँ क्रमांकित होंगी और कार्यालय के कैटलॉग पंजी में प्रविष्ट की जायेगी। - नियम-4 के तहत जिला अवर निबंधक या अवर निबंधक को किया गया प्रत्येक आवेदन पंजी में संधारित किया जायेगा। - (1) प्रत्येक आवेदन जिला अवर निबंधक या अवर निबंधक द्वारा पृष्ठांकित की जाएगी जिसके पीछे उनके द्वारा विधिवत हस्ताक्षरित निम्नलिखित पृष्ठांकित होगा-

आवेदन मेरे द्वारा दिनांक --------------------- को प्राप्त किया गया और इसे बिहार आनन्द कारज विवाह निबंधन नियमावली, 2025 के अन्तर्गत संधारित आनन्द कारज विवाह पंजी के क्रम संख्या -------- पृष्ठ ------- जिल्द --------------- पर पृष्ठांकित किया गया।

दिनांक ----------------------------- हस्ताक्षर (विवाह के निबंधक) (2) जिला अवर निबंधक/अवर निबंधक नियमावली के साथ संलग्न अनुसूची के प्रपत्र-च में आवेदन के 30 दिनों के भीतर विवाह निबंधन का प्रमाण पत्र 3 (तीन) प्रतियों में जारी करेगा। इसकी प्रथम प्रति पत्नी को, द्वितीय प्रति पति को दी जायेगी एवं तृतीय प्रति कार्यालय स्तर पर संधारित की जायेगी। - (1) इस नियमावली के अनुसार शुल्क का भुगतान निम्न दरों से किया जायेगा-

(i) विवाह निबंधन हेतु आवेदन शुल्क रू 100-00 (एक सौ रूपये) मात्र देय होगा। (ii) विवाह निबंधन शुल्क रू 200-00 (दो सौ रूपये) मात्र देय होगा।(cid:464)बहार गजट (असाधारण) 15 जनवरी 2026 3 (2) विवाह पंजीकरण की सत्यापित प्रतिलिपि हेतु रू॰ 100-00 (एक सौ रूपये) मात्र शुल्क देय होगा।

(3) खोज अथवा निरीक्षण के लिए शुल्क होगा-

(i) यदि प्रविष्टि चालू वर्ष से संबंधित है, तो रू0 50-00 (पच्चास रूपये) मात्र। (ii) यदि प्रविष्टि विगत वर्ष से संबंधित है तो रू॰ 100-00 (एक सौ रूपये) मात्र। - इस नियमों के तहत भुगतान की गई फीस की पावती के लिए इन नियमों से संलग्न अनुसूची के प्रपत्र ''ख'' में एक रसीद तैयार की जाएगी। -जिला अवर निबंधक या अवर निबंधक इन नियमों से संलग्न अनुसूची के प्रपत्र ''ग'' में एक शुल्क पंजी संधारित करेगा। नियमों के तहत प्राप्त सभी शुल्कों को प्रतिदिन शुल्क-पंजी में लेखा में लाया जाएगा तथा जिला अवर निबंधक या अवर निबंधक दिन के कुल शुल्क संग्रह की शुद्धता की पुष्टि करने के प्रमाण में उस पर हस्ताक्षर करेगा। - (1) यदि नियम 4 के तहत जिला अवर निबंधक या अवर निबंधक को आनन्द कारज विवाह के निबंधन से संबंधित प्राप्त आवेदन अधूरा या दोषपूर्ण है या विहित शुल्क का भुगतान नहीं किया गया है अथवा विवाह पंजी से सत्यापित प्रतिलिपि के लिए आवेदन नियम 08 में निर्दिष्ट शुल्क के साथ नहीं है, तो जिला अवर निबंधक या अवर निबंधक विवाह के पक्षकारों से अपेक्षा करेगा कि वे दोष को दूर करे या उक्त शुल्क का भुगतान आवेदन की तिथि पर, जैसा भी मामला हो, स्वयं पक्षकार करे। ऐसा नहीं करने पर आवेदन को अस्वीकृत कर दिया जाएगा और नियमों के साथ संलग्न अनुसूची के प्रपत्र ''घ'' में दर्ज किया जायेगा।

(2) यदि जिला अवर निबंधक या अवर निबंधक ऐसा आवेदन प्राप्त करता है जो उनके क्षेत्राधिकार के अन्तर्गत नहीं है, वह ऐसे आवेदन को सक्षम प्राधिकारी के समक्ष प्रस्तुत करने हेतु वापस कर देेगा एवं इस नियमावली के साथ संलग्न अनुसूची के प्रपत्र -'घ' में अंकित करेगा। (3)

इन नियमों के तहत विवाह का निबंधन इलेक्ट्रॉनिक माध्यम से किया जाएगा। (4)

जिला अवर निबंधक या अवर निबंधक विवाह का निबंधन की औपचारिकताएं पूरी करने के बाद, विवाह का निबंधन करेगा। इलेक्ट्रॉनिक माध्यम से विवाह प्रमाणपत्र इस नियमावली के साथ संलग्न अनुसूची के प्रपत्र ''च'' में 03 (तीन) प्रतियों में सृजित करेगा, जिसकी प्रथम प्रति पत्नी को, द्वितीय प्रति पति को और तीसरी प्रति कार्यालय में संधारित की जायेगी। विवाह प्रमाण-पत्र में पति-पत्नी एवं दो गवाहों का हस्ताक्षर (या अनपढ़ के मामले में बायें अंगूठे का निशान) लिया जायेगा। द्ध -यदि विवाह निबंधक को विवाह निबंधन के समय यह विश्वास करने का यथेष्ट प्रमाण हो कि आनन्द कारज विवाह के सम्पन्न होने का प्रमाण प्रस्तुत नहीं किया गया है, अथवा विवाह के दोनों पक्षकार सिख समुदाय के न हो अथवा पक्षकार विक्षिप्त है या दिवालिया है अथवा सक्षम न्यायालय द्वारा अयोग्य घोषित किया गया है तो विवाह का निबंधन अस्वीकार कर देगा। विवाह निबंधक के इस निर्णय के विरूद्ध अपील सहायक निबंधन महानिरीक्षक के समक्ष, जिसके क्षेत्राधिकार में विवाह निबंधक का कार्यालय है, अपीलवाद दायर करेगा। -जिला अवर निबंधक या अवर निबंधक अपने कर्त्तव्यों का निर्वहन एवं शक्तियों का प्रयोग निबंधन महानिरीक्षक के सामान्य अधीक्षण में करेंगे। -निबंधन के लिए आवेदन के विहित प्रपत्र आधिकारिक वेबसाइट पर संग्रहित किए जाएंगे। - (1) आनन्द कारज विवाह पंजी और नियम 16 में निर्दिष्ट अनुक्रमणी, उनके पूर्ण होने के 6 (छः) वर्षो के उपरांत जिला मुखयालय के अभिलेखागार में स्थायी रूप से संरक्षित किए जाएंगे।

(2) अन्य अभिलेख एवं कागजात यथा रसीद बही, शुल्क बही, पंजी सेे सत्यापित प्रति के लिए आवेदन इत्यादि 03(तीन) वर्ष पूर्ण हो जाने पर जिला अवर निबंधक या अवर निबंधक द्वारा विनष्ट कर दिये जायेंगे। आनन्द कारज विवाह पंजी की सभी प्रविष्टियाँ साफ्टवेयर में सूचीबद्ध की जायेगी तथा सूची दो प्रपत्रों में राशी जायेगी यथा एक पति के नाम से एवं दूसरे पत्नी के नाम से और ऐसी सूची किसी भी व्यक्ति द्वारा नियम 8 (4) में उल्लेखित राशि के भुगतान के उपरान्त निरीक्षण हेतु उपलब्ध होंगे।

1. Short title, extent and commencement:-

(1) These rules may be called the "Bihar Anand Karaj Marriage Registration Rules, 2025".

(2) Its jurisdiction shall extend to the whole of the State of Bihar. (3) These rules shall come into effect from the date of issue of notification.

2. Definitions:- In these rules, unless there is anything repugnant in subject or context:-

(a) "The Act" means the Anand Marriage Act, 1909. (b) "Marriage" means Anand Karaj Marriage prevalent among Sikh community under the provisions of the Act..

(c) "Registrar of Marriages" means the Sub Registrar appointed under section 6 of the Registration Act, 1908 (Act No. 16 of 1908),

(d) "Appellate Authority" means the Assistant Inspector General appointed under Section-8 of the Registration Act, 1908 (Act No. 16 of 1908), (e) "Inspector General of Registration" Means the Inspector General of Registration appointed under Section-3 of the Registration Act, 1908 (Act no. 16 of 1908).

3. Jurisdiction of Registrar of Marriages:- For the purpose of these Rules, every Sub-registrar and every District Sub-Registrar shall deemed to be the Registrar of Marriages within his respective jurisdiction to exercise its powers and discharge its duties.

4. Registration of Marriage:-

(1) The parties to the Anand Karaj Marriage can get the details of their marriage entered in Marriage Register specified for this purpose on payment of fees as specified in Rule-8 in the office of the District Sub- Registrar or Sub-Registrar.

(2) An application for registration of a marriage shall be made in From-"A" appended to the schedule to this rule to the District Sub-Registrar or Sub- Registrar within whose jurisdiction the marriage was solemnized or within whose jurisdiction the husband resides permanently or temporarily.

(3) The parties shall attach their residential certificate, age certificate, and the proof of Anand Karaj Marriage performed along with marriage application form. The person submitting the application shall be given a receipt in the following form, which shall be typed or computer generated-(cid:464)बहार गजट (असाधारण) 15 जनवरी 2026 11 Received application from ……………….(Husband) and …………….(wife) for registration under the Bihar Anand Marriage Registration Rules, 2025. having Sl. Date .......................... (Signature) (Marriage Registrar) 5. Anand Karaj Marriage Register:-

(1) The Anand Karaj Marriage Register shall be maintained in the departmental software and also in a bound volume of one hundred pages. The pages of which will be numbered continuously and will be maintained by the District Sub-Registrar or Sub-Registrar.

(2) The District Sub-Registrar or Sub-Registrar shall certify the number of pages of each marriage register by affixing his signature on the front page.

(3) At the end of each calendar year, the District Sub-Registrar or Sub- Registrar shall verify the number of applications registered during the year and whenever such register is complete with entries, the number of applications registered in that particular register will be endorsed by the District Sub-Registrar or Sub-Registrar on the register.

(4) The registers used by the District Sub Registrar or Sub-Registrar shall be numbered and entered in the catalogue register of the office. 6. Filing of application:- Every application made to the District Sub Registrar or Sub-Registrar under Rule- 4 shall be maintained by him in a register.

7. Endorsement of application:-

(1) Every application shall be endorsed by the District Sub-Registrar or Sub- Registrar, on the reverse of which shall be endorsed the following duly signed by him

(Signature) (Registrar of Marriages) (2) The District Sub-Registrar or Sub-Registrar shall issue a certificate of Marriage registration in triplicate within 30 days of application in Form-F of the schedule appended to the Rules. First copy will be given to wife, Second copy to the husband and the third copy will be maintained in the office.

8. Schedule of Fees:-

(1) The fee under these rules shall be paid at the following rates:-

(i) Fee payable for the application of registration of marriage- Rs. 100/- (One hundred rupees) Only.

(ii) Fee payable for the registration of marriage- Rs. 200/- (Two hundred rupees) Only.

(2) Fee for issuing Certified copy from Anand Karaj Marriage Register Rs 100/- (One hundred rupees) Only. (3) Fee payable for Search/Inspection:-

(i) for Current year entry-Rs.50/- (Fifty rupees) Only. (ii) for previous year entry-Rs.100/- (One hundred rupees) Only.

9. Form of receipt:- A receipt in Form- B of the Schedule appended to these rules shall be prepared for acknowledging the fees paid under these rules.

10. Fee Register: - The District Sub-Registrar or Sub-Registrar shall maintain a fee register in Form "C" of the Schedule appended to these rules. All fees received under these rules shall be accounted daily in the Fee Register and the District Sub- Registrar or Sub-Registrar shall sign it to confirm the correctness of the total fee collection for the day.

11. Powers of the Registrar:-

(1) If an application for registration of Anand Karaj Marriage received by the District Sub-Registrar or Sub-Registrar under Rule 4 is incomplete or proper fee is not paid or defective in any respect or if the application for a certified copy from the Marriage Register is not accompanied by the fees specified in Rule-8, the District Sub- Registrar or Sub-Registrar shall require the parties to the marriage to remove the defect or pay the said fee, as the case may be, on the date of application. Failing which the application shall be rejected and entry shall be made in Form-D of the schedule appended to these rules.

(2) If the District Sub-Registrar or Sub-Registrar receivies an application which is not within his jurisdiction, he shall return such application for presentation before the competent authority and shall enter it in Form- D of the schedule appended to these rules.

(3) Manner of Registration of Marriage:- The registration of marriage under these Rules shall be done through electronic means.

(4) Issue of Certificate of Registration of Marriage to the Parties:- The District Sub-Registrar or the Sub-Registrar shall after completing the formalities of registration of marriage, register the marriage, generate Marriage Certificate in 03(three) copies through electronic means in Form-F of the Schedule annexed to these Rules. The first copy will be issued to the wife, second copy to the husband and the third copy will be maintained as office copy and obtain the signatures (or left thumb impression in case of illiterate) of both husband, wife and two witnesses.

13 12. Appeal against refusal of Registration :- If the registrar of marriages has sufficient evidence to believe that proof of Anand Karaj Marriage performed is not produced or both the parties to the Marriage are not Sikh or that the party is of unsound mind or is insolvent or the marriage is declared void by the Court of Law, the registration of the marriage shall be refused. Appeal against this decision of the Marriage Registrar shall be filed before the Assistant Inspector General of Registration within whose jurisdiction the office of the Marriage Registrar is situated.

13. Superintendence:-The District Sub-Registrar or Sub-Registrar shall discharge their duties and exercise their powers under the general superintendence of the Inspector General of Registration.

14. Forms:- The Prescribed forms for application for registration will be collected from the official website.

15. Preservation of Registers and records:-

(1) The Anand Karaj Marriage Register and the register of Index specified in rule 16 will be permanently preserved in the record office of the District headquarters after 6(six) years of their completion.

(2) Other records and papers such as receipt books, fee book, applications for certified copy from the Register, etc., shall be destroyed by the District Sub-Registrar or Sub-Registrar after completion of 3 (three) Years.

16. Indexing of marriage:- All the entries in the Anand Marriage Register shall be entered in the software and the Index shall be maintained in two forms, one in the name of Husband and the other in the name of the Wife and such Index shall be available for inspection by any person after payment of the amount mentioned in rule 8(4).
