15 tuojh 2026 सं॰ एसीस-01/नि०-28/2014-63—भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल में संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः-

(1) यह नियमावली कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में प्रकाशन की तिथि से प्रवृत होगा।

v उक्त नियमावली के नियम-2 (v) को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः- "(v) आयोग से अभिप्रेत है बिहार तकनीकी सेवा आयोग;"

उक्त नियमावली के नियम 6 को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः-

" इस सवंर्ग में नियुक्ति के लिए अर्हताएँ स्वास्थ्य विभाग के नियंत्रणाधीन बिहार परिचारिका संवर्ग नियमावली, 2024 (समय-समय पर यथासंशोधित) में स्टॉफ नर्स के पद पर नियुक्ति हेतु यथा निर्धारित अर्हताएँ एवं उम्र सीमा के समरूप होगी।"

- उक्त नियमावली के नियम-7 को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः-2 (cid:464)बहार गजट (असाधारण), 19 जनवर(cid:547) 2026 " - इस सवंर्ग में भर्ती की प्रक्रिया स्वास्थ्य विभाग के नियंत्रणाधीन बिहार परिचारिका संवर्ग नियमावली, 2024 (समय-समय पर यथासंशोधित) में स्टॉफ नर्स के पद पर नियुक्ति हेतु यथा निर्धारित भर्ती की प्रक्रिया के समरूप होगी।" - उक्त नियमावली के नियम-8 को निम्नलिखित द्वारा

प्रतिस्थापित किया जायेगाः-

" आयोग की अनुशंसा के आधार पर सीधी भर्त्ती से नियुक्त ग्रेड 'ए' नर्स 01 (एक) वर्ष तक परिवीक्षा पर रहेंगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं होने पर इसे 01 (एक) और वर्ष के लिए विस्तारित किया जा सकेगा। विस्तारित अवधि में भी सेवा संतोषजनक नहीं रहने पर सेवा समाप्त की जा सकेगी।" - उक्त नियमावली के नियम-12 को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः-

" - (i) सेवा में सम्पुष्ट स्टॉफ नर्स को रिक्ति की उपलब्धता के अधीन रहते हुए उच्चतर पद पर प्रोन्नति हेतु भारतीय उपचर्या परिषद्‌ द्वारा निर्धारित अर्हता एवं अनुभव/सेवा अवधि पूर्ण करने पर वरीयता-सह-योग्यता के आधार पर इस नियमावली के परिशिष्ट-1 में प्रावधानित उच्चतर पदों पर प्रोन्नति दिये जाने पर विचार किया जा सकेगा।

(ii) प्रोन्नति पर विचार करते समय सामान्य प्रशासन विभाग द्वारा प्रोन्नति एवं कालावधि संबंधी समय-समय पर निर्गत अनुदेशों तथा चारित्री या पी०ए०आर० संबंधी मुहरबन्द लिफाफा पद्धति आदि के सबंध में निर्गत अनुदेशों का पालन करना अनिवार्य होगा।" - उक्त नियमावली के परिशिष्ट-1 को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः- [ नियम 2 (vii), 4, 12 द्रष्टव्य ]

64, 63 दिनांक 15 जनवरी 2026 का अंग्रेजी भाषा में निम्नलिखित अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जो भारतीय संविधान के अनुच्छेद 348 के (खण्ड) 3 के अधीन अंग्रेजी भाषा में उसका प्राधिकृत पाठ समझा जाएगा।

No- ESIS-01/NI-28/2014-63—In exercise of the power conferred by the proviso to Article 309 of the Constitution of India the Governor of Bihar is pleased to make the following Rules to amend the "Bihar Employees State Insurance Scheme Nurse Grade- 'A' (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.

1. Short title, extent and commencement.—

(1) These rules may be called the Bihar Employees State Insurance Scheme Nurse Grade-'A' (Recruitment, Promotion and Service Condition) Cadre (Amendment) Rules, 2026.

(2) It shall extend to whole of the State of Bihar.

(3) It shall come into force from the date of publication in the official Gazette.

2. Substitution of Rule 2 (V) of the Bihar Employees State Insurance Scheme Nurse Grade 'A' (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.—Rule 2(v) of the said Rules shall be substituted by the following:-

"(V) Commission means Bihar Technical Service Commission;"

3. Substitution of Rule 6 of the Bihar Employees State Insurance Scheme Nurse Grade- 'A' (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.—Rule 6 of the said Rules shall be substituted by the following:-

"6. Qualifications.—The qualifications for appointment in this cadre shall be the same as the qualification and age limit as prescribed for appointment to the post of Staff Nurse in the Bihar Nursing Cadre Rules, 2024 (as amended from time to time) under the control of the Health Department.

4. Substitution of Rule-7 of Bihar Employees State Insurance Scheme Nurse Grade- 'A' (Recruitment, Promotion and Service Condition) Cadre Rules 2016.—Rule-7 of the said Rules shall be substituted by the following:-

"7. Procedure of Recruitment.—The procedure for recruitment in this cadre shall be similar to the procedure prescribed for recruitment to the post of Staff Nurse as prescribed in "Bihar Nursing Cadre Rules, 2024 (as amended from time to time) under the control of the Health Department".

5. Substitution of Rule-8 of Bihar Employees State Insurance Scheme Nurse Grade- 'A' (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.—Rule-8 of the said Rules shall be substituted by the following:-

"(8) Probation period.—Grade 'A' nurses appointed through direct recruitment on the recommendation of the Commission shall be on probation for 01 (one) year. In case of unsatisfactory service during the probation period, it may be extended for 01 (one) more year. In case of unsatisfactory service even during the extended period, the service may be terminated."

6. Substitution of Rule-12 of Bihar Employees State Insurance Scheme Nurse Grade- 'A' (Recruitment, Promotion and Service Condition) Cadre Rules 2016.—Rule-12 of the said Rules shall be substituted by the following:-

"12. Hierarchy of Promotion-

(i) Confirmed Staff Nurses in service may be considered for promotion to higher posts, subject to the availability of vacancies, on the basis of seniority-cum-merit, after fulfilling the qualifications and experience/service period prescribed by the Indian Nursing Council, to the higher posts provided in Appendix-1 of these rules.

(ii) While considering promotions, it will be mandatory to follow the instructions issued from time to time by the General Administration Department regarding promotion and tenure, and the instructions issued regarding sealed cover envelope system etc regarding character or PAR." 7. Substitution of Appendix-1 of "Bihar Employees State Insurance Scheme Nurse Grade- 'A' (Recruitment, Promotion and Service Condition) Cadre Rules 2016".—Appendix-1 of the said Rules shall be substituted by the following:-

Annexure-1 [Rule 2 (vii), 4, 12] "Bihar Employees State Insurance Scheme Nurse Grade- 'A' (Recruitment, Promotion and Service Condition)
