15 tuojh 2026 सं॰ एसीस-01/नि०-41/2014-55—भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल " " में संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः-

(1) यह नियमावली कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा।

(3) यह राजपत्र में इसके प्रकाशन की तिथि से प्रवृत्त होगा।

iii उक्त नियमावली के नियम-2 (iii) को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा-

"(iii) "आयोग" से अभिप्रेत है "बिहार तकनीकी सेवा आयोग";"

उक्त नियमावली के नियम-4 को निम्नवत प्रतिस्थापित किया जाएगा- " - (i) इस संवर्ग की संरचना निम्नवत होगी-

(ii) इस संवर्ग के सभी कोटियों का कुल स्वीकृत बल तथा वेतनमान/वेतन स्तर वही होगा, जैसा सरकार द्वारा समय-समय पर अवधारित किया जायेगा।

(iii) इस नियमावली के प्रवृत होने के पूर्व से नियमित रूप से नियुक्त एवं कार्यरत कर्मी सवंर्ग में स्वतः सम्मिलित समझे जायेंगे।"

उक्त नियमावली के नियम-6 को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा-

इस संवर्ग में नियुक्ति के लिए अर्हताएँ स्वास्थ्य विभाग के "बिहार परिधापक संवर्ग नियमावली 2024 (समय-समय पर यथासंशोधित)" में परिधापक के पद पर नियुक्ति हेतु निर्धारित अहर्ताएँ के समरूप होंगी।

उक्त नियमावली के नियम-7 को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा-

इस संवर्ग में भर्ती की प्रक्रिया स्वास्थ्य विभाग के "बिहार परिधापक संवर्ग नियमावली 2024 (समय-समय पर यथासंशोधित)" में परिधापक के पद पर नियुक्ति हेतु निर्धारित प्रक्रिया के समरूप होगी।

उक्त नियमावली के नियम-8 को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा।-

"8. नियुक्ति के उपरान्त अभ्यर्थी परिवीक्षाधीन रहेंगें। परिवीक्षा अवधि एक वर्ष की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने पर अभिलिखित किये जाने वाले कारणों से इसे एक और वर्ष के लिए विस्तारित किया जा सकेगा। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पायी जाय तो नियुक्ति प्राधिकार ऐसे परिधापक को सेवामुक्त कर सकेगा।"

उक्त नियमावली के vi को विलोपित किया जाता है।

56, 55 दिनांक 15 जनवरी 2026 का अंग्रेजी भाषा में निम्नलिखित अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जो भारतीय संविधान के अनुच्छेद 348 के (खण्ड) 3 के अधीन अंग्रेजी भाषा में उसका प्राधिकृत पाठ समझा जाएगा।

No- ESIS-01/NI-41/2014-55— In excercise of the power conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules to amend the Bihar Employees State Insurance Scheme Dresser (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.

1. Short title, extent and commencement:-

(1) These 'Rules' may be called the "Bihar Employees State Insurance Scheme Dresser (Recruitment, Promotion and Service Condition) Cadre (Amendment) Rules, 2026"

(2) It shall extend to whole of the State of Bihar. (3) It shall come into force from the date of its publication in the official Gazette.

2. Substitution of rule-2 (iii) of the Bihar Employees State Insurance Scheme Dresser (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.—Rule 2 (iii) of the said Rules shall be substituted by the following:-

"(iii) 'Commission' means the Bihar Technical Service Commission;"

3. Substitution of rule-4 of the Bihar Employees State Insurance Scheme Dresser (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.—rule-4 of the said rules shall be substituted by the following:- "4. Hierarchy of the Cadre.— (a) The structure of this cadre will be as follows-

(b) The total sanctioned strength and pay scale/pay level of all categories of this cadre will be the same as determined by the Government from time to time.

(c) The employees appointed and working regularly before the coming into force of these rules will be considered automatically included in the cadre."

4. Substitution of rule-6 of the Bihar Employees State Insurance Scheme Dresser (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.—rule-6 of the said rules shall be substituted by the following:-

"6. Qualifications.—The qualifications for appointment to this cadre shall be the same as those prescribed for appointment to the post of Dresser in the Health Department's "Bihar Dresser Cadre Rules 2024 (as amended from time to time)."

5. Substitution of rule-7 of the Bihar Employees State Insurance Scheme Dresser (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.— rule-7 of the said rules shall be substituted by the following:-

"7. Procedure of Recruitment.—The recruitment process in this category will be similar to the procedure prescribed for appointment to the post of Dresser in the Health Department's "Bihar Dresser Cadre Rules 2024 (as amended from time to time)."4 (cid:464)बहार गजट (असाधारण), 20 जनवर(cid:547) 2026 6. Substitution of rule-8 of the Bihar Employees State Insurance Scheme Dresser (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.—rule-8 of the said rules shall be substituted by the following:-

"8. After appointment, the candidates will be on probation. The probation period will be of one year. If the service is not found satisfactory during the probation period, it may be extended for one more year for reasons to be recorded. If the service is not found satisfactory even in the extended period, the appointing authority may discharge such Dresser from service."

7. Deletion of the words "as mentioned in Appendix-1" in Rule-13(I) and Rule 2 (vi) and Appendix-I of the Bihar Employees State Insurance Scheme Dresser (Recruitment, Promotion and Service) Cadre Rules, 2016.—The Rule-2(vi) and Appendix-I in the said rules be deleted & the word "as mentioned in Appendix-I" in Rule- 13(I) be deleted.
