सं॰ एसीस-01/नि०-25/2014-59--भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल " " में संशोधन करने हेतु निम्नलिखित नियमावली बनाते है- (1) यह नियमावली कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में इसके प्रकाषन की तिथि से प्रवृा होगा। v उक्त नियमावली के नियम-2 (v) को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा-
"(v) "आयोग" से अभिप्रेत है "बिहार तकनीकी सेवा आयोग";" उक्त नियमावली के नियम- 4 को निम्नवत प्रतिस्थापित किया जाएगा- "4. संवर्ग का पदसोपान। इस सवंर्ग की विभिन्न कोटियों एवं पदों के सोपान परिशिष्ट-1 के अनुसार होंगे। संवर्ग के पदों पर इस नियमावली के प्रवृत होने के पूर्व से नियमित रूप से नियुक्त एवं कार्यरत कर्मी इस संवर्ग में स्वतः शामिल समझे जायेंगे।" उक्त नियमावली के नियम-6 को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा-2 (cid:464)बहार गजट (असाधारण), 20 जनवर(cid:547) 2026 "6. अर्हताएँ। इस संवर्ग में नियुक्ति के लिए अर्हताएँ स्वास्थ्य विभाग के "बिहार फर्मासिस्ट संवर्ग नियमावली, 2014 (समय-समय पर यथासंषोधित)" में फर्मासिस्ट के पद पर नियुक्ति हेतु निर्धारित अर्हताएँ के समरूप होंगी। उक्त नियमावली के नियम-7 को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा- "7. र्भाी की प्रक्रिया। इस संवर्ग में भर्ती की प्रक्रिया स्वास्थ्य विभाग के "बिहार फर्मासिस्ट संवर्ग नियमावली, 2014 (समय-समय पर यथासंषोधित)" में फर्मासिस्ट के पद पर नियुक्ति हेतु निर्धारित प्रक्रिया के समरूप होगी। उक्त नियमावली के नियम-8 को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा- "8. परिवीक्षा अवधि। नियुक्ति के उपरान्त अभ्यर्थी परिवीक्षाधीन रहेंगे। परिवीक्षा अवधि एक वर्ष की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने पर अभिलिखित किये जाने वाले कारणों से इसे एक और वर्ष के लिए विस्तारित किया जा सकेगा। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पायी जाय तो नियुक्ति प्राधिकार ऐसे भेषजज्ञ (फर्मासिस्ट) को सेवामुक्त कर सकेगा।" उक्त नियमावली के परिशिष्ट-1 को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः-

3 (cid:464)बहार गजट (असाधारण), 20 जनवर(cid:547) 2026का अंग्रेजी भाषा में निम्नलिखित अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जो भारतीय संविधान के अनुच्छेद 348 के (खण्ड) 3 के अधीन अंग्रेजी भाषा में उसका प्राधिकृत पाठ समझा जाएगा। The 15th January 2026
No. ESIS-01/NI-25/2014-59--In excercise of the power conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules to amend the Bihar Employees State Insurance Scheme Pharmacist (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.
1. Short title, extent and commencement:-
(1) These 'Rules' may be called the "Bihar Employees State Insurance Scheme Pharmacist (Recruitment, Promotion and Service Condition) Cadre (Amendment) Rules, 2026"
(2) It Shall extend to whole of the State of Bihar. (3) It shall come into force from the date of its publication in the official Gazette.
2. Substitution of Rule-2 (v) of the Bihar Employees State Insurance Scheme Pharmacist (Recruitment, Promotion and Service Condition) Cadre Rules, 2016- Rule 2(v) of the said Rules shall be substituted by the following:- "(V) 'Commission' means the Bihar Technical Service Commission;"
3. Substitution of Rule-4 of the Bihar Employees State Insurance Scheme Pharmacist (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.- Rule-4 of the said rules shall be substituted by the following:-
"4. Hierarchy posts of cadre.- The hierarchy of various categories and posts of this cadre will be as per Appendix-1. The employees who were regularly appointed and working on the posts of the cadre before the enforcement of these rules will be considered automatically included in this cadre."
4. Substitution of Rule-6 of the Bihar Employees State Insurance Scheme Pharmacist (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.- Rule-6 of the said rules shall be substituted by the following:-
"6. Qualifications- The qualifications for appointment in this cadre shall be the same as in the "Bihar Pharmacist Cadre Rules, 2014 (as amended from time to time) under the control of the Health Department".
5. Substitution of Rule-7 of the Bihar Employees State Insurance Scheme Pharmacist (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.- Rule-7 of the said rules shall be substituted by the following:-
"7. Procedure of Recruitment- The procedure of recruitment process shall be the same as procedure prescribed in Bihar Pharmacist Cadre Rules 2014 (as amended from time to time) under the control of the Health Department."
6. Substitution of Rule-8 of the Bihar Employees State Insurance Scheme Pharmacist (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.- Rule-8 of the said rules shall be substituted by the following:-
"8. Probation period.- After appointment, the candidates will be on probation. The probation period will be of one year. If the service is not found satisfactory during the probation period, it may be extended for one more year for reasons to be recorded. 7. Substitution of Appendix-1 of the Bihar Employees State Insurance Scheme Pharmacist (Recruitment, Promotion and Service Condition) Cadre Rules, 2016.-Appendix-Iof the said rules shall be substituted by the following:-
