विलुप्तप्राय वन्यजीवों को संरक्षण देने तथा पर्यटकों के बीच वन्यजीव संरक्षण एवं संवर्द्धन के संबंध में जागरूकता बढ़ाने के उद्देश्य से स्थापित संजय गाँधी जैविक उद्यान, पटना, केन्द्रीय चिड़ियाघर प्राधिकरण (Central Zoo Authority) से मान्यता प्राप्त बड़े श्रेणी का राज्य का इकलौता चिड़ियाघर है। केन्द्रीय चिड़ियाघर प्राधिकरण (Central Zoo Authority) के द्वारा दिये गये दिशा-निर्देश में सरकारी चिड़ियाघर (Zoo) के प्रबंधन हेतु सोसाईटी निर्माण का प्रावधान किया गया है।
2. उक्त प्रावधान के आलोक में उद्यान के जानवरों के स्वास्थ्य प्रबंधन, रख-रखाव में सुधार के साथ-साथ आगंतुकों की सुविधाओं में वृद्धि, अंशदान, दान, उपहार, आवंटन आदि के माध्यम से प्राप्त होने वाली निधि के प्रबंधन को बेहतर बनाने तथा प्रचार-प्रसार तंत्र को सुदृढ़ करने के उद्देश्य से संजय गाँधी जैविक उद्यान प्रबंधन एवं विकास सोसाईटी के गठन का निर्णय लिया गया है।

के अंतर्गत अपर मुख्य सचिव/प्रधान सचिव/सचिव, पर्यावरण, वन एवं जलवायु परिवर्तन विभाग, बिहार की अध्यक्षता में 09 सदस्यीय शासी निकाय तथा मुख्य वन्यप्राणी प्रतिपालक, बिहार की अध्यक्षता में 09 सदस्यीय कार्यकारी निकाय का प्रावधान है।
5. उक्त सोसाईटी के गठन संबंधी संगम-ज्ञापन तथा उप-विधि पर दिनांक-09.12.2025 को हुई राज्य मंत्रिपरिषद की बैठक में स्वीकृति प्राप्त है।

सोसाइट(cid:547) का नाम ।—
1. सोसाइट(cid:547) का नाम "संजय गांधी जै(cid:464)वक उ(cid:429)ान (cid:292)बंधन एवं (cid:464)वकास सोसाइट(cid:547) (एसजीबीपीएमडीएस)" होगा।

2. सोसाइट(cid:547) अथा(cid:91)त संजय गांधी जै(cid:464)वक उ(cid:429)ान (cid:292)बंधन एवं (cid:464)वकास सोसाइट(cid:547) का पंजीकृ त काया(cid:91)लय िनदेशक, संजय गांधी जै(cid:464)वक उ(cid:429)ान, बेल(cid:547) रोड, पटना ((cid:464)पन-800001), िजला- पटना, (cid:464)बहार के काया(cid:91)लय म(cid:581) ि(cid:232)थत होगा।

3. सोसाइट(cid:547) का काय(cid:91)(cid:162)े(cid:287) सामा(cid:219)यतः पटना िजला और (cid:464)वशेष (cid:510)प से संजय गांधी जै(cid:464)वक उ(cid:429)ान होगा, तथा ऐसा कोई भी (cid:162)े(cid:287) जो सरकार(cid:547) आदेश (cid:430)ारा इसके अंतग(cid:91)त लाया जाता है। (cid:464)वशेष प(cid:464)रि(cid:232)थितय(cid:585) म(cid:581) जैसे अ(cid:219)य (cid:162)े(cid:287)(cid:585) म(cid:581) मानव-पशु (cid:430)ंद सम(cid:219)वय, रा(cid:207)य अंतग(cid:91)त अ(cid:219)य िच(cid:464)ड़याघर(cid:585) के साथ सम(cid:219)वय आ(cid:464)द, सम(cid:219)वय के िलए यह काय(cid:91)(cid:162)े(cid:287) पूरे रा(cid:207)य तक (cid:464)व(cid:232)ता(cid:464)रत होगा। ल(cid:234)य एवं उ(cid:423)े(cid:230)य ।—
4. सोसाइट(cid:547) के ल(cid:234)य एवं उ(cid:423)े(cid:230)य िन(cid:224)न (cid:292)कार ह (cid:583):-
(क) व(cid:219)यजीव(cid:585) के संर(cid:162)ण, व(cid:219)यजीव(cid:585) के िनयं(cid:287)ण-(cid:292)बंधन (Captive Management of Wildlife) और इको-पय(cid:91)टन के िलए संजय गांधी जै(cid:464)वक उ(cid:429)ान क(cid:551) गित(cid:464)विधय(cid:585) को पूरक, सु(cid:506)ढ़ या अ(cid:219)यथा (cid:464)व(cid:232)ता(cid:464)रत करना और व(cid:219)यजीव(cid:585) के ए(cid:200)स-सीटू और इन- सीटू (cid:292)बंधन के बीच संबंध को सु(cid:464)वधाजनक बनाना।
(ख) खुल(cid:547) बहस, चचा(cid:91) आ(cid:464)द के िलए मंच (cid:292)दान करना और (cid:464)कसी धमा(cid:91)थ(cid:91), परोपकार(cid:547), वै(cid:163)ािनक, रा(cid:438)ीय, साव(cid:91)जिनक या (cid:464)कसी अ(cid:219)य सं(cid:232)था को सद(cid:232)यता देना या अ(cid:219)य सहायता (cid:292)दान करना, िजसका उ(cid:423)े(cid:230)य या (cid:292)योजन समाज के उ(cid:423)े(cid:230)य(cid:585) के अनु(cid:510)प हो या उ(cid:219)ह(cid:581) बढ़ावा देता हो।
(ग) संजय गांधी जै(cid:464)वक उ(cid:429)ान के (cid:464)विश(cid:436) संर(cid:162)ण काय(cid:91)(cid:272)म(cid:585), पा(cid:464)रि(cid:232)थितक(cid:551) पय(cid:91)टन सु(cid:464)वधाओं के (cid:464)वकास के िलए रा(cid:438)ीय/अंतरा(cid:91)(cid:438)ीय िनकाय(cid:585), (cid:464)वशेष(cid:163)(cid:585) और (cid:464)व(cid:419) पो(cid:464)षत एज(cid:581)िसय(cid:585) के साथ सम(cid:219)वय और संपक(cid:91) (cid:232)था(cid:464)पत करना तथा भारत सरकार, क(cid:581) (cid:289)(cid:547)य िच(cid:464)ड़याघर (cid:292)ािधकरण, रा(cid:207)य सरकार, गैर-सरकार(cid:547) संगठन(cid:585) या (cid:464)कसी (cid:229)य(cid:464)(cid:416), सं(cid:232)थान, रा(cid:438)ीय या अंतरा(cid:91)(cid:438)ीय एज(cid:581)िसय(cid:585), सरकार(cid:547) या िनजी, क(cid:581) (cid:289) सरकार या रा(cid:207)य सरकार के (cid:464)कसी अ(cid:219)य सं(cid:232)थान से अंशदान, सीएसआर, दान, उपहार, अनुदान और अ(cid:219)य िनिध (cid:292)ा(cid:431) करना।4 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026 (घ) संजय गांधी जै(cid:464)वक उ(cid:429)ान के जानवर(cid:585) के (cid:232)वा(cid:232) (cid:216)य-(cid:292)बंधन तथा उ(cid:429)ान के रख-रखाव के िलए प(cid:464)रसर म(cid:581) सुधार के साथ-साथ आगंतुक(cid:585) क(cid:551) सु(cid:464)वधाओं के देख-रेख और सुधार के िलए सभी अंशदान, दान, उपहार (एनजीओ, कॉरपोरे (cid:210)स, सं(cid:232)थान, िनजी और (cid:229)य(cid:464)(cid:416)गत भी शािमल ह (cid:583)) और सोसाइट(cid:547) को (cid:464)दए गए फं ड को (cid:292)ा(cid:431) करना और (cid:292)बंिधत करना, साथ ह(cid:547) संजय गांधी जै(cid:464)वक उ(cid:429)ान (cid:430)ारा (cid:464)टकट शु(cid:227)क, (cid:464)विभ(cid:219)न उपयोगकता(cid:91) शु(cid:227)क, सु(cid:464)वधाओं क(cid:551) िन(cid:464)वदा, दंड, नीलामी, (cid:464)कराया शु(cid:227)क, पशु गोद लेने, (cid:464)विभ(cid:219)न व(cid:232)तुओं क(cid:551) (cid:464)ब(cid:272)(cid:551), लाइस(cid:581)स शु(cid:227)क, उपयोगकता(cid:91)ओं या आगंतुक(cid:585) आ(cid:464)द पर लगाए गए (cid:464)कसी भी अ(cid:219)य शु(cid:227)क या (cid:292)भार के (cid:510)प म(cid:581) उ(cid:215)प(cid:219)न राज(cid:232)व को (cid:292)ा(cid:220)त करना ।
(ङ) सरकार(cid:547)/अध(cid:91)-सरकार(cid:547)/गैर-सरकार(cid:547) सं(cid:232)थाओं से प(cid:464)रयोजनाएँ (cid:292)ा(cid:431) करना और परामश(cid:91)-सेवाएं (cid:292)दान करना।
(च) (cid:464)वशेष उ(cid:423)े(cid:230)य(cid:585) के िलए (cid:464)वशेष-िनिध का िनधा(cid:91)रण और उनका सृजन करना तथा उसे या उसके (cid:464)कसी भाग को ऐसे उ(cid:423)े(cid:230)य(cid:585) के िलए लागू करना।
(छ) सोसाइट(cid:547) के कु शल-(cid:292)बंधन और संचालन के िलए शासी िनकाय के अनुमोदन से आव(cid:230)यक सं(cid:464)वदा कम(cid:91)चा(cid:464)रय(cid:585) को िनयु(cid:416) करना/रखना ।
(ज) सोसाइट(cid:547) (cid:430)ारा सं(cid:464)वदा/दैिनक मजदूर(cid:547) पर िनयोिजत (cid:229)य(cid:464)(cid:416)य(cid:585)/कम(cid:91)चा(cid:464)रय(cid:585)/सेवा (cid:292)दाताओं को शासी िनकाय के मानदंड(cid:585) और अनुमोदन के अनुसार सोसाइट(cid:547) के कोष से भुगतान होगा। इसम(cid:581) सोसाइट(cid:547) (cid:430)ारा िनयोिजत कम(cid:91)चा(cid:464)रय(cid:585) के भ(cid:464)व(cid:231)य के लाभ(cid:585) के िलए ईपीएफ अंशदान या कोई अ(cid:219)य बीमा भी सि(cid:224)मिलत होगी। वे कम(cid:568), जो सरकार(cid:547) सेवा म(cid:581) है, वे इसम(cid:581) सि(cid:224)मिलत नह(cid:547)ं होग(cid:581)।
(झ) रा(cid:207)य सरकार के पूवा(cid:91)नुमोदन से उ(cid:423)े(cid:230)य(cid:585) को आगे बढाने िलए अचल-संप(cid:464)(cid:419) अिज(cid:91)त करना।
(ञ) उपयु(cid:91)(cid:416) उ(cid:423)े(cid:230)य(cid:585) को आगे बढ़ाने के िलए कोई अ(cid:219)य गित(cid:464)विधयां संचािलत करना । सोसाइट(cid:547) क(cid:551) आय एवं संप(cid:464)(cid:419) ।—
5. सोसाइट(cid:547) (cid:430)ारा (cid:292)ा(cid:431) कोई भी आय या लाभ के वल इस (cid:163)ापन म(cid:581) िनधा(cid:91)(cid:464)रत सोसाइट(cid:547) के उ(cid:423)े(cid:230)य(cid:585) को बढ़ावा देने के िलए लगाया जाएगा और इसका कोई भी (cid:464)ह(cid:232)सा सोसाइट(cid:547) के (cid:464)कसी भी सद(cid:232)य को वेतन, लाभांश, बोनस, आय या लाभ के (cid:510)प म(cid:581) (cid:292)(cid:215)य(cid:162) या अ(cid:292)(cid:215)य(cid:162) (cid:510)प से भुगतान या ह(cid:232)तांत(cid:464)रत नह(cid:547)ं (cid:464)कया जाएगा, बशत(cid:566) (cid:464)क इसम(cid:581) िन(cid:464)हत ऐसे सद(cid:232)य(cid:585) को उिचत आकि(cid:232)मक खच(cid:607) के भुगतान पर लागू नह(cid:547)ं होगा।5 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026 सोसाइट(cid:547) का (cid:464)वघटन ।—
6. (क) सोसाइट(cid:547) का (cid:464)वघटन सोसाइट(cid:547) पंजीकरण अिधिनयम, 1860 क(cid:551) धारा 13 और 14 के (cid:292)ावधान(cid:585) के अनुसार (cid:464)कया जा सके गा।
(ख) य(cid:464)द सोसाइट(cid:547) के समापन या (cid:464)वघटन के बाद, उसके ऋण(cid:585) और देनदा(cid:464)रय(cid:585) के िनपटान के प(cid:433)ात् भी कोई संप(cid:464)(cid:419), प(cid:464)रसंप(cid:464)(cid:419) और िनिध शेष बचती है, तो उसे सोसाइट(cid:547) के सद(cid:232)य(cid:585) या उनम(cid:581) से (cid:464)कसी को नह(cid:547)ं (cid:464)दया जाएगा या उनम(cid:581) (cid:464)वत(cid:464)रत नह(cid:547)ं (cid:464)कया जाएगा, बि(cid:227)क उसको पया(cid:91)वरण, वन और जलवायु प(cid:464)रवत(cid:91)न (cid:464)वभाग के (cid:430)ारा िनधा(cid:91)(cid:464)रत तर(cid:547)के से रा(cid:207)य सरकार को ह(cid:232)तांत(cid:464)रत कर द(cid:547) जाएंगी।

संि(cid:162)(cid:220)त शीष(cid:91)क, (cid:162)े(cid:287) एवं (cid:292)ारंभ ।—
1. (क) इन उपिनयम(cid:585) को "संजय गांधी जै(cid:464)वक उ(cid:429)ान (cid:292)बंधन एवं (cid:464)वकास सोसाइट(cid:547) उपिनयम, 2025" कहा जाएगा, यहाँ से इसे 'उपिनयम' कहा जाएगा।
(ख) ये उपिनयम संजय गांधी जै(cid:464)वक उ(cid:429)ान, पटना के (cid:292)बंधन एवं (cid:464)वकास सोसाइट(cid:547) के सभी सद(cid:232)य(cid:585), संप(cid:464)(cid:419)य(cid:585), गित(cid:464)विधय(cid:585) और लेन-देन पर लागू ह(cid:585)गे।
(ग) ये उपिनयम सोसाइट(cid:547) पंजीकरण अिधिनयम, 1860 के अंतग(cid:91)त सोसाइट(cid:547) अथा(cid:91)त "संजय गांधी जै(cid:464)वक उ(cid:429)ान (cid:292)बंधन एवं (cid:464)वकास सोसाइट(cid:547)" के पंजीकरण क(cid:551) ितिथ से लागू ह(cid:585)गे। प(cid:464)रभाषाय(cid:581) ।—
2. इन उपिनयम(cid:585) म(cid:581), जब तक (cid:464)क (cid:464)वषय या संदभ(cid:91) के (cid:292)ितकू ल कोई बात न हो:-
(क) "अिधिनयम" से ता(cid:215)पय(cid:91) है- सोसाइट(cid:547) पंजीकरण अिधिनयम, 1860 (1860 का अिधिनयम सं(cid:201)या XXI)।
(ख) "अ(cid:218)य(cid:162)" से ता(cid:215)पय(cid:91) है- संजय गांधी जै(cid:464)वक उ(cid:429)ान (cid:292)बंधन एवं (cid:464)वकास सोसाइट(cid:547), पटना के शासी िनकाय (Governing Body) के अ(cid:218)य(cid:162)।
(ग) "CZA" से ता(cid:215)पय(cid:91) है- क(cid:581) (cid:289)(cid:547)य िच(cid:464)ड़याघर (cid:292)ािधकरण, नई (cid:464)द(cid:227)ल(cid:547) ।
(घ) "िनदेशक" से ता(cid:215)पय(cid:91) है- िनदेशक, संजय गांधी जै(cid:464)वक उ(cid:429)ान, पटना ।
(ड़) "काय(cid:91)कार(cid:547)-िनकाय" से ता(cid:215)पय(cid:91) है- सोसाइट(cid:547) का काय(cid:91)कार(cid:547)-िनकाय (Executive Body) । (च) "(cid:464)व(cid:419)-अिधकार(cid:547)" से ता(cid:215)पय(cid:91) है- सोसाइट(cid:547) के (cid:464)व(cid:419)-अिधकार(cid:547)।
(छ) "शासी-िनकाय" से ता(cid:215)पय(cid:91) है- इन उप-िनयम(cid:585) के अंतग(cid:91)त ग(cid:464)ठत सोसाइट(cid:547) का शीष(cid:91)- िनकाय ।
(ज) "सरकार" से ता(cid:215)पय(cid:91) है- जब तक अ(cid:219)यथा (cid:464)वशेष (cid:510)प से उ(cid:227)लेख न (cid:464)कया गया हो, (cid:464)बहार रा(cid:207)य सरकार ।
(झ) "सिचव" से ता(cid:215)पय(cid:91) है- सोसाइट(cid:547) के काय(cid:91)कार(cid:547)-िनकाय के सिचव ।
(ञ) "सोसाइट(cid:547)" से ता(cid:215)पय(cid:91) है- संजय गांधी जै(cid:464)वक उ(cid:429)ान (cid:292)बंधन एवं (cid:464)वकास सोसाइट(cid:547) । (ट) "सोसाइट(cid:547) के िनयम" से ता(cid:215)पय(cid:91) है- संजय गांधी जै(cid:464)वक उ(cid:429)ान (cid:292)बंधन एवं (cid:464)वकास सोसाइट(cid:547) के उपिनयम ह (cid:583)।
(ठ) "उपा(cid:218)य(cid:162)" से ता(cid:215)पय(cid:91) है- सोसाइट(cid:547) के शासी-िनकाय के उपा(cid:218)य(cid:162) ।
(ड) "वष(cid:91)" से ता(cid:215)पय(cid:91) है- 1 अ(cid:292)ैल से शु(cid:510) होने वाला और अगले वष(cid:91) के 31 माच(cid:91) को समा(cid:431) होने वाला (cid:464)व(cid:419)ीय-वष(cid:91)। (cid:464)बहार के सामा(cid:219)य धाराएँ एवं अिधिनयम, यथोिचत प(cid:464)रवत(cid:91)न(cid:585) स(cid:464)हत, उन शत(cid:607) क(cid:551) प(cid:464)रभाषा के िलए लागू होगा, जो इसम(cid:581) उिचत िभ(cid:219)नता के साथ प(cid:464)रभा(cid:464)षत नह(cid:547)ं (cid:464)कया गया ह (cid:583)।7 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026 िनबंिधत काया(cid:91)लय ।—

4. ये उपिनयम संजय गांधी जै(cid:464)वक उ(cid:429)ान (cid:292)बंधन एवं (cid:464)वकास सोसाइट(cid:547) के सोसाइट(cid:547) पंजीकरण अिधिनयम, 1860 के तहत पंजीकरण क(cid:551) ितिथ से लागू ह(cid:585)गे। सोसाइट(cid:547) का अिधकार (cid:162)े(cid:287) सामा(cid:219)य (cid:510)प से पटना िजले का (cid:162)े(cid:287) और (cid:464)वशेष (cid:510)प से संजय गांधी जै(cid:464)वक उ(cid:429)ान होगा। इसके अंतग(cid:91)त ऐसा कोई भी (cid:162)े(cid:287) सरकार(cid:547) आदेश (cid:430)ारा लाया जा सकता है। (cid:464)वशेष प(cid:464)रि(cid:232)थितय(cid:585) म(cid:581) जैसे अ(cid:219)य (cid:162)े(cid:287)(cid:585) म(cid:581) मानव-पशु (cid:430)ंद हेतु रा(cid:207)य के भीतर अ(cid:219)य िच(cid:464)ड़याघर(cid:585) के साथ सम(cid:219)वय आ(cid:464)द के िलए इसका (cid:162)े(cid:287) पूरे रा(cid:207)य म(cid:581) (cid:464)व(cid:232)ता(cid:464)रत होगा।
ल(cid:234)य एवं उ(cid:423)े(cid:230)य ।—
5. सोसाइट(cid:547) के ल(cid:234)य एवं उ(cid:423)े(cid:230)य िन(cid:224)न (cid:292)कार ह (cid:583):-
(क) व(cid:219)यजीव(cid:585) के संर(cid:162)ण, व(cid:219)यजीव(cid:585) के िनयंि(cid:287)त-(cid:292)बंधन (captive management of wildlife) और इको-पय(cid:91)टन के िलए संजय गांधी जै(cid:464)वक उ(cid:429)ान क(cid:551) गित(cid:464)विधय(cid:585) को पूरक, सु(cid:506)ढ़ या अ(cid:219)यथा (cid:464)व(cid:232)ता(cid:464)रत करना और व(cid:219)यजीव(cid:585) के ए(cid:200)स- सीटू और इन-सीटू (cid:292)बंधन के बीच संबंध को सु(cid:464)वधाजनक बनाना।
(ख) खुल(cid:547) बहस, चचा(cid:91) आ(cid:464)द के िलए मंच (cid:292)दान करना और (cid:464)कसी धमा(cid:91)थ(cid:91), परोपकार(cid:547), वै(cid:163)ािनक, रा(cid:438)ीय, साव(cid:91)जिनक या (cid:464)कसी अ(cid:219)य सं(cid:232)था को सद(cid:232)यता देना या अ(cid:219)य सहायता (cid:292)दान करना, िजसका उ(cid:423)े(cid:230)य या (cid:292)योजन समाज के उ(cid:423)े(cid:230)य(cid:585) के अनु(cid:510)प हो या उ(cid:219)ह(cid:581) बढ़ावा देता हो।
(ग) संजय गांधी जै(cid:464)वक उ(cid:429)ान के (cid:464)विश(cid:436) संर(cid:162)ण काय(cid:91)(cid:272)म(cid:585), पा(cid:464)रि(cid:232)थितक(cid:551) पय(cid:91)टन सु(cid:464)वधाओं के (cid:464)वकास के िलए रा(cid:438)ीय/अंतरा(cid:91)(cid:438)ीय िनकाय(cid:585), (cid:464)वशेष(cid:163)(cid:585) और (cid:464)व(cid:419) पोषण एज(cid:581)िसय(cid:585) के साथ सम(cid:219)वय और संपक(cid:91) (cid:232)था(cid:464)पत करना तथा भारत सरकार, क(cid:581) (cid:289)(cid:547)य िच(cid:464)ड़याघर (cid:292)ािधकरण, रा(cid:207)य सरकार, गैर-सरकार(cid:547) संगठन(cid:585) या (cid:464)कसी (cid:229)य(cid:464)(cid:416), सं(cid:232)थान, रा(cid:438)ीय या अंतरा(cid:91)(cid:438)ीय एज(cid:581)िसय(cid:585), सरकार(cid:547) या िनजी, क(cid:581) (cid:289) सरकार या रा(cid:207)य सरकार के (cid:464)कसी अ(cid:219)य सं(cid:232)थान से अंशदान, सीएसआर, दान, उपहार, अनुदान और अ(cid:219)य िनिध (cid:292)ा(cid:431) करना।
(घ) संजय गांधी जै(cid:464)वक उ(cid:429)ान के जानवर(cid:585) के (cid:232)वा(cid:232) (cid:216)य-(cid:292)बंधन तथा उ(cid:429)ान के रख- रखाव के िलए प(cid:464)रसर म(cid:581) सुधार के साथ-साथ आगंतुक(cid:585) क(cid:551) सु(cid:464)वधाओं के देख- रेख और सुधार के िलए सभी अंशदान, दान, उपहार (एनजीओ, कॉरपोरे (cid:210)स, सं(cid:232)थान, िनजी और (cid:229)य(cid:464)(cid:416)गत भी शािमल ह (cid:583)) और सोसाइट(cid:547) को (cid:464)दए गए फं ड को (cid:292)ा(cid:431) करना और (cid:292)बंिधत करना, साथ ह(cid:547) संजय गांधी जै(cid:464)वक उ(cid:429)ान (cid:430)ारा (cid:464)टकट8 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026 शु(cid:227)क, (cid:464)विभ(cid:219)न उपयोगकता(cid:91) शु(cid:227)क, सु(cid:464)वधाओं क(cid:551) िन(cid:464)वदा, दंड, नीलामी, (cid:464)कराया शु(cid:227)क, पशु गोद लेने, (cid:464)विभ(cid:219)न व(cid:232)तुओं क(cid:551) (cid:464)ब(cid:272)(cid:551), लाइस(cid:581)स शु(cid:227)क, उपयोगकता(cid:91)ओं या आगंतुक(cid:585) आ(cid:464)द पर लगाए गए (cid:464)कसी भी अ(cid:219)य शु(cid:227)क या (cid:292)भार के (cid:510)प म(cid:581) उ(cid:215)प(cid:219)न राज(cid:232)व को (cid:292)ा(cid:220)त करना ।
(ङ) सरकार(cid:547)/अध(cid:91)-सरकार(cid:547)/गैर-सरकार(cid:547) सं(cid:232)थाओं से प(cid:464)रयोजनाएं (cid:292)ा(cid:431) करना और परामश(cid:91) सेवाएं (cid:292)दान करना।
(च) (cid:464)वशेष उ(cid:423)े(cid:230)य(cid:585) के िलए (cid:464)वशेष िनिध िनधा(cid:91)(cid:464)रत करना और उनका सृजन करना तथा उसे या उसके (cid:464)कसी भाग को ऐसे उ(cid:423)े(cid:230)य(cid:585) के िलए लागू करना।
(छ) सोसाइट(cid:547) के कु शल-(cid:292)बंधन और संचालन के िलए शासी-िनकाय के अनुमोदन से आव(cid:230)यक सं(cid:464)वदा कम(cid:91)चा(cid:464)रय(cid:585) को िनयु(cid:416) करना/रखना ।
(ज) सोसाइट(cid:547) (cid:430)ारा िनयोिजत सं(cid:464)वदा/दैिनक मजद ूर(cid:547) पर िनयोिजत (cid:229)य(cid:464)(cid:416)य(cid:585)/कम(cid:91)चा(cid:464)रय(cid:585)/ सेवा (cid:292)दाताओं को शासी िनकाय के मानदंड(cid:585) और अनुमोदन के अनुसार सोसाइट(cid:547) के कोष से भुगतान होगा। इसम(cid:581) सोसाइट(cid:547) (cid:430)ारा िनयोिजत कम(cid:91)चा(cid:464)रय(cid:585) के भ(cid:464)व(cid:231)य के लाभ(cid:585) के िलए ईपीएफ अंशदान या कोई अ(cid:219)य बीमा भी सि(cid:224)मिलत होगी। वे कम(cid:568), जो सरकार(cid:547) सेवा म(cid:581) है, वे इसम(cid:581) सि(cid:224)मिलत नह(cid:547)ं होग(cid:581)।
(झ) रा(cid:207)य सरकार के पूवा(cid:91)नुमोदन से उ(cid:423)े(cid:230)य(cid:585) को आगे बढाने िलए अचल-संप(cid:464)(cid:419) अिज(cid:91)त करना।
शासी िनकाय और काय(cid:91)कार(cid:547) िनकाय ।—
6. संजय गांधी जै(cid:464)वक उ(cid:429)ान के (cid:292)बंधन एवं (cid:464)वकास के िलए सोसाइट(cid:547) के शासी िनकाय और काय(cid:91)कार(cid:547) िनकाय का गठन िन(cid:224)निलिखत सद(cid:232)य(cid:585) के साथ (cid:464)कया जाएगा:

7. (क) सरकार के पास अपने पूण(cid:91) (cid:464)ववेक से, (cid:464)कसी भी समय शासी िनकाय/काय(cid:91)कार(cid:547) िनकाय के िलए नािमत (cid:464)कसी भी सद(cid:232)य को पद से हटाने श(cid:464)(cid:416) होगी तथा (cid:464)र(cid:464)(cid:416) को भरने का अिधकार होगा।
(ख) पदेन सद(cid:232)य अपने काया(cid:91)लय म(cid:581) िनयु(cid:464)(cid:416) के काय(cid:91)काल के दौरान सद(cid:232)य के (cid:510)प म(cid:581) पद धारण कर(cid:581)गे।
(ग) गैर-सरकार(cid:547) सद(cid:232)य एक समय म(cid:581) तीन वष(cid:91) क(cid:551) अविध के िलए पद पर रह(cid:581)गे। उ(cid:219)ह(cid:581) स(cid:162)म (cid:292)ािधकार(cid:547) (cid:430)ारा पुनः मनोनीत (cid:464)कया जा सकता है।
(घ) रा(cid:207)य सरकार समय-समय पर सरकार के (cid:464)कसी अिधकार(cid:547) को सोसाइट(cid:547) के सद(cid:232)य के (cid:510)प म(cid:581) नािमत कर सकती है।
पदेन सद(cid:232)यता का समापन ।—
8. जब कोई (cid:229)य(cid:464)(cid:416) अपने पद या िनयु(cid:464)(cid:416) के आधार पर सोसाइट(cid:547) का पदेन सद(cid:232)य बन जाता है, तो सोसाइट(cid:547) म(cid:581) उसक(cid:551) सद(cid:232)यता उस समय समा(cid:431) हो जाएगी जब उसका पद या उसक(cid:551) िनयु(cid:464)(cid:416) समा(cid:220)त हो जाएगी ।
अ(cid:219)य क(cid:551) सद(cid:232)यता क(cid:551) समाि(cid:431) ।—
9. पदेन सद(cid:232)य(cid:585) के अलावा अ(cid:219)य सद(cid:232)य(cid:585) क(cid:551) सद(cid:232)यता िन(cid:224)निलिखत म(cid:581) से (cid:464)कसी भी ि(cid:232)थित म(cid:581) समा(cid:431) हो जाएगी:
(क) सद(cid:232)यता के िलए मनोनीत अविध क(cid:551) समाि(cid:431) पर
(ख) मृ(cid:215)यु, (cid:215)यागप(cid:287), (cid:464)दवािलयापन, पागलपन या नैितक अधमता से जुड़े (cid:464)कसी आपरािधक अपराध के िलए दोषिस(cid:464)(cid:424) पर
(ग) जब कोई सद(cid:232)य (cid:464)बना उिचत अनुमित के लगातार तीन बैठक(cid:585) म(cid:581) उपि(cid:232)थत नह(cid:547)ं होता है।10 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026 सोसाइट(cid:547) या उसके (cid:292)ािधकरण क(cid:551) गित(cid:464)वधय(cid:585) पर (cid:292)ितबंध ।—
10. सोसाइट(cid:547) या उसका कोई भी (cid:292)ािधकरण सरकार क(cid:551) पूव(cid:91) (cid:232)वीकृ ित के (cid:464)बना (cid:464)कसी (cid:229)य(cid:464)(cid:416) को िनयु(cid:416) करने, प(cid:210)टे पर देने, या (cid:464)कसी भी तरह से जै(cid:464)वक उ(cid:429)ान क(cid:551) (cid:464)कसी भी संप(cid:464)(cid:419) जैसे भूिम/प(cid:464)रसर/पूंजीगत संप(cid:464)(cid:419), (cid:464)कसी काया(cid:91)लय या भवन, वन आ(cid:464)द के अिधकार, (cid:232)वािम(cid:215)व या क(cid:222)जे को ह(cid:232)तांत(cid:464)रत करने के िलए स(cid:162)म नह(cid:547)ं होगा। हालाँ(cid:464)क, सोसाइट(cid:547) क(cid:581) (cid:289)(cid:547)य िच(cid:464)ड़याघर (cid:292)ािधकरण के (cid:464)दशा-िनद(cid:566)श(cid:585) के अनु(cid:510)प अ(cid:219)य स(cid:162)म अिधका(cid:464)रय(cid:585) (cid:430)ारा जार(cid:547) िनद(cid:566)श(cid:585) का पालन करते हुए सं(cid:464)वदा कम(cid:91)चा(cid:464)रय(cid:585) को िनयु(cid:416) कर सकती है और क(cid:581) (cid:289)(cid:547)य िच(cid:464)ड़याघर (cid:292)ािधकरण के मानक(cid:585) के अनु(cid:510)प ह(cid:547) (cid:464)कसी भी िस(cid:464)वल िनमा(cid:91)ण को शु(cid:510) या अिधकृ त कर सकती है या अपने प(cid:464)रसर का उपयोग कर सकती है।
पदािधका(cid:464)रय(cid:585) क(cid:551) श(cid:464)(cid:416)/काय(cid:91) ।—
11. सोसाइट(cid:547) के शासी-िनकाय (जीबी) के एक अ(cid:218)य(cid:162), एक उपा(cid:218)य(cid:162) और एक सद(cid:232)य सिचव तथा काय(cid:91)कार(cid:547) िनकाय (ईबी) के एक अ(cid:218)य(cid:162), एक उपा(cid:218)य(cid:162) और एक सिचव ह(cid:585)गे। िनदेशक, संजय गांधी जै(cid:464)वक उ(cid:429)ान, पटना, शासी िनकाय के सद(cid:232)य- सिचव होने के साथ-साथ सोसाइट(cid:547) के सिचव भी ह(cid:585)गे तथा इसके मु(cid:201)य काय(cid:91)कार(cid:547) अिधकार(cid:547) के (cid:510)प म(cid:581) काय(cid:91) कर(cid:581)गे।
(क) शासी िनकाय के अ(cid:218)य(cid:162) एवं उपा(cid:218)य(cid:162) ।—
(i) शासी िनकाय के अ(cid:218)य(cid:162) शासी-िनकाय क(cid:551) बैठक(cid:585) क(cid:551) अ(cid:218)य(cid:162)ता एवं संचालन
कर(cid:581)गे तथा उनक(cid:551) अनुपि(cid:232)थित म(cid:581) शासी िनकाय के उपा(cid:218)य(cid:162) अ(cid:218)य(cid:162)ता कर(cid:581)गे । (ii) शासी िनकाय के अ(cid:218)य(cid:162) को सोसाइट(cid:547) के सभी मामल(cid:585) और पदािधका(cid:464)रय(cid:585) के
कामकाज पर पय(cid:91)वे(cid:162)ण, िनद(cid:566)शन और िनयं(cid:287)ण क(cid:551) सार(cid:547) श(cid:464)(cid:416)यां ह(cid:585)गी।
(iii) शासी िनकाय के अ(cid:218)य(cid:162), शासी-िनकाय के सद(cid:232)य(cid:585) के अलावा ऐसे (cid:229)य(cid:464)(cid:416)य(cid:585)
को शासी-िनकाय क(cid:551) बैठक(cid:585) म(cid:581) (cid:464)वशेष-आमं(cid:287)ी सद(cid:232)य(cid:585) के (cid:510)प म(cid:581) आमंि(cid:287)त
कर सकते ह (cid:583), िज(cid:219)ह(cid:581) वे (cid:464)विश(cid:436) सलाह(cid:585) और (cid:464)वशेष(cid:163)ता के िलए उिचत समझ(cid:581)। (ख) काय(cid:91)कार(cid:547) िनकाय के अ(cid:218)य(cid:162) एवं उपा(cid:218)य(cid:162) ।—
(i) काय(cid:91)कार(cid:547)-िनकाय के िलए, काय(cid:91)कार(cid:547)-िनकाय के अ(cid:218)य(cid:162), तथा उनक(cid:551) अनुपि(cid:232)थित म(cid:581) काय(cid:91)कार(cid:547)-िनकाय के उपा(cid:218)य(cid:162) बैठक(cid:585) क(cid:551) अ(cid:218)य(cid:162)ता कर(cid:581)गे।
(ग) शासी िनकाय के सद(cid:232)य-सिचवा
(i) शासी िनकाय क(cid:551) बैठक(cid:581) बुलाऐंगे तथा काय(cid:91)वाह(cid:547) का (cid:464)ववरण दज(cid:91) कर(cid:581)गे।11 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026 (घ) काय(cid:91)कार(cid:547) िनकाय के सिचव ।—
(i) सोसाइट(cid:547) क(cid:551) सभी काय(cid:91)कार(cid:547) और (cid:464)व(cid:419)ीय श(cid:464)(cid:416)यां उसके सिचव म(cid:581) िन(cid:464)हत ह(cid:585)गी, जो सोसाइट(cid:547) (cid:430)ारा तय क(cid:551) गई गित(cid:464)विधय(cid:585) क(cid:551) योजना, काया(cid:91)(cid:219)वयन और िनगरानी के िलए िज(cid:224)मेदार ह(cid:585)गे।
(ii) सोसाइट(cid:547) (cid:430)ारा सिचव को स(cid:587)पे गए अ(cid:219)य कत(cid:91)(cid:229)य(cid:585) का पालन और िनव(cid:91)हन कर(cid:581)गे। (iii) सोसाइट(cid:547) के कोष का स(cid:224)पूण(cid:91) (cid:292)भार संभाल(cid:581)गे तथा ब(cid:583)क(cid:585) म(cid:581) सोसाइट(cid:547) के खाते खोल(cid:581)गे और उनका संचालन कर(cid:581)गे।
शासी-िनकाय और काय(cid:91)कार(cid:547)-िनकाय क(cid:551) श(cid:464)(cid:416)यां और काय(cid:91) ।—
12. (क) सोसाइट(cid:547) का (cid:464)(cid:272)या-कलाप शासी-िनकाय (cid:430)ारा संचािलत (cid:464)कया जाएगा, हालां(cid:464)क, यह सरकार के सम(cid:274) िनयं(cid:287)ण और नीितगत िनण(cid:91)य(cid:585) के अधीन होगा । शासी-िनकाय ऐसी सभी श(cid:464)(cid:416)य(cid:585) का (cid:292)योग करेगा जो अिधिनयम या इन उप-िनयम(cid:585) (cid:430)ारा (cid:292)ा(cid:431) ह (cid:583) और िजनका (cid:292)योग शासी-िनकाय क(cid:551) बैठक म(cid:581) सोसाइट(cid:547) (cid:430)ारा (cid:464)कया जाना आव(cid:230)यक है। शासी-िनकाय के काय(cid:607) म(cid:581) िन(cid:224)निलिखत शािमल ह(cid:585)गे: (i) सोसाइट(cid:547) (cid:430)ारा सम(cid:232)त (cid:510)प से नीित-माग(cid:91)दश(cid:91)न एवं काय(cid:91)(cid:272)म(cid:585) म(cid:581) सम(cid:219)वयन
कर लागू करना।
(ii) वा(cid:464)ष(cid:91)क काय(cid:91)-योजना, बजट और लेखा-पर(cid:547)ि(cid:162)त खात(cid:585) का सं(cid:232)वीकृ ित तथा
अनुमोदन करना।
(iii) सोसाइट(cid:547) के उ(cid:423)े(cid:230)य(cid:585), िनयम(cid:585) और (cid:464)विनयम(cid:585) को बनाना, बदलना और
संशोिधत करना, काय(cid:91)(cid:272)म(cid:585) और योजनाओं के (cid:292)भावी-(cid:464)(cid:272)या(cid:219)वयन के िलए
आव(cid:230)यक समझे जाने पर समय-समय पर सिमितय(cid:585) का गठन करना। (iv) सोसाइट(cid:547) के कम(cid:91)चा(cid:464)रय(cid:585), सिमितय(cid:585) और सलाहकार(cid:585) को (cid:292)शासिनक और
(cid:464)व(cid:419)ीय श(cid:464)(cid:416)यां और काय(cid:91) स(cid:587)पना।
(v) ऐसे उ(cid:419)रदािय(cid:215)व(cid:585) एवं कत(cid:91)(cid:229)य(cid:585) का पालन करना जो रा(cid:207)य सरकार समय-
समय पर उसे स(cid:587)पे।
(ख) शासी-िनकाय के सामा(cid:219)य िनयं(cid:287)ण और पय(cid:91)वे(cid:162)ण तथा उप-िनयम(cid:585) के तहत लगाए गए (cid:292)ितबंध(cid:585) के अधीन, काय(cid:91)कार(cid:547)-िनकाय के पास िन(cid:224)निलिखत श(cid:464)(cid:416)यां और काय(cid:91) ह(cid:585)गे, अथा(cid:91)त्:-

(cid:292)ा(cid:431) करना।12 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026 (iv) सोसाइट(cid:547) के िलए और उसक(cid:551) ओर से अनुबंध करना।
(v) सोसाइट(cid:547) के िखलाफ कानूनी काय(cid:91)वाह(cid:547) का बचाव करना।
(vi) शासी-िनकाय के पुवा(cid:91)नुमोदन से सोसाइट(cid:547) क(cid:551) (cid:464)कसी भी चल संप(cid:464)(cid:419) को
बेचना, ह(cid:232)तांत(cid:464)रत करना या अ(cid:219)यथा िनपटाना।
(vii) सोसाइट(cid:547) के उ(cid:423)े(cid:230)य(cid:585) को पूरा करने के िलए ऐसे शु(cid:227)क लगाने के िलए
कहना तथा सोसाइट(cid:547) (cid:430)ारा (cid:292)दान क(cid:551) गई सेवाओं (जैसा (cid:464)क िनधा(cid:91)(cid:464)रत (cid:464)कया
गया है) के िलए वसूल करना।
(viii) शासी-िनकाय के अनुमोदन के तहत सेवाएं (cid:292)दान करने के िलए
(cid:229)य(cid:464)(cid:416)य(cid:585)/तकनीक(cid:551) सहायता/सलाहकार(cid:585)/संगठन(cid:585) को संल(cid:202)न करना तथा
िनयोिजत करना।
(ix) व(cid:219)यजीव(cid:585) के देखभाल, संर(cid:162)ण एवं (cid:292)जनन के िलए आदान-(cid:292)दान
काय(cid:91)(cid:272)म, जाग(cid:510)कता और अनुसंधान के उ(cid:423)े(cid:230)य(cid:585) को पूरा करने के िलए
संगठन(cid:585)/सं(cid:232)थान(cid:585) के साथ सहयोग करना ।
(x) शासी-िनकाय (cid:430)ारा (cid:464)दए गए (cid:292)(cid:215)यायोजन के अनुसार पूंजीगत (cid:292)कृ ित के
काय(cid:91) करना ।
(xi) ऐसे सभी काय(cid:91) करना तथा ऐसी सभी काय(cid:607) का िन(cid:231)पादन करना जो
सोसाइट(cid:547) के उिचत (cid:292)बंधन के िलए आव(cid:230)यक ह(cid:585)।
(xii) सोसाइट(cid:547) या उसके अिधका(cid:464)रय(cid:585) (cid:430)ारा या उनके (cid:464)व(cid:509)(cid:424) या सोसाइट(cid:547) के
अिधका(cid:464)रय(cid:585) से संबंिधत (cid:464)कसी भी कानूनी काय(cid:91)वाह(cid:547) को (cid:292)ारंभ करना,
संचािलत करना, समा(cid:220)त करना या (cid:215)यागना तथा साथ ह(cid:547) देय (cid:464)कसी भी
ऋण और (cid:464)कसी भी दावे या मांग के भुगतान या संतु(cid:464)(cid:436) के िलए समझौता
करना। सोसाइट(cid:547) के (cid:464)व(cid:510)(cid:424) (cid:464)कसी भी मतभेद क(cid:551) म(cid:218)य(cid:232)थता के िलए
संदिभ(cid:91)त करना तथा उस पर (cid:464)दए गए (cid:464)कसी भी िनण(cid:91)य का पालन करना । (xiii) काय(cid:91)(cid:272)म(cid:585) के काया(cid:91)(cid:219)वयन के िलए आव(cid:230)यक माग(cid:91)दश(cid:91)न और िनदेश जार(cid:547)
करना।
(xiv) सोसाइट(cid:547) के वा(cid:464)ष(cid:91)क/(cid:287)ैमािसक काय(cid:91)(cid:272)म, काय(cid:91)-योजनाओं और प(cid:464)रयोजना के
(cid:292)(cid:232)ताव(cid:585) का समे(cid:464)कत (cid:510)प से जाँच करना और उ(cid:219)ह(cid:581) पा(cid:464)रत करना। सोसाइट(cid:547) के सिचव क(cid:551) श(cid:464)(cid:416)यां और काय(cid:91) ।—
13. (क) सोसाइट(cid:547) का सिचव इसका मु(cid:201)य काय(cid:91)कार(cid:547) अिधकार(cid:547) भी होगा। वह वा(cid:464)ष(cid:91)क काय(cid:91)-योजना तैयार करेगा और उसे काय(cid:91)कार(cid:547)-िनकाय के सम(cid:162) (cid:292)(cid:232)तुत करेगा। काय(cid:91)-योजना के वे घटक जो काय(cid:91)कार(cid:547)-िनकाय (cid:430)ारा (cid:232)वीकृ त (cid:464)कए जाऐंगे, उ(cid:219)ह(cid:581) शासी-िनकाय क(cid:551) अगल(cid:547) बैठक म(cid:581) अनुमो(cid:464)दत कराएगा।13 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026 (ख) शासी-िनकाय और काय(cid:91)कार(cid:547)-िनकाय के सभी िनण(cid:91)य, िनद(cid:566)श और आदेश सिचव (cid:430)ारा (cid:464)(cid:272)याि(cid:219)वत (cid:464)कए जाएँग(cid:581)। वह सोसाइट(cid:547) के िलए और उसक(cid:551) ओर से सभी प(cid:287)ाचार (cid:292)ा(cid:431) करेगा । वह सोसाइट(cid:547) के िलए सभी योगदान/अनुदान, उपहार, दान या अ(cid:219)य धनरािश (cid:292)ा(cid:431) करेगा और उसे सोसाइट(cid:547) के खाते म(cid:581) जमा करेगा और उसके िलए उिचत (cid:292)ाि(cid:431)-रसीद(cid:581) जार(cid:547) करेगा।
(ग) सिचव के पास सोसाइट(cid:547) के सभी संसाधन(cid:585), प(cid:464)रसंप(cid:464)(cid:419)य(cid:585), स(cid:224)प(cid:464)(cid:419)य(cid:585) और संपदाओं पर िनयं(cid:287)ण और पय(cid:91)वे(cid:162)ण होगा।
(घ) सोसाइट(cid:547) के खाते से धन क(cid:551) िनकासी सिचव और (cid:464)व(cid:419)-अिधकार(cid:547) (cid:430)ारा संयु(cid:416) (cid:510)प से ह(cid:232)ता(cid:162)(cid:464)रत चेक के मा(cid:218)यम से क(cid:551) जाएगी। य(cid:464)द (cid:464)व(cid:419)-अिधकार(cid:547) मौजूद नह(cid:547)ं है, तो उपा(cid:218)य(cid:162) और सिचव (cid:430)ारा संयु(cid:416) (cid:510)प से ह(cid:232)ता(cid:162)(cid:464)रत चेक के मा(cid:218)यम से िनकासी क(cid:551) जा सकती है। (ड) सोसाइट(cid:547) क(cid:551) ओर से सभी अनुबंध(cid:585) पर सिचव (cid:430)ारा ह(cid:232)ता(cid:162)र (cid:464)कए जाएंगे तथा काय(cid:91)कार(cid:547)- िनकाय के (cid:464)कसी अ(cid:219)य सद(cid:232)य (cid:430)ारा उनक(cid:551) गवाह(cid:547) द(cid:547) जाएगी।
(च) सिचव अपेि(cid:162)त वैधािनक (cid:464)रटन(cid:91) और (cid:464)ववरण तथा आविधक खात(cid:585) का अनुपालन करने क(cid:551) (cid:229)यव(cid:232)था कर(cid:581)गे। वह सोसाइट(cid:547) के मामल(cid:585), (cid:464)व(cid:419)ीय ि(cid:232)थित और बजट पर वा(cid:464)ष(cid:91)क (cid:292)शासिनक (cid:464)रपोट(cid:91) शासी-िनकाय और काय(cid:91)कार(cid:547)-िनकाय को (cid:292)(cid:232)तुत कर(cid:581)गे। वह समय-समय पर संशोिधत अिधिनयम क(cid:551) धारा 4 के तहत आव(cid:230)यक द(cid:232)तावेज सोसाइट(cid:547)ज के रिज(cid:232)(cid:282)ार के पास दािखल कर(cid:581)गे।
(छ) सिचव सोसाइट(cid:547) का (cid:292)ितिनिध(cid:215)व कर(cid:581)गे, तथा सभी (cid:219)याियक, अध(cid:91)-(cid:219)याियक काय(cid:91)वा(cid:464)हय(cid:585) और मामल(cid:585) म(cid:581) सोसाइट(cid:547) क(cid:551) ओर से काय(cid:91) कर(cid:581)गे, तथा उसे (cid:464)कसी भी काय(cid:91)वाह(cid:547) म(cid:581) अपना और सोसाइट(cid:547) का (cid:292)ितिनिध(cid:215)व करने के िलए अिधव(cid:416)ा रखने का अिधकार होगा। वह सोसाइट(cid:547) क(cid:551) ओर से मुकदमा कर सकता है या मुकदम(cid:585) क(cid:551) पैरवी कर सकता है।
(ज) (cid:464)व(cid:419)ीय िनयम(cid:585) के अंतग(cid:91)त अपेि(cid:162)त सोसाइट(cid:547) क(cid:551) लेखा-पु(cid:232)तक(cid:585) और अिभलेख(cid:585) को िनर(cid:547)(cid:162)ण के िलए सिचव (cid:292)(cid:232)तुत कर(cid:581)गे।
(झ) सिचव का यह कत(cid:91)(cid:229)य होगा (cid:464)क वह सोसाइट(cid:547) के उ(cid:423)े(cid:230)य(cid:585), ल(cid:234)य(cid:585) और िनयम(cid:585) के अनु(cid:510)प काया(cid:91)(cid:219)वयन, (cid:292)शासन तथा (cid:292)बंधन का काय(cid:91) कर(cid:581)गे।
(य) सोसाइट(cid:547) क(cid:551) ओर से सभी अनुबंध और अ(cid:219)य द(cid:232)तावेज सिचव (cid:430)ारा िन(cid:231)पा(cid:464)दत (cid:464)कए जाएंगे। सोसाइट(cid:547) क(cid:551) बैठक ।—
14. (क) शासी-िनकाय क(cid:551) बैठक वष(cid:91) म(cid:581) कम से कम दो बार होगी। काय(cid:91)कार(cid:547)-िनकाय क(cid:551) बैठक तीन माह म(cid:581) कम से कम एक बार होगी।
(ख) एक (cid:464)व(cid:419)ीय-वष(cid:91) के िलए शासी-िनकाय क(cid:551) पहल(cid:547) बैठक 30 जून से पहले आयोिजत क(cid:551) जाएगी, िजसम(cid:581) सोसाइट(cid:547) के अ(cid:219)य काय(cid:607) के साथ-साथ िन(cid:224)निलिखत का िनपटारा (cid:464)कया जाएगा, अथा(cid:91)त:

(iii) चालू वष(cid:91) के िलए लेखा-पर(cid:547)(cid:162)क(cid:585) क(cid:551) िनयु(cid:464)(cid:416)
(ग) सोसाइट(cid:547) के शासी-िनकाय और काय(cid:91)कार(cid:547)-िनकाय क(cid:551) बैठक सिचव (cid:430)ारा संबंिधत अ(cid:218)य(cid:162)/ उपा(cid:218)य(cid:162) के परामश(cid:91) से तय क(cid:551) गयी तार(cid:547)ख और समय पर आयोिजत क(cid:551) जाएगी।
(घ) बैठक बुलाने के िलए कम से कम सात (cid:464)दन पहले नो(cid:464)टस (cid:464)दया जाएगा। हालाँ(cid:464)क, असाधारण बैठक कम समय के नो(cid:464)टस पर बुलाई जा सकती है। डाक, ईमेल या (cid:464)कसी अ(cid:219)य (cid:464)डिजटल मा(cid:218)यम से सूचना देने को नो(cid:464)टस-(cid:292)ाि(cid:431) के (cid:510)प म(cid:581) माना जाएगा।
(ड) (cid:292)(cid:215)येक बैठक क(cid:551) अ(cid:218)य(cid:162)ता, अ(cid:218)य(cid:162) (cid:430)ारा क(cid:551) जाएगी और उनक(cid:551) अनुपि(cid:232)थित म(cid:581) अ(cid:218)य(cid:162) क(cid:551) सहमित से शासी-िनकाय के उपा(cid:218)य(cid:162) बैठक क(cid:551) अ(cid:218)य(cid:162)ता कर(cid:581)गे। इसी तरह, काय(cid:91)कार(cid:547)-िनकाय क(cid:551) बैठक के मामले म(cid:581), अ(cid:218)य(cid:162) और उनक(cid:551) अनुपि(cid:232)थित म(cid:581) काय(cid:91)कार(cid:547)-िनकाय के उपा(cid:218)य(cid:162), अ(cid:218)य(cid:162) क(cid:551) सहमित से अ(cid:218)य(cid:162)ता कर(cid:581)गे।
कोरम ।—
15. (cid:464)कसी बैठक के िलए (cid:219)यूनतम एक-ितहाई सद(cid:232)य(cid:585) क(cid:551) उपि(cid:232)थित गणपूित(cid:91) (कोरम) मानी जाएगी, बशत(cid:566) (cid:464)क संबंिधत िनकाय के अ(cid:218)य(cid:162) या उपा(cid:218)य(cid:162) बैठक म(cid:581) उपि(cid:232)थत ह(cid:585)।
अ(cid:218)य(cid:162)/उपा(cid:218)य(cid:162) क(cid:551) आपातकाल(cid:547)न श(cid:464)(cid:416) ।—
16. इन उप-िनयम(cid:585) म(cid:581) ऐसा कोई (cid:292)ावधान नह(cid:547)ं है जो अ(cid:218)य(cid:162)/उपा(cid:218)य(cid:162) को सोसाइट(cid:547) के उ(cid:423)े(cid:230)य(cid:585) को आगे बढ़ाने के िलए आपातकाल(cid:547)न ि(cid:232)थित म(cid:581) सोसाइट(cid:547) क(cid:551) श(cid:464)(cid:416)य(cid:585) का (cid:292)योग करने से रोके तथा इस संबंध म(cid:581) कृ त कार(cid:91)वाई क(cid:551) सूचना अगल(cid:547) सोसाइट(cid:547) क(cid:551) बैठक म(cid:581) (cid:464)दया जाएगा।
बैठक क(cid:551) काय(cid:91)वाह(cid:547) ।—
17. (i) सिचव, शासी-िनकाय/काय(cid:91)कार(cid:547)-िनकाय क(cid:551) (cid:292)(cid:215)येक बैठक के काय(cid:91)वाह(cid:547) को एक रिज(cid:232)टर म(cid:581) दज(cid:91) करवाऐंगे तथा उसपर उसके अ(cid:218)य(cid:162) (cid:430)ारा ह(cid:232)ता(cid:162)र करवाऐंगे एवं वह सिचव क(cid:551) अिभर(cid:162)ा म(cid:581) रहेगा।
(ii) सभी उठाए गए (cid:292)(cid:432)(cid:585) का समाधान बहुमत से (cid:464)कया जाएगा। (cid:292)(cid:215)येक सद(cid:232)य के पास एक वोट होगा और वोट बराबर होने क(cid:551) ि(cid:232)थित म(cid:581) अ(cid:218)य(cid:162) के पास िनणा(cid:91)यक वोट होगा।
(iv) बैठक क(cid:551) काय(cid:91)वाह(cid:547) सभी सद(cid:232)य(cid:585) को प(cid:464)रचािलत क(cid:551) जाएगी।15 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026 िनिध और संप(cid:464)(cid:419) ।—
18. (क) सोसाइट(cid:547) क(cid:551) चल और अचल-संप(cid:464)(cid:419)यां, िनिध, शासी-िनकाय म(cid:581) िन(cid:464)हत ह(cid:585)गी। सोसाइट(cid:547) क(cid:551) िनिधय(cid:585) म(cid:581) िन(cid:224)निलिखत सि(cid:224)मिलत ह(cid:585)गे :-
(i) सरकार(cid:547)/अध(cid:91)-सरकार(cid:547)/गैर-सरकार(cid:547) सं(cid:232)थाओं/(cid:229)य(cid:464)(cid:416)य(cid:585)/सोसाय(cid:464)टय(cid:585)/समूह(cid:585)/(cid:282)(cid:232)ट(cid:585)/ फाउं डेशन(cid:585)/ सीएसआर िनिधय(cid:585)/अ(cid:219)य (cid:464)व(cid:419)ीय सं(cid:232)थाओं आ(cid:464)द से अनुदान/उपहार/ दान/िनिध/पूंजी।
(ii) संजय गांधी जै(cid:464)वक उ(cid:429)ान (cid:430)ारा उ(cid:215)प(cid:219)न सभी राज(cid:232)व (जैसे (cid:464)टकट शु(cid:227)क, (cid:464)विभ(cid:219)न उपयोगकता(cid:91) शु(cid:227)क, सु(cid:464)वधाओं क(cid:551) िन(cid:464)वदा, जुमा(cid:91)ना, नीलामी, (cid:464)कराया शु(cid:227)क, व(cid:219)य(cid:292)ाणी द(cid:419)क(cid:274)हण क(cid:551) (cid:292)ाि(cid:431)याँ, (cid:464)विभ(cid:219)न व(cid:232)तुओं क(cid:551) (cid:464)ब(cid:272)(cid:551), लाइस(cid:581)स शु(cid:227)क, उपयोगकता(cid:91)ओं या आगंतुक(cid:585) आ(cid:464)द पर लगाए गए कोई अ(cid:219)य शु(cid:227)क इ(cid:215)या(cid:464)द) । (iii) िनवेश एवं अ(cid:219)य (cid:304)ोत(cid:585) से आय।
(ख) सोसाइट(cid:547) (cid:430)ारा या उसक(cid:551) ओर से (cid:292)ा(cid:431) सभी धनरािश सोसाइट(cid:547) के नाम से डाकघर या (cid:464)कसी अ(cid:219)य रा(cid:438)ीयकृ त ब(cid:583)क म(cid:581) खोले गए एक या अिधक बचत खात(cid:585) म(cid:581) जमा क(cid:551) जाएगी। सिचव, सोसाइट(cid:547) के (cid:464)व(cid:419)-अिधकार(cid:547) के साथ िमलकर, शासी-िनकाय (cid:430)ारा समय-समय पर िन(cid:464)द(cid:91)(cid:436) सीमाओं के भीतर ब(cid:583)क खाते का संचालन कर(cid:581)गे।
(ग) सोसाइट(cid:547) के (cid:292)योजन के िलए त(cid:215)काल आव(cid:230)यक न होने वाल(cid:547) सम(cid:232)त धनरािश को रा(cid:438)ीयकृ त ब(cid:583)क(cid:585) म(cid:581) साविध जमा म(cid:581) अथवा भारतीय (cid:282)(cid:232)ट अिधिनयम, 1882 अथवा साव(cid:91)जिनक िनिधय(cid:585) के िनवेश को (cid:464)विनयिमत करने वाले (cid:464)कसी अ(cid:219)य कानून (cid:430)ारा (cid:292)ािधकृ त (cid:292)ितभूितय(cid:585) म(cid:581) िनवेश (cid:464)कया जा सके गा।
(घ) सोसाइट(cid:547) अपने पंजीकृ त काया(cid:91)लय म(cid:581) उिचत लेखा-पु(cid:232)तक(cid:581) रखेगी, िजसम(cid:581) िन(cid:224)निलिखत को सह(cid:547) ढंग से दज(cid:91) (cid:464)कया जाना चा(cid:464)हए:
i) (cid:292)ा(cid:431) सभी धनरािशयां और उनका (cid:304)ोत तथा सोसाइट(cid:547) (cid:430)ारा (cid:229)यय क(cid:551) गई सभी धनरािशयां और वह उ(cid:423)े(cid:230)य या (cid:292)योजन िजसके िलए ऐसी धनरािशयां (cid:229)यय क(cid:551) गई ह (cid:583),
ii) सोसाइट(cid:547) क(cid:551) प(cid:464)रसंप(cid:464)(cid:419)यां और देनदा(cid:464)रयां।
अंके (cid:162)ण ।—
19. सोसाइट(cid:547) के वा(cid:464)ष(cid:91)क-लेखा का ऑ(cid:464)डट शासी-िनकाय (cid:430)ारा िनयु(cid:416) चाट(cid:91)ड(cid:91) अकाउं ट(cid:581)ट क(cid:551) (cid:292)ित(cid:464)(cid:437)त फम(cid:91) (cid:430)ारा कराया जाएगा। आव(cid:230)यकता पड़ने पर इसे महालेखाकार, (cid:464)बहार (cid:430)ारा भी ऑ(cid:464)डट कराया जा सकता है।16 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026 के (cid:219)(cid:289)/रा(cid:207)य सरकार के िनद(cid:566)श ।—
20. सोसाइट(cid:547) ऐसे िनद(cid:566)श(cid:585) का पालन करेगी जो उसे भारत सरकार या रा(cid:207)य सरकार (cid:430)ारा समय-समय पर जार(cid:547) (cid:464)कए जाएंगे । सोसाइट(cid:547) भारत सरकार या रा(cid:207)य सरकार को ऐसी (cid:464)रपोट(cid:91), (cid:464)रट(cid:91)न और अ(cid:219)य जानकार(cid:547) उपल(cid:222)ध कराएगी, िजनक(cid:551) समय-समय पर उनके (cid:430)ारा आव(cid:230)यकता हो।

21. रा(cid:207)य सरकार जब भी आव(cid:230)यक समझे, उपयु(cid:416) समझी जाने वाल(cid:547) एज(cid:581)िसय(cid:585) के मा(cid:218)यम से सोसाइट(cid:547) के काय(cid:574) के िन(cid:231)पादन का बा(cid:443)-मू(cid:227)यांकन करा सकती है।

22. अिधिनयम क(cid:551) धारा 10 और 11 के (cid:292)ावधान(cid:585) के अधीन, सोसाइट(cid:547) के (cid:292)(cid:215)येक सद(cid:232)य, कम(cid:91)चार(cid:547) और एज(cid:581)ट को सोसाइट(cid:547) के मामल(cid:585) से संबंिधत और (cid:292)ासंिगक आिधका(cid:464)रक कत(cid:91)(cid:229)य के िनव(cid:91)हन म(cid:581) (cid:464)कए गए (cid:464)कसी भी काय(cid:91) से उ(cid:215)प(cid:219)न (cid:464)कसी भी काय(cid:91)वाह(cid:547), चाहे वह िस(cid:464)वल या आपरािधक हो, का बचाव करने म(cid:581) उसके (cid:430)ारा (cid:464)कए गए (cid:464)कसी भी लागत, (cid:229)यय या देयता के िखलाफ (cid:162)ितपूित(cid:91) क(cid:551) जाएगी। (cid:464)वघटन ।—
23. (क) सोसाइट(cid:547) का (cid:464)वघटन सोसाइट(cid:547) पंजीकरण अिधिनयम, 1860 क(cid:551) धारा 13 और 14 के (cid:292)ावधान(cid:585) के अनुसार (cid:464)कया जा सके गा।

of Sanjay Gandhi Biological Park Management and Development Society Name of the Society.—
1. The name of the society shall be the "Sanjay Gandhi Biological Park Management and Development Society (SGBPMDS)".
Registered Office.—
2. The Registered Office of the Society viz., the Sanjay Gandhi Biological Park Management and Development Society shall be situated in the office of the Director, Sanjay Gandhi Biological Park, Bailey Road, Patna (Pin-800001), District- Patna, Bihar.
The area of operation.—
3. The area of operation of the Society shall be the area of Patna district in general and Sanjay Gandhi Biological Park in particular, and any such area which may be brought within its fold by Government orders. In special circumstances like Man-animal conflict co-ordination in other areas, co- ordination with other zoos within the State etc., the area would extend to the whole of the State.
Aim and Objectives.—
4. The aims and objectives of the Society are as follows:
(a) complementing, supplementing, strengthening or otherwise expanding the activities of Sanjay Gandhi Biological Park in the cause of conservation of wildlife, captive management of wildlife and eco- tourism and facilitating linkage between ex-situ and in-situ management of wildlife.
(b) to provide platform for open debate, discussion etc. and subscribe or otherwise assist any charitable, benevolent, scientific, national, public or any other institution the objectives or purpose of which are consistent with or which promotes objectives of the society.
(c) to coordinate and liaise with national/ international bodies, experts and funding agencies and to receive contribution, CSR, donation, gifts, grants and other funds from Government of India, Central Zoo Authority, State Government, non-governmental organizations or any individual, institute, national or international agencies, Government or private, any other institution of Central Government or State Government for specific conservation programmes, development of eco-tourism amenities of Sanjay Gandhi Biological Park.
(d) to receive and manage all contributions, donations, gifts (NGOs, Corporates, Institutions, including Private & Individual as well) and funds given to the Society, as well as the revenue generated by the18 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026 Sanjay Gandhi Biological Park in form of ticketing charges, various user charges, tendering of facilities, penalties, auctions, rental charges, animal adoptions, sales of various items, license fees, any other fees or charges levied on users or visitors etc. in larger interest of Sanjay Gandhi Biological Park for maintenance and upkeep of zoo animals, improve the premises as well as maintenance and improvement of visitors' amenities.
(e) to obtain projects from government/ semi-government/ non-government entities and provide consultancy services.
(f) to set apart and create special funds for special objects and apply the same or any part thereof for such objects.
(g) to engage/ employ such contractual staff as may be necessary for efficient handling and conduct of business of the society with approval of Governing Body.
(h) The persons/staffs/service providers employed by the society on contractual/daily wages basis will get payment from funds of the society as per norms and approval of the governing body. This will include EPF contributions or any other insurance for the futuristic benefits of staffs employed by the society. This does not include those employees which are in government service.
(i) to acquire immovable properties in furtherance of objectives, with the prior approval of the state government.
(j) to carry out any other activities in the furtherance of the above objectives.
Income and property of the Society.—
5. Any income or profit received by the society shall be applied solely for promoting the objectives of the society as set forth in this memorandum and no portion thereof shall be paid or transferred directly or indirectly by way of salary, dividend, bonus, income or profit to any of the members of the society provided nothing herein contained shall apply to payment of reasonable incidental expenses to such members.
Dissolution of the Society.—
6. (i) The dissolution of the Society shall be done in accordance with the provisions under Section 13 and 14 of the Societies Registration Act, 1860.
(ii) If on dissolution, there shall remain after clearance of its debts and liabilities, any property, assets and funds of the Society whatsoever, the same shall not be paid to or distributed among the members of the Society or any of them, but it shall be transferred to the State19 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026 Government in such a manner as department of Environment, Forests and Climate Change may determine.
7. Short Title, Extent and Commencement.—
1. (a) These bye-laws shall be called "The Sanjay Gandhi Biological Park Management and Development Society Bye-laws, 2025", hereinafter referred to as 'Bye-laws'.
(b) These bye-laws shall apply to all the members, properties, activities and transactions of the Society for Management & Development of Sanjay Gandhi Biological Park, Patna.
(c) These bye-laws shall come into force on the date of registration of the Society i.e. "Sanjay Gandhi Biological Park Management and Development Society" under the Societies Registration Act, 1860.
Definition.—
2. In these Bye-laws, unless there is anything repugnant to the subject or context, (a) "Act" means the Societies Registration Act, 1860 (Act No. XXI of 1860). (b) "Chairperson" means the Chairperson of the Governing Body (GB) of the Sanjay Gandhi Biological Park Management and Development Society, Patna,
(c) "CZA" means the Central Zoo Authority, New Delhi, (d) "Director" means the Director, Sanjay Gandhi Biological Park, Patna, (e) "Executive Body" means the Executive Body (EB) of the society, (f) "Finance Officer" means the Finance Officer of the Society, (g) "Governing Body" means the apex body of the society constituted under these bye-laws,
(h) "Government" means, unless otherwise specifically mentioned, the State Government of Bihar,
(i) "Secretary" means the Secretary of the Executive Body of the society, (j) "Society" means the Sanjay Gandhi Biological Park Management and Development Society,
(k) "Rules of the Society" means the Bye-laws of the Sanjay Gandhi Biological Park Management and Development Society,
(l) "Vice Chairperson" means the Vice Chairperson of the Governing Body of the society,
(m) "Year" means the financial year beginning with 1st day of April and ending on the 31st day of March of the following year.
The Bihar General Clauses Act shall apply, mutatis mutandis, for definition of the terms, not defined herein with proper variance.
Registered Office.—
3. The Registered office of the Society shall be situated at the office of the Director, Sanjay Gandhi Biological Park, Patna, Bihar until otherwise decided by the Governing Body. Date of adoption of bye-laws and jurisdiction.—
4. These bye-laws shall come into force from the date of registration of the Sanjay Gandhi Biological Park Management and Development Society under the Societies Registration Act, 1860. The jurisdiction of the Society shall be the area of Patna district in general and Sanjay Gandhi Biological Park in particular, and any such area which may be brought within its fold by Government orders. 6. The Governing Body and Executive Body of the Society for Management & Development of Sanjay Gandhi Biological Park shall be constituted with the following members:

7. (a) The Government shall have, in its absolute discretion, the power to remove from office any member nominated to the Governing Body / Executive Body at any time and shall have the right to fill the vacancy.
(b) The ex-officio members shall hold office as member during their tenure of appointment in their office.
(c) The non-official members will hold office for a period of three years at a time. They may be re-nominated by the competent authority.
(d) The State Govt. may, from time to time, nominate any official of the Government as member of the Society.
23 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026Termination of ex-officio Membership.—
8. When a person becomes an ex-officio member of the Society by virtue of the office or appointment, which he/she holds, his/her membership of the Society shall stand terminated when he/she ceases to hold that office or appointment.
Termination of Membership of other.—s
9. Membership of members other than ex-officio members, shall stand terminated in any of the following situations:
(i) on expiry of the period of membership for which nominated; (ii) death, resignation, insolvency, lunacy or conviction for a criminal offence involving moral turpitude;
(iii) when a member does not attend three consecutive meetings without proper leave of absence.
Restrictions on the activity of the Society or its Authority.—
10. The Society or any of its authority shall not be competent to appoint any person, or lease, or in any way transfer the right, title or possession of any asset such as land/premises/capital asset, any office or building, forest etc of Sanjay Gandhi Biological Park without the prior sanction of the Government. However, the Society can engage contractual employees and undertake or authorize any civil construction or use its premises following guidelines of the Central Zoo Authority and guidelines issued by other competent authorities in consonance with CZA guidelines.
Power/Function of office Bearers.—
11. There shall be a Chairperson, a Vice Chairperson and a Member-secretary of Governing Body (GB) and a Chairperson, a Vice Chairperson and a Secretary of the Executive Body (EB) of Society. The Director, Sanjay Gandhi Biological Park, Patna, besides being the member-secretary of the Governing body, shall also be the Secretary of the Society and function as its Chief Executive Officer. A. Chairperson & Vice Chairperson of Governing Body.—
(i) The Chairperson, of the Governing Body shall preside over and conduct the meetings of the Governing Body and in his absence Vice Chairperson of the Governing Body will preside.
(ii) The Chairperson of the Governing Body shall have overall powers of supervision, direction and control over all affairs of the Society and functioning of office bearers.
(iii) The Chairperson of the Governing Body may invite such persons other than the members of the Governing Body as special invitees to the meetings of the Governing Body as he/she thinks proper for specialized inputs and expertise.
B. Chairperson & Vice Chairperson of Executive Body.—
(i) For Executive Body, the Chairperson, EB, and in his/ her absence the Vice Chairperson, EB will preside over the meetings.
C. Member Secretary of Governing Body.—
(ii) Will convene the meetings of the Governing Body and record the minute of the proceedings.
24 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026D. Secretary of the Executive Body.—
(i) All executive and financial power of the Society shall vest in its Secretary, EB who shall be responsible for planning, implementation and monitoring of activities as would be decided by the Society.
(ii) Will exercise and discharge such other duties as may be delegated to the Secretary by the Society.
(iii) Will remain in overall charge of funds of the Society and open and operate the Society's accounts in the banks.
Power and Function of Governing Body and Executive Body.—
12. (a) The business of the Society shall be managed by the Governing Body, subject however, to the overall control and policy decisions of the Government. The Governing Body shall exercise all such powers as are got by the Act or by these bye-laws required to be exercised by the Society at the meeting of Governing Body. Following will be included in the functions of the Governing Body:
(i) Overall policy guidance and co-ordination of programmes implemented by the Society,
(ii) To approve and sanction the Annual Plan, Budget and Audited Accounts,
(iii) To make, alter and amend the objectives, rules and regulation of the society, constitute committees from time to time as and when considered necessary for effective execution of the programmes and schemes,
(iv) To delegate administrative and financial powers and functions to the employees, committees and consultants of the Society, (v) To execute such responsibilities and such duties which the state government assigns it from time to time.
(b) Subject to the general control and supervision of the Governing Body and the restrictions imposed under the bye-laws, the Executive Body shall have the following powers and functions, namely:
(i) to manage properties including fund of the Society, (ii) to raise funds for the society by receiving fees, gifts and
donations etc,
(iii) to receive any movable and immovable property for and on
behalf of the Society,
(iv) to enter into agreement for and on behalf of the Society, (v) to defend legal proceedings against the Society, (vi) to sell, transfer or otherwise dispose of any movable property of the Society with the prior approval of Governing Body, (vii) to ask for levying such fees & charges to meet out objectives of the society as well as to make recovery for the services (as prescribed) provided by the society.
(viii) to engage and employ persons/ technical support/ consultants/ organizations for rendering services under approval of Governing body.
(ix) to collaborate with organizations/ institutions to meet out objectives of animal care, exchange programs for conservation & breeding, awareness and research.
25 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026(x) to undertake works of capital nature as per the delegation given
by the Governing Body,
(xi) to perform all such acts and do all such things as may be
necessary for proper management of the affairs of the Society, (xii) to institute, conduct, compound or abandon any legal proceedings by or against the society or its officers or otherwise concerning the officers of the society and also to compound and allow time for payment or satisfaction of any debts due and of any claims or demands by or against the Society and to refer any difference to arbitration and observe and perform any award made thereon,
(xiii) to issue guidelines and directions as may be necessary for
implementation of programmes,
(xiv) to critically examine and to pass the annual/quarterly work
programme of the Society, action plans and project proposals.
Power and Functions of the Secretary of Society.—
13. (a) The Secretary of the Society shall also be the Chief Executive Officer of the Society. He will prepare and present the Annual Action Plan before the Executive Body. Those components of the Action Plan which are sanctioned by the Executive Body, shall be got approved in the next meeting of the Governing Body.
(b) All decisions, instructions and orders of the Governing Body and Executive body shall be carried out by the Secretary. He shall receive and make all correspondences for and on behalf of the Society. He will receive all contributions/ grants, gifts, donations or other funds meant for the Society and credit the same into Society's account and will issue proper receipts for the same.
(c) The Secretary shall have control and supervision of all resources, assets, properties and estates of the Society.
(d) Withdrawal of money from account of the Society will be through cheques jointly signed by the Secretary and Finance Officer. In case the finance officer is not there, the withdrawal may be done through cheques jointly signed by the Vice-chairperson and the Secretary.
(e) All contracts on behalf of the Society shall be signed by Secretary and witnessed by another member of the Executive Body.
(f) The Secretary shall arrange to comply with the requisite statutory returns and statements and periodical accounts. He shall submit Annual Administration Report on the affairs, financial position and budget of the Society to the Governing Body and the Executive Body. He shall file with the Registrar of Societies, documents required under Section 4 of the Act as amended from time to time.
(g) The Secretary shall represent the Society, and act on its behalf and in stead of it, in all judicial, quasi-judicial proceedings and matters and shall have powers to engage advocate(s) to represent him and the Society in any proceedings. He may sue or be sued on behalf of the society.
(h) The Secretary shall present for inspection the books of accounts and records of the Society as required under the financial rules.
26 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026(i) It shall be the duty of the Secretary to carry out the works, administration and management of the Society in conformity with the aims and objectives and rules of the Society.
(j) All contracts and other instruments on behalf of the Society shall be executed by the Secretary.
Meeting of the Society.—
14. (a) The Governing Body shall meet at least twice a year. The Executive Body shall meet at least once in 3 (three months).
(b) The first meeting of the Governing Body for a financial year shall be held at a date not later than 30th June where among other business of the Society, the following shall be disposed of, namely: (i) Consideration and approval of the Annual Report of the activities of the Society for the preceding year together with the audited copy of the balance sheet for the said year,
(ii) Income and expenditure, receipt and payment accounts and the Audit Report relating to the previous year, and (iii) Appointment of Auditors for the current year.
(c) The meeting of the Governing Body and Executive Body of the Society shall be held at such date and time as may be fixed by the Secretary in consultation with the concerned Chairperson/Vice-Chairperson.
(d) At least seven days notice shall be given for convening a meeting. An extraordinary meeting may, however, be called at a shorter notice. Delivery of notice through post, email or any other digital medium would be construed as service of notice.
(e) Every meeting shall be presided over by the Chairperson and in his/her absence the Vice-Chairperson of the Governing Body shall preside, with the consent of the Chairperson. Similarly, in case of Executive Body meeting, the Chairperson and in his/her absence the Vice-Chairperson of EB will preside over, with the consent of the Chairperson.
Quorum.—
15. A minimum one-third of the number of members would constitute the quorum for a meeting, provided that either the Chairperson or the Vice-Chairperson of the concerned Body is present at the meeting.
Emergency Power of the Chairperson/Vice Chairperson.—
16. Nothing in these bye-laws shall prevent the Chairperson/Vice-Chairperson from exercising powers of the Society in case of emergencies for furtherance of the objectives of the Society and action taken shall be reported to the Society in the next General Body meeting.
Proceeding of the meetings .—
17. (i) The Secretary shall cause minutes of every meeting of the Governing Body/ Executive Body to be entered in a Register and duly signed by the Chairperson thereof and it shall be in the custody of the Secretary. (ii) All disputed questions shall be resolved by majority votes. Each member shall have one vote and in case of equality of votes, the Chairperson shall have a second casting vote.
(iii) The proceeding of the meeting shall be circulated to all members.
27 (cid:464)बहार गजट (असाधारण), 21 जनवर(cid:547) 2026Funds and properties .—
18. (a) The funds and properties of the Society, movable and immovable, shall be vested in the Governing Body. The funds of the Society shall consist of the following:
(i) Grants/ gifts/ donations/ funds/ capital from Government/ semi- government/ non-government entities/ individuals/ societies/ groups/ trusts/ foundations/ CSR funds/ other financial institutions etc.
(ii) All revenue generated by the Sanjay Gandhi Biological Park (eg. ticketing charges, various user charges, tendering of facilities, penalties, auctions, rental charges, animal adoptions, sales of various items, license fees, any other fees or charges levied on users or visitors etc etc).
(iii) Income from investments and other sources.
(b) All money received by or on behalf of the Society shall be paid in one or more savings accounts to be opened in the name of the Society in Post Office or any other nationalized bank. The Secretary, jointly with Finance officer of the Society, shall operate the bank account within the limits, if any, specified by the Governing Body from time to time.
(c) All money not immediately required for the purpose of the Society may be invested in fixed deposits in nationalized banks or in securities authorized by the Indian Trusts Act, 1882 or any other law regulating the investments of public funds.
(d) The Society shall keep at its registered office proper Books of Accounts in which the following should be entered accurately:
i) All sums of money received and source thereof and all sums of money spent by the society and the object or purpose for which such sums are expended,
ii) The society's assets and liabilities.
Audit.—
19. The annual account of the Society shall be got audited by reputed firm of Chartered Accountants appointed by the Governing Body. It can be further audited by the Accountant General, Bihar, if required.
Directions of Central/State Government.—
20. The Society shall comply with such directions as may be issued to it from time to time by the Government of India or State Government. The Society shall furnish to the Government of India or State Government such reports, returns and other information as may be required by them from time to time.
External Evaluation.—
21. The State Government may conduct external evaluation of Society's performance as and when felt necessary through agencies as deemed appropriate.
Indemnity.—
22. Subject to the provisions of sections 10 and 11 of the Act, every member, employee and agent of the Society shall be indemnified against any cost, expense or liability incurred by him in defending any proceeding, whether civil or criminal, arising out of any act done in the discharge of official duty relating and relevant to the affairs of the Society.

23. (i) The dissolution of the Society shall be done in accordance with the provisions under Section 13 and 14 of the Societies Registration Act, 1860.
(ii) If on dissolution, there shall remain after clearance of its debts and liabilities, any property, assets and funds of the Society whatsoever, the same shall not be paid to or distributed among the members of the Society or any of them, but it shall be transferred to the State Government in such a manner as department of Environment, Forests and Climate Change may determine.
Amendment.—
24. On recommendation of the Governing Body, the State Government may make, alter and amend the objectives, rules and regulation of Society from time to time as and when considered necessary for effective execution of the programmes and schemes by passing a resolution.
