1. संक्षिप्त नाम, विस्तार एवं प्रारंभ।-
(1) यह नियमावली बिहार असैनिक सेवा (न्याय शाखा) (भर्ती) (संशोधन) नियमावली, 2026 कही जा सकेगी।
(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह बिहार सरकार के राजपत्र में प्रकाशन की तिथि से प्रभावी होगा।
2. बिहार असैनिक सेवा (न्याय शाखा) (भर्ती) नियमावली, 1955 (समय-समय पर यथा संशोधित) के परिषिष्ट 'ग' की कंडिका-2 में अंकित वैकल्पिक विषय 'साक्ष्य एवं प्रक्रिया विधि' शीर्षक के अधीन अंकित ''भारतीय साक्ष्य अधिनियम (संख्या-1, 1872)'' तथा ''दंड प्रक्रिया संहिता, 1973 (संख्या-2, 1974)'' का प्रतिस्थापन।-उक्त नियमावली के परिषिष्ट 'ग' की कंडिका-2 में अंकित वैकल्पिक विषय 'साक्ष्य एवं प्रक्रिया विधि' शीर्षक के अधीन अंकित ''भारतीय साक्ष्य अधिनियम (संख्या-1, 1872)'' तथा ''दंड प्रक्रिया संहिता, 1973 (संख्या-2, 1974)'' को निम्नवत् प्रतिस्थापित किया जाएगाः-

(भा.ना.सु.सं.)'' द्वारा।2 (cid:464)बहार गजट (असाधारण), 29 जनवर(cid:547) 2026 3. बिहार असैनिक सेवा (न्याय शाखा) (भर्ती) नियमावली, 1955 (समय-समय पर यथा संशोधित) के परिषिष्ट 'ग' की कंडिका-2 में अंकित वैकल्पिक विषय 'साक्ष्य एवं प्रक्रिया विधि' शीर्षक के अधीन परीक्षा के पाठ्यक्रम में जोड़ा जाना।-उक्त नियमावली के परिषिष्ट 'ग' की कंडिका-2 में अंकित वैकल्पिक विषय 'साक्ष्य एवं प्रक्रिया विधि' शीर्षक के अधीन परीक्षा के पाठ्यक्रम में निम्नवत् जोड़ा जाएगाः-
''भारतीय न्याय संहिता, 2023 (भा.न्या.सं.)।''
4. बिहार असैनिक सेवा (न्याय शाखा) (भर्ती) नियमावली, 1955 (समय-समय पर यथा संशोधित) के नियम 3 क (iii) का प्रतिस्थापन।-उक्त नियमावली के नियम 3 क (iii) निम्नवत् प्रतिस्थापित किया जाएगाः-
''(iii) बिहार राज्य के मूल निवासी महिला अभ्यर्थियों को ही सभी श्रेणियों में 35 प्रतिषत क्षैतिज आरक्षण तथा बिहार राज्य के मूल निवासी बेंचमार्क अस्थि दिव्यांग मात्र को ही 01 प्रतिषत क्षैतिज आरक्षण अनुमान्य होगी।''

No. 7/Ashta-04-57/2025-2089/GAD—In exercise of the powers conferred by Article 234 of Constitution of India, the Governor of Bihar is pleased to make the following rules to amend the Bihar Civil Service (Judicial Branch) (Recruitment) Rules, 1955 (as amended from time to time) in consultation with the High Court, Patna:-
1. Short, Title, Extent and Commencement.-
(1) These rules may be called the Bihar Civil Service (Judicial Branch) (Recruitment) Amendment Rules, 2026.
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force from the date of publication in the official Gazette of the Government of Bihar.
2. Substitution of The optional subjects The Indian Evidence Act (1 of 1872) and Code of Criminal Procedure, 1973 (2 of 1974) under the heading 'Law of Evidence and Procedure', mentioned in Serial no. 2 of Appendix 'C' of the Bihar Civil Service (Judicial Branch) (Recruitment) Rules, 1955 (as amended from time to time)-The optional subjects The Indian Evidence Act (1 of 1872) and Code of Criminal Procedure, 1973 (2 of 1974) under the heading 'Law of Evidence and Procedure', mentioned in Serial no. 2 of Appendix 'C' of the said Rules, 1955, shall be substituted by the following:-
(i) "Indian Evidence Act (1 of 1872)" by "The Bharatiya Sakshya Adhiniyam, 2023 (B.S.A.)."
(ii) "Code of Criminal Procedure, 1973 (2 of 1974)" by "The Bharatiya Nagarik Suraksha Sanhita, 2023 (B.N.S.S.)."
3. Insertion of The optional subject in the Syllabus of the examination under the heading 'Law of Evidence and Procedure', mentioned in Serial no. 2 of Appendix 'C' of the Bihar Civil Service (Judicial Branch) (Recruitment) Rules, 1955 (as amended from time to time).—The optional subject in the Syllabus of the examination under the heading 'Law of Evidence and Procedure', mentioned in Serial no. 2 of Appendix 'C' of the said Rules, 1955, shall be Inserted as following:-
"The Bharatiya Nyaya Sanhita, 2023 (B.N.S.)."3 (cid:464)बहार गजट (असाधारण), 29 जनवर(cid:547) 2026 4. Substitution of Rule 3A(iii) of the Bihar Civil Service (Judicial Branch) (Recruitment) Rules, 1955 (as amended from time to time).— In the Bihar Civil Service (Judicial Branch) Recruitment Rules, 1955, Rule 3A(iii) shall be substituted by the following:-
"(iii) Only female candidates who are residents of Bihar State shall be eligible for 35% horizontal reservation in all categories and only benchmark orthopedically disabled candidates who are residents of Bihar State shall be eligible for 1% horizontal reservation."
