चूँकि बिहार सरकार का मानना है कि अन्य राज्यों मेें अथवा विदेषों में असंगठित क्षेत्र में कार्य करने वाले प्रवासी मजदूरों को दुर्घटना के फलस्वरूप मृत्यु की स्थिति में अनुदान स्वरूप दी जाने वाली अनुदान राषि में वृद्धि करना, मृत प्रवासी मजदूरों के पार्थिव शरीर को उनके स्थायी निवास तक पहुँचाने हेतु आर्थिक सहायता प्रदान करने का प्रावधान करना आवष्यक है।
इसलिए अब भारत के संविधान के अनुच्छेद 39 (क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्य सरकार ''बिहार राज्य प्रवासी मजूदर दुर्घटना अनुदान योजना नियमावली, 2008'' का संषोधन करने हेतु निम्नलिखित नियमावली बनाती है :-
बिहार राज्य प्रवासी मजदूर दुर्घटना अनुदान योजना (संषोधन) नियमावली, 2026 1. संक्षिप्त नाम, विस्तार एवं प्रारंभ।-
(1) यह नियमावली ''बिहार राज्य प्रवासी मजदूर दुर्घटना अनुदान योजना (संषोधन) नियमावली, 2026'' कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह अधिसूचना राजपत्र में प्रकाषन की तिथि से प्रवृत्त होगी।
2. बिहार राज्य प्रवासी मजदूर दुर्घटना अनुदान योजना नियमावली, 2008 के नियम-5 का संशोधन।- उक्त नियमावली के नियम-5 को निम्नवत प्रतिस्थापित किया जायेगाः-
5. प्रवासी मजदूर की मृत्यु अथवा पूर्ण स्थायी एवं स्थायी आंशिक अपंगता के मामले में, न्यायनिर्णित आश्रितों अथवा प्रवासी मजदूर को अनुदान की राशि RTGS (Real Time Gross Settlement) पद्धति से उनके बैंक खाता के माध्यम से देय होगी। यदि अंचलाधिकारी द्वारा घोषित आश्रितों के विरूद्ध कोई विवाद हो, तो जिला मजिस्टे्रट के समक्ष अपील होगी, जिसका विनिश्चय अन्तिम होगा।2 (cid:464)बहार गजट (असाधारण), 9 फरवर(cid:547) 2026 (क) प्रवासी मजदूर की मृत्यु की स्थिति में उनके न्याय-निर्णित आश्रित(तों) को 4,00,000/-(चार लाख रूपये) के अनुदान राशि का भुगतान RTGS (Real Time Gross Settlement) पद्धति से उनके बैंक खाता में किया जाएगा। (ख) प्रवासी मजदूर के पूर्ण स्थायी अपंगता की स्थिति में रु॰ 1,00,000/- (एक लाख रूपये) के अनुदान की राशि का भुगतान RTGS (Real Time Gross Settlement) iद्धति से उनके बैंक खाता में किया जाएगा।
(ग) प्रवासी मजदूर के स्थायी आंशिक अपंगता की स्थिति में रु॰ 50,000/-
(पचास हजार रूपये) के अनुदान की राशि का भुगतान RTGS (Real Time Gross Settlement) पद्धति से उनके बैंक खाता में किया जाएगा।
(घ) राज्य के बाहर अथवा विदेषों में कार्य करने वाले प्रवासी मजदूरों की दुर्घटना मृत्यु होने की स्थिति में उनके पार्थिव शरीर को किसी भी परिवहन साधन द्वारा उनके स्थायी निवास स्थान तक पहुँचाने पर होने वाले व्यय की राशि राज्य सरकार वहन करेगी। IML-06/2016-16/

S.O. 75, dated 9th February 2026.—Since the Government of Bihar is convinced that it is necessary to increase the amount of grant given to migrant labourers working in unorganized sector in other States or abroad in the event of death due to accident and to provide financial assistance for transporting the dead bodies of deceased migrant labourers to their permanent residence.
Therefore, in exercise of the powers conferred by Article 39 (a) of the Constitution of India, the State Government makes following rules to amend the "Bihar State Migrant Labour Accident Grant Scheme Rules, 2008":-
Bihar State Migrant Labour Accident Grant Scheme (Amendment) Rules, 2026 1. Short title, extent and commencement.—
(1) These rules may be called the "Bihar State Migrant Labour Accident Grant Scheme (Amendment) Rules, 2026".
(2) It shall extend to the whole of the State of Bihar. (3) This notification shall come into force from the date of publication in the official Gazette.
2. Amendment in rule 5 of Bihar State Migrant Labour Accident Grant Scheme Rule, 2008.— Rule 5 of the said rules shall be substituted as follows:-
5. In case of death, permanent Partial disability or Permanent disability of a migrant labourer, Amount of grant shall be paid by Real Time Gross Settlement (RTGS) method to the adjudged dependent or to the migrant labourer. If there is any dispute against the dependents decclared by the3 (cid:464)बहार गजट (असाधारण), 9 फरवर(cid:547) 2026 Circle Officer, an appeal shall lie before to the District Magistrate whose decision shall be final.
(a) In case of death of a migrant labourer a grant of Rs. 4,00,000/- (Four Lakh) shall be paid to the decided dependent (s) in his Bank Account by Real Time Gross Settlement (RTGS) method.
(b) In case of permanent disability of a migrant labour, a amount of grant of Rs. 1,00,000/-(One Lakh) shall be paid in his Bank Account by Real Time Gross Settlement (RTGS) method.
(c) In case of permanent partial disability of a migrant labour, a amount of grant of Rs. 50,000/-(Fifty Thousand) shall be paid in his Bank Account by Real Time Gross Settlement (RTGS) method.
(d) In case of accidental death of a migrant labourers working outside the State or in foreign countries, the State Government shall bear the amount of expenditure incurred on transportation for transporting their dead bodies to their permanent place of residence by any means of transport."
