—बंधुआ मजदूरी प्रथा उन्मूलन अधिनियम, 1976 (अधिनियम 19/1976) की धारा 13 की उप धारा (2) के साथ पठित उप धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा इसके संबंध में पूर्व में निर्गत सभी अधिसूचनाओं का अवक्रमण करते हुए, बिहार राज्यपाल राज्य के सभी जिलों के लिए जिला स्तरीय निगरानी समितियाँ निम्नलिखित रूप में गठित करते हैं :-
1. जिला दंडाधिकारी उप विकास आयुक्त और/या उनकी अनुपस्थिति में अपर समाहर्त्ता 3. सहायक, निदेशक, समाजिक सुरक्षा 4. श्रम अधीक्षक अधिनियम/श्रम अधीक्षक ग्रामीण विकास विभाग के प्रतिनिधि के रूप में राष्ट्रीय रोजगार कार्यक्रम के निदेशक
केन्द्रीय सहकारिता बैंक या ग्रामीण बैंक या वाणिज्यक बैंक का एक प्रतिनिधि जिसका मनोनयन जिला दंडाधिकारी करेंगे
अनुसूचित जाति और/या अनुसूचित जनजाति के जिला में रहने वाले तीन व्यक्ति, जिनका मनोनयन जिला दंडाधिकारी करेंगे।
जिले में रहने वाले - 2 सामाजिक कार्यकर्त्ता, जिनका मनोनयन जिला दंडाधिकारी करेंगे।2 (cid:464)बहार गजट (असाधारण), 17 फरवर(cid:547) 2026 (2) निगरानी समिति अपनी प्रक्रिया का नियमन स्वयं करेंगी और आवश्यकतानुसार सचिवीय सहायता जिला मजिस्टे्रट सुलभ करायेंगे।
(3) निगरानी समितियों के निम्नलिखित कर्त्तव्य होंगे :-
(क) उपर्युक्त अधिनियम के उपबन्धों को ठीक से लागू करना सुनिश्चित करने के लिए किये जाने वाले प्रयासों तथा की जानेवाली कार्रवाईयों के संबंध में जिला दंडाधिकारी को परामर्श देना, (ख) मुक्त बंधुआ मजदूरों के आर्थिक और सामाजिक पुनर्वास के लिए उपबंध करना,
(ग) मुक्त बंधुआ मजदूरों को पर्याप्त उधार की सुविधा का संयोजन करने के उद्देश्य से आवश्यकतानुसार ग्रामीण बैंक, सहकारिता बैंको और वाणिज्यक बैंको के कार्यों का समन्वय करना, (घ) इस अधिनियम के अधीन अपराधों के संबंध में दायर होने वाले तथा निपटाये गये मामलों के संख्या पर नजर रखना,
(ड़) इस अधिनियम के अधीन ऐसा कोई अपराध हुआ है या नहीं, जिसका संज्ञान दिया जाना चाहिए, इसका सर्वेक्षण करना,
(च) मुक्त बंधक मजदूर या उसके परिवार के किसी सदस्य या उसके उपर निर्भर किसी अन्य व्यक्ति के विरूद्ध किसी बंधक ऋण या उस व्यक्ति द्वारा बंधक ऋण के रूप में दावा किए जाने वाले किसी अन्य ऋण को सम्पूर्ण या आंशिक वसूली के लिए दायर किए गये किसी मुकदमें का बचाव करना।
(छ) मुक्त बंधुआ मजदुर को केन्द्रीय प्रक्षेत्र बंधुआ मजदुर पुनर्वास योजना, 2021 से आच्छादित करने हेतु आवश्यक कार्य करना।
(ज) निगरानी समिति में नामित किये जाने वाले सदस्यों के पूर्ववृत्त का भली-भाँति जाँच पड़ताल किया जायेगा एवं समिति द्वारा नियमित रूप से कार्यशाला का आयोजन कर प्रचार-प्रसार किया जायेगा।
(झ) निगरानी समिति जिलाें में बंधुआ श्रमिकों के डाटाबेस संधारण में भी आवश्यक सहयोग करेगी एवं जिले में वैसे स्थानों को चिन्हित करेगी, जहाँ बंधुआ श्रम अथवा बंधुआ श्रम जैसी स्थिति उत्पन्न होने की संभावना अधिक हो।
(ञ) समिति के बैठकों की कार्यवाहियाँ श्रम संसाधन एवं प्रवासी श्रमिक कल्याण विभाग को अविलम्ब प्रेषित कर दी जाएंगी साथ ही जिला के बेवसाईट पर एक नाम से अलग टैब बनाकर अपलोड किया जायेगा। सभी जिलों में इसी नाम
से बेवसाईट पर टैब बनाया जाएगा।
(4) निगरानी समिति की बैठकें अपने कार्यों के सम्पादन के लिए उतनी बार हुआ करेंगी, जितनी आवश्यक हो, किन्तु हर दो माह में कम से कम एक बार अवश्य हुआ करेगी। श्रम अधीक्षक अधिनियम/ श्रम अधीक्षक निगरानी समिति के सदस्य सचिव होंगे। 01/BL-30/2025 ——— 13 Qjojh 2026 का अंग्रेजी भाषा में निम्नलिखित अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जो भारतीय संविधान के अनुच्छेद 348 के (खण्ड) 3 के अधीन अंग्रेजी भाषा में उसका प्राधिकृृत पाठ समझा जाएगा।

S. O. 77 dated The 17th Febhruary 2026—In exercise of powers conferred by sub- section (1) of Section 13 of the Bonded Labour System Abolition Act, 1976 (Act 19/1976) read with sub-section (2) thereof, and suppression of All previous orders issued in this regard, the Governor of Bihar is pleased to constitute District level vigilance Committees for all district of the State following manner:-
1. District Magistrate Chairman 2. Deputy Development Commissioner and/or Member in his absence the District Development officer 3. Assistant Director, Social Security Member 4. Labour Superintendent Act / Labour Superintendent Member Secretary 5. The Director of the National Employment Programme Member as the representative of the Rural Development Department 6. One representative of Central Co-operative Bank Member or Rural Bank or Commercial Bank to be nominated by District Magistrate
7. Three persons belonging to the Scheduled Member Castes and/or Scheduled Tribes and residing In the district to be nominated by the District Magistrate; 8. Two Social Workers, resident of the district, Member to be nominated by the District Magistrate
2. The vigilance committee shall regulate its own procedure and Secretarial assistance, as may be necessary, shall be provided by the District Magistrate;
3. The Functions of the vigilance Committee shall be as follows:-
(a) to advise the District Magistrate as to the efforts, made and action taken, to ensure that the provision of the aforesaid Act are properly implemented:
(b) to provide for the economic and social rehabilitation of the freed bonded labourers;
(c) to co-ordinate the functions of rural Banks, Co-operative Banks and Commercial Banks, as may be necessary, with a view to canalising adequate credit facilities to the freed bonded labourers;
(d) to keep an eye on the number of cases filed and disposed of in regard to the offences under this Act,
(e) to make a survey as to whether there is any offence of which cognisance ought to be taken under this Act,
(f) to defend any suit instituted against a freed bonded labourer or a member of his family or any other person dependent on him or the recovery of the whole or part of bonded debt or any other debt which is claimed by such person to be bonded debt;
(g) to take necessary action to rehabilitate the released bonded labourers under the Central Sector Scheme for Rehabilitation of Bonded Labourers, 2021.
(h) The background of the members to be nominated in the Vigilance Committee shall be thoroughly verified, and the Committee shall regularly organise workshops for publicity and awareness.
4 (cid:464)बहार गजट (असाधारण), 17 फरवर(cid:547) 2026(i) The Vigilance Committee shall also provide necessary support in maintaining the database of bonded labourers in the districts and shall identify such locations within the district where bonded labour or situations akin to bonded labour are more likely to occur.
(j) The proceedings of the Committee meetings shall be promptly forwarded to the Labour Resources and Migrant Workers Welfare Department and a separate tab titled 'Vigilance Committee constituted under Bonded Labour' shall be created on the district website for uploading the same. A tab with this title shall be created on the websites of all districts.
4. The vigilance committee shall meet as often as necessary but at least once in two months for the discharge of its functions. The Labour Superintendent Act/Labour Superintendent shall be convenor of the District level Vigilance committee.
