सं॰ एल॰जी॰-01-06/2026-2265/लेज।—बिहार विधान मंडल द्वारा यथापारित निम्नलिखित अधिनियम, जिस पर माननीय राज्यपाल द्वारा दिनांक 08 मार्च, 2026 को अनुमति दे चुके हैं, इसके द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है ।

चूँकि बिहार कर्मचारी चयन आयोग अधिनियम, 2002" की धारा-5 के अनुसार आयोग, नियमावली में यथा प्रावधानित रु0 4800/- (चार हजार आठ सौ रूपये) ग्रेड पे (समय-समय पर यथा पुनरीक्षित) से कम ग्रेड पे वाले, राज्य सरकार एवं इसके क्षेत्रीय कार्यालयों के अधीन सभी सामान्य/तकनीकी/गैर तकनीकी सेवाओं/संवर्गों/पदों पर नियुक्ति हेतु अनुशंसा कर सकेगा।
परन्तु यह कि संविदा-नियोजनों, छंटनीग्रस्त कर्मचारियों के समायोजनों, अनुुकम्पात्मक नियुक्तियों तथा मेधावी खिलाड़ियों की नियुक्तियों के मामले में नियुक्तियाँ, आयोग की अनुशंसा प्राप्त किये बिना की जा सकेगी।"
और चूँकि, बिहार राज्य के सभी बोर्ड/निगम/सोसाइटी/कम्पनी (बिहार सरकार का उपक्रम) के अधीन
मंत्रिपरिषद् द्वारा स्वीकृत नियमित गैर तकनीकी पदों पर नियुक्ति की कार्रवाई में एकरूपता एवं पारदर्शिता के साथ
करने के लिए उक्त पदों पर नियुक्ति की कार्रवाई बिहार कर्मचारी चयन आयोग द्वारा किया जाना समीचीन है। इसलिए, अब भारत गणराज्य के सतहत्तरवें गणतंत्र में बिहार राज्य विधान मंडल द्वारा निम्नलिखित रूप से यह अधिनियमित हो :-
1. -
(i) यह अधिनियम "बिहार कर्मचारी चयन आयोग (संशोधन) अधिनियम, 2026" कहा जा सकेगा। (ii) इसका विस्तार संपूर्ण बिहार राज्य में होगा।
(iii) यह राजपत्र में इसके प्रकाशन की तिथि से प्रवृत्त होगा।

- - उक्त अधिनियम की धारा-5 में "तकनीकी" शब्द को विलोपित करते हुए एक नया परन्तुक निम्नलिखित रूप में जोड़ा जायेगाः-
"परन्तु यह भी कि आयोग, बिहार राज्य के सभी बोर्ड/निगम/सोसाइटी/कम्पनी (बिहार सरकार का उपक्रम) के अधीन मंत्रिपरिषद् द्वारा स्वीकृत नियमित गैर तकनीकी पदों पर नियुक्ति हेतु चयन एवं अनुशंसा कर सकेगा। उक्त नियुक्ति हेतु प्रक्रियाएं सामान्य प्रशासन विभाग द्वारा निर्धारित की जा सकेंगी।"

अंग्रेजी अनुवाद माननीय बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-348 के खंड (3) के अधीन उक्त अधिनियम का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा ।

to amend the Bihar Staff Selection Commission Act, 2002 (Bihar Act 7 of 2002) (as amended from time to time).
Preamble :- As per Section 5 of the "Bihar Staff Selection Commission Act, 2002", the Commission may recommend appointments to all General/Technical/Non-technical Services/Cadres/Posts under the State Government and its Regional offices, with a grade pay of less than Rs. 4800/- (four thousand eight hundred rupees) as provided in the rules (as revised from time to time).
However, appointments in cases of contractual employment, reinstatement of retrenched employees, appointments on compassionate grounds, and appointments of meritorious sports persons may be made without obtaining the recommendation of the Commission."
And since it is desirable to ensure uniformity and transparency in the appointment process for regular non-technical posts sanctioned by Cabinet under all Boards/ Corporations/ Societies/ Companies (undertakings of the Government of Bihar) in the state of Bihar, it is appropriate that the appointment process for these posts be conducted by the Bihar Staff Selection Commission.
NOW THEREFORE, in the seventy-seventh year of the Republic of India, it is hereby enacted by the State Legislature of Bihar as follows:- 1. Short title, extent and commencement.—
(i) This Act may be called the "Bihar Staff Selection Commission (Amendment) Act, 2026".
(ii) It shall extend to the whole of the State of Bihar. (iii) It shall come into force on the date of its publication in the Official Gazette.
2. Amendment of Section 5 of Bihar Act 7, 2002 (as amended from time to time).—
In Section 5 of the said Act after deleting the word "Technical" a new proviso shall be added as follows:
"Provided further that the Commission, shall select and recommend candidates for appointment to regular non-technical posts sanctioned by Cabinet under all Boards/ Corporations/ Societies/ Companies (undertakings of the Government of Bihar) in the State of Bihar. The procedures for the said appointment shall be determined by the General Administration Department."
