सं॰ एल॰जी॰-01-08/2026-2268/लेज।—बिहार विधान मंडल द्वारा यथापारित निम्नलिखित अधिनियम, जिस पर माननीय राज्यपाल द्वारा दिनांक 08 मार्च, 2026 को अनुमति दे चुके हैं, इसके द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है ।

चूँकि बिहार तकनीकी सेवा आयोग अधिनियम, 2014" की धारा-8 में राज्य सरकार के विभिन्न विभागों एवं क्षेत्रीय कार्यालयों में समूह 'ख' एवं 'ग' के सभी तकनीकी सेवाओं/संवर्गों/पदों पर एवं स्वास्थ्य विभाग के अधीन बिहार स्वास्थ्य सेवा संवर्ग एवं बिहार चिकित्सा सेवा संवर्ग के विशेषज्ञ चिकित्सा पदाधिकारियों के सभी पदों पर नियुक्ति हेतु चयन एवं अनुशंसा बिहार तकनीकी सेवा आयोग द्वारा किया जाना है।
और चूँकि बिहार राज्य के सभी बोर्ड/निगम/सोसाइटी/कम्पनी (बिहार सरकार का उपक्रम) के अधीन
मंत्रिपरिषद् द्वारा स्वीकृत नियमित तकनीकी पदों पर नियुक्ति की कार्रवाई में एकरूपता एवं पारदर्शिता के साथ करने
के लिए उक्त पदों पर नियुक्ति की कार्रवाई बिहार तकनीकी सेवा आयोग द्वारा किया जाना समीचीन है।
इसलिए, अब भारत गणराज्य के सतहत्तरवें गणतंत्र में बिहार राज्य विधान मंडल द्वारा निम्नलिखित रूप से यह अधिनियमित हो :-
1. -
(i) यह अधिनियम "बिहार तकनीकी सेवा आयोग (संशोधन) अधिनियम, 2026" कहा जा सकेगा। (ii) इसका विस्तार संपूर्ण बिहार राज्य में होगा।
(iii) यह राजपत्र में इसके प्रकाशन की तिथि से प्रवृत्त होगा।

- - उक्त अधिनियम की धारा-8 में एक नया परन्तुक निम्नलिखित रूप में जोड़ा जायेगा :-
"परन्तु यह भी कि आयोग, बिहार राज्य के सभी बोर्ड/निगम/सोसाइटी/कम्पनी (बिहार सरकार का उपक्रम) के अधीन मंत्रिपरिषद् द्वारा स्वीकृत नियमित तकनीकी पदों पर नियुक्ति हेतु चयन एवं अनुशंसा कर सकेगा। उक्त नियुक्ति हेतु प्रक्रियाएं सामान्य प्रशासन विभाग द्वारा निर्धारित की जा सकेंगी"

अंग्रेजी अनुवाद माननीय बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-348 के खंड (3) के अधीन उक्त अधिनियम का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा ।
बिहार-राज्यपाल के आदेष से, अंजनी कुमार सिंह, सरकार के सचिव।3 (cid:464)बहार गजट (असाधारण), 17 माच(cid:91) 2026 BIHAR TECHNICAL SERVICE COMMISSION (AMENDMENT) ACT, 2026 [Bihar Act 05, 2026] AN ACT to amend the BiharTechnical Service Commission Act, 2014 (Bihar Act 13, 2014) (as amended time to time).
Preamble :-
WHEREAS, Since Section 8 of the "Bihar Technical Services Commission Act, 2014" stipulates that the selection and recommendation for appointment to all technical Services/Cadres/Posts in Group 'B' and 'C' in various departments and regional offices of the State Government and to all posts of specialist medical officers in the Bihar Health Service Cadre and Bihar Medical Service Cadre under the Health Department, shall be made by the Bihar Technical Services Commission.
AND WHEREAS, since it is desirable to ensure uniformity and transparency in the appointment process for regular technical posts sanctioned by Cabinet under all Boards/ Corporations/ Societies/ Companies (undertakings of the Government of Bihar) in the State of Bihar, it is appropriate that the appointment process for these posts be conducted by the Bihar Technical Service Commission.";
Therefore, in the seventy-seventh year of the Republic of India, the following is hereby enacted by the State Legislature of Bihar;
1. Short title, extent and commencement.-
(i) This Act may be called the "Bihar Technical Services Commission (Amendment) Act, 2026".
(ii) It shall extend to the whole of the State of Bihar. (iii) It shall come into force on the date of its publication in the Official Gazette.
2. Amendment of Section 8 of Bihar Technical Service Commission Act, 2014 (Bihar Act 13, 2014) (as amended from time to time).- In Section 8 of the said Act a new proviso shall be added as follows:
"Provided further that the Commission, shall select and recommend candidates for appointment to regular technical posts sanctioned by Cabinet under all Boards/ Corporations/ Societies/ Companies (undertakings of the Government of Bihar) in the State of Bihar. The procedures for the said appointment shall be determined by the General Administration Department."
