बिहार सचिवालय सेवा (संशोधन) अधिनियम, 2026
अधिनियम
भारत-गणराज्य के 77वें वर्ष में बिहार राज्य विधानमंडल द्वारा निम्नलिखित रूप में अधिनियमित हो-
-
कहा जा सकेगा। (1) यह अधिनियम (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में प्रकाशन की तिथि से प्रवृत्त होगा।
उक्त अधिनियम की धारा-9(1)को निम्नवत् प्रतिस्थापित किया जाएगा- "9(1)(i)सहायक प्रशाखा पदाधिकारी ग्रेड के 85 प्रतिशत पदों को सीधी भर्त्ती द्वारा बिहार कर्मचारी चयन आयोग द्वारा इस प्रयोजनार्थ समय-समय पर आयोजित प्रतियोगिता परीक्षा के परीक्षाफल के आधार पर भरा जाएगा; परन्तु, बिहार उत्कृष्ट खिलाड़ियों की सीधी नियुक्ति नियमावली, 2023 के प्रावधानों के आलोक में चयनित सुयोग्य उत्कृष्ट खिलाड़ी की नियुक्ति सीधी भर्त्ती के लिए उपलब्ध पदों के 10 प्रतिशत के अन्तर्गत की जा सकेगी। (ii) शेष 15 प्रतिशत पदों को बिहार सचिवालय लिपिकीय सेवा के उच्च वर्गीय लिपिकों की प्रोन्नति द्वारा भरा जाएगा। ऐसी प्रोन्नति वरीयता एवं एतद्र्थ गठित विभागीय प्रोन्नति समिति की अनुशंसा से दी जाएगी।"

उक्त अधिनियम की धारा-10को निम्नवत् प्रतिस्थापित किया जाएगा- "10- सहायक प्रशाखा पदाधिकारी ग्रेड में सीधी भर्त्ती से अथवा उत्कृष्ट खिलाड़ी से नवनियुक्त सहायक प्रशाखा पदाधिकारी योगदान की तिथि से 01 (एक) वर्ष तक परिवीक्षा पर रहेंगे। परिवीक्षा अवधि में सेवा संतोषजनक नहीं होने पर इसे 01(एक) और वर्ष के लिए विस्तारित किया जा सकेगा। विस्तारित अवधि में भी सेवा संतोषजनक नहीं रहने पर सेवा समाप्त की जा सकेगी।"

उक्त अधिनियम की धारा-11(1) को निम्नवत् प्रतिस्थापित किया जाएगा- "(1) परिवीक्षा अवधि में सीधी भर्त्ती से अथवा उत्कृट खिलाड़ी से नियुक्त व्यक्ति से ऐसा प्रशिक्षण लेने या ऐसी विभागीय परीक्षा में उत्तीर्ण होने की अपेक्षा की जाएगी जैसा सरकार/संवर्ग नियंत्री प्राधिकार द्वारा समय-समय पर विहित किया जाय।"

,yúthú&01&11@2026@2619 yst%—बिहार विधन मंडल द्वारा यथापारित और माननीय राज्यपाल द्वारा दिनांक 30 मार्च, 2026 को अनुमत बिहार सचिवालय सेवा (संशोध्न) अधिनियम, 2026 (बिहार अध्निियम 08, 2026) का निम्नलिखित अंग्रेजी अनुवाद माननीय बिहार राज्यपाल के प्राध्किार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधन के अनुच्छेद-348 के खंड (3) के अध्ीन उक्त अध्निियम का अंग्रेजी भाषा में प्राध्किृत पाठ समझा जायेगाः- बिहार-राज्यपाल के आदेष से, बासनो शंकर मेहरोत्रा, सरकार के विषेष सचिव-सह-प्रभारी सचिव।(cid:464)बहार गजट (असाधारण) 1 अ(cid:292)ील 2026 3 [Bihar Act, 08, 2026] BIHAR SECRETARIAT SERVICE (AMENDMENT) ACT, 2026 AN ACT
to amendthe Bihar Secretariat Service Act, 2007 (Bihar Act 03, 2008) [as amended from time to time] Be it enacted by Legislature of the State of Bihar in the 77th year of the Republic of India as follows-
1. Short Title, Extent, and Commencement-
(1) This Act may be called the 'Bihar Secretariat Service (Amendment) Act, 2026'.
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force on the date of publication in the official gazette.
2. Substitution of Section 9(1) of the Bihar Secretariat Service Act, 2007 (Bihar Act 03, 2008) - Section 9(1) of the said Act shall be substituted as follows-
"9(1)(i) 85 percent of the posts of Assistant Section Officer Grade shall be filled by direct recruitment on the basis of the result of competitive examination conducted from time to time for the purpose by the Bihar Staff Selection Commission.
Provided that, in accordance with the provisions of the Bihar Outstanding Sportspersons Direct Appointment Rules, 2023, the selected eligible outstanding sportsperson may be appointed under 10 percent of the posts available for direct recruitment.
(ii) The remaining 15 percent of the posts shall be filled by promotion of Upper Division Clerks of the Bihar Secretariat Clerical Service. Such promotion shall be given on the basis of seniority and on the recommendation of the Departmental Promotion Committee hereby constituted." 3. Substitution of Section-10 of the Bihar Secretariat Service Act, 2007 (Bihar Act 03, 2008)-Section-10 of the said Act shall be substituted as follows-
"10. The newly appointed Assistant Section Officer in grade of Assistant Section Officer through direct recruitment or from amongst outstanding sportsperson, shall be on probation for a period of 01 (one) year from the date of joining. In case of unsatisfactory service during the probation period, it may be extended for 01 (one) more year. In case of unsatisfactory service even during the extended period, the service may be terminated." 4. Substitution of Section 11(1) of the Bihar Secretariat Service Act, 2007 (Bihar Act 03, 2008)- Section-11(1) of the said Act shall be substituted as follows-(cid:464)बहार गजट (असाधारण) 1 अ(cid:292)ील 2026 4 "(1) During the probation period, a person appointed either through direct recruitment or from amongst outstanding sportsperson, shall be required to undergo such training or pass such departmental examination, as may be prescribed by the Government/Cadre Controlling Authority from time to time."
