सं॰ एल॰जी॰-01-03/2026-2672/लेज।—बिहार विधान मंडल द्वारा यथापारित निम्नलिखित अधिनियम, जिस पर माननीय राज्यपाल द्वारा दिनांक 02 अप्रैल, 2026 को अनुमति दे चुके हैं, इसके द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है ।

जबकि, बिहार राज्य में मदरसा शिक्षा के विकास और बेहतर देख-रेख निमिा एक स्वायत बोर्ड के गठन का उपबंध करने हेतु भारत गणराज्य के 32वें वर्ष में बिहार विधानमंडल द्वारा बिहार राज्य मदरसा शिक्षा बोर्ड अधिनियम, 1981 दिनांक 17 जनवरी, 1981 के प्रभाव से अधिनियमित किया गया था;
अब, राज्य सरकार द्वारा बिहार राज्य मदरसा शिक्षा बोर्ड अधिनियम, 1981 के कुछ प्रावधानों को संशोधित करना आवश्यक समझा जा रहा है ताकि इन्हें भारत के संविधान के अनुच्छेद 30(1) के अनुरूप प्रावधानित किया जा सके;
अतः अब भारत गणराज्य के सतहत्तरवें वर्ष में बिहार राज्य विधान मंडल द्वारा निम्नलिखित रूप में यह अधिनियमित होः-
(1) यह अधिनियम ''बिहार राज्य मदरसा शिक्षा बोर्ड (संशोधन) अधिनियम, 2026'' कहा जा सकेगा। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में प्रकाशन की तिथि से लागू होगा।
उक्त
अधिनियम की धारा 7(2)(ढ) को निम्नवत् प्रतिस्थापित किया जायेगा :-
"(ढ) मदरसों की प्रबंध समिति का गठन इस रूप में करना कि सदस्य के रूप में मदरसा के प्रधान मौलवी, नौ अनुदायी प्रतिनिधि, एक शिक्षक प्रतिनिधि, दो अभिभावक प्रतिनिधि एवं बोर्ड द्वारा नामित एक सदस्य के अलावे इन चौदह सदस्यों द्वारा सहवाचित तीन अन्य सदस्य रहें जिन्हें मदरसा शिक्षा तथा इस्लामी अध्ययन में अभिरूचि हो।"

उक्त
अधिनियम की धारा 24 को निम्नवत् प्रतिस्थापित किया जायेगाः-
" ि
मान्यता प्राप्त मदरसों में अनुमोदित शिक्षकों एवं शिक्षकेार कर्मचारियों की सेवाएँ संबंधित
मदरसा के प्रबंध समिति के पर्यवेक्षण में रहेगी।
प्रबंध समिति द्वारा किसी शिक्षण/गैर शिक्षण कर्मचारी की सेवा से पद्च्यूत अथवा बर्खास्तगी के आदेश के विरूद्ध, आदेश पारित होने के तीन माह के भीतर बोर्ड के समक्ष अपील दायर किया जा सकेगा। ऐसे अपील दायर होने पर, खासकर उन मामलों में जहाँ पद्च्यूत अथवा बर्खास्तगी का आदेश नैसर्गिक न्याय के सिद्धांतो का पालन किये बिना पारित किया गया है या प्रथम दृष्टया दुर्भावनापूर्ण प्रकृति का है, बोर्ड अपीलार्थी के सम्पूर्ण सेवा इतिहास की मांग करेगा तथा सभी पक्षों को सुनने के उपरांत, लिखित रूप दर्ज किये जाने वाले कारणों के साथ, ऐसा आदेश पारित कर सकेगा जो न्यायहित में हो। बोर्ड द्वारा पारित आदेश संबंधित मदरसों पर बाध्यकारी होगा।''

(बिहार अधिनियम 09, 2026) का 2 अप्रील 2026 को अनुमत निम्नलिखित अंग्रेजी अनुवाद माननीय बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-348 के खंड (3) के अधीन उक्त अधिनियम का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा ।

to amend the Bihar State Madarsa Education Board Act, 1981
Introduction:- WHEREAS, Bihar State Madarsa Education Board Act, 1981 was enacted by the Legislature of the State of Bihar in the Thirty-second year of the Republic of India with effect from 17th January, 1981 to provide for the constitution of an autonomous Board for development and better supervision of Madarsa Education in the State of Bihar;
NOW, it is being felt necessary by the State Government to amend certain provisions of the Bihar State Madarsa Education Board Act, 1981 to bring the same in consonance with Article 30 (1) of the Constitution of India;
NOW THEREFORE, be it enacted by the Legislature of the State of Bihar in the seventy-seventh year of Republic of India as follows:-
1. Short title, extent and commencement.—
(1) This Act may be called the Bihar State Madarsa Education Board (Amendment) Act, 2026.
(2) It shall extend to the whole of the State of Bihar.
(3) It shall come into force from the date of its publication in the Official Gazette.
2. Substitution of section 7 (2) (n) of the Bihar State Madarsa Education Board Act, 1981.—Section 7 (2) (n) of the said Act shall be substituted as follows:-
"(n) to get the Managing Committee of Madarsa constituted in a manner so as to include the Head Moulvi, nine donor representatives, one teacher representative, two guardian representatives and one member nominated by the Board and three other persons interested in Madarsa Education or Islamic studies co-opted by the above fourteen members.".
3. Substitution of section 24 of the Bihar State Madarsa Education Board Act, 1981.—Section 24 of the said Act shall be substituted as follows:-
"24. Services of teachers and non-teaching staff:-
(1) The services of the approved teachers and non-teaching staff of a recognised Madarsa shall be under the supervision of the Management Committee of the concerned Madarsa.
(2) An appeal against an order of discharge or dismissal from service of any teaching / non-teaching staff passed by the Managing Committee may be4 (cid:464)बहार गजट (असाधारण), 2 अ(cid:292)ील 2026 preferred before the Board within three months from the date of passing such order. Upon filing of such appeal especially, in cases where such order of discharge or dismissal has been passed without following the principles of natural justice or is prima facie mala fide in nature, the Board shall call for entire service records of the appellant and upon hearing the parties may pass such orders, for reasons to be recorded in writing, in the interest of justice.
The orders passed by the Board shall be binding upon the concerned Madarsas."
