सं॰ बी॰ई॰आर॰सी॰-स्था॰-05/14- —विद्युत अधिनियम, 2003 (सं0 36, 2003) की धारा 181, उपधारा 2 (zk) सह पठित धारा 91 की उप धारा (1), (2) और (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार विद्युत विनियामक आयोग अपने नियंत्रणाधीन पदाधिकारियों और कर्मचारियों की भर्त्ती एवं सेवा-शर्त्तो को विनियमित करने हेतु राज्य सरकार के अनुमोदन से निम्नलिखित संशोधन करता है।
(1) यह विनियमावली बिहार विद्युत विनियामक आयोग (पदाधिकारियों और कर्मचारियों की भर्त्ती एवं सेवा-शर्त्ते) (द्वितीय संशोधन) विनियमावली, 2026 कही जायेगी।
(2) यह पूरे बिहार राज्य में लागू होगी। (3) यह बिहार गजट में उसके प्रकाशन की तिथि से प्रवृत्त होगी। (4) यह बिहार विद्युत विनियामक आयोग के सभी पदाधिकारियों एवं कर्मचारियों पर लागू होगी। 2. बिहार विद्युत विनियामक आयोग (पदाधिकारियों और कर्मचारियों की भर्त्ती एवं सेवा-शर्त्ते) विनियमावली, 2014 की कंडिका 2(1)(त) को निम्न द्वारा प्रतिस्थापित किया जाएगा-

3. बिहार विद्युत विनियामक आयोग (पदाधिकारियों और कर्मचारियों की भर्त्ती एवं सेवा-शर्त्ते) विनियमावली, 2014 की कंडिका 4(2) के बाद निम्नलिखित उप कंडिका (3) को जोड़ा जाएगा-

4. बिहार विद्युत विनियामक आयोग (पदाधिकारियों और कर्मचारियों की भर्त्ती एवं सेवा-शर्त्ते) विनियमावली, 2014 की कंडिका 7(2) के अंत में जोड़ा जाएगा-

5. बिहार विद्युत विनियामक आयोग (पदाधिकारियों और कर्मचारियों की भर्त्ती एवं सेवा-शर्त्ते) विनियमावली, 2014 के अनुसूची-I के क्रमांक-26 के पदनाम को निम्न द्वारा प्रतिस्थापित किया जाएगा-

6. बिहार विद्युत विनियामक आयोग (पदाधिकारियों और कर्मचारियों की भर्त्ती एवं सेवा-शर्त्ते) विनियमावली, 2014 के अनुसूची-I के क्रमांक-34 के पदनाम को निम्न द्वारा प्रतिस्थापित किया जाएगा-

——— Notification The 9th April 2026 No. BERC-Estb-05/14-03 In exercise of the powers conferred by sub section 2(zk) of Section 181 read with sub-sections (1) (2) and (3) of Section 91 of the Electricity Act, 2003 (36 of 2003), the Bihar Electricity Regulatory Commission, with the approval of the State Government, amends the following Regulations to regulate recruitment, terms and conditions of service of officers and staff under its control.
1. Short Title Extent and Commencement: –
(1) These regulations shall be called the "Bihar Electricity Regulatory Commission (Recruitment and Terms and Conditions of Service of Officers and Employees) (2nd Amendment) Regulations, 2026'.
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force with effect from the date of its publication in the Bihar Gazette.
(4) It shall apply to all officers and employees of the Bihar Electricity Regulatory Commission.
2. Clause 2(1)(o) of Bihar Electricity Regulatory Commission (Recruitment and Terms and Conditions of Service of Officers and Employees) Regulations, 2014 is substituted by following:
"Direct Recruitment' means appointment made on recommendation of Bihar Electricity Regulatory Commission or Bihar Staff Selection Commission or any other Selection Board/Selection Commission/ Authority as prescribed by the State Government from time to time, other than appointment made by transfer, on deputation or on contract basis';
3. After Clause 4(2) of Bihar Electricity Regulatory Commission (Recruitment and Terms and Conditions of Service of Officers and Employees) Regulations, 2014, the following sub-clause (3) shall be added:
"In the light of the requisition as may be sent by Bihar Electricity Regulatory Commission, the Bihar Staff Selection Commission or any other Selection Board/Selection Commission/ Authority as prescribed by the State Government from time to time shall make selection for the vacancies of Assistant Section Officer, Stenographer or Office Attendant (Karyalaya Parichari) and shall be provide the recommendation of eligible candidates to the Appointing Authority (Bihar Electricity Regulatory Commission) as per rules';
4. At the end of Clause 7(2) of Bihar Electricity Regulatory Commission (Recruitment and Terms and Conditions of Service of Officers and Employees) Regulations, 2014, the following shall be added:
"…..However, the Commission may also send a requisition for selection from time to time to Bihar Staff Selection Commission or any other Selection Board/Selection Commission/ Authority as prescribed by the State Government from time to time and after obtaining the list of selected eligible candidates, make appointments';

"Assistant Section Officer'
6. The designation at Serial No. 34 of Schedule-I of Bihar Electricity Regulatory Commission (Recruitment and Terms and Conditions of Service of Officers and Employees) Regulations, 2014 shall be substituted by following:
"Office Attendant (Karyalay Parichari)'
7. Column 2 of Serial No. 26 of Schedule-II of Bihar Electricity Regulatory Commission (Recruitment and Terms and Conditions of Service of Officers and Employees) Regulations, 2014 shall be substituted by following:
"Assistant Section Officer'
8. Column 4 of Serial No. 26 of Schedule-II of Bihar Electricity Regulatory Commission (Recruitment and Terms and Conditions of Service of Officers and Employees) Regulations, 2014 shall be substituted by following:
"Direct Recruitment'
9. Column 5 and Column 6 of Serial No. 26 of Schedule-II of Bihar Electricity Regulatory Commission (Recruitment and Terms and Conditions of Service of Officers and Employees) Regulations, 2014 shall be substituted by following:
"As per guidelines issued by the State Government from time to time' 10. Column 5 and Column 6 of Serial No. 29 of Schedule-II of Bihar Electricity Regulatory Commission (Recruitment and Terms and Conditions of Service of Officers and Employees) Regulations, 2014 shall be substituted by following:
"As per guidelines issued by the State Government from time to time' 11. Column 2 of Serial No. 34 of Schedule-II of Bihar Electricity Regulatory Commission (Recruitment and Terms and Conditions of Service of Officers and Employees) Regulations, 2014 shall be substituted by following:
"Office Attendant (Karyalay Parichari)'
12. Column 5 and Column 6 of Serial No. 34 of Schedule-II of Bihar Electricity Regulatory Commission (Recruitment and Terms and Conditions of Service of Officers and Employees) Regulations, 2014 shall be substituted by following:
"As per guidelines issued by the State Government from time to time' Note: "Existing sub-clauses 4(3) and 4(4) shall be renumbered as sub-clauses 4(4) and 4(5), respectively."
