(सं0 पटना 453) पटना, सोमवार, 11 मई 2026 गृह विभाग (विषेष शाखा) ———— अधिसूचना 7 मई 2026 जी/विविध-20-03/2024 —बिहार लोक सुरक्षा (उपाय) प्रवर्तन अधिनियम (बिहार अधिनियम सं0-11, 2024) की धारा-9 की उप धारा (1) द्वारा प्रदा शक्तियाें का प्रयोग करते हुए, बिहार सरकार राज्य के प्रतिष्ठानों में लोक सुरक्षा उपायों के प्रवर्तन हेतु निम्न नियमावली बनाती हैः-

1. इन नियमों को बिहार लोक सुरक्षा (उपाय) प्रवर्तन नियमावली, 2026 कहा जायेगा और ये -

(क) बिहार राज्य के राजपत्र जिसमें ई-राजपत्र भी षामिल है, में प्रकाषन की तिथि से प्रवृा होंगेय (ख) ऐसे प्रतिष्ठानों पर लागू होंगे जिन्हें समय-समय पर लोक सुरक्षा समिति द्वारा अधिसूचित किया जायेगा।

2. इन नियमों में, जब तक संदर्भ से अन्यथा अपेक्षित न हो :

(क) से अभिप्रेत है बिहार लोक सुरक्षा (उपाय) प्रवर्तन अधिनियम, 2024 (बिहार अधिनियम संख्या, 11, 2024);

(ख) से अभिप्रेत है अधिनियम की धारा-4 के अंतर्गत गठित लोक सुरक्षा समिति; (ग)

से अभिप्रेत है वरीय पुलिस अधीक्षक/पुलिस अधीक्षक के रूप में पदस्थापित जिला पुलिस प्रशासन का प्रमुख;

(घ) से अभिप्रेत है जिला के अंतर्गत संबंधित नगर निगम का मुख्य कार्यपालक अधिकारीे;

(च) से अभिप्रेत है जिला के किसी अनुमंडल का प्रशासनिक प्रमुख; (छ)

से अभिप्रेत है जिला मुख्यालय में पुलिस उपाधीक्षक (मुख्यालय) के पद पर पदस्थापित पुलिस उपाधीक्षक की श्रेणी के पुलिस पदाधिकारी;

(ज) से अभिप्रेत है समिति या वरीय पुलिस अधीक्षक/पुलिस अधीक्षक द्वारा अधिकृत पदाधिकारी, जिसे अपराध की रोकथाम अथवा अन्वेषण हेतु विडियों फुटेज (रियल टाईम एक्सेस सहित) तक पहुँचने अथवा प्राप्त करने का अधिकार है;

(झ) से अभिप्रेत है पुलिस पदाधिकारी (पुलिस निरीक्षक से अन्यून कोटि का न हो) या नगर निगम का पदाधिकारी जिसे समिति या उप समिति द्वारा प्रतिष्ठान के निरीक्षण हेतु अधिकृत किया गया हो;

(ट) से अभिप्रेत है न्यूनतम तीस (30) दिनों अथवा सरकार द्वारा समय-समय पर अधिसूचित कोई लंबी अवधि;

(ठ) से अभिप्रेत है इस नियमावली के साथ संलग्न प्रपत्र; (ड) से अभिप्रेत हैः (i) ऐसे दुकान/व्यावसायिक इकाईयों के स्वामियों का समूह जो वाणिज्यिक प्रतिष्ठान में स्थित हाें और पट्‌टे/किराये पर दिये गये हों; तथा

(ii) किसी विशेष भौगोलिक क्षेत्र में स्थित विभिन्न दुकानों या प्रतिष्ठानों का समूह, जहाँ किसी अवधि विशेष के दौरान बडी संख्या में लोगों के एकत्रित होने की संभावना हो। 3. (1) जिला पदाधिकारी द्वारा लोक सुरक्षा समिति का गठन किया जायेगा, जिसमें निम्नलिखित सदस्य होंगेः- (क) नगर आयुक्त- अध्यक्ष (ख) अनुमंडल पुलिस पदाधिकारी (मुख्यालय)-सदस्य सचिव (ग) सी0सी0टी0वी0/सुरक्षा प्रणाली का ज्ञान रखने वाला तकनीकी विशेषज्ञ- सदस्य (जो जिला पदाधिकारी द्वारा नामित होंगे) (घ) स्थानीय शहरी निकाय का प्रतिनिधि-सदस्य (2) उप समितिः (क) समिति जिला पदाधिकारी की सहमति से अनुमंडल स्तर पर उप समिति गठित कर सकेगी। (ख) प्रत्येक उप समिति की अध्यक्षता अनुमंडल पदाधिकारी करेंगे और इसमें स्थानीय प्रशासन एवं पुलिस के पदाधिकारी शामिल होंगे।

(ग) उप समिति, लोक सुरक्षा समिति अथवा उनके प्रतिनिधि को निरीक्षण एवं अनुपालन में सहायता करेगी तथा उल्लंघनों को प्रतिवेदित करेगी।

(3) समिति एवं उप समिति प्रत्येक तिमाही में कम से कम एक बार बैठक करेगी तथा कार्यवृत एवं जारी निर्देशों का अभिलेख रखेगी और इसकी रिपोर्ट गृह विभाग को प्रेषित करेगी। 4. (1) अधिनियम की धारा-3 के अंतर्गत समिति प्रपत्र-1 में प्रतिष्ठानों की पहचान निम्न मानको पर करेगीः- (क) किसी भी समय औसत दैनिक आगमन एक सौ (100) व्यक्तियों से अधिक होना; (ख) धार्मिक, वाणिज्यिक, शैक्षणिक, मनोरंजन या आवासीय उद्‌देश्य हेतु लोगों की भीड़ एकत्रित होने की संभावना;

(ग) संवेदनशील या असुरक्षित प्रतिष्ठानों या स्थानों की निकटता; (घ) समिति द्वारा उपयुक्त समझे गये अन्य मानक। (2) समिति ऐसे पहचाने गये प्रतिष्ठानों का अभिलेख प्रपत्र-2 में रखेगी तथा समय-समय पर इसकी सूची गृह विभाग को प्रेषित करेगी। 5. (1) समिति अथवा उप समिति के निर्देश पर निरीक्षण पदाधिकारी प्रतिष्ठानों का निरीक्षण करेगा तथा प्रपत्र-3 में निरीक्षण प्रतिवेदन तैयार करेगा।

(2) लोक सुरक्षा समिति, प्रतिष्ठान के स्वामी या प्रबंधक को निर्देश जारी करेगी कि वे निर्देश प्राप्ति की तिथि से तीस (30) दिनों के भीतर अनुपालन सुनिश्चित करें।

(3) निरीक्षण पदाधिकारी, अनुपालन एवं उल्लंघन का विवरण देते हुए प्रतिवेदन प्रपत्र-4 में समिति या उप समिति को प्रेषित करेगा।

(4) समिति के निर्देशों का पालन न होने पर, निर्धारित अवधि के अंतिम तिथि से तीस (30) दिनों के भीतर प्रपत्र-5 में कारण बताओ नोटिस जारी करेगा।

(5) यदि निर्दिष्ट अवधि में जवाब प्राप्त न हो या जवाब असंतोषजनक पाया जाए, तो प्रपत्र-6 में दंडादेश जारी किया जा सकता है। 6. प्रत्येक पहचाना गया प्रतिष्ठान :

(क) निर्दिष्ट लोक सुरक्षा उपाय स्थापित एवं संधारित करेगा; (ख) यह सुनिश्चित करेगा कि सभी उपकरण कार्यशील हों; (ग) विडियो फुटेज को सुरक्षित और संग्रहित करेगा; (घ) नामित पदाधिकारी द्वारा मांगे जाने पर विडियो फुटेज (रियल टाईम एक्सेस सहित) उपलब्ध करायेगा एवं

(च) अधिनियम के अंतर्गत जारी निर्देशों का अनुपालन करेगा।

7. (1) प्रत्येक प्रतिष्ठान द्वारा स्थापित निगरानी प्रणाली में न्यूनतम निम्न सुविधाएँ होंगी :-

(क) सी0सी0टी0वी0 कैमरे न्यूनतम 1080 पिक्सेल रिजाँल्यूलेशन के साथ;

(ख) कम रोशनी वाले वातावरण के लिए इंन्फ्रारेड या रात्रि दृष्टि क्षमता की सुविधा। जहाँ भी आवश्यकता हो, ए0आई0 सक्षम कैमरा;

(ग) सर्वाजनिक सड़कों से सटे सभी प्रवेश एवं निकास बिन्दुओं और निर्दिष्ट पार्किंग क्षेत्रों का कवरेज;

(घ) डिजिटल अथवा नेटवर्क आधारित विडियो रिकार्डिंग प्रणाली, छेड़छाड-रोधी भंडारण के साथ; (च) न्यूनतम तीस (30) दिनों की विडियो संग्रहण क्षमता जिसे जिला पदाधिकारी के आदेश से अवधि बढायी जा सकती है;

(छ) जहाँ लागू हो, (बायोमैट्रिक/आर0एफ0आई0डी0/अन्य साधनों पर आधारित) अभिगम नियंत्रण प्रणाली।

2. सरकार समय-समय पर संशोधित विनिर्देश अधिसूचित कर सकती है। 8. (1) अधिनियम की धारा-5 के अंतर्गत निरीक्षण हेतु न्यूनतम दो कार्य दिवस पूर्व सूचना दी जायेगी। (2) निरीक्षण पदाधिकारी, जहाँ भी संभव हो, फोटोग्राफिक या विडियो दस्तावेजीकरण के साथ अनुपालन या कमियों को निर्दिष्ट करते हुए समिति को एकप्रतिवेदन प्रस्तुत करेगा।

(3) प्रतिवेदन प्राप्त होने पर समिति प्रतिष्ठान को लिखित निर्देश जारी कर सकती है कि वह आदेश में निर्दिष्ट अवधि के भीतर जो एक माह से अधिक नहीं होगी, अनुपालन करें।

(4) निर्देशों का अनुपालन न होने पर अधिनियम की धारा-5 (2) के अनुसार दंड अधिरोपित किया जायेगा। 9. (1) अधिनियम की धारा-6 के अंतर्गत, दंडादेश पारित होने की तिथि से तीस (30) दिनों के भीतर प्रतिष्ठान पर अधिकारिता रखने वाले जिला पदाधिकारी के समक्ष अपील दायर की जायेगी।

(2) अपीलकर्ता को अपील के निर्णय से पूर्व सुनवाई का अवसर प्रदान किया जायेगा। (3) जिला पदाधिकारी अपील दायर करने की तिथि से साठ (60) दिनों के भीतर एक सकारण आदेश पारित कर अपील का निस्तारण करेंगे।

(4) आदेश की प्रति अपीलकर्ता तथा समिति को भेजी जायेगी। 10. यदि प्रतिष्ठान अधिनियम के अंतर्गत अधिरोपित दंड का भुगतान निर्धारित अवधि में करने में विफल रहता हैै, तो उसे नियमानुसार भू-राजस्व बकाया की तरह वसूला जायेगा।

11. (1) लोकसुरक्षा समिति निम्न अभिलेख संधारित करेगी :

(क) अधिनियम की धारा-3 के अंतर्गत पहचाने गये प्रतिष्ठानों की सूची; (ख) निरीक्षण रिपोर्ट और अनुपालन नोटिस; (ग) लगाये गये दंड और निस्तारित अपीलों का अभिलेख; (घ) गृह विभाग को भेजी गयी कार्य प्रतिवेदन।

(2) सरकार कार्यपालिका निर्देशों द्वारा अभिलेखों एवं नोटिसों के प्रारूप निर्धारित कर सकती है। 12. राज्य सरकार एवं समिति जन-जागरूकता अभियान चला सकती है, दिशा निर्देश जारी कर सकती है औैैर अनुपालन, संवर्धन तथा हितधारकों की संवेदनशीलता के लिए कार्यशालाएँ आयोजित कर सकती है। 13. (1) सरकार ऐसे अनुदेश, दिशा निर्देश या स्पष्टीकरण जारी कर सकती है, जिन्हें वह अधिनियम और उसके अधीन बनाये गये नियमों के क्रियान्वयन हेतु आवश्यक समझे।

(2) इन नियमों में स्पष्ट रूप से प्रावधान न किये गये किसी मामले का निर्धारण सरकार द्वारा ऐसे तरीके से किया जायेगा, जो अधिनियम के प्रावधानों से असंगत न हो।

No. जी/विविध-20-03/2024 —In exercise of the powers conferred by sub section (1) of Section 9 of the Bihar Public Safety (Measures) Enforcement Act, 2024 (Bihar Act No. 11 of 2024), the Government of Bihar hereby makes the following rules for enforcement of Public Safety measures in establishments in the State-

Short title,

1. These rules may be called the Bihar Public Safety (Measures) Commencement

and Application

Enforcement Rules, 2026 and, (a) It shall come into force on the date of their publication in the

Official Gazette.

(b) It shall apply to such establishments as may be notified by the

Public Safety Committee from time to time.

Definitions

². In these Rules, unless the context otherwise requires –

(a) 'Act' means the Bihar Public Safety (Measures)

Enforcement Act, 2024 (Bihar Act No. 11, 2024);

(b) 'Committee' means the Public Safety Committee constituted

under section 4 of the Act;

(c) 'Senior Superintendent of Police/ Superintendent of

Police' means the head of the Police Administration of the

District posted as Senior Superintendent of Police/ Superintendent of Police;

(d) 'Municipal Commissioner' means the Executive head of the

concerned Municipal Corporation of the District;

(e) 'Sub-Divisional Officer means the Administrative Head of a

sub division within a District;

(f) 'Deputy Superintendent of Police (Head Quarter)' means the police officer of the rank of Deputy Superintendent of Police posted at the District head quarter as Deputy Superintendent of Police(HQ);

(g) 'Designated Officer' means an officer authorized by the Public Safety Committee or Senior Superintendent of

Police/Superintendent of Police to access including real time access or receive video footage for prevention or investigation of an offence;

(h) 'Inspecting Officer' means a Police Officer (not below the

rank of Inspector) or Municipal Officer, authorized by the Committee to inspect the establishments;

(i) 'Prescribed period' means a minimum of 30 days or such longer duration as may be notified by the Government from time to time;

(j) 'Form' means the Form appended to these rules;

(k) 'Association' means:

(i) A group of owners of various shops/commercial units situated in any commercial establishment Lease hold owned; or

(ii) A group of different shops and establishments concentrated in a particular geographical area having scope for large congregations at any given point of time;

Constitution and 3. (1) The District Magistrate shall constitute a Public Safety Composition of

Public Safety

Committee comprising the following members:

Committee

(a) The Municipal Commissioner - Chairperson;

(b) Sub Divisional Police Officer - Member Secretary (Headquarters)

(c) One technical expert having knowledge of CCTV/Security

System – Member

(Nominated by the District Magistrate)

(d) Representative of the Urban Local Body – Member

(2) Sub Committee:

(a) The Committee may constitute Sub Committee at the Sub

Divisional level with the approval of the District Magistrate.

(b) Each Sub Committee shall be chaired by the Sub - Divisional Officer and include officers from the local administration and

police.

(c) The Sub-Committee shall assist the Committee or its representative in inspection and monitoring of compliance and

shall report the violations.

(3) The Committee and Sub - Committees shall meet at least once every quarter and shall maintain minutes of meetings and records of directions issued and send report to the Home Department. Identification of

4. (1) The Committee shall identify establishments in Form-1 under Establishment and

Functions of Public

Safety Committee

Section 3 of the Act based on the following criteria: (a) Average daily footfall exceeding 100 persons at any point of

time;

(b) Likelihood of congregation of people for religious, commercial, educational, recreational or residential purposes; (c) Proximity to vulnerable or sensitive installations or locations; (d) Such other parameters as may be considered appropriate by

the Committee.

(2) The Committee shall maintain a record in Form-2 of such identified establishments and furnish the list to the Home Department time to time.

Inspection of Premises 5. (1) The Inspecting Officer shall conduct the inspection of establishments as per direction of the Committee or Sub Committee and prepare the inspection report in Form-3.

(2) The Public Safety Committee may issue directions to the owner or manager of an establishment to comply with its directions within thirty days from the date of receipt thereof.

(3) The Inspecting Officer shall forward the inspection report to the Committee or Sub Committee prescribed in Form-4 indicating compliance and violations.

(4) In case of non-compliance with the directions of the Public Safety Committee, a show cause notice in Form-5 shall be issued within thirty days from the last day of the prescribed period.

(5) If no reply is received within the period specified in the show cause or if the reply is found unsatisfactory, an order imposing penalty may be issued in Form-6.

Obligation of

6. Every identified establishment shall:

Establishments

(a) install and maintain public safety measures as specified;

(b) ensure all equipments are functional;

(c) secure and store video footage;

(d) provide access including real time access to the footage as and

when requested by the Designated Authority;

(e) comply with directions issued under the Act.

Technical Specifications

7. (1) The Surveillance Systems to be installed by establishments for Public Safety

shall conform to the following minimum specifications:

(a) Closed Circuit Television (CCTV) Cameras with minimum

1080 pixel resolution;

(b) infrared or night-vision capability for low light environments,

AI enabled cameras wherever needed;

(c) coverage of all entry and exit points adjoining public roads,

and designated parking areas;

(d) digital or Network – based video recording system with

tamper proof storage;

(e) minimum video retention capacity of thirty days, extendable

by the order of the District Magistrate;

(f) access control systems (biometric/RFID/ other means)

where applicable.

(2) The Government may notify revised specifications from time

to time.

Manner of Inspection 8. (1) Inspection under Section 5 of the Act shall be conducted with prior notice of not less than two working days.

(2) The inspecting officer shall submit a report to the Committee specifying compliances or deficiencies, with photographic or video documentation wherever possible.

(3) On receipt of the report, the Committee may issue written instructions to the establishment to comply within a period specified in the order not exceeding one month.

(4) Non-compliance of instructions shall attract penalty as provided under Section 5 (2) of the Act.

Manner of filing Appeal 9. (1) An appeal under Section 6 of the Act shall be filed before the District Magistrate having jurisdiction over the establishment, within thirty days of receipt of the penalty order.

(2) The appellant shall be given an opportunity of being heard before the appeal is decided.

(3) The District Magistrate shall dispose of the appeal by a speaking order within sixty days from the date of its filing.

(4) Copies of the order shall be sent to the appellant and the Committee.

Recovery of Penalty 10. Where an establishment fails to pay penalty imposed under the Act within the prescribed period, the same shall be recovered as an arrear of land revenue in accordance with law.

11. (1) The Public Safety Committee shall maintain the following Form and Record Maintenance

records:

(a) List of identified establishments under Section 3;

(b) Inspection reports and compliance notices;

(c) Records of penalties levied and appeals disposed;

(d) Report of activities submitted to the Home Department. (2) The Government may prescribe formats for maintenance of records and notices through executive instructions.

Public Awareness 12. The State Government and the Committee may conduct public awareness drives, issue guidelines and hold workshops for compliance, promotion and sensitization of the stakeholders.

Miscellaneous 13. (1) The Government may issue such instructions, guidelines or clarifications as it deems necessary for implementation of the Act and the rules made thereunder.

(2) Any matter not expressly provided for in these rules shall be determined by the Government in a manner not inconsistent with the provisions of the Act.
