सं॰ बी॰1-3-65/2026-31—बिहार राज्य की विधान सभा के सदस्यों द्वारा बिहार विधान परिशद के लिए निर्वाचित श्री नीतीष कुमार का स्थान उनकी पदावधि, जो कि 06.05.2030 सहित उस तारीख तक थी, के समाप्त होने से पूर्व त्याग- पत्र देने के कारण 30.03.2026 से रिक्त होने के फलस्वरूप हुई रिक्ति को भरने के प्रयोजन से आयोजित किये जाने वाले बिहार विधान परिशद का उप निर्वाचन, 2026 का निर्वाचन कार्यक्रम से संबंधित भारत निर्वाचन आयोग, नई दिल्ली की अधिसूचना संख्या- 100/बिहार-वि.प. /02/2026-एम.एल.ए.(1) दिनांक 01.06.2026 की हिन्दी एवं अंग्रेजी प्रति तथा रिटर्निग आफिसर के रूप में पदाभिहित अधिकारी एवं सहायक रिटर्निंग आफिसर के रूप में नियुक्त अधिकारी से संबंधित भारत निर्वाचन आयोग, नई दिल्ली की अधिसूचना संख्या-100/बिहार-वि.प./02/2026-एम.एल.ए.(2) दिनांक 01.06.2026 की हिन्दी एवं अंग्रेजी प्रति सर्वसाधारण की जानकारी के लिए प्रकाषित की जाती हैं।

(1)- यतः, (cid:464)बहार रा(cid:207)य क(cid:551) (cid:464)वधान सभा के सद(cid:232)य(cid:585) (cid:430)ारा (cid:464)वधान प(cid:464)रषद के िलए िनवा(cid:91)िचत (cid:302)ी नीतीश कु मार का (cid:232)थान उनक(cid:551) पदाविध, जो (cid:464)क 06.05.2030 स(cid:464)हत उस तार(cid:547)ख तक थी, के समा(cid:431) होने से पूव(cid:91) (cid:215)याग-प(cid:287) देने के कारण 30.03.2026 से (cid:464)र(cid:416) हो गया है; और

यतः, इस (cid:292)कार हुई (cid:464)र(cid:464)(cid:416) को भरने के (cid:292)योजन से एक उप िनवा(cid:91)चन आयोिजत (cid:464)कया जाना है;

अतः, अब, लोक (cid:292)ितिनिध(cid:215)व अिधिनयम, 1951 (1951 का 43) क(cid:551) धारा 151, धारा 39 क(cid:551) उपधारा (1) और धारा 56 के अनुसरण म(cid:581), िनवा(cid:91)चन आयोग एत(cid:217)(cid:430)ाराः-

(अ) (cid:464)बहार रा(cid:207)य के (cid:464)वधान सभा सद(cid:232)य(cid:585) से यह अपे(cid:162)ा करता है (cid:464)क वे 20 जून, 2026 (शिनवार) से पूव(cid:91) तथा उ(cid:416) अिधिनयम और त(cid:424)ीन बनाए गए िनयम(cid:585) और उनके तहत जार(cid:547) (cid:464)कए गए आदेश(cid:585) के उपब(cid:219)ध(cid:585) के अनुसार रा(cid:207)य क(cid:551) (cid:464)वधान प(cid:464)रषद म(cid:581) उ(cid:416) (cid:464)र(cid:464)(cid:416) को भरने के (cid:292)योजन से एक (cid:229)य(cid:464)(cid:416) िनवा(cid:91)िचत कर द(cid:581);

(आ) उ(cid:416) िनवा(cid:91)चन के संबंध म(cid:581):-

(क) नाम िनद(cid:566)िशत करने क(cid:551) अि(cid:219)तम तार(cid:547)ख – 08 जून, 2026 (सोमवार); (ख) नाम िनद(cid:566)शन क(cid:551) संवी(cid:162)ा क(cid:551) तार(cid:547)ख – 09 जून, 2026 (मंगलवार);

(ग) अ(cid:223)यिथ(cid:91)ताएं वापस लेने क(cid:551) अि(cid:219)तम – 11 जून, 2026 (गु(cid:509)वार);

– 18 जून, 2026 (गु(cid:509)वार); और (घ) वह तार(cid:547)ख िजसको य(cid:464)द आव(cid:230)यक हुआ

तो मतदान होगा

(ड.) वह तार(cid:547)ख िजससे पूव(cid:91) िनवा(cid:91)चन स(cid:224)प(cid:219)न – 20 जून, 2026 (शिनवार);

करा िलया जाएगा

िनयत करता है; और

(इ) 09:00 बजे पूवा(cid:91)(cid:441) से 04:00 बजे अपरा(cid:441) तक का समय उस समय के (cid:510)प म(cid:581) िनयत करता है िजसको, य(cid:464)द आव(cid:230)यक हुआ तो, (cid:464)विन(cid:464)द(cid:91)(cid:436) तार(cid:547)ख को मतदान होगा।

No.100/BR-LC/02/2026-MLA (1): - Whereas, the seat of Shri Nitish Kumar in the Legislative Council of the State of Bihar, elected by the members of the Legislative Assembly of the State, has become vacant on 30.03.2026 by the reason of his resignation, before the expiration of his term of office which was up to and including 06.05.2030; and WHEREAS, a bye-election is to be held for the purpose of filling the vacancy so caused;

NOW, THEREFORE, in pursuance of Section 151, sub-section (1) of Section 39 and Section 56 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission hereby-

(A) calls upon the members of the Legislative Assembly of the State of Bihar to elect, before 20th June, 2026 (Saturday), and in accordance with the provisions of the said Act and of the rules and orders made thereunder, a person for the purpose of filling the said vacancy in the Legislative Council of the State;

(B) appoints with respect to said election, -

(a) the 8th June, 2026 (Monday), as the last date for making nominations; (b) the 9th June, 2026 (Tuesday), as the date for the scrutiny of the nominations;

(c) the 11th June, 2026 (Thursday), as the last date for the withdrawal of candidatures;

(d) the 18th June, 2026 (Thursday), as the date on which a poll shall, if necessary, be taken; and

(e) the 20th June, 2026 (Saturday), as the date before which the election shall be completed; and

(C) fixes the hours from 09:00 am to 04:00 pm, as the hours during which the poll shall, if necessary, be taken on the date specified above, for the election.

(i) designates the officer, specified in column (1) of the TABLE below, to be the Returning Officer, and

(ii) appoints the officer, specified in column (2) of the said TABLE, to be the Assistant Returning Officer to assist the Returning officer in the performance of his functions;
