सं॰ एल॰जी॰-01-13/2026/4240/लेज—भारत संविधान के अनुच्छेद 213 के खंड-(1) के अधीन बिहार राज्यपाल द्वारा दिनांक 28 मई 2026 को प्रख्यापित निम्नलिखित अध्यादेश इसकेे द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है।2 (cid:464)बहार गजट (असाधारण), 1 जून 2026 [
] ः- चूँकि राज्य के अन्तर्गत दुकानों और प्रतिष्ठानों में नियोजित कर्मकारों के रोजगार के नियमन और सेवा की अन्य शर्त्तों से संबंधित विधियों को संशोधित और समेकित करने तथा उससे संबंधित या उसके आनुषंगिक मामलों के लिए बिहार दुकान और प्रतिष्ठान (रोजगार विनियमन और सेवा शर्त्त) अधिनियम, 2025 (बिहार अधिनियम-09, 2025) पारित किया गया है।
और, चूँकि केन्द्र सरकार द्वारा उपजीविकाजन्य सुरक्षा, स्वास्थ्य और कार्यदशा संहिता, 2020 (2020 का 37) को दिनांक-21.11.2025 के प्रभाव से लागू कर दिया गया है।
और, चूँकि उपजीविकाजन्य सुरक्षा, स्वास्थ्य और कार्यदशा संहिता, 2020 (2020 का 37) एवं बिहार दुकान और प्रतिष्ठान (रोजगार विनियमन और सेवा शर्त्त) अधिनियम, 2025 (बिहार अधिनियम-09, 2025) में अंकित प्रावधानों मेें समरूपता है।
और, चूँकि वर्तमान में बिहार राज्य में औद्योगिक क्रियाकलापों तथा आर्थिक गतिविधियों को गति देने हेतु प्रदेश में नये औद्योगिक निवेश के अवसर पैदा करने की आवश्यकता है ऐसी स्थिति में अधिनियमों के अन्तर्गत दोहरे प्रावधानों के सह-अस्तित्व के कारण बिहार दुकान और प्रतिष्ठान (रोजगार विनियमन और सेवा शर्त्त) अधिनियम, 2025 (बिहार अधिनियम-09, 2025) को निरसित किये जाने की आवश्यकता है।
और, चूँकि बिहार राज्य विधानमंडल सत्र में नहीं है,
और चूंकि बिहार राज्यपाल का समाधान हो गया है कि ऐसी परिस्थितियाँ विद्यमान है, जिनके कारण बिहार दुकान और प्रतिष्ठान (रोजगार विनियमन और सेवा शर्त्त) अधिनियम, 2025 (बिहार अधिनियम-09, 2025) को निरसित करने के लिए तुरंत कार्रवाई करना आवश्यक हो गया है;
और, चूंकि राज्यपाल से इस अध्यादेश को प्रख्यापित करने का निर्देश प्राप्त हुआ हैः
इसलिए, अब भारत-संविधान के अनुच्छेद-213 के खण्ड (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल निम्नलिखित अध्यादेश प्रख्यापित करते हैः-
- (1) इस अध्यादेश को बिहार दुकान और प्रतिष्ठान (रोजगार विनियमन और सेवा शर्त्त) (निरसन) अध्यादेश, 2026 कहा जा सकेगा।
(2) यह तुरंत प्रवृत्त होगा।
बिहार दुकान और प्रतिष्ठान (रोजगार विनियमन और सेवा शर्त्त) अधिनियम, 2025 (बिहार अधिनियम-09, 2025) को निरसित किया जाता है। परन्तु यह कि प्रस्तावित निरसन के उपरांत भी निरसित अधिनियम के अधीन स्थापित कार्रवाई जारी रहेगी, मानो अधिनियम निरसित नहीं किया गया है। भारत-संविधान के अनुच्छेद 213 के खंड-(1) के अधीन मैंने इस अध्यादेश को प्रख्यापित किया है।3 (cid:464)बहार गजट (असाधारण), 1 जून 2026 ———

to repeal the Bihar Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2025 (Bihar Act 09, 2025).
Preamble:— Whereas, the Bihar Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2025 (Bihar Act-09, 2025) was enacted to amend and consolidate the laws relating to the regulation of employment and other conditions of service of workers employed in shops and establishments within the State, and for matters connected therewith or incidental thereto;
And whereas, the Occupational Safety, Health and Working Conditions Code, 2020 (37 of 2020) has been brought into force by the Central Government with effect from the 21st day of November, 2025;
And whereas, there is an overlap between the provisions enshrined in the Occupational Safety, Health and Working Conditions Code, 2020 (37 of 2020) and the Bihar Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2025 (Bihar Act-09, 2025);
Furthermore, since there is currently a need to generate new opportunities for industrial investment within the state of Bihar in order to accelerate industrial and economic activities, and given the coexistence of overlapping provisions under various enactments, it has become necessary to repeal the Bihar Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2025 (Bihar Act-09, 2025) And whereas, the Legislature of the State of Bihar is not in session;
And whereas, the Governor of Bihar is satisfied that circumstances exist which render it necessary to take immediate action to repeal the Bihar Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2025 (Bihar Act-09, 2025);
4(cid:464)बहार गजट (असाधारण), 1 जून 2026 And whereas, instructions have been received from the Governor to promulgate this Ordinance;
Therefore, now, in exercise of the powers conferred by Clause (1) of Article 213 of the Constitution of India, the Governor of Bihar is pleased to promulgate the following Ordinance:—
1. Short title, extent and commencement.—
(1) This Ordinance may be called the Bihar Shops and Establishments (Regulation of Employment and Conditions of Service) (Repeal) Ordinance, 2026.
(2) It shall come into force at once.
2. Repeal and Savings.— The Bihar Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2025 (Bihar Act-09, 2025) is hereby repealed.
Provided, however, that notwithstanding the proposed repeal, any proceedings instituted under the repealed Act shall continue as if the Act had not been repealed.
