3 twu 2026 सं॰ प्र0-6/ल0ज0सं0(स्था0)-22/2025-3596--भारत के संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल एतद् द्वारा के भूगर्भ शास्त्री (Geologist) संवर्ग का गठन, भर्ती की प्रक्रिया तथा अन्य सेवा शर्त्तों को विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैंः- i. यह नियमावली ''लघु जल संसाधन विभाग भूगर्भ शास्त्री संवर्ग (भर्ती एवं सेवा शर्त्त) नियमावली 2026'' कही जा सकेगी । ii. इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । iii. यह राजपत्र में प्रकाशन की तिथि के प्रभाव से प्रवृत्त होगी। इस नियमावली में जब तक किसी संदर्भ में अन्यथा अपेक्षित न हो- i. ''विभाग'' से अभिप्रेत है लघु जल संसाधन विभाग। ii. ''सरकार'' से अभिप्रेत है बिहार राज्य सरकार । iii. संवर्ग" से अभिप्रेत है लघु जल संसाधन विभाग का भूगर्भ शास्त्री संवर्ग । iv. ''नियुक्ति प्राधिकार'' से अभिप्रेत है अभियंता प्रमुख, लघु जल संसाधन विभाग अथवा विभाग द्वारा प्राधिकृत मुख्य अभियंता से अन्यून कोई पदाधिकारी।
v. ''आयोग'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग अथवा कोई अन्य आयोग जिसे राज्य सरकार द्वारा अधिसूचित किया जाए।2 (cid:464)बहार गजट (असाधारण), 5 जून 2026 i. लघु जल संसाधन विभाग भूगर्भ शास्त्री संवर्ग के अधीन मूल कोटि का पद ''भूगर्भ शास्त्री'' होगा जो अभियंता प्रमुख, लघु जल संसाधन विभाग, पटना के प्रशासनिक नियंत्रण में होगा। इस संवर्ग में प्रोन्नति के आधार पर कोई प्रवेश नहीं होगा।
ii. इस पद के लिए समय-समय पर सरकार द्वारा यथा निर्धारित वेतन स्तर/वेतनमान देय होगा। iii. इस संवर्ग का स्वीकृत बल राज्य सरकार के द्वारा विनिश्चित किया जा सकेगा। भूगर्भ शास्त्री के पद पर सीधी भर्ती द्वारा नियुक्ति होगी, जिसके लिए न्यूनतम शैक्षणिक योग्यता भूगर्भ शास्त्र (Geology) में स्नातक होगी। साथ ही केन्द्रीय/राज्य सरकार अथवा उसके नियंत्रणाधीन किसी उपक्रम में 03 वर्षों का न्यूनतम कार्यानुभव आवश्यक होगा। कार्यानुभव से संंबंधित प्रमाण-पत्र संबंधित सरकारी संस्थान/उपक्रम के पदाधिकारी द्वारा निर्गत होना चाहिए। नियुक्ति हेतु न्यूनतम आयु सीमा वही होगी जो समय-समय पर राज्य सरकार द्वारा निर्धारित की जाए। अधिकतम आयु वही रहेगी जो राज्य सरकार द्वारा आरक्षण कोटिवार समय-समय पर निर्धारित की जाय।
नियुक्ति प्राधिकार प्रत्येक वर्ष की 1ली अप्रैल के आधार पर वास्तविक रिक्तियों की गणना कर आरक्षण कोटिवार अधियाचना आयोग को उपलब्ध करायेगें। आयोग अभ्यर्थियों की लिखित प्रतियोगिता परीक्षा एवं न्यूनतम अर्हता प्राप्तांक के आधार पर एक मेधा सूची तैयार करेगा तथा अपनी अनुशंसा नियुक्ति प्राधिकार को भेजेगा। लिखित प्रतियोगिता परीक्षा का पाठ्यक्रम एवं अर्हता प्राप्तांक का निर्धारण आयोग द्वारा किया जायेगा। आयोग की अनुशंसा के आधार पर सीधी भर्ती से नियुक्त सरकारी सेवक 01 (एक) वर्ष तक परिवीक्षा पर रहेंगे। परिवीक्षा अवधि में सेवा संतोषजनक नहीं होेने पर इसे 01 (एक) और वर्ष के लिए विस्तारित किया जा सकेगा। विस्तारित अवधि में भी सेवा संतोषजनक नहीं रहने पर सेवा समाप्त की जा सकेगी। i. आयोग की अनुशंसा से सेवा में नियुक्त सरकारी सेवक को परिवीक्षा अवधि में यथा निर्धारित प्रवेशकालीन प्रशिक्षण प्राप्त करना होगा।
ii. प्रशिक्षण अवधि में संबंधित सरकारी सेवक को प्रशिक्षण संस्थान द्वारा यथा निर्धारित परीक्षा भी उत्तीर्ण करनी होगी। i. राजस्व पर्षद की केन्द्रीय परीक्षा समिति द्वारा विभागीय परीक्षा आयोजित की जाएगी। विभागीय परीक्षा के विषय, पाठ्यक्रम एवं प्रक्रिया का निर्धारण राजस्व पर्षद द्वारा विभाग के परामर्श एवं सामान्य प्रशासन विभाग की सहमति से किया जा सकेगा।
ii. विभागीय परीक्षा में असफल होने पर प्रथम वेतन वृद्धि के पश्चात् आगे की वेतनवृद्धियाँ उक्त परीक्षाओं में उत्तीर्णता प्राप्त होने तक रूकी रहेंगी।
iii. परिवीक्षा अवधि में सेवा संतोषजनक रहने, प्रवेशकालीन प्रशिक्षण पूरा करने, विभागीय परीक्षा के सभी पत्रों में उत्तीर्णता प्राप्त करने तथा सेवा सम्पुष्टि हेतु निर्धारित अन्य अर्हताओं को पूरा करने के उपरान्त सरकारी सेवक की सेवा सम्पुष्ट की जा सकेगी। संवर्ग के सदस्यों की वरीयता आयोग द्वारा अवधारित उनकी मेधा क्रमांक के अनुसार होगी।
राज्य सरकार द्वारा नियुक्ति के संदर्भ में समय-समय पर यथा निर्धारित आरक्षण रोस्टर से संबंधित प्रावधान इस संवर्ग में नियुक्ति पर भी लागू होंगे।
i. इस संवर्ग के भूगर्भ शास्त्रियों का पदस्थापन विभाग के क्षेत्रीय कार्यालयों में होगा। ii. संवर्ग के कर्मियों/पदाधिकारियों का स्थानांतरण नियुक्ति प्राधिकार द्वारा किया जा सकेगा।
जहाँ सरकार की राय हो कि ऐसा करना आवश्यक या समीचीन है वहाँ लिखित रूप से अभिलिखित किये जाने वाले कारणों से व्यक्ति या पद के किसी वर्ग या कोटि के संबंध में इस नियमावली के किन्हीं प्रावधानों को शिथिल किया जा सकेगा।3 (cid:464)बहार गजट (असाधारण), 5 जून 2026 इस नियमावली में जिन विषयों का प्रावधान नहीं किया जा सका है, उनके संदर्भ में राज्य सरकार के प्रासंगिक संहिता/नियमावली/संकल्प/अनुदेश के प्रावधान लागू होंगे। विभाग समय-समय पर ऐसा सामान्य या विशेष निदेश जारी कर सकेगा, जो इस नियमावली के प्रावधानों में से किसी के कार्यान्वयन में आ रही कठिनाई के निराकरण के लिए आवश्यक हो। जहाँ इस नियमावली के प्रावधानों में से किसी के निर्वचन के संबंध में कोई शंका उत्पन्न हो, वहाँ विभाग द्वारा विधि विभाग अथवा सामान्य प्रशासन विभाग, जैसा आवश्यक हो, के परामर्श से विनिश्चय किया जायेगा और उसका निर्णय अंतिम होगा। अन्य नियमावली, नीति या कार्यकारी निर्देश के अन्तर्विष्ट होते हुए भी, यह नियमावली प्रभावी होगी एवं भूगर्भ शास्त्री संवर्ग की भर्त्ती की प्रक्रिया तथा अन्य सेवा शर्तों को विनियमित करेगी।

No. Sec-6/MWRD(Est.)-22/2025-3596--In exercise of the powers conferred under proviso to the Article 309 of the Constitution of India, the Governor of Bihar is hereby pleased to make the following Rules to regulate the formation, recruitment process and other service conditions of Geologist Cadre of the Minor Water Resources Department: - 1. Short Title, Extent, and Commencement.-
(i) These Rules shall be called the "Minor Water Resources Department Geologist Cadre (Recruitment and Service Conditions) Rules, 2026." (ii) It shall extend to the whole of the State of Bihar. (iii) It shall come into force with effect from the date of its publication in the Official Gazette.
2. Definitions. - In these Rules, unless the context otherwise requires—
(i) "Department" means the Minor Water Resources Department. (ii) "Government" means the State Government of Bihar. (iii) "Cadre" means the Geologist Cadre of the Minor Water Resources Department.
(iv) "Appointing Authority" means the Engineer-in-Chief, Minor Water Resources Department or any officer not below the rank of Chief Engineer authorized by the Department.
(v) "Commission" means the Bihar Staff Selection Commission or any other Commission as may be notified by the State Government.
3. Structure of the Cadre. -
(i) Post of basic grade under the Minor Water Resources Department Geologist Cadre will be "Geologist," which will be under administrative control of the Engineer-in-Chief, Minor Water Resources Department, Patna. There will be no entry into this Cadre through promotion.
(ii) The post will carry the pay level/pay scale as determined by the Government from time to time
(iii) The sanctioned strength of this Cadre shall be decided by the State Government.
4 (cid:464)बहार गजट (असाधारण), 5 जून 20264. Process of Appointment.—
(a) Appointment to the post of Geologist shall be made through direct recruitment, for which the minimum educational qualification shall be a Bachelor's degree in Geology. Additionally, a minimum work experience of 03 years in the Central/State Government or an enterprise under its control shall be mandatory. The certificate regarding work experience must be issued by a competent officer of the concerned government institution/enterprise.
(b) The minimum age limit for appointment shall be the same as determined by the State Government from time to time. The maximum age limit shall remain as reservation categorywise determined by the State Government from time to time.
(c) The Appointing Authority shall calculate the actual vacancies as on the 1st of April of each year and submit a reservation category wise requisition to the Commission.
(d) The Commission shall prepare a merit list based on a written competitive examination and the minimum qualifying marks secured by the candidates and shall forward its recommendation to the Appointing Authority. The syllabus for the written competitive examination and the minimum qualifying marks shall be determined by the Commission.
5. Probation.—
Government servants appointed through direct recruitment on the recommendation of the Commission shall be on probation for 01 (one) year. If the service is found unsatisfactory during the probation period, it may be extended for an additional 01 (one) year. If the service not found satisfactory even during the extended period, the service may be terminated.
6. Training.—
(i) Government servant appointed to the service on the recommendation of the Commission shall have to undergo induction training as prescribed during the probation period.
(ii) During the training period, the concerned government servant shall have to pass the examinations as prescribed by the training institute.
7. Departmental Examination and Confirmation.—
(i) A departmental examination shall be conducted by the Central Examination Committee of the Board of Revenue. Subjects, syllabus and procedure for the departmental examination may be determined by the Board of Revenue in consultation with the Department concerned and with the concurrence of the General Administration Department.
(ii) In the event of failure in the departmental examination, further increments in salary subsequent to the first increment shall be withheld until the candidate successfully passes the said examinations.
(iii) The service of government servant shall be confirmed after completion of probationary period with satisfactory service, successful completion of induction training, passing all papers of the departmental examination and the fulfillment of other qualifications prescribed for the confirmation of service.
5 (cid:464)बहार गजट (असाधारण), 5 जून 20268. Seniority. —
The seniority of members of the cadre shall be in accordance with their merit rank as determined by the Commission.
9. Reservation. —
The provisions regarding the reservation roster as prescribed by the State Government from time to time in the context of appointments shall be applicable to appointments in this cadre also.
10. Posting. —
(i) Geologists belonging to this cadre shall be posted in the regional offices of the Department.
(ii) Transfer of employees/officers of the cadre may be made by the Appointing Authority.
11. The Power of Relaxation. —
Where the Government is of the opinion that it is necessary or expedient to do so, it may, for reasons to be recorded in writing, relax any of the provisions of these Rules in respect of any class or category of person or post.
12. Residue Matters. —
In respect of matters for which no provision has been made in these Rules, the provisions of the relevant Codes/Rules/ Resolutions/ Instructions of the State Government shall apply.
13. Removal of Difficulties. —
The Department may issue such general or special directions from time to time which may be necessary for removal of difficulties coming in the implementation of any of provisions of these Rules.
14. Interpretation.—
Where any doubt arises with respect to interpretation of any provision of these Rules, it shall be determined by the Department after consultation with the Law Department or the General Administration Department as required and its decision shall be final.
15. Savings and Overriding Effect. —
Notwithstanding anything contained in any other Rules, Policy, or Executive Instructions, these Rules shall prevail and shall regulate the recruitment process and other service conditions for the Geologist Cadre.
