(सं0 पटना 606) पटना, वृह(cid:232)पितवार, 11 जून 2026 e|fu"ks/k mRikn ,oa fuca/ku foHkkx ¼fuca/ku½ ———— vf/klwpuk 10 twu 2026 3872—भारतीय स्टाम्प अधिनियम, 1899 (सं0- II 1899), जैसा कि बिहार राज्य में लागू है, की धारा 74 एवं 75 सह पठित धारा 10, 49 और 52 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्य सरकार एतद्‌ द्वारा निम्नलिखित नियम बनाती हैः- 1.

(1) यह नियमावली ''बिहार स्टाम्प (सेवा प्रदाता अनुज्ञप्ति एवं ई-स्टाम्प की आपूर्ति) नियमावली, 2026'' कहलाएगी।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह आधिकारिक राजपत्र में प्रकाशन की तिथि से लागू होगा।

2.

(1) से अभिप्र्रेत है भारतीय स्टाम्प अधिनियम, 1899 (सं0-II, 1899), जैसा कि बिहार राज्य में लागू है ;

से अभिप्रेत है राज्य सरकार द्वारा नियुक्त सहायक निबंधन (2) से अभिप्र्रेत है अधिनियम में परिभाषित कलेक्टर ; (3)

महानिरीक्षक ;

से अभिप्रेत है राज्य सरकार द्वारा नियुक्त उप निबंधन महानिरीक्षक ;

(4) (5)

से अभिप्रेत है राज्य में इलेक्ट्रॉनिक रूप से दस्तावेजों के निबंधन की कम्प्यूटरीकृत और वेब सक्षम प्रणाली अथवा निबंधन महानिरीक्षक द्वारा समय-समय पर जारी किसी अन्य एप्लीकेशन सॉफ्टवेयर से है, जो अनुज्ञप्ति प्राप्त सेवा प्रदाताओं या वर्त्तमान नियमों के अंतर्गत अधिकृत उपयोगकर्ता या निबंधन महानिरीक्षक के आदेशों से अन्य के उपयोग के लिए उपलब्ध हो ;

(6) का वही अर्थ होगा जो सूचना प्रौद्योगिकी अधिनियम, 2000 (सं0- XXI, 2000) की धारा 2 की उपधारा (1) के खंड (नक) में दिया गया है ;

(7) से अभिप्र्रेत है, स्टाम्प शुल्क या ऐसी अन्य राशि के भुगतान को दर्शाने के लिए कागज पर इलेक्ट्रॉनिक रूप से मुद्रित जिसमें अल्फान्यूमेरिक कोड या ई-स्टाम्प कोड है, जिसका अन्यथा भुगतान छपे हुए या चिपकाए गए या फ्रैंक्ड स्टाम्प के रूप में किया जाता, जो ए0सी0सी0 काउंटर या अनुज्ञप्ति प्राप्त सेवा प्रदाताओं के द्वारा ई0आर0एस0 या विभाग द्वारा समय समय पर प्रदान किये गये किसी अन्य एप्लिकेशन सॉफ्टवेयर के माध्यम से जारी किया जाए ;

(8) से अभिप्रेत है स्टाम्प शुल्क के भुगतान के बाद ई0आर0एस0 के द्वारा उपयोगकर्ता को डिजिटल प्रारूप में जारी किया गया अल्फा न्यूमेरिक कोड ;

(9) से अभिप्रेत है, इन नियमों से संलग्न प्रपत्र ; (10) से अभिप्रेत है, निबंधन अधिनियम, 1908 (संख्या-XVI, 1908) की धारा-3 के उपबंधो के अधीन नियुक्त निबंधन महानिरीक्षक ;

(11) से अभिप्रेत है, अधिनियम में परिभाषित जिले का कलेक्टर ; (12) से अभिपे्रत है इन नियमों के अधीन अनुज्ञप्तिधारी, जो विभाग द्वारा प्रदान किये गये ई0आर0एस0 के माध्यम से ई-स्टाम्प की बिक्री एवं अन्य संबंधित सेवाएं अथवा राज्य सरकार द्वारा निर्धारित तरीके से निबंधन प्रक्रिया हेतु दस्तावेजों को तैयार करने के लिए प्राधिकृत है ;

(13) से अभिप्रेत है, अधिनियम के अधीन नियुक्त जिला अवर निबंधक, अवर निबंधक एवं संयुक्त अवर निबंधक या निबंधन महानिरीक्षक के द्वारा समय-समय पर अधिसूचित किया गया कोई अन्य पदाधिकारी ;

(14) से अभिप्रेत है, निबंधन महानिरीक्षक ; (15) से अभिप्रेत है, अधिनियम की धाराएं ; (16) से अभिप्रेत है, विभाग द्वारा उपलब्ध कराये गए ई0आर0एस0 के माध्यम से सरकारी खाते में सेवा प्रदाता द्वारा जमा की गई अग्रिम राशि। सेवा प्रदाता क्रेटिड सीमा तक ई-स्टाम्प बेचने एवं ई-स्टाम्प कोड जारी करने तथा राज्य सरकार द्वारा समय-समय पर अधिसूचित कमीशन प्राप्त करने का हकदार होगा ;

(17) से अभिप्रेत है, ई0आर0एस0 के माध्यम से किसी विशेष तिथि को निबंधन पदाधिकारी के समय का स्लॉट बुकिंग ;

(18) से अभिप्रेत है, बिहार सरकार ; (19) से अभिप्रेत है निबंधन महानिरीक्षक या राज्य सरकार द्वारा नियुक्त कोई अन्य अधिकारी।

इन नियमों में प्रयुक्त किन्तु परिभाषित नहीं किए गए शब्दों और अभिव्यक्तियों का वही अर्थ होगा जो उन्हें बिहार राज्य में लागू भारतीय स्टाम्प अधिनियम, 1899 (सं0- II, 1899) और निबंधन अधिनियम, 1908 (सं0- XVI, 1908) एवं इन अधिनियमों के अंतर्गत गठित नियमावली में दिया गया है।

ई-स्टाम्प की बिक्री करने या निर्गत करने के लिए अनुज्ञप्ति प्रदान करने हेतु आवेदन प्रपत्र-क में अनुज्ञप्ति प्राधिकार को दिया जाएगा, जिसके साथ चालान या ई-भुगतान द्वारा सरकारी खाते में रू0 1,000/- जमा किये जाने की रसीद भी संलग्न करनी होगी। सेवा प्रदाता की अनुज्ञप्ति के लिए आवेदन ई0आर0एस0 अथवा निबंधन महानिरीक्षक के द्वारा समय-समय पर यथा निर्धारित विधि के माध्यम से किया जाएगा। शुल्क वापसी योग्य नहीं होगा। सभी आवेदनों का निपटारा आवेदन प्राप्त होने की तिथि से तीन महीने की अवधि के अंदर किया जाएगा।

4.

(1) सेवा प्रदाताओं की दो श्रेणियां हाेंगी, यथा -

(क) व्यक्तिगत (ख) बैंक या डाकघर या सक्षम प्राधिकार द्वारा मान्यता प्राप्त वित्तीय संस्थान।

(2) व्यक्तियों के मामले में, अनुज्ञप्ति प्राधिकार अपने विवेकानुसार किसी आवदेक को अनुज्ञप्ति निर्गत कर सकेगा यदि यह समाधान होता है कि आवेदक - (क) भारत का नागरिक हो और आवेदन की तिथि को उसकी आयु 21 वर्ष से अधिक हो। (ख) किसी सरकारी/अर्ध सरकारी/सरकारी उपक्रम/स्थानीय निकाय/विभाग में कार्यरत न हो।

(ग) किसी मान्यता प्राप्त संस्थान/विश्वविद्यालय से स्नातक या समकक्ष परीक्षा उत्तीर्ण की हो।

(घ) अच्छे नैतिक चरित्र का हो और सक्षम प्राधिकार द्वारा जारी चरित्र प्रमाण पत्र प्राप्त हो। (ड़) किसी सक्षम न्यायालय द्वारा उसे मानसिक रूप से अक्षम घोषित नहीं किया गया हो।(cid:464)बहार गजट (असाधारण) 11 जून 2026 3 (च) किसी आपराधिक न्यायालय द्वारा नैतिक अधमता से संबंधित अपराध के लिए दोषी नहीं ठहराया गया हो।

(छ) किसी सक्षम न्यायालय द्वारा दिवालिया घोषित न किया गया हो। (ज) सूचना प्रौद्योगिकी अधिनियम, 2000, (सं0- XXI, 2000) की धारा 2 के खंड (1) के उप-खंड (नक) के प्रावधानों के अनुसार इलेक्ट्रॉनिक हस्ताक्षर रखता हो।

(झ) ई-स्टाम्प की बिक्री के लिए ऋण सीमा प्राप्त करने और अन्य संबंधित सेवाएं प्रदान करने के लिए वित्तीय रूप से सक्षम हो।

(ञ) हिंदी एवं अंग्रेजी दोनों भाषाओं में सेवाएं प्रदान करने में सक्षम हो। (ट) भारतीय स्टाम्प अधिनियम, 1899 (सं0- II, 1899) और निबंधन अधिनियम, 1908 (सं0- XVI, 1908) तथा उसके अंतर्गत बनाए गए नियमों का ज्ञान हो।

(3) सेवा प्रदाताओं से यह अपेक्षा की जाती है कि उन्हें कंप्यूटर संचालन का ज्ञान हो कंप्यूटर, प्रिंटर, बायोमेट्रिक डिवाइस, वेब कैमरा, यूपीएस, स्कैनर तथा निबंधन महानिरीक्षक द्वारा निर्धारित अन्य कंप्यूटर उपकरणों के साथ हाई स्पीड इंटरनेट कनेक्शन से सुसज्जित हो।

परन्तु, अधिवक्ता, वर्त्तमान में कार्यरत अनुज्ञप्तिधारी दस्तावेज नवीस/ प्रशिक्षु/मुद्रांक विक्रेता जिन्हें उक्त नियम 4(1)(क) में वर्णित श्रेणी में सेवा प्रदाता की अनुज्ञप्ति दी जानी है, के लिए निबंधन महानिरीक्षक की अनुमति से उक्त अर्हताओं से छूट दी जा सकती है।

परन्तु सेवा प्रदाता को अनुज्ञप्ति के लिए अर्हताएं राज्य सरकार की अनुमति से

अधिसूचित/संशोधित किया जा सकेगा।

(4) नियम 4(1)(ख) में वर्णित बैंकों, डाकघरों या वित्तीय संस्थानों को अनुज्ञप्ति इस हेतु ई0आर0एस0 के माध्यम से उनके आवेदन पर अनुज्ञप्ति प्राधिकार के द्वारा निबंधन महानिरीक्षक के निर्देश पर निर्गत किया जाएगा। 5. सेवा प्रदाता को अनुज्ञप्ति 3 (तीन) वर्ष की अवधि के लिए प्रदान की जायेगी। लेकिन प्रथम बार 3 (तीन) वर्ष की अवधि पूरा होने के पूर्व एवं 2 (दो) वर्ष पूर्ण होने के पश्चात 31 मार्च को अनुज्ञप्ति नवीकरण हेतु प्रस्तुत किया जायेगा। 6. अनुज्ञप्ति की समाप्ति पर, अनुज्ञप्ति प्राधिकार नियम-3 के अनुसार निर्धारित शुल्क के भुगतान पर अनुज्ञप्ति को अगले 3 वर्षों के लिए नवीकृत कर सकता है। नवीकरण के लिए आवेदन अनुज्ञप्ति की समाप्ति से कम से कम 30 दिन पहले प्रपत्र-क में नियमों के अंतर्गत निर्धारित शुल्क का भुगतान करने की रसीद के साथ किया जायेगा। शुल्क वापसी योग्य नहीं होगा। नवीकरण के लिए आवेदनों का निपटारा आवेदन प्राप्त होने की तारीख से एक महीने की अवधि के अंदर किया जाएगा।

सेवा प्रदाता की अनुज्ञप्ति ''प्रपत्र-ख'' में राज्य सरकार द्वारा निर्दिष्ट किये गए नियमों एवं शर्तों पर जारी किया जाएगा। नियम 4 के उप-नियम (2) में उल्लिखित नौकरी प्राप्त करने पर अनुज्ञप्तिधारी के रूप में नियुक्त होने वाले व्यक्ति को तुरंत अपनी अनुज्ञप्ति वापस करनी होगी।

8.

(1) अनुज्ञप्ति प्राधिकार किसी भी समय नीचे दिए गए किसी भी आधार पर अनुज्ञप्तिधारी पर जुर्माना लगा सकता है, अनुज्ञप्ति निलंबित या निरस्त कर सकता है :-

(क) इन नियमों के किसी प्रावधान या अनुज्ञप्ति की शर्तों के उल्लंघन के लिए। (ख) पर्याप्त स्टाम्पों का भंडारण करने में असमर्थता या ई-स्टाम्पों और अन्य संबंधित सेवाओं के लिए पर्याप्त क्रेडिट सीमा रखने में असमर्थता।

(ग) संबंधित निबंधन अधिकारी की पूर्व अनुमति के बिना एक माह से अधिक अवधि तक लगातार कार्यस्थल पर उपस्थित न होने पर।

(घ) किसी अवैध लेनदेन या अनुचित व्यवहार में भाग लेने का दोषी होने पर। (ड.) कार्यालय में भ्रष्टाचार को बढ़ावा देने वाले व्यवहार में लिप्त होने के लिए। (च) निर्धारित शुल्क से अधिक राशि की वसूली किया जाना। (छ) अनुज्ञप्तिधारी के द्वारा किसी अन्य कदाचार के लिए।

(2) ऐसे आदेश की प्रति निबंधन महानिरीक्षक को प्रेषित की जाएगी।

बशर्ते कि, जुर्माना लगाने या लाइसेंस निरस्त करने का कोई आदेश तब तक पारित नहीं किया जाएगा जब तक कि अनुज्ञप्तिधारी को सुनवाई का अवसर न दे दिया गया हो। बशर्ते कि, अनुज्ञप्तिधारी को उपरोक्त नोटिस जारी करने की तारीख से लाइसेंस निलंबित रहेगा।

बशर्ते कि, राज्य सरकार नियम 4(1)(ख) में वर्णित किसी विशेष श्रेणी की अनुज्ञप्ति को बंद करने का आदेश जारी कर सकती है।(cid:464)बहार गजट (असाधारण) 11 जून 2026 4 9. निबंधन महानिरीक्षक किसी भी समय स्वयं या किसी पक्ष द्वारा किए गए आवेदन पर, अनुज्ञप्ति प्राधिकार द्वारा पारित किसी आदेश की वैधता या औचित्य के संबंध में या उसके द्वारा संचालित कार्यवाहियों की नियमितता के संबंध में स्वयं को संतुष्ट करने के प्रयोजनार्थ अनुज्ञप्ति प्राधिकार के समक्ष लंबित या उनके द्वारा निपटाए गए ऐसे किसी मामले के अभिलेख की मांग कर सकेगा और उसकी जाँच कर सकेगा तथा इसके संदर्भ में ऐसा आदेश पारित कर सकेगा जैसा वह ठीक समझे।

10.

निबंधन महानिरीक्षक, नियम 8 के तहत पारित अनुज्ञप्ति प्राधिकार के आदेश से व्यथित किसी व्यक्ति के आवेदन पर, ऐसे किसी भी मामले का अभिलेख मंगवा सकता है और उसकी जाँच कर सकता है तथा आवेदक को सुनवाई का अवसर देने के बाद, ऐसा आदेश पारित कर सकता है, जैसा वह उचित समझे। निबंधन महानिरीक्षक द्वारा पारित आदेश अंतिम होगा।

11.

सेवा प्रदाता, विभाग द्वारा उपलब्ध कराये गए एप्लिकेशन सॉफ्टवेयर के माध्यम से निम्नलिखित सेवाएं प्रदान करने के लिए जिम्मेदार होंगे-

(क) ई0आर0एस0 के माध्यम से व्यक्तियों को डाटा प्रविष्टि की सुविधा प्रदान करना। (ख) निबंधन अधिनियम, 1908 (सं0- XVI, 1908) के प्रावधानों के अनुसार निबंधन के प्रयोजन के लिए ई0आर0एस0 के माध्यम से दस्तावेजों का प्रारूपण।

(ग) पक्षकारों एवं गवाहों का दस्तावेज पर ई-साईन हेतु सुविधा प्रदान करना। (घ) संपत्ति का सही मूल्यांकन करना जो दस्तावेजों की विषय वस्तु है और उस पर देय मुद्रांक एवं निबंधन शुल्क की गणना करना।

(ड़) अनिवार्य निबंधन की आवश्यकता वाले दस्तावेजों हेतु पक्षकारों के लिए स्लॉट की बुकिंग करना। (च) सेवा प्रदाता क्रेडिट सीमा द्वारा ई-स्टाम्प का भुगतान करना। (छ) निबंधित दस्तावेजों की खोज, उनकी प्रतियों को डाउनलोड करना/जारी करना आदि जैसी अन्य सेवाएं प्रदान करना।

(ज) ई0आर0एस0 के माध्यम से उन दस्तावेजों के लिए ई-स्टाम्पों का सृजन और मुद्रण करना, जिनके लिए निबंधन अनिवार्य नहीं है तथा निबंधन के लिए विकल्प नहीं चुना गया है, या निबंधन महानिरीक्षक के द्वारा समय-समय पर अधिसूचित की गयी अन्य जिम्मेदारी। 12.

सेवा प्रदाता ई0आर0एस0 में निर्दिष्ट विधि से अग्रिम भुगतान के माध्यम से ई-स्टाम्प जारी करने के लिए क्रेडिट सीमा क्रय करेगा। वह अपनी क्रेडिट की अधिसीमा जो राज्य सरकार के द्वारा अधिसूचित की जाएगी, तक ई-स्टाम्प बेचने का हकदार होगा। 13. ई-स्टाम्प बेचने वाले या ई-स्टाम्प के लिए क्रेडिट सीमा खरीदने वालेे सेवा प्रदाता को राज्य सरकार के द्वारा समय-समय पर अधिसूचित कमीशन का भुगतान किया जायेगा।

14.

(1) कोई भी व्यक्ति जो ऐसे दस्तावेजों के लिए ई-स्टाम्प प्रमाण-पत्र खरीदना चाहता है, जो निबंधन हेतु अनिवार्य नहीं हैं और जिन्हें आवेदक निबंधन नहीं करवाना चाहता है, उसे ई0आर0एस0 में दिए गए प्रारूप में ई-स्टाम्प के लिए आवेदन करना होगा। सेवा प्रदाता ई-स्टाम्प खरीदने के लिए आवेदन पत्र में दी गई अपेक्षित जानकारी और विवरण दर्ज करेगा। दर्ज किए गए ऐसे विवरणों को फॉर्म के प्रिंट आउट पर पक्षकार द्वारा अपने हस्ताक्षर से सत्यापित किया जाएगा। सत्यापन के बाद, सेवा प्रदाता अपना इलेक्ट्रॉनिक हस्ताक्षर करेगा और ई-स्टाम्प जेनरेट कर, उसका प्रिंटआउट लेगा तथा ई-स्टाम्प जारी करेगा।

(2) ई0आर0एस0 के माध्यम से निबंधन हेतु उपस्थापित दस्तावेजों के लिए सेवा प्रदाता या उपयोगकर्ता निर्दिष्ट माध्यम के अनुसार शुल्क का भुगतान करने के बाद ईआरएस से ''ई-स्टाम्प कोड'' प्राप्त करेगा। निबंधन अधिकारी यह सत्यापित करेगा कि शुल्क ई0आर0एस0 के माध्यम से भुगतान किया गया है और ''ई-स्टाम्प कोड'' को लॉक कर देगा। 15. सेवा प्रदाता निबंधन महानिरीक्षक द्वारा उपलब्ध कराए गए विशिष्ट लॉगिन आई0डी0 एवं पासवर्ड के द्वारा ई0आर0एस0 में वैसे दस्तावेजों के लिए जो अनिवार्य रूप से निबंधित करने योग्य नहीं है, के लिए ''ई-स्टाम्प प्रमाण-पत्र'' एवं वैसे दस्तावेज जो अनिवार्य रूप से निबंधन योग्य है, के लिए ''ई-स्टाम्प कोड'' जारी करने के लिए अधिकृत हाेंगे। ई-स्टाम्पिंग निम्न प्रकार से की जाएगीः- (1) ई-स्टाम्प कोड केवल अनुज्ञप्ति प्राप्त सेवा प्रदाताओं या अधिकृत एजेन्सियों द्वारा ई0आर0एस0 के माध्यम से तैयार किया जाएगा। (2) प्रत्येक ई-स्टाम्प पर निम्न अंकित होगाः-

(क) ई-चालान का जी0आर0एन0 नंबर जिसके माध्यम से सेवा प्रदाता या अधिकृत एजेंसी के द्वारा क्रेडिट सीमा खरीदी गई है।

(ख) एक क्रम संख्या/विशिष्ट पहचान संख्या, ताकि यह सुनिश्चित किया जा सके कि इसका पुनः उपयोग नहीं किया जा सके।

(ग) जारी करने की तारीख और समय तथा शब्दों और अंकों में स्टाम्प शुल्क की राशि। (घ) क्रेता एवं दस्तावेज के अन्य पक्षकारों का नाम एवं पता।5 (cid:464)बहार गजट (असाधारण) 11 जून 2026 (ड) उस दस्तावेज का विवरण जिसके लिए ई-स्टाम्प खरीदा जा रहा है। (च) ई-स्टाम्प जारी करने वाले सेवा प्रदाता/प्राधिकृत एजेेंसियों की यूजर आई0डी0 और कोड।

(छ) सेवा प्रदाता/अधिकृत एजेंसियों का डिजिटल हस्ताक्षर। (ज) सुरक्षा विशेषताएं जैसे ऑपटिकल वॉटर मार्क, माइक्रो प्रिंट और सुरक्षा बारकोड आदि। (झ) समय-समय पर निबंधन महानिरीक्षक द्वारा निर्दिष्ट कोई अन्य सुरक्षा विशेषता या अन्य विवरण। 16.

(1) यदि प्रमाण-पत्र अनजाने में और अनियोजित रूप से खराब हो गया है, किसी मुद्रण त्रुटि के कारण या किसी अन्य कारण से नष्ट हो गया है, इच्छित उद्देश्य के लिए अनुपयुक्त हो गया है, तो सेवा प्रदाता द्वारा संशोधित ई-स्टाम्प प्रमाण-पत्र जारी किया जा सकता है, यदि उस पर कोई भी दस्तावेज लिखा नहीं गया हो।

(2) यदि सेवा प्रदाता को प्रपत्र-घ में ई-स्टाम्प प्रमाण-पत्र पुनः जारी करने के लिए आवेदन प्राप्त होता है, तो वह दावे की वास्तविकता एवं आवेदक का विवरण की जाँच करेगा और ई-स्टाम्प प्रमाण-पत्र पुनः जारी करने के लिए संबंधित निबंधन पदाधिकारी से अनुमति लेगा। (3) संबंधित निबंधन पदाधिकारी द्वारा लिखित में अनुमति दिये जाने के बाद, सेवा प्रदाता या प्राधिकृत एजेंसी ई-स्टाम्प प्रमाण-पत्र पुनः जारी करेगा और सेवा प्रदाता या प्राधिकृत एजेंसी द्वारा इस गतिविधि का एक लॉग संधारित किया जायेगा।

(4) निबंधन पदाधिकारी ऐसे आवेदनों का बिना किसी विलंब के निपटारा करेगा।

17.

(1) स्टाम्प की वापसी की शर्तें जो भारतीय मुद्रांक अधिनियम, 1899 के भाग-5 और ''बिहार ई-स्टाम्प शुल्क (एजेन्सी द्वारा क्रियान्वयन) नियमावली, 2020'' में वर्णित है जैसा है वैसा, आवश्यक परिवर्तनों के साथ लागू होगी।

(2) खराब या दुरूपयोग किए गए या अनावश्यक ''ई-स्टाम्प प्रमाण-पत्र'' या ''ई-स्टाम्प कोड'' के माध्यम से जमा की गई राशि की वापसी के लिए आवेदन 'ई-स्टाम्प प्रमाण-पत्र' के साथ निर्धारित प्रपत्र-ड. में किया जाएगा।

(3) यह आवेदन ''ई-स्टाम्प प्रमाण-पत्र'' या ''ई-स्टाम्प कोड'' जारी होने की तिथि से एक वर्ष के अंदर कलेक्टर/सहायक निबंधन महानिरीक्षक को प्रस्तुत किया जाएगा।

(4) ''ई-स्टाम्प प्रमाण-पत्र'' या ''ई-स्टाम्प कोड'' के सत्यापन के लिए कलेक्टर/सहायक निबंधन महानिरीक्षक सेवा प्रदाता या प्राधिकृत एजेंसी से उनके इलेक्ट्रॉनिक रिकॉर्ड से संबंधित प्रविष्टि की सच्ची प्रतिलिपि के साथ इस संबंध में शपथ-पत्र मांगेगा कि प्रमाण-पत्र या कोड वास्तविक है, चालान का विवरण जिसके माध्यम से सरकारी खाते में राशि स्थानांतरित की गई है और इस तथ्य के बारे में कि इसका उपयोग किसी दस्तावेज के निबंधन के लिए नहीं किया गया है।

(5) उपनियम-4 के अंतर्गत सत्यापन रिपोर्ट से संतुष्ट होने पर, यदि यह स्थापित हो जाता है कि आवेदक ने आवेदन में दर्शाए अनुसार स्टाम्प शुल्क, निबंधन शुल्क एवं अन्य शुल्क के रूप में राशि जमा कर दी है और राशि का उपयोग किसी दस्तावेज के निष्पादन या निबंधन के लिए नहीं किया गया है, तो जमा राशि की प्रत्येक शीर्ष के लिए अलग-अलग 10 प्रतिशत, न्यूनतम 200/-(दो सौ रूपये) और अधिकतम 5,000/-(पाँच हजार रूपये) की कटौती कर वापसी की जाएगी।

(6) ई-स्टाम्प द्वारा जमा की गई राशि की वापसी के लिए संबंधित जिले के कलेक्टर/सहायक निबंधन महानिरीक्षक द्वारा स्वीकृति आदेश जारी करने के बाद, संबंधित निबंधन कार्यालय के निकासी एवं व्ययन पदाधिकारी द्वारा जमा की गई राशि की वापसी नियम-17 के उपनियम (5) के अनुसार राशि की निकासी करने के पश्चात्‌ की जाएगी। बशर्ते कि, अधिनियम की धारा 2(9)(ख) के अंतर्गत निबंधन पदाधिकारी को भी वापसी का आवेदन प्राप्त करने एवं तद्‌नुसार ''ई-स्टाम्प प्रमाण-पत्र'' या ''ई-स्टाम्प कोड'' की वापसी का स्वीकृत्यादेश निर्गत करने हेतु प्राधिकृत किया जा सकेगा।(cid:464)बहार गजट (असाधारण) 11 जून 2026 6 18. अनुज्ञप्तिधारी अनुज्ञप्ति में निर्दिष्ट स्थान पर कार्य करेगा तथा ई-स्टाम्प प्रमाण-पत्र की बिक्री/निर्गत करेगा। वह बिना किसी विलंब के ई-स्टाम्प खरीदने आये व्यक्ति की पहचान उसके मतदाता पहचान पत्र, आधार कार्ड, पैन कार्ड, ड्राइविंग लाइसेंस, बैंक पासबुक, पासपोर्ट या निबंधन महानिरीक्षक द्वारा निर्दिष्ट किये गए किसी अन्य दस्तावेज की प्रति से करने के पश्चात्‌ ई-स्टाम्प का परिदान करेगा।

19.

(1) सेवा प्रदाता ई0आर0एस0 में निर्गत/बिक्री किये गये ई-स्टाम्प का दैनिक लेखा रखेगा। डिजिटल लेखा संधारित करेगा और आवश्यकता पड़ने पर अनुज्ञप्ति प्राधिकार या विभाग के किसी निरीक्षी अधिकारी को उपलब्ध कराएगा।

(2) सेवा प्रदाता किसी निर्दिष्ट दिन या अवधि से संबंधित निम्नलिखित जानकारी और रिपोर्ट निबंधन पदाधिकारी और/या अनुज्ञप्ति प्राधिकार के द्वारा निर्दिष्ट किसी अन्य पदाधिकारी को प्रस्तुत करने के लिए जिम्मेदार होगा- (क) कुल संग्रह रिपोर्ट। (ख) अतिरिक्त स्टाम्प ड्‌यूटी रिपोर्ट। (ग) लॉक ई-स्टाम्प रिपोर्ट। (घ) निरस्त किये गये ई-स्टाम्प रिपोर्ट। (ड़) संग्रह और पे्रषण की दैनिक/साप्ताहिक/पाक्षिक/मासिक रिपोर्ट या वांछित विवरण। (च) कोई अन्य सूचना या रिपोर्ट, जो निबंधन महानिरीक्षक द्वारा अपेक्षित हो।

20.

ई-स्टाम्प की खरीद के लिए भुगतान इस संबंध में निबंधन महानिरीक्षक द्वारा निर्दिष्ट राशि हस्तान्तरण के किसी भी तरीके से किया जा सकता है। 21. यदि किसी व्यक्ति के पास एक निश्चित्‌ मूल्यवर्ग का ''ई-स्टाम्प कोड'' है, परंतु किसी कारणवश उसे इसी दस्तावेज पर अतिरिक्त राशि के स्टाम्प शुल्क का भुगतान करने की आवश्यकता है, तो वह सेवा प्रदाता से अतिरिक्त राशि का ई-स्टाम्प क्रय कर सकता है।

22.

(1) सेवा प्रदाताओं द्वारा उपलब्ध कराई गई सेवाओं यथा- पक्षकारों अथवा गवाहों का ई-के0वाई0सी0 एवं ई-साईन, दस्तावेज तैयार करना आदि के लिए पारिश्रमिक के दर, नियम 12 एवं 13 में वर्णित दर को छोड़कर, के निर्धारण का अधिकार निबंधन महानिरीक्षक को होगा जिसे उनके द्वारा समय-समय पर संशोधित किया जाएगा। (2) स्थानीय बोल-चाल की भाषा में पारिश्रमिक दर की तालिका कार्यालय के सुगोचर स्थान पर प्रदर्शित की जाएगी। सेवा प्रदाताओं के द्वारा भी इसी प्रकार की एक तालिका उनके कार्य स्थल पर प्रदर्शित की जाएगी। 23. निबंधन महानिरीक्षक को इस नियमावली के परिशिष्टों/प्रपत्रों/अभिलेख संधारित करने की प्रक्रिया/रिपोर्ट एवं प्रतिवेदनों की प्रक्रिया में आवश्यक संशोधन का अधिकार होगा। 24. सेवा प्रदाता संबंधित जिला अवर निबंधक या अवर निबंधक के सामान्य पर्यवेक्षण एवं नियंत्रण में कार्य करेंगे। राज्यपाल, बिहार के आदेश से, अजय यादव, सरकार के सचिव।

S.O.No.10/Ni.(Mudrank Niyamawali)-39/2026/3872—In exercise of the powers conferred by Section 74 and 75 read with Section 10, 49 and 52 of the Indian Stamp Act, 1899 (No. II of 1899), as applicable to the State of Bihar, the State Government, hereby, makes the following rules

CHAPTER – I

(PRELIMINARY)

1. Short title, extent and commencement :-

(i) This rule shall be called "The Bihar Stamp (Service Providers' Licence and supply of e-Stamp) Rules, 2026".

(ii) It shall extend to the whole of State of Bihar. (iii) It shall come into force with effect from the date of publication in official Gazette.

2. Definitions-In these rules, unless the context otherwise requires :-

(i) "The Act" means the Indian Stamp Act, 1899 (No. II of 1899), as applicable to the State of Bihar;

(ii) "Collector" means the Collector as defined in the Act; (iii) "AIG" means the Assistant Inspector General of Registration appointed by the State Government;

(iv) "DIG" means the Deputy Inspector General of Registration appointed by the State Government;

(v) "Electronic Registration System or ERS" means the computerised and web enabled system of registering documents electronically in the State or any other application software as provided by IGR from time to time which is accessible to Licensed Service Providers or Users authorised under these rules or as orders issued by the IGR from time to time; (vi) "Electronic Signature" shall have the same meaning as assigned to it in clause (ta) of sub-section (1) of Section 2 of the Information Technology Act, 2000 (No. XXI of 2000);

(vii) "e-Stamp or electronic stamp" means an electronically generated impression on paper having alpha numeric code or e-Stamp code to denote the payment of stamp duty or such other amount that would have otherwise been paid as an impressed or adhesive or Franked stamp, issued from the ACC counter or licensed Service Providers through ERS or any other application software provided by the department from time to time;

(viii) "e-stamp code" means the alpha numeric code issued to the user in digital form, from the ERS after payment of Stamp Duty and other Fees;

(ix) "Form" means Forms appended to these rules; (x) "Inspector General of Registration (IGR)" means Inspector General of Registration appointed under the provisions of Section 3 of the Registration Act, 1908 (No XVI of 1908);

(xi) "Licensing Authority" means the Collector of the district as defined in the Act;

(xii) "Service Provider" means a licensee under these rules, authorised to sell e-stamps and to provide other related services like preparation of documents for registration process in the manner laid down by the Government, through ERS as provided by the department;

(xiii) "Registering Officer" means District Sub Registrar, Sub Registrar and Joint Sub Registrar appointed under the Act or any other officer as notified by IGR from time to time;

(xiv) "Appellate Authority" means the Inspector General of Registration;

(xv) "Section" means the section of the Act; (xvi) "Service Provider Credit Limit" means the amount deposited by a Service Provider in advance in Government account through the ERS as provided by the department. The Service Providers shall be entitled to sell e-stamps and issue e-stamp codes to their credit limit and get commission thereon to the extent as notified by the Government from time to time;

(xvii) "Slot Booking" means booking of time slots of Registering Officers on a particular date through the ERS;

(xviii) "Government" means the Government of Bihar; (xix) "Comptroller of Stamps" means the Inspector General of Registration or any other Officer appointed by the State Government.

The words and expressions used but not defined in these rules, shall have the same meaning as assigned to them in the Indian Stamp Act, 1899 (No. II of 1899) and the Registration Act, 1908 (No. XVI of 1908) as applicable to the State of Bihar and the rules framed thereunder.

CHAPTER – II (LICENSE TO SERVICE PROVIDERS)

3. Application for Grant of License:- An application for grant of license to sell or issue e-Stamp shall be made to the Licensing Authority in Form-A and shall be accompanied by a receipt of having paid a fee of Rs. 1000/- by a challan or e-payment into Government account. Application for license of Service Provider shall be made through the ERS or through any other method as decided by Inspector General of Registration from time to time. The fee shall not be refundable. All applications shall be disposed of within a period of three month from the date of receipt.

4. Eligibility for Service Provider :-

1) There shall be two classes of Service Providers, namely-

(a) Individual or (b) Banks or Post Offices or Financial Institutions recognised by appropriate authority.

2) In case of individuals, the Licensing Authority may issue license to an applicant in its discretion on being satisfied that the applicant- a) is a citizen of India and is of age 21 years or above on the date of the application;

b) is not employed in any department of the Government/Semi government/ Government Undertaking /Local Body;

c) is a Graduate from a recognized university / Institution or an equivalent degree ;

d) is of good moral character having character certificate issued by competent authority;

e) has not been declared to be of unsound mind by a competent court; f) has not been convicted by a criminal court for an offence involving moral turpitude;

g) has not been adjudged an insolvent by any court of competent jurisdiction;

h) possesses an electronic signature as per provisions of sub-clause (ta) of clause (1) of section 2 of the Information Technology Act, 2000, (No. XXI of 2000)

i) is financially able to obtain credit limit for sale of e-Stamps and to provide other related services;

j) is capable of providing services in both Hindi and English languages; and(cid:464)बहार गजट (असाधारण) 11 जून 2026 14 k) Has working knowledge of the Indian Stamp Act, 1899 (No. II of 1899) and the Registration Act, 1908 (No. XVI of 1908) and rules made thereunder.

3) The Service Providers are expected to have knowledge of computer operation and shall be equipped with Computer, Printer, Biometric device, Web Camera, UPS, Scanner and other Computer peripherals as decided by the Inspector General of Registration with broad band / high speed internet connection. Provided that, for Service Provider's license in category mentioned in rule 4(1)(a) the above qualifications may be waived, with a permission of IGR in case of Advocates or licensed deed writers/apprentices/stamp vendors presently working in Registration Offices. Provided that, qualifications for License may be notified / amended by the Government from time to time.

4) License to Banks, Post Offices or Financial Institutions as mentioned in Rule 4(1) (b) shall be issued on their application for it through ERS by Licensing Authority upon a direction of IGR.

5. Duration of License:- The license of service provider shall be granted for a period of 3 years, however for the first time license shall be placed for renewal on 31st March before the completion of 3 years but after the completion of 2 years.

For example- A license issued on 2nd July 2026 will be placed for renewal on or before 31st march 2029.

6. Renewal of License:- On expiry of the license, the Licensing Authority may renew the license on payment of the fees same as prescribed in rule 3 for further 3 years. The application for renewal shall be made in Form-A, at least 30 days before the expiry of the license and shall be accompanied with a receipt of having paid the prescribed fee under these rules. The fee shall not be refundable. Applications for renewal shall be disposed of within a period of one month from the date of receipt of an application.

7. Terms and Conditions for License:- The license of Service Provider shall be issued in Form-B on such terms and conditions as may be specified by the Government. Any Licensee shall have to surrender his license immediately after he obtains any job as mentioned in sub-rule (2) of Rule 4.

8. Suspension or Cancellation of License:-

1) The Licensing Authority may at any time impose fine, suspend or cancel a license of the licensee on any of the grounds given below :-

(a) for breach of any provisions of these rules or of the conditions of the license;

(b) for incapability to store sufficient stamp or to keep sufficient credit limit for e-Stamps and other related services;

(c) for failure to attend the place of work continuously for a period exceeding one month without the prior permission of the concerned Registering Officer;

(d) for being guilty of participating in any illegal transaction or unfair dealings;

(e) for indulging in corrupt practices; (f) for charging amount in excess of specified fee; (g) for any other act of misconduct on the part of the licensee;

2) The copy of such order shall be endorsed to the Inspector General of Registration.

Provided that, no order for imposition of fine or cancellation of license shall be passed unless the licensee has been given an opportunity of being heard; Provided that, from the date of issue of above notice to the licensee, the license shall remain suspended. Provided that, on receipt of orders from the Government a particular category as mentioned in Rule 4(1)(b) of license may be discontinued.

9. Revision:-The Inspector General of Registration may, at any time on his own motion or on an application made by any party, for the purpose of satisfying himself as to the legality or propriety of any order passed by the Licensing Authority or as to the regularity of the proceedings conducted by him, call for and examine the record of any such case pending before him or disposed of by the Licensing Authority and may pass such order in reference thereto as he thinks fit.

10. Appeal to the Inspector General of Registration:- The Inspector General of Registration may, on the application of any person aggrieved by the order of the Licensing Authority passed under rule 8, may call for and examine the record of any such case and after giving an opportunity of being heard to the applicant, may pass such order as he thinks fit. The order passed by the Inspector General of Registration shall be final thereon.

11. Responsibilities of Service Providers. Service Providers shall be responsible for providing following services through the application software provided by the department, namely:-

1) facilitate individuals for data entry through the ERS; 2) drafting of documents for the purpose of registration as per the provisions of the Registration Act, 1908 (No. XVI of 1908) through the ERS;

3) facilitate the parties and witnesses to e-Sign the document; 4) proper valuation of the property which is subject matter of instruments and calculation of stamp duty and Registration fees payable thereon; 5) booking of slot for the parties for documents which require mandatory registration;

6) Payment for e-stamps from the Service Provider credit limit; 7) Performing other services like search of registered documents, issuance of their downloaded copies etc;

8) Generation and printing of e-Stamps through the ERS for documents of which registration is not mandatory and not opted for registration, or, any other responsibility as notified by the IGR from time to time.

CHAPTER – III

(SALE OF e-STAMP)

12. Method of Supply of e-Stamps /Credit Limit to Licensees:- The Service Provider shall purchase credit limit to issue e-Stamps through advance payment in the manner specified in the ERS. He shall be entitled to sell e-stamps to the extent of his credit limit as notified by the Government from time to time

13. Commission:- The Service Provider who sells e-Stamp or Service Provider, who purchases credit limit for e-stamps, shall be allowed commission thereon as notified by the Government from time to time.

14. Sale of e-Stamps:-

1) Any person wanting to purchase e-Stamps for documents which are not compulsorily registrable and of which the applicant does not want to get it registered, shall apply for e-Stamps in the format provided in the ERS.

16 The Service Provider shall enter the requisite information and details as given in the application form for purchasing e-Stamp. Such entered details shall be verified by the applicant with his signature on the printout of the Form. After verification, the Service Provider shall affix his electronic signature, and generate the e-Stamp, take a printout and issue e-Stamp.

2) For the documents that are presented for registration through ERS, the Service Provider or user shall obtain the "e-Stamp code" from the ERS after paying the duty as per the mode specified in the application software. The Registering Officer shall verify that duty has been paid through ERS and lock the "e-Stamp code".

15. Manner of e-Stamping:-The Service Provider shall be authorized to issue e- Stamp certificates only through the ERS for documents that are not compulsorily registrable and for documents which are compulsorily registrable he shall issue "e-Stamps Code" through a unique login ID and password provided by Inspector General of Registration. e- Stamping shall be done in the following manner -

1) "e-Stamp Code" shall be generated only by licensed Service Providers or authorized agencies from the ERS.

2) Each e-stamp shall bear-

a) the GRN No. of e-Challan through which the credit limit of service provider or authorized agency has been purchased;

b) a serial number/Unique Identification Number, to ensure that it can not be re-used;

c) the date and time of issuance and amount of stamp duty in words and figures;

d) the name and address of the purchaser and of other parties to the document;

e) particulars of the document for which the e-Stamp is being purchased;

f) the user ID and Code of the Service Provider/ authorized agencies issuing the e-Stamp;

g) Digital Signature of Service Provider/ authorized agencies; h) security features such as Optical Water Mark, Micro Print and Security barcode etc;

i) an y security feature or other details as specified by the Inspector General of Registration from time to time. CHAPTER – IV (CORRECTION, REFUND OF e-Stamp) 16. Correction of Error of printed e-Stamp certificate:-

1) Corrected e-Stamp certificate may be issued by the Service Providers if the certificate is inadvertently and undesignedly spoiled, obliterated due to any printing error or due to any other means, rendered unfit for the purpose intended, but before any instrument is written thereon.

2) If the Service Provider receives an application to re-issue e-Stamp certificate in Form-D, he will verify and investigate the genuineness of the claim, the applicant details and seek permission from the concerned Registering Officer for re-issue of e-Stamp certificate.

3) After the permission is granted in writing by the concerned Registering Officer, the Service Provider or the authorized agency will re-issue e-(cid:464)बहार गजट (असाधारण) 11 जून 2026 17 Stamp certificate and a log of this activity will be maintained by the Service Provider or the authorized agency.

4) The Registering Officer will dispose such applications without any delay.

17. Refund of printed "e-Stamp certificate" and "e-Stamp Code":-

1) The conditions for refund of stamp prescribed under Chapter V of the Indian Stamp Act, 1899 and "The Bihar Stamp (Payment of Duty by means of e-Stamping) Rules, 2020" shall apply as it is with such modifications as are necessary.

2) An application for refund of 'spoiled' or 'misused' or 'not required' e- Stamp certificate or amount deposited through "e-Stamp Code" shall be made through ERS in the prescribed Form-E along with "e-Stamp certificate".

3) This application shall be made to Collector/Divisional AIG within one year from the date of issue of "e-Stamp certificate" or "e-Stamp Code". 4) For verification of the "e-Stamp certificate" or "e-Stamp Code" the Collector/Divisional AIG will seek an affidavit from the Service Provider or the authorized agency about the genuineness of the certificate or code, the details of the challan through which the amount was transferred to Government account and about the fact that it has not been used for registration of any document along with a true copy of the concerned entry of "electronic records of Service Provider or the authorized agency."

5) On being satisfied from the verification report under sub rule- 4, if it is established that the applicant has deposited the amount as Stamp duty, Registration Fee and other Fees as indicated in the application and the amount has not been utilized for registration of any document, the amount shall be refunded separately for each head after deducting 10% of the deposited amount subject to a minimum of Rs. 200/- (Rupees two hundred) and a maximum of Rs. 5000/- (Rupees five thousand).

6) After the issue of sanction order by the Collector of concerned district or Divisional AIG for the refund of amount deposited by the e-Stamp, the Drawing & Disbursing Officer of the concerned registration office shall refund the amount in accordance with sub-rule 5 of Rule-17 after drawing the amount.

However, under Section 2(9)(b) of the Act, a Registering Officer can also be delegated the power of receiving the application for refund and accordingly issue sanction order thereof for refund of "e-Stamp certificates" or "e-Stamp Codes". CHAPTER – V (MISCELLANEOUS)

18. Identification of the particulars: - The licensee shall work at such place as indicated in the license and shall sell / issue e-stamp certificates. He will deliver the e-stamp certificates without delay, after identification of the person who has come to purchase the stamps from a copy of his Voter's Identity Card, Aadhaar Card, Permanent Account Number Card, Driving License, Bank Pass Book, Passport or any other document which the Inspector General of Registration may specify in this regard.

19. Register/information to be maintained by the Service Providers :-

1) The Service Provider shall keep a daily account of e-stamp issued/sold, in the ERS. The digital ledger shall be maintained and provided to the Licensing Authority or any Inspecting Officer of the department as and when required.

18 2) The Service Provider shall be responsible for furnishing the following information and reports pertaining to any specified day or period to the concerned Registering Officer and / or to any other officer specified in this behalf by Licensing Authority –

a) Total Collection Reports; b) Additional Stamp Duty Reports; c) Disabled (locked) e-stamp Reports; d) Cancelled e-stamp Reports; e) Daily/Weekly/Fortnightly/Monthly reports or desired details of the collection and remittances;

f) Any other information or report as may be required by the Inspector General of Registration.".

20. Mode of payment for e-Stamp- The payment for purchase of e-stamp may be made by any mode of transferring funds as specified by the Inspector General of Registration, in this behalf.

21. e-Stamps of additional amount - If for any reason, a person who has an "e- Stamp Code" of certain denomination, needs to pay an additional amount of stamp duty on the same document, he can purchase e-stamp of additional amount from the Service Provider.

22. Power of IGR to fix remuneration of Service Providers for different services –

1) The Inspector General of Registration shall have the power to fix rate of remuneration, except the rate mentioned in Rule 12 and 13, for the sevices made available by the Service Providers such as e-KYC and e-Sign of parties and witnesess, drafting deeds etc. which shall be amended by him from time to time.

2) A table of the prescribed rates of remuneration shall be exhibited in commonly spoken local languages at a conspicuous place of registration office. Similar table shall also be exhibited by the Service Providers at their place of work.

23. The IGR will have the power to make necessary amendments in the Appendices/Forms /method of keeping records/ method of reports and returns relating to these rules.

24. Supervision and control-The Service Providers will act under the general supervision and control of the concerned District Sub-Register or Sub-Registrar.

TERMS AND CONDITIONS

1. The sale/issuance of stamps under this license shall be carried on only by the holder of the license.

2. The Licensee shall comply with directions that may be given by Licensing Authority and the Department from time to time.

3. The infringement of any of the "The Bihar Stamp (Service Providers' Licence and supply of e-Stamp) Rules, 2026" shall render the holder liable to penalty prescribed in the law for the time being in force.

4. All dues of Government, any sum of commission paid to the licensee in excess, any fine imposed under these rules, and other sum, if any, shall be recovered from the deposit or from movable or immovable property of the licensee, as arrears of land revenue.
