/3881—भारतीय स्टाम्प अधिनियम, 1899 (सं0- II 1899), जैसा कि बिहार राज्य में लागू है, की धारा 74 एवं 75 सह पठित धारा 10, 49 और 52 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राज्य सरकार एतद् द्वारा निम्नलिखित नियम बनाती हैः-
1.
(1) यह नियमावली ''बिहार स्टाम्प (सेवा प्रदाता अनुज्ञप्ति एवं ई-स्टाम्प की आपूर्ति) (संशोधन) नियमावली, 2026'' कहलाएगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह आधिकारिक राजपत्र में प्रकाशन की तिथि से लागू होगा।
2. बिहार स्टाम्प (सेवा प्रदाता अनुज्ञप्ति एवं ई-स्टाम्प की आपूर्ति) नियमावली, 2026 के नियम-12 में उल्लेखित प्रावधान के आलोक में सेवा प्रदाता के लिए अधिकतम क्रेडिट सीमा रू0- 10,00,000/-(दस लाख) मात्र निर्धारित की जाती है।
3. बिहार स्टाम्प (सेवा प्रदाता अनुज्ञप्ति एवं ई-स्टाम्प की आपूर्ति) नियमावली, 2026 के नियम-13 में उल्लेखित है किः-
''कमीशनः-ई-स्टाम्प बेचने वाले या ई-स्टाम्प के लिए क्रेडिट सीमा खरीदने वाले सेवा प्रदाता को राज्य सरकार के द्वारा समय-समय पर अधिसूचित कमीशन का भुगतान किया जायेगा''। नियम-13 को निम्न प्रकार से प्रतिस्थापित किया जाता है- ''सेवा शुल्कः-ई-स्टाम्प बेचने वाले सेवा प्रदाता को देय सेवा शुल्क का निर्धारण निबंधन महानिरीक्षक द्वारा समय-समय पर किया जायेगा तथा वर्तमान में लागू व्यवस्था के अनुरूप सेवा शुल्क का भुगतान सेवा प्रदाता को पक्षकार द्वारा किया जायेगा''। (cid:464)बहार गजट (असाधारण) 12 जून 2026 2 11 twu 2026 /3881 उपर्युक्त अधिसूचना का निम्नलिखित अंग्रेजी अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-348 के खण्ड (3) के अधीन उक्त राज्यादेश का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

S.O.No.-10/Reg-04-(Credit Limit and Commission)-05/2026/3881—In exercise of the powers conferred by Sections 10, 49 and 52 read with sections 74 and 75 of the Indian Stamp Act, 1899 (No. II 1899), as applicable to the State of Bihar, the State Government hereby make following Rules:
1. Short Title, Extent & Commencement:-
i. These rules may be called the "Bihar Stamp (Service Provider Licence and Supply of e-Stamp) (Amendment) Rules, 2026".
ii. It shall extend to the whole of the State of Bihar. iii. It shall come into force from the date of publication in the Official Gazette.
2. In the light of the provisions stipulated in Rule 12 of the Bihar Stamp (Service Provider Licence and Supply of e-Stamps) Rules, 2026, the maximum credit limit for a Service Provider is fixed at Rs. 10,00,000/- (Ten Lakhs) only.
3. Rule-13 of the Bihar Stamp (Service Provider Licence and Supply of e-Stamp) Rules, 2026 states that:-
"Commission: The service provider selling e-stamps or purchasing credit limit for e-stamps shall be paid commission as notified by the State Government from time to time." Rule-13 is substituted as follows:- "Service charge: The service charge payable to the Service Provider selling e- stamps shall be determined by the Inspector General of Registration from time to time and shall pe paid by the party to the Service Provieder as per the existing system."
