सं॰ BSEB(SS)/Coll-Estab/688/D/2026—बिहार विद्यालय परीक्षा समिति अधिनियम 2019 (यथा अद्यतन संशोधित) 2024 के अध्याय-VI की धारा-33 कि तहत बिहार विद्यालय परीक्षा समिति संबंद्धता (माध्यमिक एवं उच्च माध्यमिक) (संशोधन) विनियमावली, 2026 पर प्रशासी विभाग से अनुमोदन प्राप्त हो चुका है, को निदेशक (माध्यमिक शिक्षा) के पत्रांक 863 दिनांक 07.06.2026 के आलोक में सर्वसाधारण की सूचना के लिए प्रकाशित किया जाता है।2 (cid:464)बहार गजट (असाधारण), 16 जून 2026 बिहार विद्यालय परीक्षा समिति अधिनियम, 2019 के अध्याय (vi) की धारा-33 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार विद्यालय परीक्षा समिति एतद्‌ द्वारा प्रशासी विभाग द्वारा संपुष्टिकरण के अधीन रहते हुए, बिहार विद्यालय परीक्षा समिति (उच्च माध्यमिक) संबद्धता विनियमावली, 2011 (यथा अद्यतन संशोधित) में संशोधन करने के लिए निम्नलिखित विनियमावली बनाती है :-

(i) यह विनियमावली बिहार विद्यालय परीक्षा समिति सम्बद्धता (माध्यमिक एवं उच्च माध्यमिक) (संशोधन) विनियमावली, 2026 कही जायेगी।

(ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (iii) यह अधिसूचना की तिथि के प्रभाव से प्रवृत होगी। iv (v) V बिहार विद्यालय परीक्षा समिति सम्बद्धता (उच्च माध्यमिक) विनियमावली, 2011 प्रभावी होने के पूर्व से संबद्ध एवं संचालित वैसे शैक्षणिक संस्थान, जो सोसायटी/न्यास के द्वारा संचालित नहीं है, वे सभी संस्थान जिस व्यवस्था के तहत्‌ पूर्व से संचालित है वहाँ वैसी ही व्यवस्था बनी रहेगी।

(ii) (क) (i) उच्चतर माध्यमिक स्तर तक की संबद्धता हेतु विद्यालय के पास निर्धारित आधारभूत संरचना (भवन आदि) तथा संबद्धता समिति के समाधानप्रद रूप में विद्यार्थियों की शिक्षा तथा शारीरिक एवं स्वास्थ्य शिक्षा देने और खेल-कूद के संचालन के लिए संस्था के स्वामित्व में अथवा अन्य संस्था/संगठन के साथ लीज सहित न्यूनतम्‌ कुल भूमि 6000 वर्गमीटऱ होना अनिवार्य होगा। कुल वांछित भूमि में से विद्यालय परिसर अंतर्गत न्यूनतम 2000 वर्गमीटऱ क्षेत्र खेल के मैदान के रूप में उपलब्ध होना आवश्यक होगा तथा सम्पूर्ण विद्यालय परिसर (खेल मैदान सहित) एक चाहरदिवारी के अंतर्गत होना अनिवार्य होगा।

(ii) वांछित भूमि निबंधित विक्रय विलेख अथवा निबंधित लीज डीड (न्यूनतम 30 वर्ष) के माध्यम से विद्यालय के स्वामित्व में होना आवश्यक होगा।

(घ) (i) पटना नगरीय क्षेत्र में उच्चतर माध्यमिक विद्यालय स्तर तक की संबद्धता हेतु विद्यालय के पास निर्धारित आधारभूत संरचना (भवन आदि) तथा संबद्धता समिति के समाधानप्रद रूप में विद्यार्थियों की शिक्षा तथा शारीरिक एवं स्वास्थ्य शिक्षा देने और खेल-कूद के संचालन के लिए संस्था के स्वामित्व में अथवा लीज के रूप में कम से कम 3200 वर्गमीटर एवं राज्य के अन्य नगरीय क्षेत्रों में कम-से-कम 4000 वर्गमीटर भूमि एक खण्ड अथवा अधिकतम दो खण्ड में होना आवश्यक होगा। सुगम एवं सुरक्षित पहुँच पथ सहित दोनों भू-खण्डों के बीच की दूरी 200 मीटर से अधिक नहीं होनी चाहिए। (ii) नगरीय क्षेत्र के विद्यालय जो उप कंडिका (घ)(i) के छूट के आधार पर संबद्धता हेतु इच्छुक है, के पास वांछित भूमि में से खेल-कूद एवं अतिरिक्त क्रियाविधि के लिए न्यूनतम एक खण्ड में 2000 वर्गमीटर क्षेत्र खेल-मैदान के रूप में उपलब्ध होना आवश्यक होगा अथवा उन्हें नजदीक के विद्यालय/महाविद्यालय/खेल-कूद परिसर/अन्य परिसर के साथ साझा व्यवस्था के अंतर्गत न्यूनतम्‌ 2000 वर्गमीटर क्षेत्र खेल के मैदान के रूप में उपलब्ध हो। यह व्यवस्था छात्र-छात्राओं के सुगम पहुँच एवं उनकी सुरक्षा से समझौता किये बिना अधिकतम 200 मीटर दूरी के अंतर्गत होना चाहिए एवं यह भी सुनिश्चित होना चाहिए कि छात्र-छात्राओं को किसी जिला/ राज्य/राष्ट्रीय उच्च पथ/किसी अन्य मुख्य सड़क जिसपर यातायात का दबाव हो एवं छात्र-छात्राओं की सुरक्षा के लिए खतरा हो, को पार करने की आवश्यकता न पड़े। (iii) ऐसी व्यवस्था किसी निजी संस्थान के साथ करने की स्थिति में विद्यालय एवं उस निजी संस्थान के बीच हस्ताक्षरित एकरारनामा कर उसकी प्रति संबद्धता समिति को प्रस्तुत करना आवश्यक होगा। किसी परिस्थति में दोनों पक्षों के बीच एकरारनामा के भंग होने या रद्द होने की स्थिति में विद्यालय की संबद्धता निलम्बित/समाप्त की जा सकेगी।3 (cid:464)बहार गजट (असाधारण), 16 जून 2026 (iv) परन्तु ऐसी व्यवस्था किसी नगरपालिका/विकास प्राधिकार/सरकारी संस्थान के साथ किये जाने की स्थिति में उस संस्थान से निर्गत एतद संबंधी पत्र की प्रति भी संबद्धता समिति को प्रस्तुत करना आवश्यक होगा। यदि नगरपालिका/विकास प्राधिकार/ सरकारी संस्थान द्वारा एतद्‌ संबंधी आदेश वापस/रद्द कर दिया जाता है तो विद्यालय की संबद्धता निलम्बित/समाप्त की जा सकेगी।

(v) वांछित भूमि का कोई भाग या सम्पूर्ण क्षेत्र, जो 30 वर्षों से कम के लीज पर लिया गया हो, की दशा में ऐेसे मामलों पर विचार किया जा सकेगा, बशर्तें कि भूमि, सरकार अथवा सरकारी एजेंसी द्वारा शैक्षणिक कार्य हेतु आवंटित की गयी हो तथा यह प्रचलित विधि के अनुसार हो।

(ii) (ङ) (i) माध्यमिक विद्यालय के भौतिक आधारभूत संरचना का न्यूनतम क्षेत्रफल 870 वर्गमीटर होगा, जो निम्नलिखित रूप में वितरित होगा :-

o. ट्‌यूूब-वेल के लिए सिमेंटेड स्पेस - 05 वर्गमी0 P. सुरक्षा गार्ड के लिए कक्ष - 30 वर्गमी0 परन्तु नगरीय क्षेत्र के विद्यालयों के मामले में भौतिक आधारभूत संरचना माध्यमिक, उच्च माध्यमिक एवं संयुक्त सम्बद्धता विद्यालय हेतु निर्धारित न्यूनतम क्षेत्रफल क्रमशः 870 वर्गमीटर, 880 वर्गमीटर, 1110 वर्गमीटर की अनिवार्यता को भूतल एवं उपरितल के रूप में वितरित किया जा सकेगा।5 (cid:464)बहार गजट (असाधारण), 16 जून 2026 (ङ) (iv) विद्यालयों के आधारभूत संरचनाओं (भवन आदि) की बनावट (डिजाईन) एवं उंचाई, उस क्षेत्र के लिए जिस क्षेत्र मेें विद्यालय अवस्थित है, तत्समय प्रवृत भवन उपविधियों (बिल्डिंग बायलॉज) द्वारा निर्धारित मानकों एवं मापदण्डों के अनुरूप तथा सक्षम प्राधिकार द्वारा स्वीकृत होना आवश्यक होगा।

(ङ) (v) विद्यालय को सक्षम प्राधिकार से निर्गत भवन पूर्णता प्रमाण-पत्र देना आवश्यक होगा। .

(ii) (ट) भूमि का निबंधन संस्थान के नाम से अथवा राज्यपाल, बिहार सरकार वास्ते संस्थान के नाम से होना अनिवार्य होगा। इसी प्रकार सोसायटी/न्यास के द्वारा संचालित माध्यमिक/उच्च माध्यमिक विद्यालय की स्थिति में भूमि का निबंधन सोसायटी/न्यास वास्ते विद्यालय के नाम से होना अनिवार्य होगा। भूमि का डीड, भू-स्वामित्व प्रमाण-पत्र अद्यतन लगान रसीद संलग्न किया जाना अनिवार्य होगा।

(ठ) सक्षम प्राधिकार द्वारा भूमि के शैक्षणिक उपयोग करने हेतु निर्गत प्रमाण-पत्र संलग्न करना आवश्यक होगा। उक्त विनियमावली, 2011 (यथा अद्यतन संशोधित) के विनियम-4 के उपविनियम-(2) को विलोपित किया जाता है। (1) बोर्ड से सम्बद्धता चाहने वाले/पूर्व से सम्बद्ध विद्यालय का निरीक्षण, समिति अथवा शिक्षा विभाग द्वारा गठित निरीक्षण दल द्वारा किया जा सकेगा। 12. सम्बद्धता हेतु आवेदन के साथ आवेदक को निरीक्षण शुल्क (Inspection Fee) के रूप में 15,000/- (पन्द्रह हजार) रू0 तथा छात्रों की संख्या के अनुसार समिति द्वारा समय-समय पर यथा निर्धारित एक मुश्त सम्बद्धता शुल्क अलग-अलग Online जमा करना होगा।

निरीक्षण शुल्क एवं संबद्धता शुल्क की राशि अप्रत्र्यपनीय (Not refundable) होगी। परन्तु यह कि राज्य सरकार द्वारा स्थापित एवं चलायी जाने वाली संस्था पर यह शर्त लागू नहीं होगा। उक्त विनियमावली, 2011 (यथा अद्यतन संशोधित) के विनियम-14 के उपविनियम (6) को विलोपित किया जाता है। (10) वैसे विद्यालयों को, जो भूमि सहित संबद्धता की सभी शर्ताें को पूरा करते हो, प्रारम्भ में कालावधि के लिए संबद्धता दी जायेगी। उसके बाद प्रत्येक आगामी पाँच वर्षों के लिए नवीकरण बिहार विद्यालय परीक्षा समिति अधिनियम, 2019 (यथा अद्यतन संशोधित) एवं सम्बद्धता विनियमावली, 2011 (यथा अद्यतन संशोधित) के प्रावधानो एवं शर्त्तों का अनुपालन करने पर की जा सकेगी। परन्तु यह कि नवीकरण हेतु शुल्क एवं अन्य शर्तों का निर्धारण समिति द्वारा समय-समय पर किया जाएगा।

(1) समिति द्वारा सम्बद्ध गैर सरकारी माध्यमिक/उच्च माध्यमिक विद्यालयों के किसी एक संकाय अथवा सभी संकायों की प्रदत्त सम्बद्धता को निलंबित अथवा वापस किया जा सकेगा, यदि समिति को यह समाधान हो जाय कि ऐसी संस्थाएँ सम्बद्धता विनियमावली में उल्लिखित मानकों एवं शर्तों का अनुपालन नहीं कर रही है अथवा संस्थाएं सम्बद्धता जारी रखने के योग्य नहीं है।6 (cid:464)बहार गजट (असाधारण), 16 जून 2026 (3) सम्बद्धता का निलंबन अथवा वापसी की कार्यवाही, विद्यालयों द्वारा शर्तों का अनुपालन नहीं किये जाने पर समिति विद्यालय प्रबंधन को युक्तियुक्त शो-कॉज नोटिस निर्गत करने के पश्चात्‌ प्रारंभ करेगी। (4) शो-कॉज नोटिस की अधिकतम अवधि एक माह से अधिक नहीं हो होेगी। संस्था द्वारा समर्पित शो-कॉज नोटिस के उत्तर पर सम्यक विचारोपरांत समिति को यदि यह समाधान हो जाय कि तत्काल संस्था का संचालन तत्समय प्रचलित सम्बद्धता विनियमावली के शर्तों एवं मानकों के अनुरूप संभव नहीं है, तो ऐसी स्थिति में समिति संस्था की सम्बद्धता को तत्काल निलंबित कर सकेगी। कदाचार/नामांकन/परीक्षा/घोर वित्तीय अनियमितता/ सामाजिक घृणा फैलाने जैसे किसी अन्य क्षेत्र, जो समिति की राय में विद्यालय की सम्बद्धता वापस लेने के लिए पर्याप्त एवं न्यायसंगत हो, ऐसे मामलों में समिति सीधे सम्बद्धता वापसी की कार्रवाई कर सकेगी। समिति का यह निर्णय अंतिम एवं बाध्यकारी होगा। (3) सोसायटी/न्यास के द्वारा विहित प्रक्रिया के तहत विद्यालय संचालन हेतु गठित प्रबंध समिति का अनुमोदन समिति द्वारा किया जायेगा। विद्यालय प्रबंध समिति में संबंधित जिला कार्यक्रम पदाधिकारी (माध्यमिक शिक्षा)समिति द्वारा नामित सदस्य होंगे। 1. अध्यक्ष द्वारा शासी निकाय के गठन की प्रक्रिया प्रारंभ की जायेगी। 2. दानदाता अध्यक्ष नहीं होने की स्थिति में माध्यमिक विद्यालय/उच्च माध्यमिक विद्यालय/(2) महाविद्यालयों के लिए निकटस्थ राजकीय/राजकीयकृत उच्च माध्यमिक (2) विद्यालय के कार्यरत प्रधानाध्यापक/प्रभारी प्रधानाघ्यापक को अध्यक्ष नामित किया जायेगा। किसी भी परिस्थिति में शासी निकाय एवं प्रबंध समिति के अध्यक्ष का कार्यकाल दो बार (छः वर्ष) से अधिक नहीं होगा।

3. शासी निकाय एवं प्रबंध समिति के अभिभावक सदस्य तथा अन्य सदस्यों (सदस्य सचिव को छोड़कर) की कालावधि-क्रमशः-01 वर्ष एवं 03 वर्ष की होगी। I 9. - सम्बद्धता हेतु वांछित भूमि धारण करने का प्रमाण विद्यालय प्रयोजन के लिए भूमि एवं भवन की सामान्य उपयुक्तता, वर्ग-कक्षों की पर्याप्तता, विहित नियमों के अनुसार सह-पाठ्‌यचर्या के क्रियाकलापों के लिए अतिरिक्त कमरों की उपलब्धता।

BIHARSCHOOLEXAMINATIONBOARD

AFFILIATION (AMENDMENT)REGULATIONS, 2026

In exercise of the powers conferred under Section 33 of Chapter (vi) of the Bihar School Examination Board Act, 2019, the Bihar School Examination Board ,subject to confirmation by the Administrative Department, hereby makes the following regulations to amend the Bihar School Examination Board (High Secondary) Affiliation Regulations, 2011 (as amended from time-to-time):-

1. Short title, extent and commencement-

(i) These regulations may be called the Bihar School Examination Board Affiliation (Secondary and Senior Secondary) Amendment Regulation, 2026.

(ii) These regulation shall extend to the whole of the State of Bihar. (iii) These regulation shall come into force from the date of notification.

2. A new sub-clause (v) shall be inserted after sub-regulation (1) (iv) of regulation 3 of the Regulations, 2011 (as amended from time-to- time) -

In all such educational institutions which are affiliated and running before the coming into force of the Bihar School Examination Board Affiliation (High Secondary) Regulations,2011 and are not run by a society/trust, the same system shall continue to be in place under which they were managed earlier.

3. Sub-clause (a) and (d) of sub-regulation (3) (ii) of Regulation 3 of the Regulations, 2011 (as amended from time-to-time) shall be substituted as follows- (a) (i) For affiliation up to Senior secondary level, the school must have the prescribed infrastructure (building etc.) and a minimum total land of 6000 sq. meters owned by the institution or on lease with other institution/organization for imparting education and physical and health education to the students and for conducting sports to the satisfaction of the Affiliation Committee. Out of the total desired land, a minimum area of 2000 sq. meters must be available as playground within the school premises and the entire school premises (including playground) must be within a boundary wall.

(ii) The required land must be owned by the school through a registered sale deed or a registered lease deed (minimum 30 years).

(d) (i) For affiliation up to Senior Secondary School level in Patna urban area, the school must have the prescribed infrastructure (building etc.) and at least 3200 square meters of land owned by the institution or on lease for imparting education and physical and health education to the students and for conducting sports to the satisfaction of the Affiliation Committee and at least 4000 square meters of land in one plot or maximum two plots in other urban areas of the state. The distance between the two plots should not be more than 200 meters including easy and safe approach road.

(ii) Schools in urban areas seeking affiliation under the exemption in sub- clause (d) (i) shall have a minimum area of 2000 square metres available as playground for sports and extracurricular activities in one block of the required land or a minimum area of 2000 square metres available as playground under a shared arrangement with a nearby school/college/sports complex/other complex. This arrangement shall be within a maximum radius of 200 metres without compromising on the easy access and safety of students and it should also be ensured8 (cid:464)बहार गजट (असाधारण), 16 जून 2026 that the students are not required to cross any District/State/National Highway/any other Main road which has heavy traffic and poses a threat to the safety of the students.

(iii) If such an arrangement is made with a private institution, a signed agreement between the school and the private institution shall be required and a copy of it shall be necessarily submitted to the Affiliation Committee. In the event of any breach or cancellation of the agreement between the parties, the school's affiliation may be suspended or terminated.

(iv) However, if such an arrangement is made with a municipality/ development authority/government institution, a copy of the letter issued by that institution to this effect must also be submitted to the Affiliation Committee. If the municipality/ development authority/ government institution withdraws/cancels the said order, the school's affiliation may be suspended/terminated.

(v) In case, a part or the entire area of the required land is taken on lease for less than 30years, such cases may be considered provided the land has been allotted for educational purposes by the Government or a Government agency and it is in accordance with the prevailing law.

4. Sub-clause (e) of sub-regulation (3) (ii) of Regulation 3 of the Regulations, 2011 (as amended from time-to-time) shall be substituted by the following- (e) (i) The minimum area of physical infrastructure of a secondary school shall be 870 square metres, which shall be distributed as follows-

Provided that in case of schools in urban areas, the minimum area requirement of 870 sq.m., 880 sq.m., 1110 sq.m. prescribed for physical infrastructure secondary, senior secondary and joint affiliation schools respectively may be distributed in the form of ground floor and upper floor. e (iv) The construction (design) and height of the basic structures (buildings etc.) of the schools shall be in accordance with the norms and standards prescribed by the building bye-laws for the time being in force for the area in which the school is situated and shall be approved by the competent authority.

e (v) The school shall be required to provide building completion certificate issued by the competent authority.

5. The following sub-clause shall be added in sub-regulation (3) (ii) of Regulation 3 of the Regulations, 2011 (as amended from time-to- time) - (k) The land must be registered in the name of the institution or in the name of the institution for the Governor of Bihar. Similarly, in the case of a secondary/senior secondary school run by a society/trust, the land must be registered in the name of the school for the society/trust. The land deed, land ownership certificate and updated rent receipt must be attached.

(l) It shall be necessary to attach a certificate issued by the competent authority for educational use of the land.

6. Sub-regulation (2) of Regulation 4 of the Regulations, 2011 (as amended from time-to-time) shall be repealed- Sub-regulation (2) of Regulation 4 of the Regulations, 2011 (as amended from time-to-time) is hereby repealed.

7. Sub-regulation (1) of Regulation 11 of the Regulations, 2011 (as amended from time-to-time), shall be substituted as follows- The school already affiliated / seeking affiliation with the Board may be inspected by the inspection team constituted by the Board or the Education Department.

8. Regulation 12 of the Regulations, 2011 (as amended from time-to- time) shall be substituted as follows- The applicant shall have to deposit a sum of Rs. 15,000/- (fifteen thousand) as inspection fee and also one-time affiliation fee as determined by the Board from time-to-time according to the number of students, online separately along with the application for affiliation.

(cid:464)बहार गजट (असाधारण), 16 जून 2026 The inspection fee and affiliation fee shall be non-refundable however, this condition shall not apply to institutions established and run by the state government.

9. Sub-regulation (6) of Regulation 14 of the Regulations, 2011 (as amended from time-to-time) shall be repealed- Sub-regulation (6) of Regulation 14 of the Regulations, 2011 (as amended from time-to-time) is hereby repealed.

10. Sub-regulation (10) of Regulation 14 of the Regulations, 2011 (as amended from time-to-time) shall be substituted as follows- (10) Those schools which fulfil all the conditions of affiliation including land shall be given affiliation initially for a period of five years. Thereafter, renewal may be done for every subsequent five years on compliance with the provisions and conditions of Bihar School Examination Board Act, 2019 (as amended from time-to-time) and Affiliation Regulations, 2011 (as amended from time-to-time).

Provided that the fee and other conditions for renewal shall be decided by the Board from time-to-time.

11. Sub-regulation (1) of Regulation (15) of the Regulations, 2011 (as amended from time-to-time) shall be substituted as follows- (1) The affiliation granted by the Board to any or all faculties of affiliated non-government secondary/senior secondary schools may be suspended or withdrawn if the Board is satisfied that such institutions are not complying with the norms and conditions mentioned in the Page 7 of 9 Affiliation Regulations or the institutions are not fit for continuation of affiliation.

12. Sub-regulation (3) of Regulation 15 of the Regulations, 2011 (as amended from time-to-time) shall be substituted as follows- The Board shall initiate proceedings for suspension or withdrawal of affiliation after issuing a reasonable show cause notice to the school management if the schools do not comply with the conditions.

13. Sub-regulation (4) of Regulation 15 of the Regulations, 2011 (as amended from time-to-time) shall be substituted as follows- (4) The maximum period of show-cause notice shall not exceed one month. After due consideration of the reply to the show-cause notice submitted by the institution, if the Board is satisfied that it is not possible to run the institution immediately as per the conditions and standards of the Affiliation Regulations prevalent at that time, then in such a situation the Board may suspend the affiliation of the institution immediately. In cases such as malpractice / enrolment / examination / gross financial irregularity / spreading social hatred or any other case, which in the opinion of the Board is sufficient and justifiable for withdrawal of affiliation of the school, the Board may directly take action for withdrawal of affiliation. This decision of the Board shall be final and binding.

14. Sub-regulation (3) shall be inserted after sub-regulation (2) of Regulation 16 of the Regulation, 2011 (as amended from time-to- time) as follows- (3) The Board shall approve the managing committee formed by the society/trust for the operation of the school in accordance with the prescribed procedures. The concerned District Program Officer (Secondary Education) shall be a nominated member of the school management committee by the Board.

15. Note (1) and (2) of Regulation 17-A of the Regulations, 2011 (as amended from time-to-time) shall be substituted as follows- NOTE-

1. The President shall initiate the process of constitution of the Governing Body.

2. In the absence of a donor president, for Secondary schools / Senior Secondary schools / (+2) colleges, the serving Headmaster / In- charge Headmaster of the nearest Government / Government-aided Senior Secondary (+2) school shall be nominated as the President. Under no circumstances shall the tenure of the President of the governing body and management committee exceed two terms (six years).

3. The tenure of the Guardian Member and other members (except Member Secretary) of the Governing Body and Management Committee shall be 01 year and 03 years respectively.

16. Clause 9 in Appendix-1 of the Regulations, 2011 (as amended from time- to-time) shall be substituted as follows-
