la0 02/रेगु०-2-1200-02/2026/119/cc(b)—माननीय उच्च न्यायालय, पटना द्वारा उक्त CWJC No.-1373/2026 मेसर्स तिरूपति सुगर लिमिटेड (बगहा चीनी मिल), प० चम्पारण बनाम बिहार सरकार एवं अन्य में दिनांक-15.04.2026 को निम्नलिखित आदेश पारित किया गया है :-
"Considering the stand taken by the authorities and there being no adherence of the statutory provisions, which aspect has already been considered by the Co-ordinate Bench of this Court in the case of M/s Vishnu Sugar Mills Limited and Another (Supra), and such consideration being apparently absent in the impugned orders, this Court finds it appropriate to set aside the original order as well as the appellate order, which is annexed in the writ petition as Annexure-P/5 and Annexurer-P/6 respectively.
Accordingly, in view of the impugned orders having been set aside, the Respondent No.-3, The Cane Commissioner, Sugarcane Industries Development, Government of Bihar, Patna is directed to undertake the process of consideration of settlement of disputed 10 villages by providing proper hearing to all the parties concerned within a period of four (cid:464)बहार गजट (असाधारण) 18 जून 2026 2 also the parameters fixed by a Co-ordinate Bench of this Court in the case referred hereinabove, to avert further litigation in the matter. Accordingly, the writ petition is disposed off."
माननीय उच्च न्यायालय, पटना के उपरोक्त आदेष के आलोक में तथा सम्यक सुनवाई के पष्चात् ईखायुक्त, बिहार द्वारा दिनांक-15.05.2026 को आदेष पारित किया गया। उक्त आदेष की प्रति अनुलग्नक-1 पर है। उपरोक्त के आलोक में बिहार ईख अधिनियम-1981 की धारा 31(1) के तहत् प्रदत्त षक्तियों के आलोक में मेसर्स तिरूपति सुगर्स लिमिटेड, बगहा, प० चम्पारण एवं मेसर्स एच०पी०सी०एल० बायोफ्यूल्स लि०, लौरिया, पष्चिम चम्पारण को निम्नवत् ग्राम आरक्षित करते हुए अधिसूचित किया जाता है :-
पष्चिम चम्पारण जिलान्तर्गत योगापट्टी प्रखण्ड के 1 ग्राम-चौमुखा-36 को मेसर्स तिरूपति सुगर्स लिमिटेड, बगहा, प० चम्पारण के साथ एवं षेष 9 ग्राम यथा डिही-361, कौलापुर-357, भवानीपुर-401, हरिहरपुर-358, सेमरी भवानीपुर-404, सेमरी-415, निमुईया-417, चन्द्रौल-418, एवं बड़हरवा-44 को मेसर्स एच०पी०सी०एल० बायोफ्यूल्स लि०, लौरिया, पष्चिम चम्पारण के पक्ष में परम्परागत रूप से पेराई सत्र 2025-26 से 2029-30 (05 वर्षों) में षेष अवधि के लिए आरक्षित रहेंगे।
पूर्व में निर्गत विभागीय आदेष संख्या-1782/ई०का० दिनांक-26.09.2025 को इस हद तक संषोधित किया जाता है।
