309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, उच्च न्यायालय, पटना के परामर्श से बिहार उच्च न्याय सेवा नियमावली, 1951 में संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः-
1. संक्षिप्त नाम, विस्तार एवं प्रारंभ।-
(1) यह नियमावली ''बिहार उच्च न्याय सेवा (संशोधन) नियमावली, 2026'' कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) ;g fcgkj ljdkj ds jkti= esa izdk"ku dh frfFk ls izo`Ùk gksxhA
2. बिहार उच्च न्याय सेवा नियमावली, 1951 (समय-समय पर यथा संषोधित) के परिषिष्ट-'ग' के उप नियम-8 में अंकित विषय "द इंडियन एविडेंस एक्ट, 1872", "द कोड ऑफ क्रिमिनल प्रोसीजर, 1973" तथा "इंडियन पेनल कोड, 1860" का प्रतिस्थापन।-उक्त नियमावली के परिषिष्ट-'ग' के उप नियम-8 में अंकित विषय "द इंडियन एविडेंस एक्ट, 1872", "द कोड ऑफ क्रिमिनल प्रोसीजर, 1973" तथा "इंडियन पेनल कोड, 1860 को क्रमषः निम्नलिखित से प्रतिस्थापित किए जायेगेंः- (i) भारतीय साक्ष्य अधिनियम, 2023 (बी0एस0ए0)। 2 (cid:464)बहार गजट (असाधारण), 18 जून 2026 3. बिहार उच्च न्याय सेवा नियमावली, 1951 (समय-समय पर यथा संषोधित) के परिषिष्ट-'ग' के उप नियम-9 में अंकित विषय "द इंडियन एविडेंस एक्ट, 1872", "द कोड ऑफ क्रिमिनल प्रोसीजर, 1973" तथा "इंडियन पेनल कोड, 1860" का प्रतिस्थापन।-उक्त नियमावली के परिषिष्ट-'ग' के उप नियम-9 में अंकित विषय "द इंडियन एविडेंस एक्ट, 1872", "द कोड ऑफ क्रिमिनल प्रोसीजर, 1973" तथा "इंडियन पेनल कोड, 1860 को क्रमषः निम्नलिखित से प्रतिस्थापित किए जायेगेंः- (i) भारतीय साक्ष्य अधिनियम, 2023 (बी0एस0ए0)।
(ii) भारतीय नागरिक सुरक्षा संहिता, 2023 (बी0एन0एस0एस0)।
(iii) भारतीय न्याय संहिता, 2023, (बी0एन0एस0)।

No. 7/Astha.-04-16/2026-10900/GAD—In exercise of the powers conferred by Article 233 of the Constitution of India read with the proviso to Article 309, the Governor of Bihar, in consultation with the High Court of Judicature at Patna is pleased to make the following amendment in the Bihar Superior Judicial Service Rules, 1951:-
1. Short title, extent and commencement:-
(1) These rules may be called "The Bihar Superior Judicial Service (Amendment) Rules, 2026".
(2) It shall extend to the whole of the State of Bihar.
(3) It shall come into force from the date of publication in the Official Gazette of the Government of Bihar.
2. Substitution of subject "The Indian Evidence Act, 1872", "The Code of Criminal Procedure, 1973" and "Indian Penal Code, 1860" mentioned in sub rule-8 of Appendix 'C' of the Bihar Superior Judicial Service Rules, 1951 (as amended from time to time).—The subject "The Indian Evidence Act, 1872", "The Code of Criminal Procedure, 1973" and "Indian Penal Code, 1860" mentioned in sub rule-8 of Appendix 'C' of the said Rules shall be substituted by the following respectively:-
(i) The Bharatiya Sakshya Adhiniyam, 2023 (BSA).
(ii) The Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS).
(iii) The Bharatiya Nyaya Sanhita, 2023 (BNS).
