18/लो0से0अ0-12-01/2026 —बिहार लोक सेवाओं का अधिकार अधिनियम, 2011 (बिहार अधिनियम 04, 2011) की धारा-13 एवं 14 अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार लोक सेवाओं का अधिकार नियमावली, 2011 (समय-समय पर यथासंशोधित) का संशोधन करने के लिए निम्नलिखित नियमावली बनाते हैं :-
- (1) यह नियमावली
कही जा सकेगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजकीय गजट में अधिसूचना की तिथि से प्रवृत्त होगी। उक्त नियमावली के नियम-3 को निम्नवत् प्रतिस्थापित किया जाता है-
(1) नामनिर्दिष्ट लोक सेवक को, आदेश द्वारा, अपने किसी अधीनस्थ पदाधिकारी/कर्मचारी को, आवेदनों को प्राप्त करने और अभिस्वीकृति देने के लिए, प्राधिकृत करने की शक्ति होगी।
(2) इस नियम के अन्तर्गत आवेदन अथवा प्रथम/द्वितीय अपील सरकार द्वारा विकसित पोर्टल पर ऑनलाईन माध्यम से भी दाखिल की जा सकेगी।2 (cid:464)बहार गजट (असाधारण), 18 जून 2026 उक्त नियमावली के नियम-10 को निम्नवत् प्रतिस्थापित किया जाता है- क) जब आवेदक नामर्दिष्ट लोक सेवक अथवा उसके आदेश द्वारा अधिकृत अधीनस्थ अधिकारी/कर्मचारी के समक्ष आवेदन प्रस्तुत करता है या सरकार द्वारा विकसित पोर्टल पर ऑनलाईन आवेदन करता है, तब यह माना जायेगा कि आवेदक द्वारा स्वतः अपील हेतु अपनी सहमति दे दी है। यदि नियत समय-सीमा में सेवा उपलब्ध नहीं करायी जाती है अथवा अपीलीय प्राधिकार नियत समय-सीमा में अपील का विनिश्चय करने में असफल रहे हैं, वैसी स्थिति में प्रथम/द्वितीय अपील स्वतः दायर की गयी समझी जायेगी। आवेदक की ओर से पोर्टल (पोर्टलों) पर स्वतः प्रथम/द्वितीय अपील के संबंध में सॉफ्टवेयर में उपयुक्त उपबंध किये जायेंगे। आवेदक के लिए आवेदनों को प्रस्तुत करते समय अपना मोबाईल संख्या देना अनिवार्य होगा। अपीलीय प्राधिकार, या पुनर्विलोकन प्राधिकार के समक्ष किसी प्रथम एवं द्वितीय अपील के लिए आवेदन के साथ निम्नांकित सूचनाएँ शामिल किये जायेंगे- (1) आवेदक या प्रथम एवं द्वितीय अपील करनेवाले व्यक्ति का नाम एवं पता। (2) संभव हद तक, नामनिर्दिष्ट लोक सेवक/अपीलीय प्राधिकार जिसके निर्णय के
विरुद्ध प्रथम या द्वितीय अपील प्रस्तुत किया गया है, का नाम एवं पता।
(3) आदेष, जिसके विरुद्ध प्रथम या द्वितीय अपील होता है, का सार। (4) यदि अपील आवेदनों की अभिस्वीकृति की प्राप्ति नहीं होने के विरुद्ध किया जाता है तो नामनिर्दिष्ट लोक सेवक के नाम एवं पता के साथ आवेदन की तिथि। (5) प्रथम या द्वितीय अपील का आधार। (6) माँगा जा रहा अनुतोष। (7) प्रथम या द्वितीय अपील का विनिष्चय करने के लिए आवष्यक अन्य कोई

No.- 18/Lo.Se.A.-12-01/2026 -10936/GAD—In exercise of the powers conferred under Section-13 and 14 of the Bihar Right to Public Services Act, 2011 (Bihar Act 4, 2011), the Government of Bihar is pleased to make the following Rules to amend the Bihar Right to Public Services Rules, 2011 (as amended from time to time):-
1. Short title, extent and commencement:-
(1) These Rules may be called as the Bihar Right to Public Services (Amendment) Rules, 2026.
(2) It shall extend to the whole State of Bihar. (3) It shall come into force from the date of its notification in the Official Gazette.
2. Substitution of Rule-3 of the Bihar Right to Public Services Rules, 2011 (as amended from time to time):- Rule-3 of the said Rules shall be substituted as follows-
"3. Power of Designated Public Servant to authorize for receiving the applications:-
(a) The Designated Public Servant shall have the power to authorize by order any of his/her subordinate officer/staff for receiving the applications and giving acknowledgement.
3(cid:464)बहार गजट (असाधारण), 18 जून 2026 (b) Under this rule, the application or the first/second appeal may also be filed through online mode on the portal (s) developed by the Government."
3. Substitution of Rule-10 of the Bihar Right to Public Services Rules, 2011 (as amended from time to time):- Rule-10 of the said Rules shall be substituted as follows – "10. Procedure of application for First and Second Appeals.-
(a) Consent of the applicant shall be presumed, at the time of submitting the application to designated public servant or any of his/her subordinate officer/staff authorized by order or through online mode on the portal(s) developed by the government, regarding auto appeal to appellate authority/reviewing authority as the case may be, in case there is failure to deliver service/appellate authority has failed to decide the appeal within the stipulated time limit. Hence, first/second appeal shall be deemed to have been filed automatically. A suitable provision shall be made in the software regarding automatic first/second appeal on the portal(s) on behalf of applicant. It shall be mandatory for applicant to give his/her mobile number while submitting the application.
(b) Following information shall be included with application for any First and Second Appeals to Appellate Authority or Reviewing Authority i.e.,
(1) Name and address of applicant or person asking for First and Second Appeals.
(2) To the extent possible, name and address of Designated Public Servant/Appellate Authority against whose decision the First or Second Appeal has been presented.
(3) Gist of the order against which the First or Second Appeal lies. (4) Date of application along with name and address of the Designated Public Servant if the appeal is made against non- receipt of acknowledgement of the applications.
(5) Basis for First or Second Appeal. (6) Relief asked for. (7) Any other related information that may be necessary for determining the First or Second Appeal."
