(सं0 पटना 635) पटना, शु(cid:272)वार, 19 जून 2026 e|fu"ks/k] mRikn ,oa fuca/ku foHkkx ¼fuca/ku½ ———— vf/klwpuk 18 twu 2026 laŒlaŒ MVR 4059—भारतीय स्टाम्प अधिनियम, 1899 (1899 का अधिनियम-II) की धारा 75 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, समय-समय पर संशोधित बिहार स्टाम्प (लिखत का न्यून मूल्यांकन निवारण) नियमावली, 1995 में निम्नलिखित संशोधन करने हेतु नियमावली बनाते हैंः-

1.

(i) यह नियमावली बिहार स्टाम्प (लिखत का न्यून मूल्यांकन निवारण) (संशोधन) नियमावली, 2026 कहा जायेगा।

(ii) इसका विस्तार बिहार राज्य के संपूर्ण क्षेत्र में होगा। (iii) यह राजपत्र में प्रकाशन की तिथि से प्रभावी होगा।

''परन्तु यह कि राज्यभर में भूमि का वर्गीकरण एकरूप होगा तथा ग्रामीण एवं शहरी क्षेत्रों में भूमि का

बिहार स्टाम्प (लिखत का न्यून मूल्यांकन निवारण) नियमावली, 1995 यथासंशोधित के नियम-6 के उपनियम (2)(ग) को निम्नलिखित रूप में प्रतिस्थापित किया जाएगाः-

''जिला मूल्यांकन समिति प्रत्येक तीन वर्ष पर जिले के शहरी, पेरिफेरल एवं ग्रामीण क्षेत्रों के प्रत्येक मौजा/वार्ड में भूमि की प्रत्येक श्रेणी के लिए भूमि/सम्पति मूल्यों के प्राक्कलित न्यूनतम मूल्य मार्गदर्शक पंजी (एम0वी0आर0) का वृहत्‌ पुनरीक्षण करेगी, जो इस नियम के उपनियम (2)(च) में वर्णित प्रक्रिया के अनुसार होगा।'' 4. बिहार स्टाम्प (लिखत का न्यून मूल्यांकन निवारण) नियमावली, 1995 के नियम-6 में उपनियम (2)(घ) के रूप में निम्नलिखित जोड़ा जाएगाः-

''उपनियम (2)(ग) में उल्लिखित तीन वर्ष की अंतरिम अवधि के दौरान प्रत्येक मौजा/वार्ड में भूमि की प्रत्येक श्रेणी के लिए प्राक्कलित न्यूनतम मूल्य की मार्गदर्शक पंजी (एम0वी0आर0) की दरों में प्रत्येक वित्तीय वर्ष के प्रारंभ में स्वतः 5% (पाँच प्रतिशत) की दर से वृद्धि की जाएगी।''

परन्तु यह कि, इन संशोधित प्रावधानों के अंतर्गत प्राक्कलित न्यूनतम मूल्य मार्गदर्शक पंजी (एम0वी0आर0) अधिसूचना प्रकाशन की तिथि से एकमुश्त वृद्धि (Summary Revision) की जाएगी, जिसके तहत वर्तमान प्राक्कलित न्यूनतम मूल्य की मार्गदर्शक पंजी (एम0वी0आर0) के दरों में ग्रामीण क्षेत्रों के लिए 1.6 गुना तथा शहरी एवं पेरिफेरल क्षेत्रों के लिए 2.0 गुना वृद्धि की जाएगी। इसके पश्चात पुनरीक्षित दरों का वार्षिक पुनरीक्षण उपर्युक्त प्रावधान (6)(2) (घ) के अनुसार किया जायेगा।

5. i) बिहार स्टाम्प (लिखत का न्यून मूल्यांकन निवारण) नियमावली, 1995 के नियम 6(2)(च)(i) को निम्न रूप में प्रतिस्थापित किया जायेगाः-

"जिला अवर निबंधक प्रत्येक 03 (तीन) वर्ष पर नवम्बर माह में प्राक्कलित न्यूनतम मूल्य मार्गदर्शक पंजी (एम0वी0आर0) में संशोधन हेतु जिला मूल्यांकन समिति से अनुशंसा प्राप्त करेगा। अनुशंसा की सूचना प्राप्त होने पर जिला अवर निबंधक पूर्व वर्ष की माह जनवरी से उपरोक्त दिसम्बर माह तक की अवधि में निबंधित सभी मौजो/शहरी क्षेत्र के वार्डो की मुहल्लावार प्रत्येक कोटि की भूमि/सम्पति के लिए उच्चतम मूल्य दरों वाले दस हस्तान्तरण दस्तावेज के औसत से संबंधित आकड़े, अपने क्षेत्राधिकार सहित, अधीनस्थ सभी अवर निबंधकों से प्राप्त करेगा और सभी आकड़े 31 जनवरी तक तैयार कर जिला मूल्यांकन समिति को उपलब्ध कराये जायेंगे।''

(ii) बिहार स्टाम्प (लिखत का न्यून मूल्यांकन निवारण) नियमावली, 1995 के नियम 6(2)(च)(vii) को विलोपित किया जाएगा।

(iii) बिहार स्टाम्प (लिखत का न्यून मूल्यांकन निवारण) नियमावली, 1995 के नियम 6(2)(च)(viii) के परन्तुक में प्रयुक्त शब्द पांच दस्तावेजों को शब्द दस दस्तावेजों द्वारा प्रतिस्थापित किये जायेंगे।

laŒlaŒ MVR 4059 उपर्युक्त अधिसूचना का निम्नलिखित अंग्रेजी अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है जिसे भारतीय संविधान के अनुच्छेद 348 के खण्ड (3) के अधीन उक्त राज्यादेश का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायगा।

F. No.- 10/Ni MVR Punirakshan 4059—In exercise of the powers conferred by Section 75 of the Indian Stamp Act, 1899 (Act II of 1899), the Governor of Bihar is pleased to make the following Rules to further amend the Bihar Stamp (Prevention of Under-Valuation of Instruments) Rules, 1995, as amended from time to time.

1. Short Title, Extent, and Commencement:-

i. These Rules may be called the "Bihar Stamp (Prevention of Under- Valuation of Instruments) (Amendment) Rules, 2026."

ii. It shall extend to the whole of the State of Bihar. iii. It shall come into force from the date of its publication in the Official Gazette.

2. A proviso shall be added to the Rule-5 of The Bihar Stamp (Prevention of under valuation of Instruments) Rules, 1995 as followings:-

"Provided that there shall be uniformity of Categorisation of land across the state and rate per Decimal shall be fixed for the following categories of land in rural and urban areas:-

Substitution of Sub-rule (2)(c) of Rule 6:- The provisions of Sub-rule (2)(c) of Rule 6 of the Bihar Stamp (Prevention of Under-Valuation of Instruments) Rules, 1995, as substituted by Rule 3 of the Bihar Stamp (Prevention of Under-Valuation of Instruments) (Amendment) Rules, 2013, shall be substituted by the following:-

"The District Valuation Committee shall undertake a comprehensive revision of the Minimum Value Register (MVR) of estimated land/property values for every category of land in every Mauza/Ward across urban, peripheral, and rural areas in the district every three years according to the procedure mentioned in sub-rule 2 (f) of this rule."

4. Insertion of Sub-rule (2)(d) of Rule 6:- The provisions of Sub-rule (2)(d) of Rule 6 of the Bihar Stamp (Prevention of Under-Valuation of Instruments) Rules, 1995, as shall be Inserted by the following:- "During the interim period of 03 years mentioned in Sub-rule (2)(c), the rates in the Minimum Value Register (MVR) for every category of land in each Mauza/Ward shall be automatically enhanced by 5% (five percent) at the commencement of each financial year.

Provided that, for the initial implementation of the Minimum Value Register (MVR) under these revised provisions, a one-time automatic enhancement (Summary Revision) shall be executed from Date of publication of notification increasing the existing MVR rates by 1.6 times for rural areas and by 2.0 times for urban and peripheral areas. Thereafter, annual revision on the newly determined rates shall proceed dynamically as per the compounding provision above."(cid:464)बहार गजट (असाधारण) 19 जून 2026 4 5. Deletion and Substitution of Certain Rules and Sub-rules:-

i. Rule 6 (2) (f) (i) of the Bihar Stamp (Prevention of Under-Valuation of Instruments) Rules, 1995 as amended shall be substituted by the following:- "District sub-registrar shall get the approval for the comprehensive revision of MVR from District Valuation Committee in the month of November every 03 (Three) year" After receiving the information of approval, District-Sub-Registrars shall obtain for all categories of land/property figures of average of ten conveyances having highest valuation rates in every category of land/property of all villagers/wards of urban area muhalla-wise registred within the period from the month January of the previous year to the aforesaid month of December from all registering officers of the sub-district of their jurisdiction including his own jurisdiction and shall present all figures before the District Valuation Committee by 31st January"

ii. Rule 6 (2) (f) (vii) of the Bihar Stamp (Prevention of Under-Valuation of Instruments) Rules, 1995 as amended will be deleted.

iii. In the proviso of Rule 6 (2) (f) (viii) of the Bihar Stamp (Prevention of Under-Valuation of Instruments) Rules, 1995 as amended the word "Five Documents" will be substituted by "Ten Documents".
