4A —राष्ट्रीय सहबद्ध एवं स्वास्थ्य देखभाल वृत्ति आयोग अधिनियम, 2021 (2021 का 14) की धारा 68 की उपधारा (1) द्वारा प्रदत्त शक्तियों और इस संबंध में अन्य सभी शक्तियों का प्रयोग करते हुए, बिहार के राज्यपाल उक्त अधिनियम के प्रावधानों को कार्यान्वित करने के लिए बिहार राज्य सहबद्ध एवं स्वास्थ्य देखभाल परिषद नियमावली, 2026 का संशोधन करने के लिए निम्नलिखित नियमावली बनाते हैं :-
(1) यह नियमावली ''बिहार राज्य सहबद्ध एवं स्वास्थ्य देखभाल परिषद (संशोधन) नियमावली, 2026'' कही जा सकेगी ।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (3) यह राजपत्र में प्रकाशन की तिथि से प्रवृत होगी ।

y स्व-प्रमाणन से अभिप्रेत है राज्य सरकार द्वारा निर्धारित प्रारूप में राष्ट्रीय रजिस्टर या बिहार राज्य के अलावा किसी अन्य राज्य परिषद के राज्य रजिस्टर में पंजी—त सहबद्ध एवं स्वास्थ्य देखभाल पेशेवर द्वारा प्रस्तुत किया गया प्रमाण पत्र।

(1) इन नियमों में किसी भी बात के होते हुए भी कोई भी सहबद्ध एवं स्वास्थ्य देखभाल पेशेवर, जिसका नाम किसी अन्य राज्य परिषद के राज्य रजिस्टर या राष्ट्रीय रजिस्टर में वैध रूप से दर्ज है, बिहार राज्य में नए पंजीकरण या अपने पूर्व राज्य परिषद से अनापत्ति प्रमाण पत्र(cid:464)बहार गजट (असाधारण) 30 जून 2026 2 (एन0ओ0सी0) प्राप्त किए बिना वैध रूप से अपने पेशे का अभ्यास करने का हकदार होगा, बशर्ते वह राज्य परिषद को स्व-प्रमाणन प्रस्तुत करे।
(2) सचिव यह भी सुनिश्चित करेंगे कि इन नियमों के प्रावधानों के तहत राज्य के भीतर कानूनी रूप से अभ्यास करने के लिए स्व-प्रमाणन प्रस्तुत करने वाले सभी सहबद्ध और स्वास्थ्य देखभाल पेशेवरों की एक अलग लाइव सूची डिजिटल रूप से रखी और प्रकाशित की जाए।
(3) राज्य परिषद की स्व-प्रमाणन मॉडल के तहत कार्यरत किसी भी सहबद्ध एवं स्वास्थ्य देखभाल पेशेवर को कदाचार का दोषी पाये जाने पर बिहार राज्य में प्रैक्टिस करने के अधिकार को निलंबित करने का अधिकार होगा। ऐसा निलंबन इस नियम की उपधारा (2) के अंतर्गत रखे गये रजिस्टर में दर्ज किया जायेगा एवं उचित कार्रवाई के लिए राष्ट्रीय आयोग या प्राथमिक पंजीकरण करने वाले संबंधित राज्य परिषद को तुरंत सूचित किया जायेगा।
(4) इस नियम के स्व-प्रमाणन प्रावधानों के तहत राज्य में विधिवत प्रैक्टिस करने वाले किसी भी सहबद्ध एवं स्वास्थ्य देखभाल पेशेवर को इस नियमावली के नियम-50 के प्रयोजनों के लिए पंजी—त सहबद्ध एवं स्वास्थ्य देखभाल पेशेवर माना जायेगा।

4A का निम्नलिखित अँग्रेजी अनुवाद, बिहार राज्यपाल के प्राधिकार से, एतद द्वारा प्रकाशित किया जाता है जो भारत-संविधान के अनुच्छेद-348 क खंड (3) के अधीन अँग्रेजी भाषा में उक्त अधिसूचना का प्राधि—त पाठ समझा जायेगा।

No 04/ 4A —In exercise of the powers conferred by sub- section (1) of section 68 of the National Commission for Allied and Healthcare Professions Act, 2021 (14 of 2021), and of all other powers enabling it in that behalf, the Governor of Bihar is pleased to make the following Rules to amend the " Bihar State Allied and Healthcare Council Rules, 2026 to carry out the provisons of the said Act, namely":-
1. Short title, extent and commencement.-
(1) These Rules may be called the "Bihar State Allied and Healthcare Council (Amendment) Rules, 2026."
(2) It shall extend to the whole State of Bihar. (3) It shall come into force from the date of its publication in the official gazette.
2. Insert a new clause after sub-rule-1(x) of Rule-2 of the Bihar State Allied and Healthcare Council Rules, 2026 ".- After sub-rule-1(x) of Rule-2 of the Bihar State Allied and Healthcare Council Rules, 2026, following clause shall be inserted, which is as follows:- "Rule-2(1y):-"Self-certification means a certificate submitted by an allied and healthcare professional registered with the National Register or State Register of any State Council other than the State of Bihar, in the format as prescribed by the State Government." 3. Omission of sub-rule 3 of Rule-28 of the Bihar State Allied and Healthcare Council Rules, 2026 ".- Rule-28 clause (3) shall be omitted of Bihar State Allied and Healthcare Council Rules, 2026,(cid:464)बहार गजट (असाधारण) 30 जून 2026 3 4. Insert a new clause after Rule-28 of the Bihar State Allied and Healthcare Council Rules, 2026 ".- After Rule-28 of the Bihar State Allied and Healthcare Council Rules, 2026, following clause shall be inserted, which is as follows:- "Rule- 28A- "Practice on submission of self-certification:—
(1) Notwithstanding anything contained in these rules, any allied and healthcare professional whose name is validly entered in the State Register of any other State Council or the National Register, shall be entitled to lawfully practice their profession in the State of Bihar based on self- certification, without requiring a No Objection Certificate (NOC) or fresh local registration.
(2) The Secretary shall maintain and publish digitally a separate live list of all allied and healthcare professionals practicing in the State on the basis of self-certification.
(3) The State Council shall have the power to suspend the right to practice within the State of Bihar for any professional operating under the self- certification model who is found guilty of professional misconduct or negligence. Such suspension shall be marked in the list maintained under sub-rule (2) and shall be immediately communicated to the National Commission or the concerned State Council of primary registration for appropriate action.
(4) Any professional lawfully practicing in the State under the self- certification provisions of this rule shall be exempt from the penal provisions under Rule 50 for using the description of an allied and healthcare professional.
