सं॰ एल॰जी॰-01-16/2026/5077/लेज—भारत संविधान के अनुच्छेद 213 के खंड-(1) के अधीन बिहार राज्यपाल द्वारा दिनांक 26 जून 2026 को प्रख्यापित निम्नलिखित अध्यादेश इसकेे द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है।2 (cid:464)बहार गजट (असाधारण), 30 जून 2026 [

चूँकि, बिहार राज्य में विधान मंडल सत्र में नही है;
और चूँकि बिहार राज्यपाल का समाधान हो गया है कि ऐसी परिस्थितियाँ विद्यमान है जिनके कारण बिहार एवं उड़ीसा नर्सेज पंजीकरण अधिनियम, 1935 का, इसमें आगे वर्णित रीति से, संशोधन करने हेतु उनके लिए तुरन्त कार्रवाई करना आवश्यक हो गया है;
इसलिए, अब, भारत-संविधान के अनुच्छेद 213 के खण्ड-(1) द्वारा प्रदत शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल निम्नलिखित अध्यादेश प्रख्यापित करते हैं :-
(1) इस अध्यादेश को 'बिहार नर्सेज पंजीकरण (संशोधन) अध्यादेश 2026 कहा जा सकेगा। (2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह बिहार राजपत्र में प्रकाशन की तिथि से प्रवृत होगा।
बिहार एवं उड़ीसा नर्सेज पंजीकरण अधिनियम, 1935 (जिसे इस अधिनियम में आगे मूल अधिनियम कहा गया है) की धारा-2 में उपधारा-(l) के बाद निम्नलिखित उप-धारा जोड़ी जायेगी, जो इस प्रकार हैः- ''(m) स्व-प्रमाणन का अर्थ है भारतीय नर्सिंग परिषद या बिहार राज्य के अलावा किसी अन्य राज्य की नर्सिंग परिषद में पंजीकृत नर्स, स्वास्थ्य आगन्तुक, दाई, प्रशिक्षित दाई द्वारा राज्य सरकार द्वारा निर्धारित प्रारूप में प्रस्तुत किया गया प्रमाण पत्र।'' A मूल अधिनियम की धारा, 10 के बाद निम्नलिखित धारा जोड़ी जायेगी जो इस प्रकार है :-
'' A (1) इस अधिनियम में किसी भी बात के होते हुए भी, कोई भी नर्स, स्वास्थ्य आगन्तुक, दाई, प्रशिक्षित दाई जिसका नाम भारतीय नर्सिंग परिषद् या किसी अन्य राज्य नर्सिंग परिषद् के रजिस्टर में वैध रूप से पंजीकृत है, बिहार राज्य में कानूनी रूप से नर्सिंग अभ्यास करने की हकदार होगी, बिना किसी स्थानीय पंजीकरण या पूर्ववर्ती राज्य नर्सिंग परिषद् से अनापति प्रमाण पत्र की आवश्यकता के, बशर्ते कि वह परिषद् को स्व-प्रमाणन प्रस्तुत करे।''
(2) परिषद् स्व-प्रमाणन के आधार पर राज्य में कार्यरत नर्सों, स्वास्थ्य आगन्तुकों और दाईयों से संबंधित एक रजिस्टर का संंकलन करेगी।
(3) परिषद् को स्व-प्रमाणन मॉडल के तहत काम करने वाले किसी भी कर्मी के बिहार राज्य के भीतर अभ्यास करने के अधिकार को निलंबित करने का अधिकार होगा, यदि वह पेशेवर कदाचार का दोषी पाया जाता है।
(4) जहाँ किसी कार्मिक के अभ्यास का अधिकार इस धारा की उपधारा (3) के तहत निलंबित किया जाता है, तो ऐसे निलंबन को इस धारा की उपधारा (2) के तहत संधारित रजिस्टर में दर्ज किया जायेगा और मूल विभाग या राज्य नर्सिंग परिषद् या भारतीय नर्सिंग परिषद् को सूचित किया जायेगा।
बशर्ते कि इस धारा के स्व-प्रमाणन प्रावधानाें के तहत राज्य में वैध रूप से अभ्यास करने वाली कोई भी नर्स, स्वास्थ्य आगन्तुक या दाई को इस अधिनियम की धारा-21 के प्रयोजनों के लिए पंजीकृत नर्स, स्वास्थ्य आगन्तुक या दाई माना जायेगा।3 (cid:464)बहार गजट (असाधारण), 30 जून 2026
मूल अधिनियम की धारा-17 की उपधारा (2) में, विद्यमान खण्डों के अंत में, निम्नलिखित खण्ड जोड़ा जायेगा, जो इस प्रकार है :-
'' (f) किसी अन्य राज्य नर्सिंग परिषद् या भारतीय नर्सिंग परिषद् में पंजीकृत नर्सिंग कर्मियों द्वारा स्व-प्रमाणन प्रस्तुत करने के लिए प्रारूप, प्रक्रियात्मक दिशा-निर्देश और प्रशासनिक तंत्र निर्धारित करने की शक्ति विशेष रूप से राज्य सरकार में निहित होगी।'' भारत-संविधान के अनुच्छेद 213 के खंड-(1) के अधीन मैंने इस अध्यादेश को प्रख्यापित किया है। ———
—बिहार राज्यपाल द्वारा दिनांक 26 जून 2026 को प्रख्यापित (बिहार अध्यादेश संख्या-02, 2026) का निम्नलिखित अंग्रेजी अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-348 के खंड (3) के अधीन उक्त अध्यादेश का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।
[Bihar Ordinance No.-02, 2026] THE BIHAR NURSES REGISTRATION (AMENDMENT) ORDINANCE, 2026 AN
ORDINANCE to further amend the Bihar and Orissa Nurses Registration Act, 1935 (Act I of 1935) Preamble:- WHEREAS, The Legislature of the State of Bihar is not in session;
AND WHEREAS, The Governor of Bihar is satisfied that the circumstances exist which render it necessary for him to take immediate action to amend the BIHAR AND ORISSA NURSES REGISTRATION ACT, 1935, in the manner hereinafter appearing;
NOW, THEREFORE, in exercise of the powers conferred by Clause (1) of Article 213 of Constitution of India, the Governor of Bihar is pleased to promulgate the following Ordinance :-
CHAPTER I
PRELIMINARY
1. Short title, extent and commencement.-
(1) This Ordinance may be called the Bihar Nurses Registration (Amendment) Ordinance, 2026.
(2) It shall extend to the whole of the State of Bihar.
(3) It shall come into force from the date of its publication in the official Gazette.
2. Amendment of section 2.—In section 2 of the Bihar and Orissa Nurses Registration Act, 1935 (hereafter in this Act referred to as the principal Act) after sub-section (l), the following sub-section shall be inserted, which is as follows:—
4 (cid:464)बहार गजट (असाधारण), 30 जून 2026"(m) Self-certification means a certificate submitted by a nurse, health visitor, midwife, trained dai or dai registered with the Indian Nursing Council or with the Nursing Council of any State other than the State of Bihar, in the format as prescribed by the State Government."
CHAPTER II
3. Insertion of new section10 A.—After section 10 of the principal Act the following section shall be inserted, which is as follows:—
"10A- Practice on submission of self-certification:—
(1) Notwithstanding anything contained in this Act, any nurse, health visitor, or midwife whose name is validly entered in the register of the Indian Nursing Council or any other State Nursing Council, shall be entitled to lawfully practice in the State of Bihar, without requiring a No Objection Certificate (NOC) from the previous state nursing council or fresh local registration, provided that they submit a self-certification to the council.
(2) The council shall maintain a register of nurses, health visitors, and midwives practicing in the state on the basis of self-certification.
(3) The Council shall have the power to suspend the right to practice within the State of Bihar for any personnel operating under the self-certification model who is found guilty of professional misconduct.
(4) Where the right to practice of any personnel is suspended under sub- section (3) of this section, such suspension shall be marked in the register maintained under sub-section (2) of this section and shall be communicated to the parent department or state nursing council or Indian Nursing Council.
Provided that Any nurse, health visitor, or midwife lawfully practicing in the state under the self-certification provisions of this section shall be treated as a registered nurse, health visitor, or midwife for the purposes of section 21 of this Act."
4. Amendment of section 17.—In section 17 of the principal Act, in sub-section (2), after the existing clauses, the following clause shall be inserted, which is as follows:—
"(f) to determine the format, procedural guidelines, and the administrative mechanism for the submission of self-certification by nursing personnel registered in any other State Nursing Council or the Indian Nursing Council, the power to prescribe which shall be vested exclusively in the State Government."
